Geographic Place Names Act 1998

The Act defines several key terms in section 3. A geographic name means the name registered in the Register as the name for a particular place. The term Register refers to the Register of Geographic Names established under section 9, which incorporates the earlier register of place names and the register of names of streets and roads under Part II of the Survey Co-ordination Act 1958 (section 9(3)). The Registrar is the Registrar of Geographic Names appointed by the Minister under section 7 for a term not exceeding five years, with eligibility for reappointment. The guidelines are the Geographic Names Policy Guidelines that the Governor in Council may make by Order published in the Government Gazette (section 5(1)). These guidelines are central to the operation of the Act because applications for registration or amendment must be made in accordance with them (sections 10 and 11). The guidelines must set out rules and processes for selecting, assigning or amending names; processes for consulting on Aboriginal or Torres Strait Islander names; criteria for assessing cultural heritage or other significance; and consultation requirements before a name is selected, assigned or amended (section 5(2)). The Act deliberately leaves the substantive content of naming policy to delegated legislation (the guidelines), which gives the executive considerable flexibility but also creates uncertainty for applicants who must comply with guidelines that may change without parliamentary scrutiny beyond the Government Gazette publication.

A Committee is a Geographic Place Names Advisory Committee appointed under section 12 from a panel maintained by the Minister under section 14. The panel should, as far as possible, include persons with knowledge or experience in mapping or geography, planning, local government administration, Aboriginal culture and language, heritage or historical matters, and orthography or linguistics (section 14(2)). This panel structure ensures a degree of expertise but the Minister may remove any panel member at any time (section 14(4)), which gives the Minister substantial control over the pool from which committees are drawn. The Registrar is expressly excluded from the panel (section 14(5)). The definition of place in section 3 is broad and includes any place or building that is or is likely to be of public or historical interest. It explicitly includes townships, suburbs, topographical features including undersea features, streets, roads, transport stations, government schools, government hospitals and government nursing homes. Notably, private property is not expressly included unless it is of public or historical interest. The Act does not define what constitutes “public or historical interest”, leaving that assessment to the Registrar, committees, and ultimately the Minister.

The Act affects a wide range of stakeholders, though primarily those who seek to assign, change or officially recognise a place name in Victoria. Applicants may be any person or body who applies under section 10 to register a name or amend an existing geographic name, subject to compliance with the guidelines. This includes local councils, state government departments, developers, historical societies, Aboriginal groups, and individual members of the public. The Act does not restrict who can apply, but the Registrar has discretion to refuse applications that do not comply with the Act and guidelines, or to refer them to a Committee for advice. Local councils are particularly affected because many place naming decisions (such as suburban boundaries, street names, and park names) are made at a local level. Although the Act does not apply to naming municipal districts or wards (section 4(a)(ii)), it does apply to places within them, such as roads, parks, and government buildings. Councils must ensure their naming decisions are consistent with the guidelines, or they risk having those names not recorded in the Register (and therefore not evidence under section 18). Developers often need to name new streets, suburbs, or residential estates; they must navigate the application process and the guidelines, which may impose consultation or heritage assessment requirements. Government agencies such as the Department of Transport (for roads and stations), the Department of Education (for government schools), and health departments (for government hospitals and nursing homes) are directly affected because many of the places listed in the definition of “place” are under their control. These agencies may have their own naming powers under other Acts, which are preserved by section 4(b), but any name they assign is not automatically registered; they must apply to the Registrar to have it entered in the Register if they want the evidentiary benefit of section 18.

Aboriginal and Torres Strait Islander communities are affected by the requirement in section 5(2)(b) that the guidelines must set out the process to be followed before selecting or assigning an Aboriginal or Torres Strait Islander name. This recognition is significant but the Act does not vest any veto power in those communities; the process is left to the guidelines, which are made by the Governor in Council. Public servants may be affected if they serve as Registrar (a 5-year appointment), as members of a Committee (entitled to fees and allowances fixed by the Minister, except public service employees who receive no additional fees under section 15), or as members of the panel (subject to removal at the Minister’s pleasure). Surveyors, cartographers, and GIS professionals rely on the Register for authoritative place names for maps, cadastral records, and official documents. The evidentiary provision in section 18 means that registered names are presumed correct for official purposes, affecting land titles, addresses, and spatial data.

The Act imposes most duties on the Registrar and Committee members, and provides only limited rights to applicants. The Registrar has several mandatory duties. Under section 8(1), the Registrar must carry out the functions of registering names of places, keeping and maintaining the Register, advising the Minister on the guidelines, disseminating information on the guidelines, and monitoring and reviewing compliance with the guidelines. Section 11(1) and (2) require the Registrar to enter in the Register each name for which an application is made in accordance with the Act and the guidelines, unless the application is referred to a Committee. However, this duty is qualified: the Registrar must also comply with any directions given by the Minister concerning the registration of names and must not make an entry inconsistent with any such direction (section 11(5)). This means ministerial direction can override the normal registration process, effectively allowing the Minister to block or compel a registration. Section 11(6) imposes a duty to publish notice of each entry or amendment in the Government Gazette and in newspapers circulating generally in the State. The Registrar must also ensure the guidelines are reviewed at least every five years and report to the Minister (section 6).

Committees have a duty under section 13 to give advice to the Registrar on matters referred to them. Committee members have a duty under section 17 to disclose any direct or pecuniary interest in a matter being dealt with, and to disclose any office or property that might create a conflict of interest. After disclosure, they must not take any further part in discussion or voting on that matter (section 17(4)). The person presiding must ensure the disclosure is recorded in the minutes (section 17(3)). These are standard conflict-of-interest provisions, but enforcement relies on internal committee procedures rather than external penalties.

Applicants have a right to apply for registration or amendment of a geographic name under section 10, but they have no right to have the name registered. The Registrar has discretion to refuse applications that do not comply with the Act and guidelines, and the Minister can direct the Registrar to refuse an application even if it complies. There is no statutory right of appeal against a refusal; any challenge would have to be by way of judicial review on administrative law grounds. The Act does not create a right to a hearing or to reasons for a decision. The evidentiary provision in section 18 gives a right to any person who relies on the Register: if a name is registered, it is evidence of the name of the place for the purposes of any Act, proclamation, Order in Council, local law, rule, regulation, official map, record, legal instrument or document. This is a statutory evidentiary shortcut, but it is not conclusive; it may be rebutted by other evidence.

The Geographic Place Names Act 1998 contains no penalty provisions of its own. There are no criminal offences, no civil pecuniary penalties, and no infringement notices created by the Act. Enforcement is achieved through administrative mechanisms rather than punitive sanctions. The primary enforcement tool is the Registrar’s power to refuse to register or amend a name if the application does not comply with the Act and the guidelines (sections 11(1) and (2)). This gives the Registrar effective control over which names enter the official register. If an application is referred to a Committee, the Registrar must make entries or alterations necessary to give effect to the Committee’s advice (section 11(3)), so the Committee’s advice is binding on the Registrar (subject to any ministerial direction). The Minister has the ability to direct the Registrar concerning the registration of names (section 11(5)), and the Registrar must comply. This means the Minister can effectively enforce policy preferences without needing a penalty provision.

Beyond registration refusal or ministerial direction, the Act has no mechanism to compel compliance. If a local council or other body assigns a place name without following the guidelines, that name simply will not be entered in the Register. However, because the Act does not apply to all naming (section 4 preserves other powers), an unauthorised name might still be valid under another Act. The absence of penalties means there is no deterrent against naming places without regard to the guidelines, other than the loss of the evidentiary benefit of section 18. That benefit is significant for official documents and legal instruments, but for informal or private naming it may be irrelevant. The Act also does not provide for enforcement against the Registrar or Minister for failure to perform duties; any such failure would be subject to general administrative law remedies such as mandamus.

The evidentiary provision in section 18 itself has an indirect enforcement effect. If a place is registered under a particular name, that name is evidence for all official purposes. This can have practical consequences for land titles, addresses, and statutory instruments. A person or body that uses an unregistered name in an official document may face evidentiary challenges, but the Act does not make it unlawful to do so. In summary, the Act’s enforcement relies on administrative discretion and the incentives created by registration, not on penalties.

Section 4(b) of the Act expressly states that the Act does not affect the powers and authorities conferred by or under any other Act on the Governor in Council or on any person to assign or amend the name of a place. This means that other Victorian statutes that grant naming powers continue to operate independently. For example, the Local Government Act 1989 gives councils powers to name roads and public places; those powers survive and can be exercised without reference to this Act. However, any name assigned under another Act is not automatically entered in the Register of Geographic Names. The Registrar may make entries for names assigned by or under any other Act (section 11(4)), but that is discretionary. The practical effect is that a name assigned under another Act is valid for the purposes of that Act, but for broader evidentiary recognition under section 18, the name should also be registered under this Act.

Section 4(a) excludes from the Act’s operation the naming of electoral regions or districts and municipal districts or wards. These are governed by other electoral and local government legislation respectively. The Act does not affect the naming of federal electorates or state electoral boundaries.

The Act repealed Part II of the Survey Co-ordination Act 1958 (section 20), which previously governed place naming and maintained a register of names of streets and roads. However, the Register under this Act incorporates the old register of place names and the register of names of streets and roads as part of the new Register (section 9(3)). This ensures continuity and avoids a gap in the official record. The transitional provision in section 21 deals with inquiries that the old Place Names Committee had commenced but not completed; that committee may complete the inquiry as if the old Act were still in force, and its recommendation is deemed to be a recommendation under this Act.

The guidelines made under section 5 may interact with other legal frameworks, such as heritage legislation (since criteria for cultural heritage significance are required by section 5(2)(c)), Aboriginal heritage legislation (through the requirement for consultation on Aboriginal names), and planning legislation. However, the Act does not purport to override those other statutes; it merely adds a layer of procedural requirements for names to be registered.

Section 18 provides that a registered name is evidence for the purposes of any Act, proclamation, Order in Council, local law, rule, regulation, official map, record, legal instrument or document. This gives the Register a broad evidentiary reach across the entire Victorian legal system. It does not make the registered name conclusive but shifts the evidentiary burden. In practice, this interacts with land title, surveying, and property law by providing an authoritative source for place names that can be used in title descriptions, caveats, contracts, and other documents.

The Act has been amended five times since its commencement on 21 April 1998 (Part 1) and 31 December 1998 (remaining provisions). The amendments are:

1. Public Sector Reform (Miscellaneous Amendments) Act 1998 (No. 46/1998): Assented 26 May 1998, commenced 1 July 1998. This amended section 15 (fees and allowances for Committee members) as part of broader public sector reforms. The specific change to section 15 is noted in the Table of Amendments.

2. The Constitution Act Amendment (Amendment) Act 1999 (No. 24/1999): Assented 25 May 1999, commenced 8 June 1999. This amended section 4(a) to update the reference to electoral regions or districts following constitutional changes.

3. Constitution (Parliamentary Reform) Act 2003 (No. 2/2003): Assented 8 April 2003, commenced 31 October 2006. This further amended section 4(a) to reflect the new electoral structure established by the 2003 reforms, which created multi-member electoral regions.

4. Land Legislation Amendment Act 2009 (No. 80/2009): Assented 8 December 2009, commenced 1 May 2010. Section 94 amended section 7(2) relating to the Registrar’s term of office. The exact wording of the amendment is not specified in the source, but it forms part of land legislation amendments.

5. Statute Law Revision Act 2013 (No. 70/2013): Assented 19 November 2013, commenced 1 December 2013. Section 3(Schedule 1 item 19) repealed sections 22-24, which presumably were spent or obsolete provisions. The Act as at the version date no longer contains those sections.

The Act has not been amended since 2013, at least up to the version date of 1 December 2013. The endnotes indicate that no explanatory details were published at the date of publication. There is no evidence of any substantial policy amendments; the changes are largely machinery or consequential.

The source does not cite any reported case law under the Geographic Place Names Act 1998. The Act is an administrative statute that creates few private rights and no civil causes of action. Its narrow scope and lack of penalty provisions make litigation unlikely. Disputes over place names that have been registered would most likely arise in the context of other proceedings, such as land title disputes, where a party challenges the evidentiary weight of a registered name under section 18. However, because section 18 provides that the registered name is evidence (not conclusive proof), the opposing party could adduce other evidence to contradict it. The Act itself does not create a statutory right to challenge a registration decision.

Given the nature of the Act, potential litigation could include:

• Judicial review of a decision by the Registrar to refuse registration or amendment, on grounds such as procedural fairness, failure to consider relevant matters, or acting under ministerial direction that was unlawful. The Act does not oust the jurisdiction of the Supreme Court.
• Judicial review of a Minister’s direction under section 11(5), if a direction were challenged as ultra vires or for an improper purpose.
• Disputes about whether a particular place falls within the definition of “place” under section 3, particularly the “public or historical interest” criterion.
• Disputes about the validity of the guidelines themselves, if they were not properly made under section 5 (by Order published in the Government Gazette).
• Administrative law challenges to a Committee’s advice if tainted by bias or failure to comply with the disclosure requirements in section 17, though the Committee’s advice is not a binding decision but only advice to the Registrar.

No such cases are recorded in the source. The absence of significant litigation suggests that the Act’s administrative machinery has operated without major controversy, or that disputes are resolved informally without recourse to courts. The limited scope for private enforcement and the absence of monetary penalties mean that litigation is not incentivised.

Several provisions in the Act create traps for the unwary. The most significant is the ministerial override in section 11(5): the Registrar must comply with any directions from the Minister concerning registration and must not make an entry inconsistent with any direction in force. This means that even if an applicant complies fully with the Act and the guidelines, and even if a Committee has given favourable advice, the Minister can block registration. There is no notice requirement or appeal provision. Applicants have no statutory right to know that a direction has been given or to make submissions. The Minister’s discretion is not constrained by any criteria in the Act.

The definition of place in section 3 is deceptively broad: it includes “any place or building that is, or is likely to be, of public or historical interest”. The phrase “likely to be” is speculative and gives the Registrar broad power to decide whether to accept applications. For example, a developer naming a new private estate might find the Registrar refusing registration on the ground that the name is not likely to be of public interest. Conversely, if the Registrar accepts an application for a private property, the owner may be bound by the registered name even if they later object, because the Act does not require the owner’s consent. The Act also lacks a mechanism for deregistering a name except by an amendment application.

The guidelines are not reproduced in the Act. An applicant must obtain and comply with them, but the Act does not require the guidelines to be tabled in Parliament. They are made by the Governor in Council on the recommendation of the Minister and published in the Government Gazette. Changes can be made without parliamentary approval, and the Registrar must comply with the guidelines as amended from time to time. This creates regulatory risk for applicants who may begin an application under one version and find the rules changed before completion.

Section 11(6) requires the Registrar to publish notice of each entry or amendment in the Government Gazette and in newspapers circulating generally in the State. This is a mandatory requirement that imposes cost on the Registrar (and, indirectly, on the state budget). There is no exception for trivial or minor entries. The cost of newspaper publication is not trivial and may affect the willingness of the Registrar to register minor or obscure names.

The panel of potential Committee members is maintained by the Minister, and the Minister may remove any member at any time for any reason (section 14(4)). This means Committee members have no security of tenure. A member who gives advice the Minister dislikes could be removed from the panel, effectively ending their ability to serve on any future committee. This creates a chilling effect on independent advice.

Section 4 preserves other naming powers, but this can cause confusion. A name assigned by a local council under the Local Government Act 1989 is valid for local government purposes, but if it is not registered under this Act, it is not evidence for the purposes of other Acts. This could lead to inconsistency between registers. For example, a road name used by the council might not match the name in the Register for evidentiary purposes, creating confusion in title searches or emergency services.

Finally, the Act imposes a duty on the Registrar to review the guidelines every five years (section 6), but there is no duty to consult stakeholders or to publish the review report beyond giving it to the Minister. The public may not have access to the review findings unless the Minister chooses to release them.

For a person or body wishing to register a geographic name or amend an existing registered name, compliance involves the following steps, all of which are subject to the guidelines that are not contained in the Act itself. The applicant should first obtain the current Geographic Names Policy Guidelines from the Registrar, as these will specify the detailed requirements.

Step 1: Determine whether the place falls within the Act. The Act does not apply to electoral regions or districts, municipal districts or wards (section 4(a)). If the place is one of those, the applicant must use whatever other legislation governs naming. For all other places within the broad definition in section 3 (including townships, suburbs, topographical features, streets, roads, government schools, hospitals, nursing homes, transport stations, and any place of public or historical interest), the Act applies.

Step 2: Check if another Act already assigns a name. Under section 4(b), other Acts may authorise naming. If the applicant has power under another Act to assign or amend the name, they can exercise that power separately, but to have the name registered they will also need to apply under this Act. The Registrar has discretion to enter names assigned under other Acts (section 11(4)), so the applicant should provide evidence of that assignment.

Step 3: Prepare the application. The application must be in accordance with the guidelines. The guidelines will set out required information, such as the proposed name, the location of the place (including map or survey details), justification for the name, evidence of consultation (especially if the name is Aboriginal or Torres Strait Islander, as required by section 5(2)(b)), and any cultural heritage assessments required by the guidelines. The applicant should also ensure they follow any procedures for assessment of cultural heritage or other significance (section 5(2)(c)).

Step 4: Lodge the application with the Registrar. There is no prescribed form in the Act; the Registrar will determine the form. The Act does not specify fees, but regulations under section 19 may prescribe fees. The applicant should confirm whether a fee applies.

Step 5: Await processing. The Registrar will decide whether to register the name directly or refer the application to a Geographic Place Names Advisory Committee for advice (section 12). If referred, the Committee will consider the matter and provide advice. The Registrar must then make entries consistent with that advice (section 11(3)). However, the Minister may issue a direction that overrides this (section 11(5)). The applicant has no right to be heard by the Committee, though the guidelines may provide for consultation.

Step 6: Publication. Once registered, the Registrar must publish a notice in the Government Gazette and in newspapers circulating generally in the State (section 11(6)). The applicant should monitor the Gazette for the entry, as the date of publication is important for evidentiary purposes. There is no right of appeal if registration is refused; the applicant may reapply with additional information or seek judicial review.

Step 7: Ongoing compliance. If the name is later amended or if the place changes, a new application for amendment is required. The applicant must also be aware that the guidelines may change; the Registrar must review them every five years (section 6). Any future applications will be assessed against the then-current guidelines.
