26 Order for destruction of GMO or thing containing GMO

[Section 26 Amended by No. 44 of 2007, s. 22, Applied:13 Nov 2007] The Secretary, in writing, may order the destruction of a GMO or a thing that contains a GMO if he or she is satisfied that –

(a) [Section 26 Amended by No. 44 of 2007, s. 22, Applied:13 Nov 2007] an offence under this Act has been or is being committed in relation to the GMO or thing; or

(b) [Section 26 Amended by No. 44 of 2007, s. 22, Applied:13 Nov 2007] for any other reason the GMO or thing should be destroyed.
