25 Fee for inspection

(1)  [Section 25 Subsection (1) substituted by No. 44 of 2007, s. 19, Applied:13 Nov 2007] By written notice provided to a permit holder, affected person or exempt person, the Secretary may require the permit holder, affected person or exempt person to pay a fee, determined by the Secretary, in respect of an inspection under section 20 .

(2)  A fee under subsection (1) must not exceed the reasonable costs of the inspection.

(3)  [Section 25 Subsection (3) amended by No. 44 of 2007, s. 19, Applied:13 Nov 2007] The permit holder, affected person or exempt person must pay any fee he or she is required to pay under subsection (1) .

(4)  [Section 25 Subsection (4) amended by No. 44 of 2007, s. 19, Applied:13 Nov 2007] If the whole or any part of any fee the permit holder, affected person or exempt person is required to pay under subsection (1) is due and unpaid, that amount may be recovered in a court of competent jurisdiction as a debt due to the Crown.
