Genetically Modified Crops Management Act 2004

The Act rests on a small set of core legal concepts expressed in the text and linked to definitions in the Gene Technology Act 2001. Key statutory concepts are:

• Genetically modified food crop: defined to include crops that are GMOs, derived or produced from GMOs, or that have inherited traits due to gene technology (s3(1), definition “genetically modified food crop”). That definition is central because many obligations, prohibitions and powers turn on whether a crop is a genetically modified food crop for the purposes of the Act. The Act also creates a mechanism for the Minister to declare thresholds of presence of a particular GMO in a class of crop for the purpose of disregarding low‑level presence (s4).

• Designated area: an area of the State in which “no genetically modified food crops may be cultivated” (s5(1) for Kangaroo Island by force of the subsection; s5A permits Minister to designate council areas on application). The statutory effect of designation is criminal prohibition of cultivation in that area (s5(12), s5A(8)), with a maximum penalty of $200 000.

• Exemption: a ministerial Gazette notice that can carve out specific permitted activities within a designated area, but only in narrow situations: limited experimental cultivation under a GMO licence; limited and contained cultivation at specified places; or cultivation where a closed loop system means one person handles all dealings and segregation is assured. Exemptions may be conditional; the Minister must be satisfied the exemption is reasonable having regard to market requirements; and before granting certain categories of exemption the Minister must consult the Advisory Committee (s6(1)-(5)).

• Advisory Committee: a Ministerially appointed body with functions assigned by the Act or the Minister and with prescribed membership composition to reflect production, seed supply, GM‑free interests, handling and marketing expertise, administration, and export/wholesale/retail experience (ss8-15). The Committee’s role is advisory and procedural rather than decisional; the Minister remains the decision maker.

• Inspector and inspection powers: inspectors are appointed by the Minister and must carry identity cards; the Act incorporates specified parts of the Gene Technology Act 2001 so that inspector entry powers and related enforcement machinery apply for the purposes of assessing market risk (s16-17). The Act expressly expands the grounds for entry to include determining whether there is an actual or potential market risk from presence of a crop, GMO or GM‑related material (s17(2)).

• Orders for destruction and cost recovery: the Minister may order destruction of crops or GM material cultivated or dealt with contrary to the Act, and inspectors may enter, seize and destroy to effect such an order (s18). Reasonable costs incurred by inspectors or the Department in taking action may be recovered by the Minister as a debt from the person who acted in contravention (s18(4)). The Act also creates a mechanism for compensation payable by the Crown where loss arises from exercise of powers if prosecution is not commenced within 12 months or is discontinued or the defendant is acquitted (s18(5)-(6)).

• Immunities and limits on private actions: the Crown is protected from liability for making regulations or Ministerial actions under Part 2 (s26). Section 27 provides a specific protection against suits in South Australian courts against owners or occupiers for presence of genetically modified plant material that resulted from spread and where the original introduction was not knowingly undertaken by the owner or occupier; the protection is subject to an exception if an owner deliberately dealt with the crop to gain commercial benefit and the court decides another person’s rights should be protected (s27).

• Corporations and officer liability: where a body corporate is guilty of an offence under the Act, each member of its governing body and the manager are guilty of the same offence unless they can prove they exercised due diligence to prevent it (s22). The regulations may further modify criminal liability for officers (s22(3)).

• Delegation and administrative procedure: the Minister may delegate functions under the Act by written instrument, and delegations are revocable and may be absolute or conditional (s19). The regulations may also give discretion to the Minister or other prescribed persons and may incorporate codes, standards or policies (s28(3)(c)-(d)).

• Relationship with the Gene Technology Act 2001: the Act imports definitions and licensing concepts from the Gene Technology Act 2001 (eg, GMO, GMO licence, gene technology) (s3 definitions). Exemptions that authorise experimental cultivation expressly require a GMO licence authorising release of the GMO into the environment for experiment purposes (s6(2)(a)(i)). Inspector powers are read as if part of the Gene Technology Act were incorporated into this Act (s17).

These concepts together create a regulatory architecture that distinguishes statutory rule‑making, executive decision‑making (Minister), advisory inputs (Committee), administrative enforcement (inspectors) and limited judicial remedies (court powers on conviction, restriction on private suits in s27). The Act ties regulatory permission for experimental work to the Gene Technology Act licensing regime and uses Gazette notices as the formal instrument for designations and exemptions. The Minister’s discretion is central: designation of council areas, granting or revoking exemptions, imposing conditions and setting procedures (s5A, s6, s7, s19, s28).

The Act affects a defined set of actors in different ways, and the statutory text identifies who bears legal obligations and risks.

Primary affected persons and entities:

• Landowners and occupiers: the Act defines “owner of land” and “occupier” and expressly places offences, potential seizure and destruction powers and cost recovery mechanisms that affect owners and occupiers (s3 definitions; s5, s5A offence provisions; s18 seizure/destruction and cost recovery). Owners or occupiers cultivating a genetically modified food crop in a designated area are criminally liable (maximum $200 000) (s5(12), s5A(8)). Owners/occupiers whose land contains GM plant material because of spread are protected from actions in South Australian courts except in narrow cases (s27).

• Primary producers and seed/propagating material suppliers: the Act’s definition of “cultivate” is broad and includes breeding, germination, propagation, growth, raising, culture, harvest, collection and dealing with plant material (s3, definition “cultivate”). The Advisory Committee must include members with experience in seed and propagating material supply and crop production (s9(1)(a), (b)). Producers and suppliers will need to register or follow any regulatory record keeping and reporting requirements the regulations prescribe (s28(2)(b), (c)).

• Councils and local governments: councils can apply for their area to be designated as a GM‑free area under s5A(1). Councils must consult with their community, including those engaged in primary production and food processing, before making an application (s5A(2)). A council’s application triggers Ministerial consultation with the Advisory Committee; the Minister must publish a notice in the Gazette before the commencement day or it will be void (s5A(3)-(4)).

• Exporters, wholesalers and retailers: the Advisory Committee must include at least one person directly involved in exporting, wholesaling or retailing food or food products (s9(1)(g)). The Act’s stated aim to preserve crop identity “for marketing purposes” points to market actors whose product labelling, segregation and supply chains may be affected by regulation or Ministerial decisions. The Minister must consider market requirements before granting exemptions (s6(2)(b)).

• Anyone conducting experimental releases of GMOs: experimental cultivation is possible only under narrow exemptions and must be conducted under a GMO licence issued under the Gene Technology Act 2001 (s6(2)(a)(i)). Therefore researchers and commercial developers proposing field trials must comply with the separate federal/state licensing framework and the conditions of any exemption under this Act.

• Crown and Departmental actors: the Minister, Chief Executive of the Department, and inspectors are given roles in decision making and enforcement. Only these actors, or persons authorised in writing by the Minister, may commence prosecutions before courts under this Act (s21(1)). The Minister also has power to delegate functions (s19). The Crown is given specific statutory immunity for making regulations or Ministerial determinations under Part 2 (s26).

• Corporations and their governing bodies: corporate bodies that commit offences attract personal criminal liability for members of governing bodies and managers unless due diligence is proven (s22). The regulations may further specify liability rules for officers (s22(3)).

• Anyone furnishing information: persons who provide false or misleading information to the Minister or Advisory Committee commit an offence with a maximum penalty of $10 000 (s20).

Groups affected indirectly:

• Insurers and financiers: crop destruction orders (s18) and potential criminal convictions (s24 orders to pay financial benefits to the Crown) create loss and liability exposures for farm businesses, which may affect insurance claims and lending security. The Act’s restrictions could alter the insurability of certain cropping activities in designated areas.

• Markets and consumers: the Act’s stated market focus (long title) and the Minister’s obligation to consider market requirements when granting exemptions (s6(2)(b)) indicate that downstream market actors, exporters, processors and retailers, are intended beneficiaries of the identity preservation regime, and might influence applications and consultations.

• Persons outside South Australia: the Act bars civil suits in South Australian courts against owners/occupiers for presence of GM plant material resulting from spread (s27). However, it does not speak to actions under Commonwealth law or actions in overseas jurisdictions; the statutory protection is expressly limited to “a South Australian court or under South Australian law” (s27(2)).

Who decides:

• The Minister has primary decision authority to designate council areas, grant or revoke exemptions, make recommendations, issue orders for destruction, and initiate prosecutions or authorise others to do so (s5A, s6, s18, s19, s21). The Advisory Committee is advisory and consultative (Part 3 Div 1, ss8-15).

Who pays:

• Persons found to have acted in contravention may be ordered to pay fines, costs (including reasonable costs of seizure/destruction recovered as a debt) and in some cases amounts equal to financial benefit gained as assessed by a court (s18(4), s24(1)(b)). The Crown may be liable for compensation in narrowly defined circumstances where action is taken but prosecution is not commenced within 12 months or is discontinued or results in acquittal (s18(5)-(6)).

The Act therefore reconfigures regulatory risk and enforcement burden chiefly onto landowners, occupiers and persons who cultivate or deal with crops, while centralising decision rights with the Minister and conferring advisory and procedural roles on councils and the Advisory Committee.

The Act creates a set of duties for regulated parties and rights for the Minister and others. Below are the primary duties, procedural rights, and statutory protections reflected in the text.

Duties imposed on persons and entities

• Do not cultivate genetically modified food crops in designated areas: Kangaroo Island is expressly designated as a no‑cultivation area by operation of section 5(1), and cultivating in contravention is an offence (s5(1), s5(12)). Council areas designated under s5A are similarly subject to prohibition and criminal penalties (s5A(1), (8)). The statutory maximum penalty is $200 000 for contravening those prohibitions (s5(12), s5A(8)).

• Comply with conditions of exemptions: where an exemption notice authorises otherwise prohibited cultivation, the person granted the exemption must comply with conditions attached to the exemption; contravening a condition is an offence with maximum penalty $200 000 (s6(4)-(6)).

• Comply with relevant GMO licensing requirements for experimental releases: an exemption to permit experimental cultivation must be for cultivation under, and in accordance with, a GMO licence authorising release of the relevant GMO into the environment for experiment purposes (s6(2)(a)(i)). That links conduct to the Gene Technology Act 2001 regulated licensing scheme.

• Provide accurate information: furnishing false or misleading information to the Minister or Advisory Committee for the purposes of the Act is an offence (maximum $10 000) (s20).

• Submit to inspection and comply with recordkeeping and reporting requirements that may be prescribed by regulation: the regulations may require keeping records and providing reports in connection with activities associated with crops, GMOs or GM‑related material (s28(2)(b)-(c)). Inspectors appointed under the Act have powers to enter premises, seize and take samples consistent with the incorporated parts of the Gene Technology Act (s16, s17).

• Observe obligations under the regulations: the Governor may create regulations that prohibit, restrict or regulate dealings with crops or GM‑related material, fix fees or charges, and prescribe fines not exceeding $10 000 for contraventions (s28(2)(d), (h), (j)).

Procedural rights and duties of the Crown and Minister

• Duty to consult: before making certain decisions, the Act requires consultation. Councils must consult their communities before applying to the Minister to designate their area (s5A(2)). The Minister must consult the Advisory Committee before publishing designation notices and before granting certain exemptions (s5A(3), s6(3)). The Minister may, more generally, seek advice or submissions before taking action under Part 2 (s7(1)).

• Power to determine and condition exemptions: the Minister may grant exemptions by Gazette notice, and may attach conditions as the Minister thinks fit. The Minister may also vary or revoke exemptions or conditions (s6(1), (4)-(5)).

• Power to issue destruction orders and recover costs: the Minister may order destruction of crops or GM related material cultivated or dealt with contrary to the Act and recover reasonable costs and expenses incurred by an inspector or the Department as a debt from the person who acted in contravention (s18(1), (4)). However, before inspectors seize or destroy, they must ensure owners or occupiers have a reasonable opportunity to remove or destroy the material in response to the order (s18(3)).

• Right to commence prosecutions: criminal proceedings under the Act may only be commenced by the Minister, the Chief Executive of the Department, an inspector, or a person authorised in writing by the Minister (s21(1)). That concentrates prosecutorial discretion in the executive. A document purporting to be under the hand of the Minister authorising proceedings must be accepted as proof in the absence of contrary evidence (s21(2)).

Rights and protections for landowners and occupiers

• Protection from private civil action for spread of GM material: section 27 provides that where GM plant material is present on land due to spread and the original introduction was not knowingly undertaken by an owner or occupier, no action may be brought in a South Australian court or under South Australian law against the owner or occupier for the presence of the material or dealing with it (s27(2)). The protection is subject to a defined exception if the owner deliberately dealt with the crop knowing GM material was present to gain commercial benefit and the court decides another’s rights should be recognised (s27(3)).

• Right to compensation in some circumstances following destruction: if a person suffers loss or damage as a result of exercise of powers under s18 and proceedings for an offence involving the crop or material have not been commenced within 12 months, or were commenced and later discontinued or resulted in acquittal, that person is entitled to reasonable compensation payable by the Crown, recoverable as a debt in court (s18(5)-(6)).

Other important duties and rights

• Corporate officers’ liability and due diligence defence: if a corporate body commits an offence (other than specified exceptions), each member of its governing body and the manager may be prosecuted unless they prove they could not by due diligence have prevented the offence (s22(1)). This creates a statutory onus in officer prosecutions.

• Judicial orders on conviction: courts may order remedial actions beyond fines, including orders to destroy crops, orders to disgorge to the Crown an amount equal to the financial benefit gained, and orders to pay compensation to persons who have suffered loss or damage (s24(1)(a)-(c)).

• Delegation powers: the Minister may delegate functions under the Act by written instrument; delegations are revocable and do not derogate from the Minister’s ability to act (s19). Delegation gives administrative flexibility but leaves ultimate executive responsibility with the Minister.

• Regulatory powers: regulations may impose requirements for analysis, preservation of evidence, record keeping, notices of events, and may incorporate codes and standards or confer discretionary determinations to the Minister or others (s28(2), (3)). The regulations can prescribe fines up to $10 000.

In sum, duties fall primarily on those who cultivate or otherwise handle crops and GM material, with strict prohibitions for designated areas and significant executive powers to regulate, inspect, seize and destroy. Rights for landowners include procedural protections (reasonable opportunity before seizure/destruction) and limited compensation in specified circumstances, and section 27 creates a narrow shield from private suits where spread has occurred without the owner’s knowledge.

The Act sets out both criminal and civil enforcement tools and creates administrative enforcement by the executive through inspectors. The penalties, enforcement actors and mechanisms are set out in the Act.

Criminal penalties

• Cultivation in designated areas: cultivating a genetically modified food crop in contravention of the Kangaroo Island designation is an offence with a maximum penalty of $200 000 (s5(12)). An identical maximum penalty applies for cultivating in contravention of a council area designation (s5A(8)).

• Breach of conditions of exemption: contravening, or failing to comply with, a condition of an exemption under s6 is an offence with a maximum penalty of $200 000 (s6(6)).

• False or misleading information: furnishing false or misleading information to the Minister or Advisory Committee is an offence, maximum penalty $10 000 (s20).

• Regulatory contraventions: the Governor may, by regulation, prescribe fines not exceeding $10 000 for contravention of a regulation (s28(2)(j)).

• Continuing offences: where an offence consists of a continuing act or omission, a convicted person may be liable in addition to the principal penalty to a daily penalty of up to one‑tenth of the maximum prescribed penalty for each day the act or omission continued (s23(1)(a)). If the act continues after conviction the person is guilty of a further offence and liable to a similar daily penalty for the continued period (s23(1)(b)). Where an offence is an omission to do something required, the omission will be taken to continue until compliance (s23(2)).

Corporate liability and officer liability

• Offences by bodies corporate: where a body corporate is guilty of an offence (other than certain specified offences), each member of its governing body and its manager are guilty of the same offence and liable to the same penalty unless they prove they could not by due diligence have prevented the offence (s22(1)). The regulations may further deal with criminal liability of officers (s22(3)).

Administrative enforcement powers

• Inspectors: the Minister appoints inspectors who must carry identity cards and may be issued with appointments subject to conditions (s16). Inspectors’ powers are largely defined by incorporation of Part 11 Divisions 3-5 and 7-11 of the Gene Technology Act 2001 into this Act (s17(1)), with the Act specifying that the grounds for entry include determining whether there is an actual or potential market risk from presence of crops, GMOs or GM related material (s17(2)). The precise powers and procedures, including obtaining warrants, sample taking and seizure powers, will be understood in relation to the incorporated provisions of the Gene Technology Act 2001.

• Seizure, destruction and recovery of costs: the Minister may order destruction of crops or GM related material cultivated or dealt with contrary to the Act, and inspectors may enter land, seize and destroy material to carry out such orders (s18(1)-(2)). Inspectors must give owners or occupiers a reasonable opportunity to remove or destroy the material in response to an order before taking action (s18(3)). Reasonable costs and expenses incurred by an inspector or the Department in taking action may be recovered by the Minister as a debt from the person who acted in contravention (s18(4)). This creates an administrative cost recovery mechanism against the person found in breach.

• Courts’ remedial powers on conviction: in addition to penalties, courts may order corrective actions such as making good contraventions, destroying illegally cultivated crops or GM material, ordering payment to the Crown of an amount equal to a fair assessment of any financial benefit gained from the offence, and ordering compensation to persons who suffered loss or incurred costs due to the contravention (s24(1)(a)-(c)). The Act defines “associate” for the purposes of benefit disgorgement (s24(2)-(3)).

Prosecution gatekeeping and evidentiary provisions

• Who may prosecute: only the Minister, the Chief Executive of the Department, an inspector or a person acting with written authorisation of the Minister may commence proceedings for an offence under this Act (s21(1)). This centralises prosecutorial standing in public authorities or Ministerial delegates.

• Evidentiary weight: a certificate executed by the Minister certifying matters such as delegations, requirements to consult the Advisory Committee or details of analysis carried out on a sample constitutes proof of such matters in proceedings unless evidence to the contrary is produced (s25). Also, an apparently genuine authorisation from the Minister purporting to allow proceedings is prima facie proof in the absence of contrary proof (s21(2)). These provisions streamline prosecution evidence and place an evidential onus on defendants to rebut official certificates.

Compensation and Crown liability

• Compensation following administrative action: where a person suffers loss or damage as a result of exercise of powers under s18 and no prosecution is commenced within 12 months, or prosecution is discontinued or the defendant acquitted, the person is entitled to reasonable compensation payable by the Crown, recoverable as a debt in court (s18(5)-(6)). This provides a limited remedy against the Crown for wrongful destruction/seizure in specific circumstances.

• Crown immunity for certain acts: no liability attaches to the Crown or Minister by virtue of the fact that the Governor made a regulation under Part 2 or that the Minister made a recommendation, declaration or determination, or granted an exemption under Part 2 (s26(3)(a)-(b)). That provision limits Crown exposure for policy choices made under Part 2 but does not remove the compensation right under s18 where administrative action resulted in loss and prosecution was not commenced within the statutory period.

Enforcement architecture and practical effect

• The enforcement architecture consolidates investigative and enforcement powers in inspectors and the Minister, with prosecutorial authority limited to executive actors (s16, s18, s21). Courts retain the power to impose fines, remedial orders and compensation on conviction (s24). The Act combines criminal sanctions, administrative seizure/destruction powers and cost recovery mechanisms as the principal tools to secure compliance. Regulatory instruments can add administrative fines for lower level breaches (s28).

The Act is architected to operate alongside, and to rely on, provisions and concepts in the Gene Technology Act 2001 and other State legislation. The text of the Act itself prescribes several specific points of interface.

Linkage with the Gene Technology Act 2001

• Definitions and licensing: the Act imports definitions and concepts from the Gene Technology Act 2001. Key terms such as “genetically modified organism (GMO)”, “gene technology” and “GMO licence” are given the same meanings as in the Gene Technology Act 2001 (s3 definitions). An exemption under s6(2)(a)(i) must be to allow cultivation on a limited scale “under, and in accordance with, a GMO licence authorising the release of the relevant GMO into the environment for the purposes of an experiment”, thereby tying experimental work under this Act to the licensing and regulatory scheme of the Gene Technology Act (s6(2)(a)(i)).

• Inspector powers: section 17(1) states the Act is to be read as if Part 11 Divisions 3 to 5 and 7 to 11 of the Gene Technology Act 2001 were incorporated into this Act, subject to modifications by regulation. That incorporation means the procedural, evidentiary and entry powers in those parts of the Gene Technology Act 2001 apply when enforcing this Act. The Act further clarifies that inspectors may enter premises to determine whether an actual or potential market risk exists from the presence of a crop, GMO or GM related material (s17(2)). This creates a direct enforcement overlap with the Gene Technology Act investigative framework and suggests that any warrants, sample analysis methodologies and handling of GM material will be governed by the incorporated provisions.

Interaction with Local Government Act 1999 and Outback Communities (Administration and Management) Act 2009

• Council applications and area designations: section 5A permits councils constituted under the Local Government Act 1999 to apply to the Minister for their area to be designated as a no‑GM cultivation area, and requires councils to consult their communities before making such an application (s5A(1)-(2)). For parts of the State not within a council area, s5A(9) treats references to a council as references to the Outback Communities Authority under the Outback Communities (Administration and Management) Act 2009 and its area as the outback (s5A(9)). The Act therefore interfaces with local government processes and structures for community consultation.

Relationship with other South Australian law

• Proceedings and remedies: section 27 limits actions “in a South Australian court or under South Australian law” against owners or occupiers arising from presence of genetically modified plant material attributable to spread and not knowingly introduced by the owner or occupier. That clause signals a statutory limitation on State common law causes of action (eg, nuisance, trespass or negligence claims) within South Australia. The clause does not extinguish claims in other jurisdictions or under Commonwealth law; it expressly confines the protection to South Australian courts and laws (s27(2)).

• Corporations Act and family relationship definitions: the Act cross‑references other statutes for definitional purposes. For example, the definition of “associate” for disgorgement orders mirrors common relational categories and refers to related bodies corporate within the meaning of the Corporations Act 2001 (Commonwealth) (s24(2)(g)). The Act also adopts the Family Relationships Act 1975 definition of domestic partner for specified purposes (s24(4)).

Regulatory incorporation and standards

• Regulations under s28 may apply or incorporate codes, standards or policies, whether prepared by the Minister or other prescribed persons or bodies, wholly or partially and with or without modification (s28(3)(d)). That provision creates a statutory mechanism for the Act’s practical implementation to rely on technical standards or protocols established elsewhere.

Potential overlaps and jurisdictional boundaries

• Federal and State domains: the Act links with the Gene Technology Act 2001, which is a Commonwealth statute. The Act does not attempt to displace the Gene Technology Act’s licensing regime for GMOs; rather it relies on it for experiments and imports defined terms (s3, s6(2)(a)(i), s17). Operators must therefore comply with both Commonwealth licensing requirements and State prohibitions or exemptions under this Act. The Act does not purport to regulate gene technology generally, but to regulate cultivation and market identity consequences within South Australia.

• Limits on private enforcement: because prosecutions under the Act may only be commenced by specified executive actors (s21(1)), private litigants are not given standing to prosecute offences. Section 27 also restricts certain private civil actions in South Australian courts. These structures centralise enforcement within the executive and limit the private enforcement role.

Uncertainties arising from incorporations and regulations

• The Act expressly incorporates parts of the Gene Technology Act 2001 but allows regulations to prescribe modifications, additions or exclusions (s17(1)). Until such regulations specify modifications, the exact mechanics of entry, sample analysis, warrant processes and inspector powers for this Act will be as provided in the Gene Technology Act text. That creates an implementation dependence on the content of both the referenced Act and any modifying regulations.

In short, the Act is deliberately positioned to operate in conjunction with the Gene Technology Act 2001 licensing and enforcement machinery, local government processes for council applications, and State regulatory standards. Compliance will typically require attention to both Commonwealth and State requirements and to regulations and incorporated standards the Governor or Minister may adopt.

The Act’s legislative history, as recorded in the text provided, shows multiple amendments between 2006 and 2020 that change definitions, committee composition and the designated area regime. The principal Act was assented to on 8 April 2004 and commenced on 29 April 2004. The table in the statutory text lists subsequent amending Acts and their commencement dates. Key amendments include:

• 2006 (No 34) Genetically Modified Crops Management (Extension of Review Period and Controls) Amendment Act 2006: commenced 1 January 2007 (s2). The legislative history indicates amendments to Schedule 1 and changes to review periods and controls, though the exact clause changes are listed in the table and show deletions in Schedule 1 and other amendments referenced in the historical versions.

• 2006 (No 43) Statutes Amendment (Domestic Partners) Act 2006: amendments to Part 40 affecting definitions used in the Act, with a commencement date for the relevant provision on 1 June 2007 (Gazette references provided).

• 2009 (No 84) Statutes Amendment (Public Sector Consequential Amendments) Act 2009: amendments affecting s12 and other provisions, with commencement on 1 February 2010.

• 2013 (No 16) Statutes Amendment (Directors' Liability) Act 2013: amended s22(1) to substitute provisions relating to officers’ liability and inserted s22(3), commencing 17 June 2013.

• 2015 (No 8) Statutes Amendment (Boards and Committees,Abolition and Reform) Act 2015: substituted s9(1) and inserted s9(1a) regarding Advisory Committee membership and appointment of a presiding member, commencing 1 July 2015. Section 10(1)-(3) were also amended by this Act.

• 2020 (No 13) Genetically Modified Crops Management (Designated Area) Amendment Act 2020: multiple changes commenced on 15 May 2020 or 15 November 2020 depending on the section. Notable 2020 changes include:

  • Substitution of s5(1) so that Kangaroo Island is designated by force of the subsection as an area in which no genetically modified food crops may be cultivated, and deletion of earlier subsections (s5 substituted by 13/2020 s5(1) commencing 15.11.2020; s5(12) as amended).
  • Insertion of s5A to enable designation of council areas by Gazette notice on application by councils (s5A inserted by 13/2020 s6, commencing 15.5.2020).
  • Amendments to the definition of “cultivate” and to the definition of “designated area” (s3 amendments by 13/2020 s4(1-2) commencing 15.11.2020).
  • Other transitional and saving provision changes across Schedule 1 (s8 amendments).

The legislative history lists the dates of assent and commencement for each amending Act and identifies which provisions were substituted, inserted or deleted. The text also notes that earlier historical versions of the Act exist with commencement snapshots at various dates (1.1.2007, 1.6.2007, 1.2.2010, 17.6.2013, 1.7.2015, 15.5.2020).

Regulatory instruments and expiry provisions

• The Genetically Modified Crops Management Regulations 2008 are referenced as subordinate legislation. A later instrument (Genetically Modified Crops Management Regulations (Postponement of Expiry) Act 2017) postpones expiry, providing that the Genetically Modified Crops Management Regulations 2008 will expire on 1 September 2025 (unless further action is taken) (transitional/regulatory note).

Transitional provisions

• Schedule 1 contains transitional provisions that were amended by 2020 changes. For example, an interim controls clause was modified (cl 1 amendments) and the operation of s6(3) was varied for exemptions that come into operation on the day that section comes into operation (Sch 1 cl1 and cl3 amendments referenced). The Schedule also allows regulations to apply to crops planted or in existence before commencement, subject to limits on retroactive criminal liability (Sch 1 cl2).

Practitioner note

• The 2020 amendments are significant because they concretely designated Kangaroo Island and created a pathway for council area designations, as well as changing the timing mechanics related to commencement day for notices (s5, s5A and Schedule 1 changes). The legislative history table provides section‑level mapping for the amendments so advisers should consult the consolidated Act and the Gazette notices for the operative instruments and precise commencement days of the relevant provisions.

This history shows the Act has evolved from a primarily declaratory framework to one with specific area designations and more detailed procedural provisions for exemptions and committee composition. Any practitioner advising on compliance should verify which version of the Act and which subordinate regulations were in force at the relevant time, and examine Gazette notices for designation and exemption instruments.

The text provided does not list any cases or judicial decisions. The Act’s legislative materials and the included “Legislative history” table do not name judicial proceedings or report any litigation under the Act. Therefore, as per the source you gave, there is no litigation history recorded in the document.

Practical implications of the absence of recorded cases

• The absence of recorded cases in the Act materials does not mean the Act has not been litigated; it means the statutory text provided here contains no annotated case law. For practical legal research, practitioners should search South Australian court databases, legal reporting services and the consolidated legislation website for any decisions that apply or interpret the Act or its provisions (particularly s27 on private actions, s18 on destruction orders and s22 on officer liability). Where the Act imports provisions from the Gene Technology Act 2001 (s17), decisions interpreting those incorporated parts of the Gene Technology Act may be relevant to the interpretation of inspectors’ powers and evidentiary procedures.

• Because prosecutions under the Act can only be commenced by the Minister, Chief Executive, inspectors or Minister‑authorised persons (s21(1)), any criminal enforcement that has occurred will be recorded in prosecutorial and court records under those authorities. Similarly, any judicial consideration of section 27’s protection against civil actions for spread, or of s18 compensation, would be found in court judgments or administrative decisions rather than in the Act text.

Research recommendation

• If litigation precedent is material to advising a client, search for reported decisions and unreported judgments in South Australian courts that mention the Genetically Modified Crops Management Act 2004, key provisions such as s5/s5A, s6, s18, s22, s24, and s27, and decisions under the Gene Technology Act 2001 parts that are incorporated by s17. Also search administrative decisions and any decisions arising from tribunal proceedings or review applications if relevant.

The Act contains a number of specific drafting choices, timing traps and practical issues that can cause non‑obvious compliance or litigation risks. The following items are concrete statutory "gotchas" drawn from the text.

Timing requirements for council designation notices

• Section 5A(4)(a) requires that a notice under s5A(1) must be published before the commencement day and says a notice published on or after the commencement day is void and of no effect. The Act defines commencement day as the day on which section 5 of the Designated Area Amendment Act 2020 comes into operation (s5A(10)). That creates a strict chronological requirement: if a council application proceeds but the Minister publishes the Gazette notice on or after the commencement day, the notice is void. Practitioners advising councils or the Minister must ensure Gazette publication is scheduled to meet the statutory timing or the designation will be void (s5A(4)).

Narrowness of permitted exemptions

• Exemptions are limited in scope and purpose. The Minister must not confer an exemption unless the purpose is one of the three narrow statutory grounds: experimental cultivation under an appropriate GMO licence, limited and contained cultivation at specified places, or closed loop systems where one person undertakes all dealings and segregation is assured (s6(2)(a)(i)-(iii)). The Act also requires the Minister to be satisfied that granting the exemption is reasonable having regard to market requirements (s6(2)(b)). Practitioners should not assume the Minister has broad discretion to permit commercial GM cultivation within designated areas; the statutory gate is narrow.

Ministerial monopoly over prosecutions

• Only certain executive actors can commence prosecutions (s21(1)). Private landholders or market participants cannot initiate prosecutions unless authorised in writing by the Minister. This centralises enforcement and can delay or prevent private enforcement of criminal breaches; it can also create strategic risk if clients expect private remedies or enforcement actions.

Incorporation dependency on external statute

• Section 17 incorporates parts of the Gene Technology Act 2001, but only “as if” those parts were incorporated, and subject to any modifications prescribed by regulation. The practical scope of inspector powers and the procedures they must follow are therefore dependent on both the text of the Gene Technology Act and on any consequential regulations under this Act that modify or exclude parts. Until regulations are consulted, there is legal and operational uncertainty about the exact enforcement mechanics.

Risk of seizure and destruction with cost recovery

• The Minister can order destruction of crops or GM material and inspectors can carry out seizure and destruction (s18(1)-(2)). While inspectors must give landowners a reasonable opportunity to remove or destroy material before acting (s18(3)), once destruction is carried out the Minister can recover reasonable costs and expenses as a debt from the person who acted in contravention (s18(4)). That creates an immediate commercial risk: if a client’s crop is found to be in contravention, not only can it be destroyed, but the government can seek recovery of the sequestration costs. Counsel should advise clients to document any contact with the Minister or inspectors and to act promptly on any direction to remove or destroy material to limit costs.

Limited Crown exposure but a narrow compensation remedy

• Section 26(3) limits Crown or Minister liability for making regulations and Ministerial acts under Part 2. However, s18(5)-(6) provides for compensation if people suffer loss as a result of exercise of powers and prosecution is not commenced within 12 months or is discontinued or the defendant is acquitted. Practitioners should note that compensation is available only in those narrow circumstances and must be pursued as a debt against the Crown; the Crown is otherwise insulated by s26(3).

Bar on private civil claims for spread

• Section 27 prevents actions in South Australian courts against owners or occupiers for the presence of genetically modified plant material attributable to spread and not knowingly introduced by the owner or occupier (s27(2)). This is a statutory bar on certain private suits in South Australia, which may be surprising to persons used to pursuing tort claims where contamination occurs. The statutory protection contains a judicial exception if an owner deliberately dealt with a crop knowing GM material was present to gain commercial benefit (s27(3)(a)-(b)). If advising a client who believes their crop has been contaminated because of another landowner’s negligence, be aware that the private remedy may be limited or unavailable depending on the facts and whether the contamination qualifies as spread and whether the original introduction was knowingly undertaken by the other landowner.

Regulatory fines and recordkeeping obligations

• The regulations can impose recordkeeping, reporting and procedural requirements, and may fix fees or charges in relation to applications and submissions (s7(2)-(3), s28(2)(b)-(c), (h)). Regulations may also prescribe fines up to $10 000 for contravention. Practitioners should ensure clients keep full records and comply with any notice or reporting obligations under regulations to avoid administrative fines.

Officer liability on corporate offences

• Section 22 makes officers and governing body members criminally liable for corporate offences unless they can prove due diligence. This imposes a potentially significant enforcement risk for directors and managers of agribusinesses. Director clients should be advised to implement and document compliance systems that demonstrate due diligence to mitigate personal liability risk.

Gazette notice formalities

• Designations and exemptions are effected by Gazette notice (s5A(1), s6(1)). The formality of Gazette publication is material in law. Advisers should ensure the precise text, timing and publication of any notice meet statutory requirements; defective notices can be void or susceptible to judicial challenge.

Evidence presumption in favour of Ministerial certificates

• Certificates executed by the Minister certifying matters such as authority to act or analysis details constitute proof unless the contrary is proved (s25). That creates an evidential burden on defendants to rebut ministerial certificates in proceedings.

In short, the Act contains strict procedural and timing formalities, narrow exception pathways, significant executive enforcement tools and a statutory bar on some private civil actions. Practitioners should pay attention to Gazette timings, keep records, prepare for inspection and potential seizure, and ensure that any experimental work is approved under the Gene Technology Act licensing regime.

Compliance requires attention to substantive prohibitions, consultation procedures, licensing regimes under the Gene Technology Act 2001 and administrative practices. Below are practical, statute‑grounded compliance steps and considerations.

1. Identify whether land is in a designated area

• Check for designated areas: Kangaroo Island is designated by section 5(1) as an area in which no genetically modified food crops may be cultivated (s5(1)). For council areas, check the Gazette for any s5A notice designating a council area. Because s5A(4)(a) requires publication before a defined commencement day to be effective, confirm the notice’s publication date and the statutory commencement day where relevant (s5A(4)).

2. Do not cultivate GM food crops in designated areas unless a valid exemption applies

• If land is within a designated area, avoid cultivating genetically modified food crops entirely unless a valid exemption exists under s6. Violating the prohibition is an offence with maximum penalty $200 000 (s5(12), s5A(8)). If an exemption is in place, strictly comply with all conditions attached to it since contravention of conditions is itself an offence (s6(4)-(6)).

3. For experimental or limited cultivation, secure the necessary GMO licence and Ministerial exemption

• Experimental releases require a GMO licence under the Gene Technology Act 2001 authorising release of the GMO into the environment for experimental purposes, and any exemption under this Act must be for cultivation “under, and in accordance with” such a licence (s6(2)(a)(i)). Ensure compliance with both Commonwealth licensing conditions and the conditions of any exemption notice issued under this Act. Before conducting any experimental cultivation in a designated area, obtain the exemption notice in the Gazette and document compliance with the GMO licence terms.

4. If proposing a council designation, follow local consultation steps

• A council that wishes to apply for designation must consult its community, including primary producers and food processors/manufacturers in the area, before making the application to the Minister (s5A(2)). Ensure that documented consultation records are prepared to support the application. The Minister will consult the Advisory Committee before publishing any designation notice (s5A(3)).

5. Maintain records and be prepared for inspection

• Anticipate recordkeeping and reporting requirements potentially set out in the regulations (s28(2)(b), (c)). Because the Act may incorporate standards and codes by reference (s28(3)(d)), maintain records documenting seed sources, propagation material, handling, segregation systems, transportation, storage, and lab testing. Inspectors appointed under the Act must be allowed to examine records and premises consistent with the incorporated powers from the Gene Technology Act (s16-17). Ensure staff can produce identity cards and the inspector’s authority, and record interactions with inspectors.

6. Establish and document segregation and closed loop systems if seeking an exemption under s6(2)(a)(iii)

• If an exemption application will rely on a closed loop system where all dealings are by the same person, put in place documented procedures and systems to ensure segregation of the GM crop and any GM related material from other crops and materials. Document chain of custody, log books, staff training and physical segregation measures. The Minister can impose conditions on exemptions and will require proof that market identity will be preserved (s6(2)(a)(iii), (4)).

7. Provide accurate information and avoid false or misleading statements

• Ensure all submissions, reports and information provided to the Minister or Advisory Committee are accurate. Furnishing false or misleading information is an offence with a $10 000 maximum penalty (s20). Establish internal controls to verify data before submission.

8. Engage with the Advisory Committee and Minister early in contentious matters

• The Act gives the Advisory Committee a consultative role and requires Ministerial consultation with the Committee before certain actions (s5A(3), s6(3)). Where market requirements, segregation protocols, or experimental designs may be material to a Ministerial decision, seek early engagement with the Committee to understand the likely considerations and to obtain advice that can be included in applications and submissions.

9. Prepare for enforcement risk and potential remedies

• Be aware that inspectors may seize and destroy crops or GM material under Ministerial order (s18(1)-(2)). If ordered to remove or destroy material, act promptly to take up the “reasonable opportunity” which inspectors must provide before they act (s18(3)). If destruction occurs and no prosecution follows within 12 months, or prosecution is discontinued or results in acquittal, there is a statutory right to seek compensation from the Crown (s18(5)-(6)). Keep contemporaneous records of any interactions and losses to support a compensation claim where appropriate.

10. Corporate governance and officer due diligence

• Directors and managers of corporate agribusinesses should implement and document compliance systems to demonstrate due diligence because s22 makes officers personally liable for corporate offences unless they can prove due diligence (s22(1)). Compliance systems might include standard operating procedures, audit trails, staff training, incident reporting mechanisms and legal review of exemption conditions and licence compliance.

11. Understand the limits of private enforcement and seek Ministerial authorisation if private prosecution is intended

• Because only specified public actors may commence prosecutions, private parties seeking criminal enforcement must request Ministerial authorisation in writing (s21(1)). Where private civil remedies are contemplated for contamination, consider whether s27’s protections will bar an action in South Australian courts and assess whether alternative remedies or interstate/federal avenues exist.

12. Monitor regulatory changes and Gazette publications

• The Act’s operational detail will be shaped by regulations and Gazette notices (designations, exemptions). Keep regular checks on the South Australian Government Gazette, the consolidated Act, and relevant subordinate legislation (notably the Genetically Modified Crops Management Regulations 2008, which the text records will expire on 1 September 2025 unless further action is taken). Regulators may also adopt technical standards to be incorporated by regulation (s28(3)(d)).

In brief: do not cultivate GM food crops in designated areas unless the Minister’s exemption expressly authorises the activity and you have complied with any GMO licence that applies; keep detailed records; implement segregation and compliance systems; be ready to cooperate with inspectors; and document all consultations and actions to preserve legal defences and to support potential compensation claims.
