sec.14 No double jeopardy for offences against applied provisions
This section applies if— an act or omission is an offence against both the applied provisions and the Commonwealth gene technology laws; and the offender has been punished for the offence under the Commonwealth gene technology laws. The offender must not be prosecuted or punished under the applied provisions for the offence. (sec.14-ssec.1) This section applies if— an act or omission is an offence against both the applied provisions and the Commonwealth gene technology laws; and the offender has been punished for the offence under the Commonwealth gene technology laws. (sec.14-ssec.2) The offender must not be prosecuted or punished under the applied provisions for the offence.
- (a) an act or omission is an offence against both the applied provisions and the Commonwealth gene technology laws; and
- (b) the offender has been punished for the offence under the Commonwealth gene technology laws.
