Geelong Lands (Steampacket Place) Act 1996

The Act is compact and turns on a small set of recurring concepts:

• “Reserved land”: defined in s 3(7) as land reserved under the Crown Land (Reserves) Act 1978. That definition is used in both s 3 and s 4 to distinguish the two leasing regimes. For s 3 the operative term is a manager of reserved land; for s 4 reserved land is specifically excluded from the tranche the Minister may grant under s 4(1).

• “Manager”: defined in s 3(7) to mean Trustees or a Committee of Management where the reserve is so managed; otherwise the Minister. The manager has the statutory capacity to grant leases of reserved land under s 3(1), but only subject to Ministerial written approval under s 3(2).

• Ministerial satisfaction and written approval: the Act conditions the exercise of the grant powers on the Minister’s satisfaction that the lease involves “buildings and works of such a substantial nature and value” and, for reserved land, that other circumstances justify a term of more than 21 years (s 3(3)(a); s 4(2)). For reserved land, there is an additional satisfaction requirement that a lease for a purpose other than the reserve purpose be “not detrimental to the purpose for which the land is reserved” (s 3(3)(b)). Section 3(2) requires the Minister to approve in writing a manager’s proposed grant.

• Purpose limitation and permitted uses: the Act limits grants to leases “for the purposes of the construction or occupation of substantial buildings and works” (s 3(1), s 4(1)). Section 4 narrows uses on non-reserved land to amusement and recreation purposes in addition to the construction/occupation criterion (s 4(1)).

• Term limits and extensions: the Act specifies precise caps. Reserved-land leases may have an initial term up to 50 years with extensions permitted so long as each extension does not exceed 21 years and total initial plus extensions does not exceed 99 years (s 3(4)-(5)(a)). Non-reserved Crown land grants have a lower initial cap of 21 years and an aggregate cap of 50 years including extensions (s 4(3)-(4)(a)). Both permit a discretionary post-expiry occupation of up to three months under the same terms (s 3(5)(b), s 4(4)(b)).

• Override or inconsistency clauses: s 3(6) and s 4(5) expressly state the Act’s provisions operate despite contrary provisions in the Land Act 1958 and, for reserved land, the Crown Land (Reserves) Act 1978 and related regulations. Those clauses reduce the need to seek direct amendments to the other statutes to enable the specific leasing outcomes in the hatched area.

• Covenants and conditions: for reserved land the manager’s lease is “subject to any covenants, exceptions, reservations and conditions that are determined by the manager and approved by the Minister” (s 3(5)(c)). The Act does not spell out an analogous clause for non-reserved land; however the Minister’s grant power implies discretion to set terms.

• Spatial focus: everything in the Act is framed by the Schedule plan , the hatched area limits which parcels of Crown land are within the special regime. The Schedule is therefore integral to the operation of every substantive power in ss 3-4.

These concepts establish a framework in which long-term private investment (substantial buildings and works) can be secured by leasehold title in a precisely delimited area, subject to Ministerial gatekeeping and specified term caps.

The Act expressly changes rights and decision-making for three primary groups and indirectly affects others.

• Managers of reserved Crown land in the hatched area: where Crown land is reserved and managed by Trustees or a Committee of Management, those bodies are managers as defined by s 3(7)(a). Under s 3(1) they may grant leases for substantial buildings and works, but only with the Minister’s written approval (s 3(2)). That creates a two-step decision path, obliging the manager to obtain Ministerial approval before completing a grant.

• The Minister: the Act places central statutory authority in the Minister for non-reserved Crown land in the hatched area (s 4(1)), and requires the Minister’s written approval before a manager of reserved land may grant a lease (s 3(2)). The Minister must satisfy themselves of specified factual and evaluative conditions before approval (s 3(3), s 4(2)). The Minister therefore becomes the primary gatekeeper for long-term leases in the area.

• Lessees and prospective developers/investors: private parties seeking to construct or occupy “substantial buildings and works” in the hatched area gain a new statutory route to long-term leases that may exceed durations otherwise available under the Land Act 1958 and Crown Land (Reserves) Act 1978 (ss 3(6), 4(5)). The Act allows potential initial terms up to 50 years (reserved land) or 21 years (non-reserved), with extensions subject to aggregate caps (ss 3(4)-(5), 4(3)-(4)). That creates an investment regime tailored to projects that justify longer recovery horizons.

• Trustees and Committees of Management: if reserves in the area are managed by such bodies, their internal governance and fiduciary decision-making will need to account for the need to secure Ministerial approval before leasing (s 3(2)), and the manager retains the ability to determine covenants and conditions subject to Ministerial approval (s 3(5)(c)). The Act places an approval requirement on managerial discretion.

• Local stakeholders and reserve-purpose beneficiaries: when a lease would be for a purpose different from the reserve’s purpose, the Minister must be satisfied the lease is not detrimental to the reserve purpose (s 3(3)(b)). That creates a formalised protective test to be applied to override reserve purposes, and those who benefit from the reserve’s object will be affected by the Minister’s exercise of that test.

• Administrators of the Land Act 1958 and the Crown Land (Reserves) Act 1978 regime: the Act operates “despite anything to the contrary” in those statutes for the hatched area (s 3(6), s 4(5)), thereby displacing some statutory constraints or default mechanisms in the specified spatial zone. Agencies or officers applying the Land Act or the Crown Land (Reserves) Act will need to apply the special rules in this Act for Crown land within the hatched plan.

The Act does not itself impose tax, rent-setting or registration mechanisms; it is silent about rent, fee-setting, registration, compensation on resumption, or transferability of leases. Any obligations in those domains would derive from other statutes or from lease terms approved under the Act. The parties who actually pay for construction and occupation , the lessee and their financiers , will bear the capital and operating costs entailed by delivering “substantial buildings and works,” but the Act does not prescribe financial terms.

The Act creates a small set of express duties and confers rights that operate in the hatched area.

Duties and preconditions on managers and the Minister

• Written Ministerial approval for manager grants: a manager of reserved land must not grant a lease under s 3(1) unless the Minister has approved the granting of the lease in writing to the manager (s 3(2)). That is a precondition to any valid grant by a manager.

• Ministerial satisfaction requirements: the Minister must not approve a proposed reserved-land lease under s 3(1) unless satisfied of two things: (a) the lease provides for buildings and works of sufficient substantial nature and value and other circumstances justify a term of more than 21 years; and (b) if the lease is for a purpose other than the reservation purpose, the lease is not detrimental to the reserve purpose (s 3(3)(a)-(b)). For non-reserved land, the Minister may grant a lease only if satisfied the lease provides for buildings and works of such substantial nature and value and other terms justify a term of more than 21 years (s 4(2)). The Act does not prescribe how that satisfaction is to be evidenced or recorded.

Rights to grant or receive leases

• Manager’s power to grant (reserved): the manager may grant leases for construction or occupation of substantial buildings and works (s 3(1)), subject to the Minister’s written approval (s 3(2)).

• Minister’s power to grant (non-reserved): the Minister may grant leases of non-reserved Crown land in the hatched area for construction/occupation of substantial buildings and works used for amusement and recreation (s 4(1)); the Minister need be satisfied of the substantiality test (s 4(2)).

Lease terms and lessee rights

• Maximum initial terms: reserved-land leases may be granted for an initial term of up to 50 years (s 3(4)); non-reserved leases are limited to an initial term not exceeding 21 years (s 4(3)). These are rights conferred on the lessor to offer, and on lessees to accept, but are statutory caps.

• Extensions and aggregate caps: reserved-land leases may include extensions, each not exceeding 21 years, with an aggregate cap of 99 years on initial plus extensions (s 3(5)(a)(i)-(ii)). Non-reserved leases may include extensions each not exceeding 21 years with an aggregate cap of 50 years (s 4(4)(a)(i)-(ii)). Those provisions define the maximum leasehold tenure a lessee can secure under a lease granted pursuant to the Act.

• Holdover occupancy: both regimes permit a lessee to remain in occupation under the same terms after expiry for not more than three months “at the discretion of the lessor” (s 3(5)(b), s 4(4)(b)). That is a limited post-term occupation right dependent on lessor discretion.

• Covenants, exceptions and conditions (reserved): a manager’s reserved-land lease is “subject to any covenants, exceptions, reservations and conditions that are determined by the manager and approved by the Minister” (s 3(5)(c)). That gives managers and the Minister a role in shaping the operative legal obligations attached to a lease. The Act does not set similar explicit constraints for non-reserved grants; the Minister’s power to set lease terms is implicit.

Overrides and primacy

• Statutory primacy in the hatched area: s 3(6) and s 4(5) mean the Act’s powers apply notwithstanding contrary provisions in the Land Act 1958 and the Crown Land (Reserves) Act 1978 (s 3(6); s 4(5)). Practically, this grants an elevated statutory permissive scheme that allows the term lengths and purposes described even where those other Acts might otherwise prevent them.

Silences (matters not specified in the Act)

• The Act does not address rent, user charges, registration, transferability, mortgage priority, compensation on resumptions, requirements for competitive tendering or public notice, environmental approvals, building approvals, or how the Minister should record or publish the exercise of satisfaction. Those matters will be governed by other legislative regimes or by the terms that the manager/Minister inserts into a lease.

Overall, duties are concentrated on obtaining Ministerial approval and meeting the textual satisfaction tests. Rights are the statutory authority to grant longer leases in the specified area, and lessee rights are bounded by the term and extension caps the Act prescribes.

The Act contains no express criminal offences, monetary penalties, administrative fines or enforcement regime within its text. The statutory structure is regulatory and permissive rather than punitive: it authorises certain leasing behaviours and prescribes preconditions and caps, but does not create offences tied to non-compliance within the Act itself.

Enforcement pathways and consequences therefore arise indirectly:

• Invalidity of a purported grant: if a manager grants a lease in contravention of s 3(2) (for example, without the Minister’s written approval) or grants a lease that exceeds the maximum term caps set out at s 3(4)-(5) or s 4(3)-(4), legal consequences would follow from general principles of statutory authority. A lease made without the required statutory precondition may be vulnerable to challenge as ultra vires or voidable. The Act itself does not spell out a remedy; customary public law and property law remedies (injunction, declaration, relief against usurpation of statutory functions) would be the likely legal routes, but the Act contains no internal enforcement provisions.

• Ministerial review and administrative remedies: because the Minister’s written approval and satisfactions are preconditions, internal administrative review mechanisms (such as merits review panels or ombudsman complaints) could be available under other instruments or general administrative law, but the Act provides none.

• Interaction with other statutory enforcement: the Act expressly operates “despite” certain provisions of the Land Act 1958 and the Crown Land (Reserves) Act 1978 (s 3(6), s 4(5)). Those other statutes may contain enforcement and penalty regimes applicable to Crown land management more generally. Any attempt to rely on those regimes against an action authorised under this Act would need to reconcile the override clauses; the Act’s express “despite” language suggests that where there is a direct conflict, the Act’s provisions prevail in the hatched area.

• Contractual enforcement: covenants and lease terms approved under s 3(5)(c) will create contractual rights and remedies enforceable between lessor and lessee. The Act permits the manager to determine covenants and requires Ministerial approval for them (s 3(5)(c)), thereby shaping the private enforcement landscape via lease terms rather than statutory penalties.

• Judicial review: the Act requires the Minister to be satisfied of certain matters before approving a lease (s 3(3), s 4(2)). Those satisfaction decisions are amenable to judicial review for legal error, procedural fairness, irrationality or failure to take into account relevant considerations under general administrative law principles, although the Act does not itself set out a review process. The Act does not supply standards for how those satisfactions are to be documented or evidenced.

Because the Act is silent on explicit civil or criminal penalties, compliance will be enforced mainly by ensuring statutory preconditions are met and through the legal consequences (invalidity, contract enforcement, judicial review) that attach to exercises of power not compliant with the Act. Practitioners should therefore treat the statutory preconditions and approval formalities as the primary compliance levers.

The Act is expressly framed to operate within, and to displace aspects of, existing Crown land statutes in the specified geographical area.

Express overrides

• Land Act 1958: sections 3(6) and 4(5) each provide that the respective leasing powers “have effect despite anything to the contrary in the Land Act 1958.” That means where the Land Act would otherwise limit terms, uses or processes applicable to Crown land in the hatched area, the Geelong Lands Act’s provisions prevail in relation to leases authorised under it.

• Crown Land (Reserves) Act 1978: s 3(6) states that section 3 “has effect despite anything to the contrary in the Crown Land (Reserves) Act 1978 or regulations made under section 13 of the Crown Land (Reserves) Act 1978.” Where those instruments would normally constrain reserve managers’ ability to grant long leases or leases for different purposes, s 3 displaces those constraints for the hatched reserved land, subject to the managerial and Ministerial conditions in ss 3(1)-(5).

Consequences of the express overrides

• Inconsistency resolution: the Act creates a higher-order local rule for the hatched area that modifies the default legislative framework. Those overrides narrow the scope for relying on contrary provisions in the Land Act and, for reserved land, the Crown Land (Reserves) Act to prevent the long leases envisaged in this Act. Practically, officers applying the Land Act and the Crown Land (Reserves) Act must apply the special rules contained in this Act for land inside the plan hatched area.

• Silent topics remain governed by other laws: the Act does not address many administrative and substantive aspects of leasing (such as registration, fees, tendering, planning approvals, building approvals, environmental assessment, taxation consequences, or mortgage priority). Those matters remain subject to other laws and regimes, including the Land Act 1958, planning and building laws, environmental laws, and general taxation law.

Administrative law and judicial review

• Ministerial satisfactions, approvals in writing, and managerial determinations are administrative acts that will interact with general administrative law principles. The Act’s requirement that the Minister be “satisfied” of specified matters (s 3(3), s 4(2)) imports an evaluative decision-making step that is not qualified by the Act beyond the textual tests. That leaves the usual administrative law remedies (judicial review, procedural fairness obligations where applicable) and disclosure obligations under freedom-of-information-type regimes to apply via the general law rather than the Act.

Contract and property law interactions

• Lease terms and covenants: s 3(5)(c) permits managers to include covenants and conditions approved by the Minister. Those covenants will interact with property and contract law principles, and with registration regimes that apply to leases of Crown land. The Act does not specify priority rules for mortgages or dealings, which means standard property law and any relevant registration statutes will determine those outcomes.

Spatial boundary issues

• The Schedule plan is a statutory reference point. Where disputes arise about whether particular parcels are inside the hatched area, courts will resort to principles of statutory construction and extrinsic evidence about the Schedule plan as published at the time the Act was enacted. The Act itself makes the plan the operative spatial definition.

In short, the Act creates an exception-focused overlay to existing Crown land statutes in a narrowly-defined area. It displaces inconsistent provisions of the Land Act 1958 and, for reserved land, the Crown Land (Reserves) Act 1978, but leaves most detailed governance features (financial terms, registration, environmental and planning approvals, mortgage rules) to other statutes and to lease terms agreed under this Act. Users must therefore read the Act alongside the Land Act, the Crown Land (Reserves) Act, and any planning, environmental, and property registration laws that will affect implementation.

The source text includes an Endnotes section that addresses commencement and amendments.

• Commencement: sections 1 and 2 came into operation on 22 October 1996 (the date of Royal Assent). The remainder of the Act came into operation on 1 January 1998 by virtue of s 2(3) (s 2(1)-(3); Endnotes). The Minister’s second reading speech and the legislative dates recorded in the Endnotes confirm those commencement dates.

• Amendments: the Endnotes contain a Table of Amendments and explicitly state “There are no amendments made to the Geelong Lands (Steampacket Place) Act 1996 by Acts and subordinate instruments.” The version supplied is labelled Version No. 003 and is current as at 6 September 2012, with no recorded amendments up to that date.

• Explanatory details: the Endnotes include a note that there are “No entries at date of publication.” The Second Reading speech appears in the Endnotes, noting the Bill long title and the dates of the Legislative Assembly and Legislative Council second readings (12 September 1996 and 9 October 1996 respectively). The actual explanatory memorandum text is not reproduced beyond that summary.

Implications

• The Act’s substantive provisions have remained unamended according to the supplied Endnotes up to the stated version date (6 September 2012). Users should verify whether later amendments exist outside this document if reliance beyond 2012 is contemplated.

• Because the Act is narrow and self-contained, changes affecting its operation in practice may arise from amendments to interacting statutes (for example, the Land Act 1958, Crown Land (Reserves) Act 1978, planning law, or environmental law) rather than from amendments to this Act itself. The Endnotes do not record such changes; practitioners should cross-check the contemporaneous state of those other laws where implementation is planned.

The Act’s amendment history as provided is therefore: no amendments recorded in the supplied version, with commencement dates as noted.

The supplied legislative text and Endnotes do not record any litigation history. There are no cases, judicial decisions, or litigation references included in the Act text or its endnotes.

Consequences of that silence in the source

• No precedent or judicial interpretation supplied: because the supplied source contains no reported decisions, this note cannot identify any judicial interpretation or construction of the Act’s satisfaction tests, the scope of the Schedule plan, the effect of the override clauses, or the limits on managerial power. Practitioners must therefore approach any contentious questions (for example, what constitutes “substantial buildings and works” or what level of evidence is required to satisfy the Minister that a lease would not be detrimental to the reserve purpose) on the basis of the statutory text and general administrative and property law principles in the absence of guidance from judicial authorities within this source.

• Potential for future litigation zones: the Act creates several fact-sensitive decision points that could be sources of dispute if exercised (though no cases are recorded here). Those include the Minister’s satisfactions under s 3(3) and s 4(2), the scope and application of the reserve-purpose non-detriment test in s 3(3)(b), the legal effect of a manager proceeding without required Ministerial written approval under s 3(2), and the interpretation of the Schedule plan boundaries. In the absence of reported litigation in this source, the resolution of those points would rely on general principles of statutory construction and administrative law.

• No recorded appeals or administrative reviews: the Endnotes do not record any administrative or tribunal decisions related to the Act.

Practitioners should therefore treat the Act’s text as the primary source of authority for its operation and be prepared to rely on general legal principles where the Act is silent. For any current matter, a search of subsequent case law and tribunal decisions external to this source would be necessary to identify any judicial development post-dating the supplied version.

This Act is short but contains several features that can cause practical pitfalls if not addressed explicitly.

1. Spatial limitation by Schedule plan: every authority under ss 3-4 is tied to the area shown hatched on the Schedule plan (s 3(1), s 4(1); Schedule). The Act does not specify coordinates or textual descriptions in the main body; the plan in the Schedule is operative. Practitioners must ensure the precise parcels intended to be leased lie within that hatched area. Where the plan’s publication or record-keeping is incomplete, boundary disputes could arise.

2. “Substantial buildings and works” is undefined: both ss 3(1) and 4(1) require the lease to be for construction or occupation of “substantial buildings and works.” The Act provides no quantitative or qualitative test. The Minister’s satisfaction that the works are sufficiently substantial is a precondition (s 3(3)(a); s 4(2)), but the statute does not prescribe evidentiary standards or thresholds. Expect negotiation and documentation to evidence the capital value, scale or strategic importance required to meet the test.

3. Ministerial discretion and evidentiary gap: the Act requires the Minister to be “satisfied” about matters in ss 3(3) and 4(2), but does not require reasons, public notice, or consultation in the text. The formality of the Minister’s written approval to the manager is required (s 3(2)), but the Act does not state the content of that approval or whether reasons must be recorded. Parties should therefore seek to have written approvals include sufficient reasons and recitals to reduce post-hoc challenge risk.

4. Reserve-purpose protection test: where a reserved land lease is for a purpose other than the land’s reservation purpose, the Minister must be satisfied the lease is “not detrimental to the purpose for which the land is reserved” (s 3(3)(b)). The Act does not define “detrimental” or the applicable balancing test. Assessing detriment will likely require cross-reference to reserve instruments and objectives under the Crown Land (Reserves) Act, and to environmental and planning tests.

5. Different regimes for reserved and non-reserved land: reserved land managers can grant leases (subject to Ministerial approval) with higher initial terms and longer aggregate potential (s 3(4)-(5)); non-reserved Crown land must be granted by the Minister with lower initial and aggregate caps (s 4(1), s 4(3)-(4)). Mistaking which regime applies to particular Crown parcels would materially affect permissible tenure lengths.

6. Covenants and approvals (reserved): s 3(5)(c) allows the manager to determine covenants etc., but those require Ministerial approval. Managers must therefore coordinate with the Minister early in drafting lease terms; failing to secure approvals for covenants may render parts of proposed terms inoperative or subject to re-negotiation.

7. Holdover limited to three months at lessor’s discretion: both regimes allow a lessee to remain in occupation post-expiry for up to three months “at the discretion of the lessor” (ss 3(5)(b), 4(4)(b)). This is short and discretionary; lessees and financiers should not rely on extended de facto possession rights unless specifically provided for in the lease terms consistent with the Act’s caps.

8. Silence on rent, registration and mortgages: the Act does not address how rent is set, whether leases must be advertised, whether grants require tendering, or how leases deal with security interests and priority. Absent direction, those matters will be governed by other statutes and by the lease terms approved under this Act. Parties should not assume any special registration or mortgage priority arises from this Act.

9. Overrides may create interface issues: ss 3(6) and 4(5) displace contrary provisions in the Land Act 1958 and, for reserved land, the Crown Land (Reserves) Act 1978. That can create confusion when administrative staff or external advisers apply standard Crown land processes; explicit cross-referencing and internal guidance will be necessary to ensure the Act’s exception regime is followed.

10. No internal enforcement mechanics or prescribed process: because the Act sets preconditions but contains no administrative process, practitioners should document approvals, satisfactions and managerial determinations thoroughly. The absence of specified procedural safeguards increases the importance of clear written records to avoid challenges based on procedural fairness or lack of evidence.

Addressing these gotchas requires focus on documentation, early Ministerial engagement, careful mapping against the Schedule, and cross-referencing other statutory regimes that will apply to the proposed development or occupation.

Compliance with the Act’s requirements involves procedural steps, documentation practices and interlocking checks against other statutory regimes, given the Act’s silences.

Step 1 , Confirm spatial eligibility

• Obtain the operative Schedule plan and verify the parcel(s) lie within the hatched area. The Act’s powers are expressly tied to that plan (s 3(1), s 4(1)). If there is any ambiguity about the plan, obtain the official published plan as annexed to the Act or seek the administering agency’s clarification.

Step 2 , Determine whether the land is reserved

• Confirm whether the particular Crown land is “reserved” under the Crown Land (Reserves) Act 1978. The manager’s powers, Ministerial approval requirement, and different term caps hinge on this classification (s 3(7); compare ss 3 and 4).

Step 3 , Engage the appropriate decision-maker

• If the land is reserved and managed by Trustees or a Committee of Management, treat that body as the manager with power to grant subject to written Ministerial approval (s 3(1)-(2), s 3(7)(a)). If reserved land is not managed by such bodies, the manager is the Minister (s 3(7)(b)). For non-reserved land the Minister alone has the power to grant (s 4(1)).

Step 4 , Prepare evidence to satisfy the Minister

• Both s 3(3)(a) and s 4(2) require the Minister to be satisfied that the lease provides for “buildings and works of such a substantial nature and value” and that other circumstances justify terms exceeding 21 years. For reserved land, also prepare evidence addressing s 3(3)(b) (that any differing purpose is not detrimental to the reserve purpose). Assemble documentation (project scope, capital budgets, economic impact, risk assessments, planning approvals, environmental assessments) to support the Ministerial satisfaction.

Step 5 , Draft lease terms within statutory caps

• For reserved land ensure the initial term does not exceed 50 years (s 3(4)). For non-reserved land ensure initial term does not exceed 21 years (s 4(3)). If including extension options, ensure each extension does not exceed 21 years and aggregate initial plus extensions does not exceed the statutory cap: 99 years for reserved land (s 3(5)(a)(ii)) and 50 years for non-reserved (s 4(4)(a)(ii)). Include a discretionary holdover clause limited to three months if desired (s 3(5)(b), s 4(4)(b)).

Step 6 , For reserved land, draft covenants and secure Ministerial approval

• s 3(5)(c) makes a manager’s lease subject to covenants, exceptions and conditions determined by the manager and approved by the Minister. Draft those covenants in parallel with the Minister’s approval process and obtain explicit written Ministerial approval of both the grant and the covenants. Do not rely on implied or informal approvals.

Step 7 , Record the written Ministerial approval

• s 3(2) requires the Minister’s written approval to the manager prior to the grant. Ensure the approval is documented, dated and retained in the project file. Where feasible, include recitals in the approval that state the Minister’s satisfaction on the statutory points to reduce later challenge risk.

Step 8 , Coordinate with other regulatory regimes

• The Act is silent about planning, building, environmental, registration and taxation matters. Before construction or occupation, secure any required planning permits, building approvals, environmental licences, and ensure compliance with registration and property transfer systems. Where the lease will be mortgaged or used as security, ensure the lease terms and the applicable registration statute accommodate the financier’s requirements.

Step 9 , Seek legal and administrative advice on procedural fairness and publication

• The Act does not prescribe public consultation or notice obligations. Where public or stakeholder interest is likely, consider publishing notices or conducting consultations voluntarily to reduce procedural fairness risks and to provide record evidence that relevant considerations were taken into account in the Minister’s decision.

Step 10 , Maintain contemporaneous records

• Keep a complete administrative record of the manager’s decision-making, Ministerial satisfactions, the covenants approved, and any correspondence. Because the Act does not set an internal appeal process, a well-documented decision trail reduces the chances of successful legal challenge under administrative law.

Step 11 , Confirm registration and enforceability

• After grant, ensure the lease is registered where required by property law or registration statutes, and that the lease contains enforceable clauses (e.g. assignment, mortgage clauses) consistent with other statutory regimes. The Act imposes term and extension caps but is silent on registration; compliance depends on following other applicable registration rules.

Following these steps will align the process and documentation with the Act’s textual requirements. Because the Act leaves many matters to other laws or to the terms of the lease, practitioners must plan for parallel compliance across planning, environmental, taxation and property registration regimes and seek explicit written Ministerial approvals and reasoned recitals where possible.
