What it does
This Act revokes earlier statutory instruments and restructures the legal status and ownership path for a parcel described in the Act as the Haimes Homes in the City of Geelong. The Preamble records that the Haimes Homes was permanently reserved as a site for "an Asylum for Aged Females" by an Order of the Governor in Council on 1 July 1895 and granted by Crown Grant volume 2614 folium 522761 to trustees. The Act revokes that Crown Grant and the reservation (see s 3(1) and s 3(2)) and declares that the hatched land in the Schedule is to be treated as unalienated Crown land, freed and discharged from trusts, encumbrances and other interests (s 4).
Once the land is treated as unalienated Crown land, the Governor in Council may grant the hatched land in fee simple to the trustees of the Haimes Homes, subject to whatever conditions, exceptions and reservations the Governor in Council thinks fit (s 5). The trustees are then given statutory authority to sell and transfer the land on terms, conditions and reservations they determine (s 6). The Act specifies the destination for the net proceeds of any such sale: the trustees of the Haimes Homes must pay net proceeds to the trustees and Committee of Management of the Austin Homes, and those recipients shall apply the net proceeds towards "the cost of the building, development and improvement of facilities at the Austin Homes" (s 7). When the trustees of the Haimes Homes have sold the hatched land and applied the net proceeds in accordance with s 7, they are to be freed and discharged from further duties and liabilities under the trust in respect of the Haimes Homes (s 8). Finally, the Crown will not be liable to pay compensation in respect of any act, matter or thing done under or arising out of this Act (s 9).
Mechanically, therefore, the Act: (1) removes the prior reservation and Crown grant; (2) treats the parcel as Crown land without past encumbrances; (3) enables a statutory grant by Governor in Council to the Haimes Homes trustees in fee simple; (4) empowers the trustees to sell; (5) fixes the statutory destination of sale proceeds to Austin Homes; and (6) extinguishes Crown liability for compensation under the Act.
