sec.108 Commencement of customer connection services
If the distributor and the applicant enter into a connection contract, the distributor must, subject to section 109 , start to provide the customer connection services for the covered gas at the time provided under this section. Generally, the distributor must use reasonable endeavours to comply with the obligation within the required period after entering into the contract. However, if, within the required period after entering into the contract, the distributor requires any of the following the obligation ceases— the giving of security for the services in an amount and a way that is fair and reasonable; the giving of a reasonable advance payment for the services; the payment of charges for establishing a connection to the applicant’s premises, if the charges are reasonable having regard to the expected revenue from the transportation of the covered gas as a result of the connection. If the requirement is met, the distributor must use reasonable endeavours to connect the premises within the required period after meeting the requirement. In this section— required period , after entering into the contract or meeting the requirement, means— if starting to provide the services only involves opening a physical connection to the distributor’s pipeline or system— 10 business days; or any longer period agreed to by the applicant within the 10 business days; if starting to provide the services involves more than opening a physical connection to the distributor’s pipeline or system— a reasonable period; or any longer period agreed to by the applicant. s 108 amd 2006 No. 60 s 90 ; 2014 No. 48 s 124 ; 2023 No. 25 s 31 sch 1 (sec.108-ssec.1) If the distributor and the applicant enter into a connection contract, the distributor must, subject to section 109 , start to provide the customer connection services for the covered gas at the time provided under this section.
