#### 83A Delegation 83A Delegation > > (1) The Minister may delegate the Minister’s functions under this Act to the Secretary, other than the following— > > > > > (a) this power of delegation, > > > > > (b) the Minister’s functions under sections 9, 11, 11A, 12, 38, 40 and 41. > > > (2) The Secretary may subdelegate a function delegated to the Secretary by the Minister under subsection (1) to an authorised person, unless the Minister otherwise provides in the instrument of delegation to the Secretary. > > > (3) The Secretary may delegate the Secretary’s functions under this Act, other than this power of delegation, to an authorised person. > > > (4) In this section— > > > > authorised person means the following— > > > > > (a) a person employed in the Department, > > > > > (b) a person, or person of a class, prescribed by the regulations. > > **s 83A:** Ins 2000 No 60, Sch 3.2 \[6\].
