#### 81 Proceedings for offences 81 Proceedings for offences > > (1) Proceedings for an offence against this Act or the regulations are to be dealt with summarily before the Local Court. > > > (2) Proceedings for an offence against this Act may instead be dealt with summarily before the Supreme Court in its summary jurisdiction. > > > (3) Proceedings for an offence against this Act or the regulations may be instituted at any time within 2 years after the commission of the offence. > > > (4) The maximum monetary penalty that may be imposed by the Local Court in proceedings for an offence against a provision of this Act or the regulations is— > > > > > (a) for a corporation—2,000 penalty units, and > > > > > (b) for an individual—1,000 penalty units. > > > (5) The maximum penalty that may be imposed by the Supreme Court in proceedings for an offence against a provision of this Act or the regulations is the maximum penalty specified by that provision in respect of the offence. > > **s 81:** Am 1999 No 85, Sch 2.26; 2007 No 94, Schs 2, 4; 2025 No 21, Sch 1\[33\].
