Gas Safety (Safety Case) Regulations 2018

The Regulations organise obligations around three core concepts: safety case structure, incident reporting and gas quality standards.

Safety case structure. The Regulations require a safety case to identify the entity (ABN/ACN, regs 8, 23, 43), the person responsible for management and authorisation (regs 9 and 24), and the person responsible for preparing and updating the safety case (regs 10 and 25). A safety case must include a facility description (regs 11, 26) adequate to permit assessment of the extent and scope of operations and associated risks. For non‑retail facilities, a formal safety assessment is mandatory and must set out methodology, hazard identification, systematic risk assessment (likelihood and consequences) and measures to minimise risk as far as practicable (reg 27). A safety management system is a required element (regs 12 and 28) and must include, depending on whether the facility is a gas retail facility or another type, rules on organisational responsibilities, supply safety, gas quality, gas installation supply, incident reporting, emergency preparedness, internal monitoring, auditing, reviewing and competence/training (Divs 3 and 5, regs 14-21 and 29-38).

Incident reporting. The Regulations distinguish routine data flows and urgent notifications. Routine reporting is a quarterly statistical summary for the purposes of s 36(1) of the Act (reg 44(1)). Immediate reporting is required "as soon as practicable" where incidents involve transmission pipelines, death or injury, significant property damage, or significant community disruption (reg 44(2)). For other incidents, the Regulations set out the discrete data fields that must be supplied when reporting under s 36(1) and s 36(2): nature, when/where, cause, emergency services attendance, remedial actions and corrective/preventive actions (reg 44(4)).

Gas quality and testing. The Regulations adopt AS 4564,2011 as the prescribed standard for natural gas conveyed through transmission or distribution pipelines and for natural gas sold or supplied to a customer; AS 4670:2018 is the prescribed standard for LP Gas sold or supplied to a customer for appliance use (reg 45). They add a prescriptive odour requirement: gas must have a distinctive and unpleasant odour discernible at one‑fifth of the lower explosive limit, with two specific exclusions for automotive LPG and LNG (reg 46). For transmission pipelines, the Regulations require routine testing of the Wobbe Index and hydrogen sulphide content with instruments that either sample every six minutes or are of a class approved by Energy Safe Victoria, and tests must be NATA‑accredited methods or approved by Energy Safe Victoria (reg 47).

Administrative discretion and enforcement. Energy Safe Victoria's administrative powers are significant: it approves classes of instruments or methods (reg 47), receives and evaluates safety cases and reports, accepts voluntary safety cases and levies an annual administration fee for voluntary safety cases (reg 48), may waive or rebate fees in whole or part based on its opinion (reg 49), and may grant exemptions in writing subject to conditions (reg 50). The Regulations set criminal penalties by reference to penalty units for certain failures, for example failing to maintain the records system (20 penalty units for reg 39(1)) and failing to comply with exemption conditions (20 penalty units for reg 50(4)).

Interoperability with standards and other Acts. The Regulations integrate external standards and schemes: AS 4564 and AS 4670 (reg 5 and reg 45), NATA accreditation (reg 5; reg 47(5)), Monetary Units Act 2004 and Sentencing Act 1991 for application of fee and penalty units (endnotes), and the Subordinate Legislation Act 1994 (sunset provision referenced in the endnotes). Published technical standards that safety management systems must specify include Standards Australia, BSI, ISO, IGEM and similar bodies (reg 5).

Primary regulated parties under these Regulations are gas companies, operators of facilities, manufacturers and operators of complex gas installations and Type B appliances, and those that convey natural gas through transmission pipelines. The text uses "gas company" for retail and other facilities and maps that term to manufacturers or operators in the context of voluntary safety cases (Part 3, regs 40-43).

• Gas retailers (facilities for sale by retail of gas). For retail facilities the safety case obligations focus on supply safety to customers, gas quality to customers, supply for use in installations, incident reporting, emergency preparedness and competence (Div 2 and Div 3, regs 7-21). Retailers must include an ABN/ACN (reg 8) and identify responsible persons (regs 9-10).

• Non‑retail facilities and transmission/distribution operators. Operators of other facilities must prepare a facility description and a formal safety assessment (reg 26-27). Transmission pipeline operators are directly affected by the gas quality testing regime in reg 47, which imposes frequent testing and specified methods for Wobbe Index and hydrogen sulphide content. The testing obligations (reg 47) require technical capability and accredited methods, so transmission pipeline operators who convey natural gas must ensure instrumentation and accreditation are in place.

• Manufacturers and operators of complex gas installations and Type B appliances. The Regulations apply Divs 4-6 of Part 2 to safety cases under ss 52-54 of the Act (Part 3, regs 40-42), mapping the facility references to complex gas installations and the gas company references to operators or manufacturers. Voluntary safety cases under those Act sections attract the administrative fee in reg 48 and the waiver/rebate process in reg 49.

• Energy Safe Victoria (ESV). The agency administers approvals of testing instrument classes or methods, fee assessment and waivers, and exemptions (regs 47(3)(b), 47(4)(b), 48-50). The Regulations expressly require reports and copies of incident reports to be provided to Energy Safe Victoria (reg 39(2)(e) and reg 44).

• Third parties and communities. While not directly regulated, the Regulations impose duties aimed at protecting the public (see requirements for emergency response plans, public safety measures, and odour requirements in regs 19, 34 and 46). Community safety benefits follow from the obligations on regulated entities to ensure safe conveyance and supply, and to report significant incidents promptly (reg 44).

• Service providers and auditors. Dedicated roles are prescribed in the safety management system: persons authorised to issue permits to work, persons responsible for audits and monitoring, and persons responsible for training and competence (regs 20, 33, 36-38). External auditors may be engaged to provide written audit reports that must be retained as records (reg 39(2)(c)).

Compliance and cost bearers. The Regulations make the gas company responsible for preparing, submitting and maintaining the safety case and implementing the safety management system (regs 10; 12; 28). For voluntary safety cases, the operator or manufacturer must pay an annual administration fee (reg 48). Testing obligations (reg 47) and NATA accreditation (reg 47(5)) impose capital and operating costs on transmission pipeline operators. Recordkeeping and reporting duties (reg 39; reg 44) impose administrative costs on all affected entities.

Duties

• Prepare and submit a safety case that contains specified elements. For retail facilities this includes a detailed facility description and a safety management system meeting the elements set out in Div 3, regs 11-21. For other facilities a safety case must include a facility description, a formal safety assessment consistent with the description (reg 26-27), and a safety management system compliant with Div 5 (regs 28 and 29-38).

• Specify ABN/ACN and responsible persons. Safety cases must specify the ABN/ACN of the gas company (regs 8, 23, 43). They must specify the person responsible for the management, control and safe operation and who authorised the safety case (regs 9 and 24), and the title and contact details of the person responsible for preparing, submitting and updating the safety case (regs 10 and 25).

• Implement and document a safety management system that contains organisational structure and responsibilities, supply and quality arrangements, emergency preparedness, permitting, internal monitoring, auditing, reviewing, competence and training (Divs 3 and 5, regs 14-21 and 29-38). The system must specify published technical standards used (reg 31), and, for non‑retail facilities, must demonstrate how technical and other measures identified in the formal safety assessment will achieve risk minimisation (reg 28(2)).

• Operate permit-to-work systems where required. A permit-to-work system must prohibit unauthorised work, specify authorising positions, and ensure competence and provision of tools and emergency support (reg 33).

• Report gas incidents. Gas companies must provide quarterly statistical summaries (reg 44(1)), and report immediately where incidents involve transmission pipelines, death/injury, significant property damage or significant community disruption (reg 44(2)). For other reportable incidents the company must provide specified information to the extent available (reg 44(4)).

• Test gas quality on transmission pipelines. Transmission pipeline operators must test Wobbe Index and hydrogen sulphide content by instruments that sample at least once every six minutes or are of a class approved by Energy Safe Victoria; tests must be NATA‑accredited methods or approved by Energy Safe Victoria (reg 47).

• Maintain records. A gas company must maintain a system for keeping records relating to the safety case for each facility; required records include the accepted safety case, revisions, written audit reports, investigation reports, and copies of reports given to Energy Safe Victoria (reg 39(1)-(2)) and must be kept at the address nominated in the safety case, be retrievable, secure and kept for seven years (reg 39(3)).

• Pay fees for voluntary safety cases. Operators or manufacturers submitting voluntary safety cases under ss 52-54 must pay an annual administration fee of 1007 fee units, payable on acceptance and on each anniversary (reg 48).

Rights and administrative discretions

• Right to apply for exemption. A gas company or a manufacturer/operator may apply in writing to Energy Safe Victoria for exemption from any of the requirements of the Regulations or, in the case of a prescribed quality standard, to seek an exemption if it can satisfy Energy Safe Victoria that conveyance, supply, sale or use will be safe in the circumstances (reg 50(1)-(2)).

• Energy Safe Victoria discretion to grant exemptions and impose conditions. Exemptions must be in writing and may specify conditions; recipients must comply with conditions (reg 50(3)-(4)). Non‑compliance with conditions carries a penalty (20 penalty units).

• Energy Safe Victoria discretion to waive or rebate fees. The agency may waive or rebate all or part of the administration fee if, in its opinion, the consideration or administration of the safety case imposes a lesser or no appreciable burden (reg 49(1)). In doing so Energy Safe Victoria may consider the voluntary operator's safety performance and, for complex gas installations, the number and characteristics of Type B appliances (reg 49(2)).

• Right to use Energy Safe Victoria‑approved instrumentation/methods. The Regulations permit use of instruments or methods that are of a class or type approved by Energy Safe Victoria as an alternative to the strict six‑minute sampling requirement (reg 47(3)(b)-(4)(b)).

• Right to rely on prescribed standards. The Regulations prescribe AS 4564 and AS 4670 as the quality standards to be applied (reg 45), giving regulated parties a clear benchmark.

Legal consequences and enforcement cues. Failure to maintain the records system is an offence attracting a penalty of 20 penalty units (reg 39(1)). Failure to comply with conditions attached to an exemption similarly attracts a 20 penalty unit penalty (reg 50(4)). Other breaches will engage the enforcement powers in the Act; the Regulations themselves specify statutory duties and obligations and identify Energy Safe Victoria as the recipient and decision maker for approvals, waivers and exemptions.

The Regulations specify explicit monetary penalties by reference to penalty units prescribed under the Sentencing Act 1991 and set enforcement paths largely through Energy Safe Victoria's regulatory role.

Specified penalties in the text

• Recordkeeping offence. A gas company that fails to establish and maintain the required system for keeping records relating to the safety case is liable to a penalty of 20 penalty units (reg 39(1)). The regulation then details the specific records required (reg 39(2)) and storage, retrieval and retention conditions (reg 39(3)).

• Exemption condition breach. A person to whom an exemption is granted under reg 50 must comply with any conditions; failure to do so carries a penalty of 20 penalty units (reg 50(4)).

The endnotes explain how monetary and penalty units are converted into dollar amounts for a given financial year. For the financial year commencing 1 July 2018 the value of a fee unit was $14.45 and the value of a penalty unit was $161.19 (endnotes). Using those 2018 values, the annual administration fee of 1007 fee units in reg 48 would have equated to approximately $14,551.15 before rounding rules are applied; a 20 penalty unit sanction at the 2018 penalty unit value equated to approximately $3,223.80. The endnotes expressly state that fee and penalty unit values are set annually by the Treasurer and published (endnotes), so actual dollar amounts change over time.

Enforcement mechanisms and administrative powers

• Energy Safe Victoria as regulator. Energy Safe Victoria receives safety case submissions, incident reports and copies of investigation reports (reg 39(2)(e); reg 44). The agency is empowered to approve classes of instrumentation or methods (reg 47), to accept, administer and levy fees on voluntary safety cases (reg 48), to waive or rebate fees (reg 49), and to grant written exemptions subject to conditions (reg 50). Those provisions create administrative discretion and a centralised decision‑making role for ESV.

• Criminal and civil enforcement. The Regulations create specific offences with monetary penalties. Other breaches of obligations in the Regulations are likely to be enforced under the complementary enforcement framework in the Act, including powers to require compliance and to pursue sanctions available under the principal Act. The Regulations do not themselves recite the full enforcement mechanics of the Act, but they feed into Energy Safe Victoria's administrative and enforcement functions by defining reportable matters, safety case contents and record requirements.

• Procedural obligations with indirect enforcement effects. Several operational duties (for example continuous testing regimes for transmission pipelines in reg 47 or permit‑to‑work obligations in reg 33) are prescriptive and, if not complied with, will create evidence of non‑compliance with statutory duties in the Act. The requirement to keep audit reports and investigation reports and to provide copies to Energy Safe Victoria (reg 39(2)(c)-(e)) means that non‑compliance may be discovered via routine submissions or audits.

Practical enforcement signals

• The administrative discretion over waivers and exemptions (regs 49-50) provides ESV with levers to impose conditions on compliance and to reward demonstrable performance with fee rebates, which can be enforced by the penalty for non‑compliance with exemption conditions (reg 50(4)).

• The six‑minute sampling requirement and NATA accreditation requirement (reg 47) create technical compliance standards that are relatively binary: either appropriate instrumentation and methods are used or they are not. Energy Safe Victoria approval of alternative instrument classes provides some flexibility but relies on the regulator's approval process.

• The recordkeeping penalty is not trivial. The prescribed retention period of seven years and the requirement to keep records at the nominated address and in a retrievable, secure manner (reg 39(3)) make operational record systems a clear compliance checkpoint.

The Regulations operate as subordinate legislation to the Gas Safety Act 1997. They are explicitly made under s 118 of the Act and are intended to give effect to and detail duties and processes referenced in specific sections of the Act (reg 2; see multiple cross‑references to ss 32-36, and to ss 52-54 in Part 3).

Interconnections explicitly in the text

• Gas Safety Act 1997 references. The Regulations repeatedly link duties back to sections of the Act: obligations to ensure safety of supply to customers (s 32) are reflected in the safety management system requirements (reg 15); duties on gas quality (s 33) are operationalised by reg 16 and Part 5 (regs 45-46); supply of gas for use in gas installations (ss 34-35) are reflected in reg 17; and reporting duties under s 36 are given shape in reg 18, reg 35 and Part 4 (reg 44). Voluntary safety cases under ss 52-54 of the Act are given specific treatment in Part 3 (regs 40-43).

• Monetary Units Act 2004 and Sentencing Act 1991. The Regulations set fees and penalties by reference to fee units and penalty units; the endnotes explain that the Monetary Units Act and Sentencing Act are used to convert those units into dollar amounts and specify publication and value‑setting processes (endnotes). The Regulations therefore inherit the administrative processes and annual variation mechanisms of those Acts.

• Subordinate Legislation Act 1994. The endnotes state the Regulations will sunset 10 years after the day of making under the Subordinate Legislation Act 1994 (endnotes). That imposes a statutory expiry timetable unless renewed or remade.

• Standards and accreditation regimes. The Regulations incorporate or adopt whole Australian Standards (AS 4564 and AS 4670) by reference (reg 5 and reg 45). They also require testing methods to be accredited by NATA or approved by Energy Safe Victoria (reg 47(5)), bringing in the external accreditation regime into the compliance mix.

Practical legal interactions and administrative practice

• The Regulations create direct interdependencies between technical standards and administrative approvals. Compliance with AS 4564 and AS 4670 is the primary route for meeting s 33 duties (reg 45). However, exemption power (reg 50) allows deviation from those standards where a gas company satisfies Energy Safe Victoria that conveyance or supply will be safe, thereby making ESV the gatekeeper to authorised departures.

• Approval and accreditation channels matter. The ability to use instrumentation “of a class approved by Energy Safe Victoria” (reg 47(3)(b), 47(4)(b)) allows regulated entities to seek administrative approvals rather than strictly conform to the sampling frequency; that shifts part of the compliance pathway from purely technical standard conformance to an administrative approval process.

• Records and reporting obligations feed into the enforcement framework of the Act. The requirement to provide copies of reports to Energy Safe Victoria (reg 39(2)(e)) and the specified content and timing of incident reports under reg 44 give ESV direct access to data it needs to exercise its statutory powers under the Act.

• The Regulations rely on external standards that may be updated. AS 4564 and AS 4670 are applied "as published or amended from time to time" (reg 5 and reg 45), so a change in those standards could alter compliance requirements without an amendment to these Regulations, subject to the usual legal doctrine on applied standards and the particulars of how the standards are incorporated.

The text itself contains an internal amendment history and endnotes. Key points from the instrument:

• These Regulations revoke two prior instruments: the Gas Safety (Safety Case) Regulations 2008 and the Gas Safety (Gas Quality) Regulations 2017 (reg 4). That shows the 2018 Regulations were intended to consolidate and replace earlier subordinate instruments.

• The Table of Amendments in the endnotes states that there are no amendments made to the Gas Safety (Safety Case) Regulations 2018 by statutory rules, subordinate instruments and Acts as at the version date (endnotes, Table of Amendments). The endnotes also state there are no amendments "Not in Operation" at publication.

• The endnotes record that these Regulations were made on 25 September 2018 and came into operation on 22 October 2018; they will sunset 10 years after the day of making on 25 September 2028 under the Subordinate Legislation Act 1994 (endnotes).

• The instrument incorporates external standards by reference and includes a "Table of Applied, Adopted or Incorporated Matter" in the endnotes that identifies AS 4564,2011 and AS 4670:2018 in respect of the matters they govern. The explanatory details cross‑reference the statutory rule numbers of the revoked instruments (endnotes, explanatory details).

There are no recorded statutory amendments to this instrument in the available source. Any future changes to fee‑unit or penalty‑unit dollar values will occur under the Monetary Units Act 2004 and the Sentencing Act 1991 processes and be published separately (endnotes). The Regulations themselves do not record further amendment history beyond the initial revocation of prior rules and the applied standards table.

The statutory text and the endnotes do not record any judicial decisions, appeal outcomes or litigation history arising under these Regulations. The Table of Amendments and "Amendments Not in Operation" sections both list no entries, and there are no case names referenced in the body of the Regulations or the endnotes.

Practical implication for researchers and practitioners. As of the version date (22 October 2018) there is no litigation history recorded in this document to show how the provisions have been interpreted by courts or tribunals. That means:

• There is no judicial gloss in the source material on key interpretative issues such as the meaning of "as far as practicable" in reg 27(d), the scope of Energy Safe Victoria's opinion‑based discretions in reg 49, or the evidential sufficiency of the reporting fields in reg 44(4). Practitioners should expect that interpretation questions, if contested, would be resolved in proceedings interpreting the Act and these Regulations under general principles of statutory construction.

• For compliance decisions that rely on regulatory approval or exemption (reg 47, reg 49, reg 50) there is no precedent in this text to indicate how ESV will exercise its discretion in comparable factual scenarios; reliance on the recorded administrative criteria and internal ESV guidance (if any) will be important.

• Where disputes concern the conversion of fee units or penalty units into dollar amounts, the endnotes provide the statutory mechanism and the 2018 values as a reference point; any litigation would have to consider the operative monetary values at the relevant time as set under the Monetary Units Act 2004 and Sentencing Act 1991.

In short, the Regulations themselves contain no reported litigation for guidance. Practitioners must rely on the text, related provisions of the Act, and any administrative guidance or enforcement practice published by Energy Safe Victoria when advising clients or formulating compliance strategies.

The Regulations are prescriptive in many technical and administrative respects; several items frequently cause compliance slips or raise implementation choices that merit early attention.

1. Continuous or near‑continuous testing requirement for transmission pipelines (reg 47). The prescribed option is an instrument that determines the Wobbe Index and hydrogen sulphide content at least once every six minutes. This is an operationally demanding requirement: it implies real‑time monitoring, data collection, storage and analysis capabilities that not all pipeline operators will have immediately. The alternative is an instrument class approved by Energy Safe Victoria, but that requires an administrative application and approval process. The six‑minute frequency is a clear compliance yardstick that will be tested in audits.

2. NATA accreditation or Energy Safe Victoria approval for methods (reg 47(5)). Tests must be carried out in accordance with methods accredited by NATA or approved by Energy Safe Victoria. NATA accreditation is an external process that can be time‑consuming and costly; relying on Energy Safe Victoria approval instead places the operator at the regulator's discretion.

3. Formal safety assessment content and "as far as practicable" (reg 27). Non‑retail facilities must provide a formal safety assessment with a systematic risk assessment and measures to minimise risk "as far as practicable" (reg 27(2)(c)-(d)). The phrase "as far as practicable" is not defined in the Regulations; its application will depend on factual and technical evidence. That uncertainty may affect capital expenditure decisions and risk appetite.

4. Broad administrative discretion for fee waiver or rebate (reg 49). Energy Safe Victoria may waive or rebate the administration fee in whole or part "in the opinion of Energy Safe Victoria" where burden is less than usual. The opinion‑based test offers no strict entitlement; applicants should expect that ESV may consider safety performance and characteristics of the installation (reg 49(2)). There is no independent appeal right contained in the Regulations; appeal routes lie under the Act or general administrative law.

5. Exemptions and conditionality (reg 50). Exemptions are expressly permitted but must be applied for in writing and may carry conditions; non‑compliance with those conditions attracts a penalty (20 penalty units). Any reliance on an exemption requires strict compliance with conditions and retaining the exemption document in writing.

6. Multiple recordkeeping requirements plus a tangible penalty (reg 39). The Regulations set out an explicit list of records to be kept, a nominated location (the address nominated in the safety case), retrievability, security and a seven‑year retention period (reg 39(2)-(3)). The failure to maintain the records system is a penal offence (reg 39(1)), so companies must align operational record locations with the safety case and ensure access and retention.

7. Mapping of terminology for voluntary safety cases (regs 40-43). Divisions 4-6 of Part 2 are applied as if references to a facility were references to complex gas installations or Type B appliances and references to a gas company were references to the operator or manufacturer. Practitioners must ensure the correct mapping of obligations and the ABN/ACN, responsible persons and safety management systems in that context (regs 40-43).

8. Odour requirements with limited exemptions (reg 46). The odour standard requires gas to be both distinctive and unpleasant and discernible at one‑fifth of the lower explosive limit. Exemptions apply to LPG and LNG used for automotive purposes (reg 46(2)). Operators of non‑automotive fuel supply should ensure odourisation practices meet this exacting standard.

9. Specifying published technical standards (reg 31). Safety management systems must list the published technical standards applied in design, construction and operation. The Regulations name several standards bodies (reg 5). Failure to identify or then comply with nominated standards in operation could create audit findings.

10. Fee quantum and timing (reg 48). The administration fee for voluntary safety cases is payable on acceptance and on each anniversary. Where an operator assumes a voluntary safety case will be a one‑off fee, they may be caught by the ongoing annual requirement. The 1007 fee units figure is fixed in the Regulations, but the dollar equivalent changes with the fee unit value set annually by the Treasurer (endnotes).

11. Record address tied to safety case (reg 39(3)(a)). Records must be kept at the address or location nominated in the safety case. A change in physical record location without updating the safety case could create a compliance breach.

12. No express transitional guidance for changes in standards. The Regulations adopt AS 4564 and AS 4670 "as published or amended from time to time" (reg 5 and reg 45). A standards update could change obligations; the Regulations do not prescribe a transition mechanism. Practitioners should monitor published standards and ESV guidance.

These are concrete operational and administrative risks, each traceable to a particular regulation in the instrument. Early engagement with Energy Safe Victoria for approvals, instrument classes, and any exemptions or waivers reduces uncertainty.

Compliance requires aligning technical, organisational and administrative systems to the Regulations' prescriptive elements. Below is a practical, stepwise compliance checklist mapped to the specific regulations.

1. Identify applicability and scope

   • Confirm whether the facility is a gas retail facility or another type, as different Divisions apply (reg 7 and reg 22). If preparing a safety case under ss 52-54 (voluntary safety case), apply Divs 4-6 of Part 2 as mapped by regs 40-42.

2. Prepare the safety case document

   • Include ABN or ACN (regs 8, 23, 43).
   • Specify the person responsible for the facility and who authorised the safety case (regs 9 and 24): name, title and business address.
   • Specify the person responsible for preparing, submitting and updating the safety case with contact details (regs 10 and 25).
   • Draft a detailed facility description sufficient to permit assessment of scope and risks (regs 11 and 26).

3. For non‑retail facilities, prepare a formal safety assessment

   • Document the methodology, investigations, hazard identification, systematic risk assessment (likelihood and consequences) and measures to minimise risk "as far as practicable" (reg 27).
   • Ensure the formal safety assessment is consistent with the facility description (reg 27(2)).

4. Design and document the safety management system (SMS)

   • For retail facilities include organisational structure, responsibilities, safety of supply to customers, gas quality assurance, supply for installations, incident reporting, emergency preparedness, monitoring/auditing and competence/training (regs 12 and 14-21).
   • For other facilities specify published technical standards (reg 31) and demonstrate how design, construction, commissioning, operation, maintenance and modification meet safety, public protection, property damage minimisation, conveyance reliability and gas quality requirements (reg 32).
   • Specify a permit‑to‑work system if relevant, authorising positions and competency requirements (reg 33).
   • Include emergency response plans addressing reasonably foreseeable emergencies identified through assessment (reg 19(1) and reg 34(1)), and demonstrate how these ensure public safety and duty compliance (regs 19(2) and 34(2)).

5. Competence, training and resourcing

   • Within the SMS identify minimum qualifications and competence for roles (regs 21 and 38), and document training plans and assessment mechanisms.

6. Monitoring, auditing and review

   • Establish processes and KPIs for internal monitoring and auditing with mechanisms for regular identification and remediation of deficiencies (regs 20 and 36).
   • Prepare for external audits and ensure written audit reports are produced and retained (reg 39(2)(c)).

7. Incident reporting system

   • Implement procedures for quarterly statistical summaries and immediate reporting for high‑severity incidents (reg 44(1)-(2)).
   • Ensure incident reports capture required details: nature, location/time, cause, emergency service attendance, remedial actions and corrective/preventive actions (reg 44(4)).
   • Make arrangements to notify Energy Safe Victoria as required and to provide copies of reports to ESV (reg 39(2)(e)).

8. Gas quality testing and instrumentation (for transmission pipeline operators)

   • Acquire instrumentation capable of determining Wobbe Index and hydrogen sulphide content at least once every six minutes, or apply for Energy Safe Victoria approval for an alternative instrument class (reg 47(3)-(4)).
   • Ensure testing methods are NATA‑accredited or approved by Energy Safe Victoria (reg 47(5)).
   • Implement data collection, storage and analysis appropriate to continuous or near‑continuous sampling.

9. Adopt and record technical standards

   • Specify the published technical standards applied in design, construction, commissioning, operation, maintenance and decommissioning (reg 31).
   • Ensure any referenced standard is the current edition or document the edition being followed as used in the safety management system.

10. Records management

    • Establish the records system required by reg 39(1)-(3): keep the accepted safety case, revisions, audit reports, investigation reports and copies of reports given to Energy Safe Victoria.
    • Nominate a physical or electronic address/location in the safety case and ensure records are retrievable, secure and retained for seven years (reg 39(3)).
    • Implement version control and retention schedules aligned with the seven‑year requirement.

11. Fees and financial compliance (voluntary safety cases)

    • For voluntary safety cases under ss 52-54, pay the annual administration fee of 1007 fee units to Energy Safe Victoria on acceptance and on each anniversary (reg 48).
    • Consider applying for a waiver or rebate under reg 49 if administrative burden is less than usual; prepare supporting material on safety performance and characteristics of the installation where relevant (reg 49(2)).

12. Exemptions and approvals

    • If seeking an exemption from any requirement or from the prescribed quality standards, apply in writing and state reasons (reg 50(1)-(2)). Be prepared to propose conditions and demonstrate that conveyance, supply, sale or use will be safe (reg 50(1)(b)).
    • If relying on an Energy Safe Victoria approval for instrumentation classes or testing methods, engage early with ESV to understand application requirements and timelines (reg 47(3)(b), 47(4)(b), 47(5)).

13. Update and maintenance obligations

    • Appoint a named person or position responsible for preparing, submitting and updating the safety case (regs 10 and 25).
    • Keep the safety case and the nominated record location up to date; failure to maintain the record system is an offence (reg 39(1)).

14. Regulatory liaison

    • Develop a protocol for liaison with Energy Safe Victoria for approvals, waivers, exemptions, incident reporting and provision of investigation reports.
    • Track changes to AS 4564 and AS 4670 and any ESV guidance or interpretations that affect compliance.

15. Audit readiness

    • Maintain audit trails for testing data, incident investigation records, permit‑to‑work issuance and revocation, training records and safety case revisions.

Practical compliance tips

• Map each element of the safety case back to the relevant regulation and to the corresponding duty in the Act so that audit evidence ties to statutory obligations (regs 11, 12, 26, 27, 28).
• For transmission pipeline testing, treat the six‑minute frequency as the default planning assumption unless an alternative instrument class has been approved by Energy Safe Victoria (reg 47).
• Keep contemporaneous records of all interactions with Energy Safe Victoria, including approvals, waiver applications and exemption decisions; exemptions must be in writing and may include enforceable conditions (reg 50).
• Regularly review the nominated technical standards and document versioning in the safety management system (reg 31).

These steps, grounded in the specific regulatory provisions, create a defensible compliance posture and an auditable trail for meeting the obligations set out in the Gas Safety (Safety Case) Regulations 2018.
