Gas Safety (Gas Installation) Regulations 2018 (Victoria)

These Regulations set technical standards, procedural requirements and compliance mechanics for gas appliances, gas installations and gasfitting work in Victoria under the Gas Safety Act 1997 (the Act). Mechanically the instrument does the following.

Prescribes the technical standards to be applied to gasfitting work and gas installations by reference to specific Australian and New Zealand Standards (eg AS/NZS 5601.1, AS/NZS 5601.2, AS 3814, AS 4575 and AS/NZS 5263.1.3), and defines classes of premises and numeric thresholds that determine whether an installation is a "standard gas installation" (reg 12-14; reg 7). The Regulations adopt those standards "as published or amended from time to time" (reg 5 and table in Endnotes).
Establishes application requirements and fees for acceptance of appliances (reg 8 and Schedule 2) and for acceptance of gas installations (reg 26 and Schedules 7-9), together with ESV’s powers to require further tests and to inspect, remove parts and order non‑destructive testing (regs 9, 26(4), 27(1), 27(5)).
Sets equipment‑marking and compliance plate requirements where acceptance conditions require them (reg 10; reg 29; Schedules 4 and 12).
Creates procedural gates for higher‑risk work: hot‑tapping work and consumer piping with operating pressure above 200 kPa require prior authorisation from Energy Safe Victoria (ESV) and are to be carried out to standards determined in that authorisation (regs 22-23).
Imposes operational bans or constraints on specified appliances and locations (eg flueless space heaters: limited replacement rules and absolute location bans in healthcare, education and child services, reg 24; conversion prohibited, reg 25; open‑flued space heaters restricted to units meeting detailed fail‑safe, combustion and test‑room criteria, reg 25A).

INTERPRETATION OF LEGISLATION ACT 1984 (ILA)

Style changes

Section 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.

References to ILA s. 39B

Sidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided regulation, rule or clause of a Schedule is amended by the insertion of one or more subregulations, subrules or subclauses the original regulation, rule or clause becomes subregulation, subrule or subclause (1) and is amended by the insertion of the expression "(1)" at the beginning of the original regulation, rule or clause.

Interpretation

As from 1 January 2001, amendments to section 36 of the ILA have the following effects:

• Headings

All headings included in a Statutory Rule which is made on or after
1 January 2001 form part of that Statutory Rule. Any heading inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule.
This includes headings to Parts, Divisions or Subdivisions in a Schedule; Orders; Parts into which an Order is divided; clauses; regulations; rules; items; tables; columns; examples; diagrams; notes or forms.
See section 36(1A)(2A)(2B).

• Examples, diagrams or notes

All examples, diagrams or notes included in a Statutory Rule which is made on or after 1 January 2001 form part of that Statutory Rule. 1 January 2001. Provision numbers include regulation numbers, rule numbers, subregulation numbers, subrule numbers, paragraphs and subparagraphs. See section 36(3C).

• Location of "legislative items"

A "legislative item" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.

• Other material

Any explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule. See section 36(3)(3D)(3E).

The Regulations operate through a set of recurring legal concepts and threshold rules. Those concepts determine who does what, what technical standards apply, and when higher procedural gates or supervisory obligations are triggered.

Standard gas installation. The Regulations prescribe the classes of residential and commercial premises and numeric thresholds relevant to the Act’s definition of "standard gas installation" (reg 7). For residential premises the instrument lists caravans and mobile homes, Class 1a buildings under BCA Volume Two, Class 2 buildings up to five storeys, and occupied Class 2 premises above five storeys (reg 7(1)). For commercial premises the prescription is Class 5 and Class 6 buildings up to five storeys (reg 7(2)). Quantitative thresholds are 500 MJ/h gas consumption (reg 7(3)), metering/operating pressure caps (LP Gas second‑stage regulator max 70 kPa and subsequent regulator max 7 kPa; other cases max metering pressure 7 kPa) (reg 7(4)), and a cap of five gas supply points (reg 7(5)). Those definitions feed back into the Act’s distinction between standard and complex installations and into which standards and procedural requirements apply.
Prescribed technical standards. The Regulations prescribe by reference the specific Australian/New Zealand Standards that apply to gasfitting work, Type A and Type B appliances, and gas installations: AS/NZS 5601.1 and .2 for installations (reg 12(1); reg 14(1)); AS 3814 for Type B appliances (reg 13); AS 4575 for Type A appliance servicing work on appliances that are part of a standard gas installation (reg 12(4)). The instrument incorporates these standards "as published or amended from time to time" (reg 5 and explanatory table).
Type A versus Type B appliances. The Regulations follow the Act’s Type A/Type B distinction and prescribe different standards and processes. Type A servicing on standard gas installations must follow AS 4575 (reg 12(4)) and is subject to the new record requirements (regs 36-39; Sch 14). Type B appliances are governed by AS 3814 and attract additional acceptance information (Schedules 9) and potentially ESV conditional acceptance with required tests (reg 28).
Acceptance and commissioning. Acceptance of appliances (s 69 of the Act, implemented by reg 8 and Schedule 2) and of gas installations (s 73 of the Act, implemented by reg 26 and Schedules 7-9) is a formal process requiring prescribed information, fees and, where ESV requires, further testing (reg 9). Energy Safe Victoria may inspect, audit and require removal/submission of parts or non‑destructive testing (reg 27(1), reg 26(4)). Commissioning gas may be supplied for up to 21 business days or longer if authorised (reg 27(1)(c)-(4)).
Authorisation gates for higher‑risk activities. Hot‑tapping work and high‑pressure consumer piping (operating pressure > 200 kPa) require prior authorisation from ESV and the work must meet standards determined in that authorisation (regs 22-23). This inserts a discretionary authorisation step for work outside common operating envelopes.
Records, reporting and compliance plates. The instrument places specific record and reporting duties on gasfitters and owners (regs 20-21, 30-31, 36-39). Records for Type A servicing must include Schedule 14 matters and the gas appliance servicing checklist (AS 4575, Appendix E) and be supplied to the customer and to the VBA within five days (regs 36-37). Complex gas installation owners must retain service records for three years (reg 30(c)); licensed gasfitters must keep records for 10 years (reg 39(a)). Compliance plates for appliances and Type B appliances are regulated (regs 10 and 29; Schedules 4 and 12).
Enforcement architecture. Inspectors have explicit authority to disconnect or order disconnection of non‑compliant or dangerous installations (reg 32). Several offences carry monetary penalties expressed in penalty units (often 20 penalty units) and a discrete infringement scheme applies to specific record/reporting defaults with infringement penalties set out in Schedule 15 and implemented under regs 40-41.

These concepts interact: the standards prescribed (AS/NZS and AS documents) define technical obligations; the standard/complex classification and numeric thresholds determine which procedural and record obligations attach; ESV’s authorisation and testing powers create discretionary gates for higher risk work; and inspector powers plus the infringement table create an enforcement pathway.

The Regulations allocate obligations and procedural steps among several groups and public bodies. Identify who pays, who decides and who must change behaviour.

Energy Safe Victoria (ESV). ESV is the central decision‑maker for acceptance, authorisation, testing requirements and some technical determinations. ESV may require further tests for an appliance acceptance application (reg 9), authorise hot‑tapping and high‑pressure piping (regs 22-23), determine standards for those authorised works (regs 22(2), 23(2)), require provision of design documentation, material samples, joint removal and non‑destructive testing in relation to installation acceptance (reg 26(4)), issue or approve compliance plates (reg 10), and allow or refuse commissioning periods longer than 21 business days (reg 27(4)). ESV also has discretion to waive or rebate fees (reg 35).
Victorian Building Authority (VBA). The VBA is given a practical role in standardising record format and content for Type A appliance servicing records (regs 36-38). The VBA must publish matters and forms it specifies on its website (reg 38). Licensed and supervising gasfitters must provide parts of their records to the VBA in the manner and form it specifies within five days (regs 36(4), 37(4)).
Licensed gasfitters. The Regulations target licensed gasfitters with multiple duties: to report gas incidents during work, to make installations safe on discovery of defect and notify owner/occupier (regs 20-21); to create and supply records for Type A appliance servicing work within five days to both the customer and the VBA (regs 36-37); to keep copies of records for 10 years and supply to VBA if requested (reg 39).
Registered gasfitters and supervising gasfitters. The Regulations use and define "registered gasfitter" and "supervising gasfitter" (definitions in reg 5 inserted by S.R. 29/2022). Where work is carried out by a registered gasfitter, the supervising licensed gasfitter must create specified records and include supervising gasfitter identification and licence numbers (Sch 14 items 3 and 7).
Owners of complex gas installations. Owners must keep complex installations and any Type B appliance in a proper state of repair, hold records of service/maintenance/repair/modification for three years (reg 30), and report gas incidents occurring in relation to the complex installation without delay to ESV and the relevant gas distributor or LPG retailer (reg 31).
Gas distribution companies and LPG retailers. These entities are named as recipients of mandatory incident reports from persons carrying out gasfitting work and owners (regs 20(1), 20(2), 31). They also appear in the "exception" to the inspector disconnection power where supply of gas is by a gas company for commissioning with ESV approval (reg 33).
Applicants for acceptance (manufacturers, installers, owners). Parties seeking appliance acceptance or acceptance of installations must supply detailed technical information in the prescribed Schedules (Schedules 2, 7-9), pay prescribed fees (reg 8(2) 51 fee units for appliance application; reg 19 prescribes an 8.03 fee unit application fee for exemptions), and comply with ESV testing/inspection requests (regs 8-9; reg 26(4)).
Users and occupants at particular locations. The Regulations forbid installation or location for use of flueless space heaters in listed institutional premises (hospitals, registered community health centres, schools excluding some workshops, children's services) and restrict conversion of such heaters (reg 24(3)-(4); reg 25). Open‑flued gas space heaters may only be installed if they meet technical conditions (reg 25A).
Businesses that supply LPG. Suppliers must comply with prescribed odour and AS 4670 (reg 34(1)), affix a warning sign in the form of Schedule 13 (reg 34(2)) and supply only appliances accepted for LPG (reg 34(3)).

Who pays. The direct payors are applicants (acceptance fees) and gasfitters/owners who may face penalty unit fines or infringement penalties for non‑compliance. ESV may waive fees (reg 35).

Who decides. ESV exercises substantial administrative discretion: accepting appliances/installations, imposing testing conditions, authorising higher‑risk works, issuing compliance plates, allowing commissioning periods, and waiving fees. The VBA exercises delegated control over the content/form of servicing records and publishes guidance (regs 36-38).

Required behaviour change. Licensed/registered gasfitters must adopt prescribed record‑keeping, produce statements of compliance in specified forms (Schedules 10-11), report incidents promptly, and obtain authorisations where required. Owners of complex installations must formalise record retention, ensure servicing of Type B appliances and report incidents. Applicants must provide comprehensive technical documentation per the Schedules.

This section lists the principal positive and negative obligations, and the administrative rights allocated to regulators and regulated parties.

Duties imposed on gasfitters and installers

Report gas incidents. A person carrying out gasfitting work must report without delay any gas incident occurring during the work to ESV and to the supplying gas distribution company (natural gas) or LPG retailer (LPG) (reg 20(1)). If the work is on a Type B appliance and the person is aware the work is because of a prior gas incident, they must report that incident without delay (reg 20(2)). Penalty: 20 penalty units (see reg 20 footnote).
Make installations safe and notify. If a gasfitter becomes aware of a danger arising from a defect in the installation, they must take all necessary steps to make the installation safe and notify owner and occupier (reg 21(1)); if they cannot reasonably do so, they must notify ESV and the gas distributor or LPG retailer (reg 21(2)-(3)). Penalty: 20 penalty units.
Follow prescribed standards. All gasfitting work must comply with the prescribed standards specified in regs 12-14 (eg AS/NZS 5601.1 or .2, AS 3814, AS 4575 for Type A servicing), and additional prescribed requirements such as clearances from meters (reg 15) and protections when installing mixing devices (reg 17).
Prior authorisation for certain work. Gasfitters must apply to and obtain ESV authorisation prior to hot‑tapping work (reg 22(1)) and prior to carrying out work on consumer piping that will have operating pressure in excess of 200 kPa (reg 23(1)). The authorised standard is the standard determined by ESV in each authorisation (regs 22(2), 23(2)).
Records and notifications. Licensed gasfitters who carry out Type A appliance servicing work on appliances that are part of a standard gas installation must create a record including the items in Schedule 14 and a completed AS 4575 checklist, and must give a copy to the person for whom the work was carried out within five days (reg 36(2)-(3)). Where work is carried out by a registered gasfitter and supervised by a licensed gasfitter, the supervising gasfitter must create the record and provide it (reg 37). Those records must be supplied in a manner and form specified by the VBA (reg 36(4), 37(4)), and kept for 10 years by the creating gasfitter/supervising gasfitter (reg 39).
Acceptance application content and testing. Applicants for acceptance of appliances and installations must supply the detailed information in Schedules 2, 7-9 and must comply with ESV requests for further testing (reg 8; reg 26(1)-(4); reg 9). ESV may inspect, remove parts, demand samples and non‑destructive testing (reg 26(4); reg 27(1), (5)).
Keep complex installations in proper repair. Owners of complex gas installations must keep them safe and in a proper state of repair, keep Type B appliances safe and in proper repair, and keep service/maintenance/repair/modification records for three years (reg 30).

Rights and administrative discretions

ESV’s powers. ESV can accept appliances and installations subject to conditions, require further testing and determine standards for authorised work (regs 8-9; reg 26(4); regs 22-23). ESV may issue compliance plates or approve issuing bodies (reg 10). ESV can also waive or rebate fees in circumstances it considers appropriate (reg 35). ESV may disconnect or order disconnection via an inspector (reg 32(1)(c)-(d)).
Inspector’s operational power. Inspectors can disconnect an installation deemed non‑compliant or immediately dangerous, and can order any person to disconnect; it is an offence not to comply (reg 32(1)-(3)). Reconnection without ESV or inspector authorisation is an offence (reg 32(3)).
VBA’s publication and specification role. The VBA must publish on its website the additional matters it specifies for servicing records and the forms and manner in which records are to be given to the VBA (reg 38). The VBA specifies the form of the records and the additional matters to be included (regs 36(2)(d), 36(2)(b), 37(2)(d), 37(2)(b)).
Fee and infringement framework. The Regulations prescribe fees measured in fee units (eg reg 8(2) prescribes 51 fee units for appliance acceptance applications; reg 19 prescribes 8.03 fee units for exemption application) and penalties measured in penalty units. The explanatory Endnotes fix fee unit and penalty unit values for the 2025-26 financial year for conversion: a fee unit is $16.81 and a penalty unit is $203.51 for the financial year commencing 1 July 2025 (Endnotes). The VBA and ESV can impose infringement penalties (regs 40-41; Schedule 15).

Procedural mechanics , statements and plates

Statements of compliance. Statements required for acceptance and completion must be in the prescribed forms (Schedules 10 and 11) and signed by a person ESV considers suitably qualified (reg 26(5)-(6), reg 28(3)).
Compliance plates. If ESV requires compliance plates as part of acceptance conditions, the plate must be issued by ESV or an approved body and affixed in a readily accessible place; prescribed forms are Schedules 4 and 12 (reg 10; reg 29).

Timeframes and retention

Five‑day requirement for records to customer and VBA for Type A servicing (regs 36(3), 36(4), 37(3), 37(4)).
Ten‑year retention by the gasfitter of servicing records (reg 39(a)).
Three‑year retention by owners of complex installations for service/maintenance/repair/modification records (reg 30(c)).

These duties and rights create a layered compliance architecture: technical standards prescribe how installations must be built and serviced; ESV and the VBA fill in procedural and documentation details; gasfitters and owners bear the primary operational and record‑keeping obligations; inspectors and ESV exercise on‑the‑spot enforcement and administrative discretion.

The Regulations combine statutory penalties in penalty units, an infringement scheme for particular record/report defaults, and inspector powers. The instrument also makes clear which breaches attract criminal or monetary sanctions and how infringement notices are applied.

Penalty units and monetary values

The Regulations express penalties in penalty units. The Endnotes fix the value of a penalty unit for the financial year commencing 1 July 2025 at $203.51, to be rounded to the nearest dollar for penalties (Endnotes). Therefore common penalties expressed as 20 penalty units (the figure used in regs 20, 21, 30, 31, 32 and elsewhere) equate to approximately $4,070.20; the Endnotes instruct rounding to the nearest dollar, so the figure is to be treated as about $4,070 per 20 penalty units for 2025-26. The exact monetary amount will change as the Treasurer fixes future values.
Application fees are stated in fee units. The Endnotes set the fee unit for the 2025-26 financial year at $16.81. For example, reg 8(2) prescribes 51 fee units for an appliance acceptance application: 51 × $16.81 ≈ $857.31 (fees are to be rounded to the nearest 10 cents, per Endnotes). Reg 19 prescribes an 8.03 fee unit application fee for exemptions: 8.03 × $16.81 ≈ $134.98 (rounded per the fee unit rules).

Infringement penalties and the specific table

The Regulations introduce an infringement notice scheme for select record‑keeping offences by prescribing specified offences under Part 6A of the Act (reg 40) and fixing the associated infringement penalties under section 117AE of the Act (reg 41), with the prescribed list and monetary penalties in Schedule 15.
Schedule 15 sets infringement penalties (Column 3) opposite the prescribed offences (Column 2). Calculated using the penalty unit value noted above and rounding rules, the listed infringement penalties are modest relative to the 20 penalty unit criminal penalties. For instance:
- Regulation 36(3) (failure to give a copy of the record to the person for whom the work was carried out within five days) is an infringement of 2 penalty units (Schedule 15, item 1), approximately $407 for 2025-26 (2 × $203.51, rounded).
- Regulation 36(4) (failure to give VBA relevant parts of the record in manner/form specified) is 2 penalty units (Schedule 15, item 2), again approximately $407.
- Regulation 39 (failure to keep a copy of the record for 10 years or provide a copy to the VBA on request) is 1.5 penalty units (Schedule 15, item 5), approximately $305 (1.5 × $203.51).
The explanatory notes point out that penalties are to be multiplied by the penalty unit value and rounded to the nearest dollar; fee calculations have a separate rounding rule (to the nearest 10 cents) (Endnotes).

Inspector and ESV enforcement powers

Disconnection. An inspector may disconnect or order the disconnection of a gas installation or part where it does not comply with the Act/Regulations or is immediately dangerous or defective (reg 32(1)). It is an offence to disobey such an order (reg 32(2)). Reconnection after disconnection by an inspector or by order is prohibited unless authorised by ESV or an inspector (reg 32(3)). Penalty: 20 penalty units.
Acceptance and test enforcement. ESV can require further testing for appliance acceptance, and may impose conditions on acceptance, including third‑party testing by bodies approved by ESV. Where acceptance of a gas installation containing a Type B appliance is conditional on tests by an ESV‑approved person or body, the applicant must arrange the tests and notify ESV with a Schedule 11 statement of compliance from the testing person or body (reg 28).
Inspection and removal powers. For inspection and testing, ESV may remove any part of the gas installation from the premises to carry out tests (reg 27(5)), and may require samples, removal of pipe joints and non‑destructive testing before acceptance (reg 26(4)). ESV may also allow or refuse gas supply for commissioning and the period (reg 27(1)(c)-(4)).
Fee waivers. ESV may waive or rebate all or part of a fee where it considers appropriate (reg 35), a discretionary administrative power affecting compliance costs.

Criminal and civil enforcement pathways

The Regulations embed both criminal penalty routes (penalty units) and civil infringement routes (Schedule 15). The more serious immediate safety defaults (reporting, making installations safe, owner obligations, reconnecting after disconnection) attract 20 penalty units (criminal sanction), while specific record keeping defaults have infringement penalties attached (Schedule 15).
The instrument explicitly notes that infringement notices may be served for offences under regulations 36, 37 and 39 (notes to those regs).

Enforcement practicalities and operational levers

The practical levers for compliance are: ESV’s acceptance and authorisation power (which can delay or withhold necessary acceptance/commissioning), inspector disconnection powers (immediate cessation of gas supply), monetary penalties and the prospect of infringement notices, and the administrative cost of tests, samples and non‑destructive testing that ESV can order prior to acceptance.
Publication and supervisory measures (VBA’s publication of required forms and matters under reg 38) create a secondary compliance mechanism: failure to adopt the VBA’s specified forms may trigger record‑keeping breaches and associated penalties.

In sum, the Regulations pair technical prescription with an enforcement architecture that relies heavily on administrative discretion by ESV supported by inspectorial emergency powers and a mix of criminal and civil monetary sanctions calibrated according to the type of default.

The Regulations are embedded in a network of statutes, Codes and technical standards. The primary legal skeleton is the Gas Safety Act 1997, but the instrument cross‑references building laws, the Sale of Land Act, the Health Services Act, the Education and Training Reform Act, the Children’s Services Act, the Plumbing Regulations, the Monetary Units Act, the Sentencing Act and various Australian/New Zealand Standards. Key interactions are as follows.

Relation to the Gas Safety Act 1997

These Regulations are made under section 118 of the Gas Safety Act 1997 (reg 2) and operationalise multiple Act provisions referenced within regs (eg sections 69, 70, 72, 73, 79A, 117AC and 117AE cited throughout). They specify forms, fees and technical content for the Act’s acceptance, standards and enforcement provisions (eg reg 8 pursuant to s 69; regs 12-14 pursuant to s 72; reg 26 pursuant to s 73).

Building and plumbing law connections

Definitions and licensing. The Regulations rely on the Building Act 1993 to define "licensed gasfitter" (persons licensed under s 221M of the Building Act) and "registered gasfitter" (s 221O), and the supervising gasfitter concept (s 221OA(5)) (reg 5 inserted by S.R. 29/2022). The Regulations therefore sit alongside the Building Act and Plumbing Regulations 2018 for licensing and registration frameworks and require gasfitters to hold the relevant building/plumbing licences or registrations.
BCA/NCC. The "standard gas installation" definitions in reg 7 identify specific classes under the Building Code of Australia/National Construction Code volumes (BCA Volume One and Two), and the explanatory table in the Endnotes maps those references to clauses in the NCC 2016 (Endnotes table). The Regulations therefore align gas installation classifications with building classification regimes.

Public health, education and child services law

The Regulations forbid installation/location of flueless space heaters in hospitals, registered community health centres, day procedure centres, registered residential services, schools, TAFE institutions and universities (excluding workshops or assembly halls), and children's services as defined by the Health Services Act 1988, the Education and Training Reform Act 2006 and the Children’s Services Act 1996 (reg 24(3)). That creates a direct interaction with public health, education and child services regimes by referencing definitions from those Acts to delimit appliance bans.

Sale of land and land definition

Reg 16 references "allotment" with the meaning found in section 8A of the Sale of Land Act 1962 when regulating installation of consumer piping on land other than the allotment on which the gas installation sits. That imports property law concepts into the plumbing/regulatory rules.

Standards and incorporated technical instruments

The Regulations incorporate, by reference, a set of external Standards and the NCC. These adopted documents are listed and described in the Endnotes’ Table of Applied, Adopted or Incorporated Matter. The Regulations apply the standards as they are "published or amended from time to time" (reg 5 and Endnotes table), which means that changes to those external standards will flow into the regulatory duties unless the Regulations are amended. Notable incorporated standards are AS/NZS 5601.1, AS/NZS 5601.2, AS 3814, AS 4575, AS/NZS 5263.1.3 and AS 4670.
Test room accreditation. Regulation 5 defines "test room" and requires that a test room be located in a laboratory accredited by an ILAC signatory to test an open‑flued gas space heater to AS/NZS 5263.1.3. This links laboratory accreditation law/practice to the appliance acceptance regime.

Sentencing and monetary statute interactions

Penalties are expressed in penalty units under the Sentencing Act 1991 and fee and penalty unit values are determined by the Monetary Units Act 2004 (Endnotes). The Endnotes provide the 2025-26 financial year unit values and rounding rules, forming a monetary bridge between these Regulations and broader fiscal statutes.

Plumbing Regulations and licensing

The Regulations repeatedly reference the Plumbing Regulations 2018 (in definitions and the concept of gasfitting work), situating gasfitting work within the regime of regulated plumbing trades and licensing.

Administrative law implications

The Regulations confer discretion on ESV in multiple areas (eg acceptance conditions, authorisations, waiver of fees). Those decisions will be subject to administrative law principles and potential review avenues available under general administrative law and the governing Acts (though the Regulations themselves do not specify appeal mechanisms). The interface with administrative law is operational rather than textual in the instrument.

Operational cross‑compliance issues

Where a project crosses sectors (eg gas installations in high‑rise Class 2 buildings, or consumer piping crossing property boundaries), practitioners must navigate Building Act licensing, BCA/NCC building classifications, Sale of Land Act definitions for allotments, plumbing licensing (Plumbing Regulations 2018), and the technical standards adopted by these Regulations. The instrument therefore requires multi‑disciplinary compliance actions by designers, installers and owners.

Taken together, these cross‑references mean that compliance with the Regulations rarely stands alone; it typically requires parallel compliance with building codes, licensing rules, standards and other sectoral statutes. The adoption "as amended" of standards produces an ongoing pipeline of technical requirements external to the Regulations themselves.

The Regulations incorporate several subordinate‑instrument amendments; the Endnotes present the amendment table. The key amendment instruments and their mechanical effects recorded in the text are as follows.

Gas Safety (Gas Installation) Amendment (Type A Appliances) Regulations 2022, S.R. No. 29/2022 (made 17 May 2022, commenced 1 June 2022). Principal mechanical changes recorded in the Regulations and Endnotes:

The Endnotes contain a table of applied, adopted or incorporated matter for each amending statutory rule and confirm that standards are applied "as published or amended from time to time" (Endnotes). This means that regulatory content is partly anchored to evolving technical standards rather than solely to static legislative text.

In short, the major amendment waves added the Type A servicing record regime (S.R. 29/2022), tightened controls and testing/acceptance for open‑flued heaters and test rooms (S.R. 64/2022), and in S.R. 145/2025 introduced checklist requirements, longer retention and an infringement scheme for record defaults (regs 36-41, Sch 14-15). Each amendment expanded the record and administrative compliance apparatus and shifted more procedural duties to GASFITTERS, VBA and ESV.

The statutory instrument as provided contains no citation to any judicial decisions or litigation history. The Endnotes and the body of the Regulations do not identify any court cases, appeals or adjudicative precedents concerning these Regulations. Therefore, within the text supplied, there is no recorded litigation history to summarise.

Practical note for practitioners: because ESV and VBA decisions under these Regulations will involve administrative discretions (eg authorisations, testing conditions, waivers, acceptance conditions), potential judicial review or merits review pathways under relevant administrative law frameworks could arise in practice. The instrument itself does not set out appeal routes or case law; practitioners should review the Gas Safety Act 1997, statutory review mechanisms and any applicable procedural fairness or merits review provisions outside this instrument when advising clients about disputing ESV decisions.

This section flags traps and friction points where the Regulations’ text creates operational or compliance risk, or where behaviour commonly expected by practitioners might produce non‑compliance. Each point is tied to the relevant regulation or schedule.

Reliance on external standards that are applied "as amended". The Regulations adopt Standards "as published or amended from time to time" (reg 5 and Endnotes). That means technical obligations change when Standards are amended without Parliamentary amendment of these Regulations. Practitioners must monitor amending Standards (eg AS/NZS 5601.1, AS 4575, AS 3814, AS/NZS 5263.1.3) to ensure continued compliance.
Discretion and authorisation gates (regs 22-23, reg 26(4)). Hot‑tapping and consumer piping above 200 kPa require ESV authorisation and standards determined by ESV in each authorisation (regs 22(1)-(2); 23(1)-(2)), and ESV can demand design documents, material samples, removal of joints and non‑destructive testing prior to acceptance (reg 26(4)). This centralised discretion creates potential for delay, cost increases, and unpredictable testing requirements for applicants unless applicants engage with ESV early.
Stringent technical conditions for open‑flued heaters and strict test requirements (reg 25A). Open‑flued heaters may only be installed if they have fan‑assisted combustion, a fail‑safe interlock with specified shut‑down timing and manual reset requirement, specified carbon monoxide/carbon dioxide ratios and a test‑room ppm limit (reg 25A(2)(a)-(e)). The test‑room must be ILAC‑accredited (definition of "test room" in reg 5). Practitioners must coordinate accredited laboratory testing and design to meet both the interlock and emissions conditions.
Flueless space heater replacement limits (reg 24). Replacement is allowed only where both old and new heaters operate on LP Gas and the new heater meets specified NOx and CO/CO2 ratio limits (reg 24(2)(a)-(d)). Additionally, flueless heaters are banned in a list of institutional premises (reg 24(3)). Misreading "replacement" for "new installation" could lead to non‑compliance.
Short timeframes for record delivery and retention obligations (regs 36-39). Licensed gasfitters must give the customer a copy of the Type A servicing record within five days and must give the VBA specified parts within five days (reg 36(3)-(4); reg 37(3)-(4)). Records must be kept by the creating gasfitter for 10 years (reg 39) and by owners of complex installations for three years (reg 30(c)). Non‑compliance attracts penalty units or infringement notices (reg 39 penalty 10 units; Schedule 15 infringement amounts). Practitioners need systematised record workflows to meet short times and retention lengths.
Two separate retention regimes and differing duties across licensed and registered gasfitters. The record creation and supply duties differ depending on whether work is done by a licensed or registered gasfitter and whether a supervising licensed gasfitter exists; Schedule 14 includes supervising gasfitter identification requirements. Failure to identify the supervising gasfitter or to have the supervising gasfitter produce the record would be an offence.
Multiple reporting addressees and immediate reporting obligations (regs 20, 31). Gas incident reporting must be made without delay to ESV and to the supplying gas distribution company or LPG retailer depending on gas type (reg 20(1); reg 31). "Without delay" is immediate and not time‑limited to a later reporting window; a late report attracts penalty units. Practitioners should have incident reporting templates and contact lists.
Commissioning gas length and reconnection risk (reg 27; reg 32). ESV can allow commissioning gas for up to 21 business days (reg 27(1)(c)), and only ESV or an inspector may authorise reconnection after disconnection (reg 32(3)). Reconnecting a disconnected installation without authorisation is an offence (20 penalty units). Projects that assume reconnection can be made by the installer risk criminal exposure.
The compliance plate must be issued by ESV or an approved body (reg 10(a), reg 29(a)). Practitioners who source plates independently risk non‑compliance if the plate is not an ESV‑issued or approved plate or in the prescribed form (Schedules 4 and 12).
Divergent retention and disclosure obligations between owners and gasfitters (regs 30 and 39). Owners of complex installations have a three‑year retention obligation for service records; gasfitters must retain servicing records for 10 years and produce them to VBA on request within five days (reg 39). This can create mismatches in expectations and evidence if an owner requests records the installer no longer holds for the owner’s three‑year requirement.
Monetary calculation nuances. Fees and penalties are expressed in fee units and penalty units with separate rounding rules (Endnotes). Practitioners should convert fees and penalties using the current Monetary Units Act (fee unit) and Sentencing Act (penalty unit) values published annually.
Precise Schedule detail for Type B appliances (Schedule 9). Acceptance for Type B appliances requires highly technical materials (purge time calculations, combustion chamber volume, safe start gas rate, explosion relief calculations and process instrumentation diagrams). Submitting insufficient or incorrect computational material will allow ESV to require further tests (reg 9) and delay acceptance (reg 26(4), reg 28).
Overlap with other regulatory regimes. Because the Regulations cross‑reference BCA/NCC building classes, the Building Act licensing regime and the Plumbing Regulations 2018, projects must ensure compliance across multiple statutory instruments. For example, a high‑rise residential Class 2 building may be standard or complex depending on occupation status and storeys (reg 7(1)(c)-(d)).

In practice these "gotchas" translate into predictable implementation risks: delay and costs from ESV authorisation or testing demands; administrative burden to meet five‑day and ten‑year retention obligations; technical testing and accredited lab coordination for open‑flued heaters; and potential monetary exposure via penalty units or infringement notices for record/report defaults.

This section provides practical, source‑grounded steps for compliance mapped to the Regulations’ main obligations. It focuses on immediate actions for practitioners, gasfitters, applicants and owners who must operate under these Regulations.

Classify the installation and appliance at the project outset

Determine whether the premises and installation qualify as a "standard gas installation" using reg 7: check the building class under the NCC/BCA Volume One/Two references (reg 7(1)-(2)), whether the gas rate exceeds 500 MJ/h (reg 7(3)), number of supply points exceeds five (reg 7(5)), and whether pressure thresholds are exceeded (reg 7(4)). This classification drives which standards and record obligations apply (eg Type A servicing rules for appliances in standard gas installations).
If the installation is near the thresholds (eg operating pressure close to 200 kPa or building storeys near the 5/10 storey cut‑offs), document the basis for classification; minor misclassification can change duties substantially.

Apply the prescribed technical standards at design and installation stages

Use the specified Standards as the starting point: AS/NZS 5601.1 or 5601.2 for installations (regs 12(1), 14(1)); AS 3814 for Type B appliances (reg 13); AS 4575 for Type A appliance servicing on standard installations (reg 12(4)). Because the standards are applied "as amended", ensure you have the current versions and monitor standards updates.
For LP Gas supply, ensure compliance with AS 4670 and the odour and warning sign requirements (reg 34(1)-(2); Sch 13).

Prepare acceptance applications with full Schedules and calculations

For appliance acceptance under s 69, use reg 8 and Schedule 2: provide all specified appliance, component and valve train diagrams, test results from ESV‑accepted testing agencies, and the appliance electrical circuit diagram (reg 8; Sch 2).
For installation acceptance under s 73, complete Schedule 7 and, where applicable (gas rate > 3.8 GJ/h, operating pressure > 200 kPa or building > 10 storeys), include Schedule 8 (reg 26(1)-(2)). If the installation contains Type B appliances add Schedule 9 material (reg 26(3), Sch 9) with purge time calculations, safe start rates, explosion relief area calculations and process/instrumentation diagrams as required by AS 3814.
Anticipate ESV requests under reg 26(4) (design/analysis, samples, removed joints, non‑destructive testing) and have procurement plans and test laboratories lined up. Note reg 9 allows ESV to require further tests if not satisfied with initial results.

For high‑risk activities, obtain ESV authorisation before starting

Apply for ESV authorisation before carrying out hot‑tapping work (reg 22(1)(a)) and before carrying out gasfitting work in relation to consumer piping to be operated above 200 kPa (reg 23(1)(a)). Do not commence such work until ESV authorises it (regs 22(1)(b), 23(1)(b)). Prepare to meet standards determined by ESV in each authorisation (regs 22(2), 23(2)).

Institute incident reporting and safety procedures

Implement an incident reporting protocol that ensures any gas incident discovered during work is reported "without delay" to ESV and the supply company (natural gas) or LPG retailer (reg 20). For Type B appliances, report prior incidents that prompted the work (reg 20(2)).
Develop a defect discovery procedure requiring immediate steps to make installations safe when a danger is identified, notification to owner/occupier (reg 21(1)), and immediate ESV and supply company notification if making safe is impossible or unreasonable (reg 21(3)).

For Type A appliance servicing on standard gas installations, adopt the record framework

Create a template record that includes all Schedule 14 matters (Sch 14 items 1-8) plus any additional matters the VBA specifies (reg 36(2)(b), 37(2)(b)), and use the form specified by the VBA (reg 36(2)(d), 37(2)(d)).
Include a completed copy of the gas appliance servicing checklist (AS 4575 Appendix E) with every servicing record (regs 36(2)(e), 37(2)(e)).
Deliver a copy of the record to the customer within five days of the work (reg 36(3), 37(3)).
Deliver the relevant parts of the record to the VBA in the manner and form it specifies within five days (reg 36(4), 37(4)).
Keep records yourself for 10 years and respond to VBA requests for records within five days (reg 39). Note the penalties for non‑compliance and the infringement penalties for specific defaults (Schedule 15).

Ensure compliance plate and acceptance labelling requirements are followed

If ESV requires a compliance plate as a condition of acceptance, ensure the plate is issued by ESV or a body approved by ESV and affixed in a readily accessible location (reg 10). For Type B appliances, use the ESV compliance plate format in Schedule 12 when required (reg 29).

Follow commissioning and reconnection discipline

If commissioning gas is needed, be aware ESV can allow up to 21 business days by default (reg 27(1)(c)) and may allow longer only upon application and ESV’s agreement (reg 27(2)-(4)).
Do not reconnect an installation that has been disconnected by an inspector or on an inspector’s order unless ESV or an inspector has authorised reconnection (reg 32(3)).

For flueless and open‑flued space heaters, check the specific technical and locational prohibitions

Replacement of flueless space heaters is narrow: only where both old and new appliances use LP Gas and the new heater meets NOx and CO/CO2 ratio limits (reg 24(2)). The installation or location of flueless heaters is barred in specified institutional premises (reg 24(3)).
Open‑flued gas space heaters are permitted only if they meet the fan‑assisted combustion, fail‑safe interlock, emissions and test room ppm limits in reg 25A. Coordinate accredited test facility work and ensure the appliance meets AS/NZS 5263.1.3 thermal efficiency requirements (reg 25A(2)-(3); reg 5 definition of "test room").

Recordkeeping and owner obligations for complex installations

Owners must keep complex installations in a proper state of repair and retain records of service, maintenance, repair and modification of both the installation and Type B appliances for three years (reg 30). Implement straightforward service contract forms that capture the required data and ensure retention.

Plan for fees, potential waivers and infringement exposures

Budget for application fees: reg 8(2) prescribes 51 fee units for appliance acceptance applications and reg 19 prescribes 8.03 fee units for exemption applications. Convert fee units using the current Monetary Units Act value (Endnotes provide $16.81 for FY 2025-26) and be aware ESV may rebate or waive fees in appropriate circumstances (reg 35).
Integrate compliance checks to avoid infringement notices under Schedule 15, particularly the 2 penalty unit infringement for failure to supply specified records to customers and VBA (Schedule 15 items 1-4).

Keep audit trails for sampling, tests and ESV interactions

When ESV requests samples, removed joints or non‑destructive testing (reg 26(4)), maintain chain‑of‑custody, testing lab accreditation and documented test results. Maintain communication logs with ESV, and when ESV approves, retain the written authorisation for hot‑tapping/high‑pressure works.

Coordinate across building, plumbing and gas safety frameworks

Check licences and registrations under the Building Act 1993 and Plumbing Regulations 2018 for the personnel performing the work (reg 5 definitions). Confirm that designs meet NCC/BCA requirements where building class issues affect the "standard/complex" classification (reg 7).

Use the VBA published materials and align record formats

Check the VBA website for the specific matters and forms it has published pursuant to reg 38 and use those forms to avoid technical defaults in record form/content (reg 38).

Regular compliance review and staff training

Given the short notification/retention timeframes and the potential for technical standards to change, implement periodic compliance audits, staff training for incident reporting and a documented escalation path for ESV authorisations and testing requests.

Following these steps will align operational practices with the Regulations’ prescriptions (refer to the specific regulations and Schedules cited throughout). Practitioners should also schedule periodic reviews of the referenced Standards and the Monetary Units and Sentencing Acts to ensure fee and penalty calculations remain current.
