Gas Pipelines Access (Western Australia) Act 1998

Institutional duality. The Act separates review (the Board) from arbitration (the arbitrator) and spells out different constitutions, functions and procedures for each (s 49-56; s 62-76). The Board is constituted for particular proceedings with a legal presiding member plus two experts (s 51). The arbitrator is a statutory officeholder appointed by the Governor, with specific appointment mechanics and an independent office structure (s 62-65, s 63).

Panels and appointment constraints. The Act relies on panels to source members. Legal panel members must be legal practitioners of at least seven years’ standing, and expert panel members must have relevant expertise in industry, commerce or accounting (s 52(1)). Public sector employees (as defined in the Public Sector Management Act 1994) and officers or employees of certain public bodies are excluded from panel membership (s 52(2)). Panel appointments are made by the Governor and notified in the Gazette, with terms capped at five years (s 52(3)-(5)).

Fresh hearing as default. The Board conducts fresh hearings; it may receive oral testimony or affidavits and is explicitly not bound by the rules of evidence (s 57(1)-(2)). The Board must act according to equity and the substantial merits, and the presiding member determines questions of law or procedure while other questions are decided by the members (s 57(2)-(3)).

Summons and document powers. The Board may summon witnesses, compel production of documents, inspect and retain documents and require oaths and answers (s 58(1)). Failures to attend, produce documents, to take an oath or to answer are criminalised with monetary penalties (s 58(2)); the same penalty regime applies to conflict‑of‑interest disclosure failures by persons chosen to act as Board members (s 53).

Procedural rights and deliverables. Parties have the right to appear personally or through counsel, to call and cross‑examine witnesses and to make submissions; the Board must provide reasonable notice and at the end of proceedings must give written reasons (s 59). The Board may make determinations in the absence of a party if reasonable opportunity was given (s 59(5)-(6)).

Arbitrator jurisdiction and limits. The arbitrator’s functions are those conferred under named statutes and regulations (s 73-74). Regulations may prescribe additional dispute classes and can make the arbitrator’s jurisdiction exclusive of courts and other tribunals (s 74(1)-(2)). The Commercial Arbitration Act 2012 is explicitly inapplicable to the arbitrator’s processes (s 77).

Independence and ministerial direction. The arbitrator is independent of direction except for written directions from the Minister limited to general administrative policies, including financial administration; such directions cannot constrain the arbitrator’s adjudicative functions and must be published and tabled (s 75). This creates a clear administrative/operational space in which ministerial oversight is permitted but adjudicative autonomy is protected.

Conflict of interest regimes. Both the Board and the arbitrator operate under statutory conflict‑of‑interest obligations. Board members chosen to act must disclose conflicts and must not participate without party consent (s 53). The arbitrator must inform the Minister of any direct or indirect interest that conflicts or may conflict with duties; failing to do so attracts a $10,000 penalty and the Minister may direct resolution or disqualify the arbitrator for a particular matter (s 79).

Financial and administrative framework. The arbitrator has a dedicated bank account to receive appropriations and fees and to meet expenditure including remuneration (s 82). The arbitrator may borrow from the Treasurer with approval (s 83) and is subject to Financial Management Act 2006 and Auditor General Act 2006 provisions (s 84), though performance indicators are limited to management functions. Administrative support for the Board is to be provided by the arbitrator (s 56).

Immunity and liability reallocation. Members of the Board and persons acting under s 56 enjoy immunity from civil liability for good faith acts and omissions (s 60). Similarly, the arbitrator, acting persons and delegates enjoy immunity and where a liability would lie against an individual, it instead lies against the Crown (s 85).

Regulatory completeness. The Governor is empowered to make regulations to fill in matters required or permitted by the Act or necessary for its purposes (s 86). Regulations can extend the arbitrator’s dispute classes, prescribe procedural elements, and set fees and methods of calculating fees where necessary (s 74(1), (3)-(4)).

Cross‑statutory references. The Act integrates with other energy and public sector statutes by importing functions and by being treated as a tribunal under the Public Sector Management Act 1994 (s 50(2); s 64), by requiring decisions to be copied to the Economic Regulation Authority (s 76), and by making the arbitrator’s functions dependent on and complementary to provisions in the National Gas Access (WA) Act 2009, Electricity Industry Act 2004, Gas Services Information Act 2012 and Gas Supply (Gas Quality Specifications) Act 2009 (s 50(2A); s 73(1)).

The Act allocates rights, duties and exposure across a defined set of public officeholders, private parties and public agencies. The primary affected groups are:

• Parties to energy disputes that fall within the statutory jurisdiction of the Board or the arbitrator. The Act gives the Board functions under the Electricity Industry Act 2004 and allows the arbitrator to perform functions conferred under the National Gas Access (WA) Act 2009, Electricity Industry Act 2004, Gas Supply (Gas Quality Specifications) Act 2009 and regulations (s 50(2A); s 73(1)). Regulations may extend the arbitrator’s jurisdiction to disputes connected with distribution, transportation or supply of gas or access to gas pipeline systems (s 74(1)).

• Legal practitioners and experts who serve on the panels. Legal panel members must be legal practitioners of at least seven years’ standing and expert panel members must have industry, commerce or accounting expertise (s 52(1)). Panel members are appointed by the Governor, serve up to five years, are eligible for reappointment and may continue to sit to finish part‑heard matters if their term expires (s 52(3)-(6)).

• The Attorney General, who selects the presiding legal practitioner from the legal panel for particular Board proceedings (s 51(1)(a)). The presiding member also selects the two expert members from the expert panel (s 51(1)(b)).

• The Public Sector Commissioner and the Coordinator of Energy, who are central to the arbitrator appointment process; the Commissioner must advertise vacancies and form a selection panel chaired by the Coordinator of Energy (s 63(1)-(6), (11)).

• The Minister and Governor, who have constitutional and administrative roles: the Minister initiates Commissioner action on vacancies, can accept or reject Commissioner nominations and can recommend alternate nominees to the Governor; the Governor makes appointments to panels and to the arbitrator, and may suspend or remove panel members or the arbitrator in specified circumstances (s 52(3); s 63; s 67-69; s 54).

• State agencies and public service officers whose services may be used by the arbitrator. The arbitrator may make arrangements to use public sector staff and facilities, but cannot use officers or employees of an electricity corporation for that purpose (s 80(1)-(4), (5)).

• The Economic Regulation Authority, which must receive copies of draft and final arbitration decisions where the arbitrator is required to give them to parties (s 76).

• Electricity corporations and the Crown. The Act binds the Crown (s 5) and reallocates liability in certain circumstances so that liabilities that would otherwise lie against officials lie against the Crown (s 85(2)). Electricity corporations are excluded from providing staff under the arbitrator’s s 80 arrangements (s 80(1)-(2)).

• Persons who might be subject to Board summonses or document production orders. The Board has powers to summon attendance and require production and can retain and copy documents (s 58).

• Users of dispute resolution processes who must adapt to procedures that are non‑technical and oriented to substantial merits rather than formal evidence rules: the Board is not bound by rules of evidence and conducts fresh hearings (s 57).

• Insurers and employers of panel members and arbitrator staff, because the Act creates statutory immunities for good faith acts (s 60; s 85) and shifts residual liability to the Crown in specified instances (s 85(2)).

• Parties facing costs exposure: the arbitrator’s account can be credited with fees and charges payable in connection with performance of the arbitrator’s or the Board’s functions, and regulations may prescribe fees or methods for calculating them, including cost‑based calculation (s 82(3)(a)(ii); s 74(3)-(4)).

• Any person chosen to act as a Board member or the arbitrator, who must disclose conflicts of interest. Board appointees who fail to disclose have monetary penalty exposure (s 53). The arbitrator must inform the Minister of direct or indirect interests and faces a $10,000 penalty for non‑disclosure; the Minister may direct resolution or disqualify the arbitrator for a particular matter (s 79).

• Courts and other tribunals, whose jurisdiction may be excluded by regulation in respect of classes of disputes delegated to the arbitrator (s 74(2)(b)).

Overall, the Act primarily affects energy sector participants in gas and electricity (developers, network operators, suppliers, shippers and large consumers subject to regulated arrangements), the legal and expert talent pool for panels, specified public officials involved in appointment and oversight, and public bodies that interact operationally with the arbitrator or Board. The Act also affects parties’ litigation strategies because it creates statutory processes that can, by regulation, be exclusive of courts (s 74(2)(b)) and because the arbitrator’s processes fall outside the Commercial Arbitration Act 2012 (s 77).

Duties

• Conflict disclosure by persons chosen to act as Board members. Any person chosen to act who has a conflict of interest must disclose the nature of the conflict to each party concerned (s 53(1)). They must not take part in proceedings or exercise any powers in relation to the matter unless each party consents (s 53(2)). The Act defines conflict broadly to include any direct or indirect interest, pecuniary or otherwise, that conflicts or could conflict with proper performance of functions (s 53(3)). Non‑compliance attracts a $10,000 penalty (s 53(1)-(2)).

• Conflict disclosure by the arbitrator. The arbitrator must inform the Minister in writing of any direct or indirect interest in business or any other interest that conflicts or may conflict with duties (s 79(1)). Failure carries a $10,000 penalty (s 79(1)). The Minister may direct the arbitrator to resolve the conflict in relation to a particular matter, and may disqualify the arbitrator from acting in relation to the matter if the conflict is not resolved to the Minister’s satisfaction (s 79(2)).

• Provision of administrative support. The arbitrator is obliged to provide the Board with the services of officers, facilities and support reasonably required by the Board (s 56(1)). That includes the services of persons suitably qualified to advise the Board (s 56(2)).

• Oath and impartiality for the arbitrator. Before performing functions, the arbitrator must take an oath or affirmation to perform functions faithfully and impartially, administered by a Judge (s 70).

• Attendance and production obligations before the Board. Persons served with a Board summons must attend or produce documents, answer questions and submit to oaths or affirmations unless they have a reasonable excuse (s 58(1) and (2)). Non‑compliance or refusal is an offence with a $10,000 penalty (s 58(2)).

• Administrative duties for the arbitrator regarding finances and reporting. The arbitrator must operate an approved bank account into which appropriations and fees are credited and from which expenditure is charged (s 82). The Financial Management Act 2006 and Auditor General Act 2006 apply to the arbitrator’s financial administration and auditing, subject to the limitation on performance indicators (s 84).

• Publication and tabling of ministerial directions to the arbitrator. If the Minister gives a written direction about general administrative policy, the arbitrator must publish the text in the Gazette within 14 days and provide copies on request; the direction must be tabled in both Houses of Parliament within 14 sitting days and included in the arbitrator’s annual report (s 75(4)-(5)).

Rights

• Right to a fresh hearing. Parties to proceedings before the Board have the right to a fresh hearing and to have evidence received either orally or by affidavit at the Board’s discretion (s 57(1)).

• Procedural rights in Board hearings. Parties are entitled to reasonable notice of proceedings, to appear personally or by counsel, to call and give evidence, to examine and cross‑examine witnesses and to make submissions (s 59(2)-(4)). Parties are entitled to written reasons for determinations at the conclusion of proceedings (s 59(6)).

• Right for a person chosen to act as a member of the Board to obtain party consent to participate notwithstanding a conflict, subject to the Act’s disclosure and consent requirements (s 53(2)).

• Right of the arbitrator to delegate non‑adjudicative functions. The arbitrator may delegate functions to competent persons, but not the hearing and determination of disputes or any aspect of that hearing or determination (s 78(1)-(2)).

• Right to independent adjudication. The arbitrator is independent of direction or control by the Crown or ministers in the performance of adjudicative functions (s 75(1)), subject only to limited written directions on general administrative policy (s 75(2)-(3)).

• Right to administrative support. The Board has the right to require the arbitrator to provide officers and facilities reasonably required to perform its functions (s 56).

• Right to expertise. The Board may refer matters to experts for report and accept those reports in evidence (s 59(1)(c)).

• Right to immunities for good faith acts. Members of the Board, persons acting under s 56 and the arbitrator and delegates enjoy immunity for acts or omissions done in good faith in performing official functions; where a liability would have lain against a person, it instead lies against the Crown for the arbitrator context (s 60; s 85).

• Right to have arbitrator decisions copied to the Economic Regulation Authority. Where the arbitrator gives a copy of a draft or final decision to parties the arbitrator must also give a copy to the Economic Regulation Authority (s 76).

Rights and duties are tightly interlinked by the Act’s procedural architecture: disclosure duties and criminal penalty exposure (s 53, s 58, s 79) sit alongside rights to fresh hearings, counsel, written reasons and administrative independence (s 57, s 59, s 70, s 75). The Act also creates administrative duties on government actors who participate in appointments and oversight (s 63; s 67-69).

Monetary penalties and offences

• Penalties for Board member conflict failures. A person chosen to act as a member of the Board who fails to disclose a conflict of interest must report the nature of the conflict and faces a $10,000 penalty for non‑disclosure (s 53(1)). Similarly, participating in proceedings while conflicted without the consent of each party attracts a $10,000 penalty (s 53(2)).

• Penalties for failing to obey Board summonses and related conduct. Section 58(2) creates offences and a $10,000 penalty for: failing without reasonable excuse to attend in obedience to a summons (s 58(2)(a)); failing without reasonable excuse to comply with a summons to produce books, papers or documents (s 58(2)(b)); misbehaving before the Board, wilfully insulting the Board or a member, or interrupting proceedings (s 58(2)(c)); and refusing to be sworn or to answer relevant questions when required (s 58(2)(d)).

• Penalties for arbitrator conflict non‑disclosure. The arbitrator must inform the Minister in writing of any direct or indirect interests that conflict or may conflict with duties; failure to do so carries a $10,000 penalty (s 79(1)).

Enforcement mechanisms

• Executive enforcement through Governor and Minister. Removal, suspension and disqualification are available enforcement levers. The Governor may suspend the arbitrator if satisfied on grounds of incapacity, incompetence, neglect or misbehaviour (s 67). Removal requires that a statement of grounds of suspension be laid before each House of Parliament and an address be passed praying for removal; failure to restore after suspension results in vacancy (s 68). For panel members, the Governor may remove a person for incapacity, incompetence, neglect, misconduct, failure to comply with s 53 or becoming insolvent under administration, among other grounds (s 54).

• Ministerial powers concerning conflicts. The Minister may direct the arbitrator to resolve a conflict in relation to a particular matter and may disqualify the arbitrator from acting in that matter if the conflict is not resolved (s 79(2)). For Board members chosen to act, participation in proceedings while conflicted is prevented unless each party consents and non‑compliance attracts a penalty (s 53(2)).

• Board procedural enforcement. The Board can issue summonses and compel production and attendance (s 58(1)). It may retain material and make copies, enabling documentary control within proceedings (s 58(1)(c)). The Board may also proceed in the absence of a party if satisfied reasonable opportunity was provided (s 59(5)), which is an enforcement mechanism against non‑participating parties.

• Criminal enforcement. The specified penalties of $10,000 for offences under s 53, s 58 and s 79 create criminal or regulatory exposure enforceable under the Act’s enforcement regime. The Act does not elaborate alternative enforcement (for example, injunctive remedies or civil recovery) in those provisions; the specified penalties are the statutory teeth for those duties.

Liability immunities and Crown assumption

• Immunity for Board and supporting personnel. No civil liability attaches to a member of the Board or a person acting under s 56 for an act or omission in good faith in the performance of official functions (s 60). This immunises individuals from civil suits for good faith acts.

• Immunity and Crown substitution for the arbitrator. No personal liability attaches to the arbitrator, acting persons, delegates or persons acting under the arbitrator’s authority for good faith acts and omissions (s 85(1)). Subsection 85(2) states that a liability that would otherwise lie against a person lies instead against the Crown. This both limits individual exposure and exposes the Crown as the residual respondent.

Administrative transparency and accountability mechanisms

• Publication and Parliamentary tabling of ministerial directions. Ministerial directions to the arbitrator about administration or finances must be published in the Gazette within 14 days and tabled in both Houses of Parliament within 14 sitting days; the direction must also be included in the arbitrator’s annual report (s 75(4)-(5)). This creates a transparency mechanism and a parliamentary accountability path.

• Financial and audit oversight. The arbitrator’s operations are subject to the Financial Management Act 2006 and the Auditor General Act 2006 for financial administration, audit and reporting (s 84(1)). The Treasurer’s instructions apply except insofar as they require performance indicators that extend beyond management functions (s 84(2)).

Jurisdictional exclusivity

• Regulations may make the arbitrator’s function exclusive of courts and other tribunals. Where regulations are made under s 74(2)(b), the arbitrator’s hearing and determining of prescribed disputes can be the exclusive avenue, effectively restricting court access for those specified disputes. The Act does not itself make such disputes exclusive; it vests the power to do so in regulations.

Practical enforcement landscape

• Enforcement is a mix of administrative (suspension, removal), procedural (summonses, document retention, ex parte determinations), regulatory fines for specified failures, and public accountability for ministerial directions and financial management. Immunities and the Crown substitution of liability limit direct civil exposure for officeholders but shift residual liability onto the Crown.

The Act is explicitly designed to sit within a network of energy and public sector statutes. The principal cross‑statutory interactions set out in the Act are:

Public Sector Management Act 1994. Both the Board and the arbitrator are to be taken to be tribunals within item 4 of Schedule 1 to the Public Sector Management Act 1994 (s 50(2); s 64(1)). In addition, specific provisions of the Public Sector Management Act are applied to the arbitrator and to officers whose services are used under s 80, by deeming the arbitrator and those officers a public sector body for the purposes of that Act and the arbitrator the chief employee for certain sections (s 64(2)). The Act also imports the Public Sector Commissioner into the arbitrator appointment process (s 63(11)).

Electricity Industry Act 2004 and related energy statutes. The Act gives the Board functions conferred under the Electricity Industry Act 2004 and the Gas Services Information Act 2012, as well as any other written law (s 50(2A)). The arbitrator’s functions are explicitly tied to the National Gas Access (WA) Act 2009, Electricity Industry Act 2004, Gas Supply (Gas Quality Specifications) Act 2009 and any other regulations or written laws conferring functions (s 73(1); s 50(2A)). This means that the scope of the Board’s and the arbitrator’s substantive authority is defined elsewhere and imported into the Act by reference.

Economic Regulation Authority Act 2003. The arbitrator must deliver copies of draft or final decisions to the Economic Regulation Authority where the arbitrator is required to give copies to parties (s 76). The compilation table and Other notes in the Act also record transitional savings and the continuity of decisions following the ERA’s establishment (Other notes, Schedule 3 commentary). This ensures ERA visibility over arbitration outcomes and continuity across institutional transitions.

Commercial Arbitration Act 2012. The Act expressly provides that the arbitrator is not an arbitrator within the meaning of the Commercial Arbitration Act 2012 and that the dispute resolution processes under the Act are not arbitrations under that Act (s 77). That exclusion signals that parties cannot rely on the procedural regime and remedies available under the Commercial Arbitration Act 2012 for arbitrator proceedings under this Act.

Financial Management Act 2006 and Auditor General Act 2006. The arbitrator’s financial administration and reporting are subject to these Acts, including audit, although the scope of performance indicators is restricted (s 84). The arbitrator operates a named bank account into which appropriations and fees are credited (s 82), and may borrow from the Treasurer on approved terms (s 83), thereby interacting with the State’s fiscal framework.

Regulations under this Act and other energy statutes. Section 74 allows regulations to prescribe additional arbitrator functions and to make prescriptive provision similar to the Gas Corporation Act 1994 provisions (as referenced) and to make the arbitrator’s jurisdiction exclusive. Section 86 empowers the Governor to make regulations required or convenient to give effect to the Act. Because the Act imports functions from other statutes, regulations under the Act and the other statutes operate together to define actual jurisdictional boundaries.

Interaction with employment and corporate law. The Act excludes public sector employees and officers of entities listed in Schedule 1 to the Public Sector Management Act from panel membership (s 52(2)). It also disqualifies persons from panels if they become employees referred to in s 52(2) or become insolvent under administration as defined in the Corporations Act 2001 (s 54(2)(b), (c)). Thus, the Act links to public sector employment law and corporate insolvency definitions.

Gazette and Parliamentary procedures. The Act requires publication of panel appointments and publication and tabling of ministerial directions to the arbitrator (s 52(4); s 75(4)-(5)). The arbitrator’s appointment process requires Gazette notice if the Minister recommends a named person in the absence or rejection of Commissioner nominations and requires reasons to be published (s 63(10)(b)). These provisions integrate statutory and parliamentary transparency mechanisms.

Transitional and saving provisions. The compilation table and Other notes reproduce Schedule 3 of the Economic Regulation Authority Act 2003, which preserves continuity for decisions and records administered by predecessor regulators and transfers bank account funds and records to successor bodies (Other notes, Schedule 3 clauses 3-11). This indicates the Act was intended to work within administrative transitions and preserve ongoing regulatory decisions and records.

Exclusion of electricity corporations for staffing use. Section 80 allows the arbitrator to use public servants and State agency staff but expressly excludes officers or employees of an electricity corporation from being used under s 80 arrangements (s 80(1)-(2), (5)). This creates a statutory firewall between electricity corporations and the arbitrator’s staffing arrangements.

In sum, the Act functions as an integrative statute that imports tasks and authorities from existing energy statutes, subjects the arbitrator’s finances and audit to standard public finance law, creates procedural distinctions from the general Commercial Arbitration Act, and embeds transparency and appointment protocols that cross to the Public Sector Management Act and parliamentary processes.

The Act’s compilation table and marginal notations in the text record numerous amendments, deletions and reprints that have reshaped its structure over time. Key amendments and their mechanical effects recorded in the source are:

• Initial enactment and early operation. The Act originated as the Gas Pipelines Access (Western Australia) Act 1998 (No. 65 of 1998) with commencement stages in January and February 1999 and other provisions phased in as specified in the compilation table.

• Frequent structural deletions and insertions. Parts 2-5 and numerous sections were deleted by later amending Acts; Part 6 (Review board and arbitrator) was reconstituted and its heading inserted by No. 16 of 2009 s 31, with multiple earlier subdivisions and sections removed by amending Acts (see marginal notes under Part 6).

• Creation and alteration of review and arbitration functions. Amendments to s 50, s 51 and s 52 reflect changes to the Board’s establishment and panel rules. Section 50 was amended by No. 16 of 2009 s 36, No. 5 of 2012 s 16 and No. 25 of 2013 s 40(2) to clarify functions and tribunal status (s 50(2A)).

• Expansion of arbitrator functions and renaming. Various Acts extended and redefined the arbitrator’s functions to reflect evolving energy regulatory architecture: amendments by No. 53 of 2003 (Energy Legislation Amendment Act 2003), No. 16 of 2009 and further amending statutes adjusted s 73 and related provisions to incorporate functions under the National Gas Access (WA) Act 2009, Gas Supply (Gas Quality Specifications) Act 2009 and other statutes (see s 73 and compilation table entries for 2009-2010).

• Interaction with the Economic Regulation Authority. The Economic Regulation Authority Act 2003 (No. 67 of 2003) introduced transitional and saving provisions, set commencement for certain regulatory functions on 1 January 2004, and included Schedule 3 transitional measures that the Act’s notes reproduce and rely upon (compilation table and Other notes).

• Reprints. The Act was reprinted several times to incorporate amendments: Reprint 1 of the Gas Pipelines Access (WA) Act 1998 as at 11 August 2000; Reprint 2 as at 8 October 2004; Reprint 3 of the Energy Arbitration and Review Act 1998 as at 19 March 2010; and Reprint 4 as at 19 August 2016. Each reprint reflects the cumulative amendments up to the given date.

• Later amendments that specifically inserted or updated provisions. Notable changes recorded include: No. 9 of 2022 s 357 inserting s 49 (definition of Board); No. 5 of 2012 (Gas Services Information Act 2012) inserting functions for the Board (s 50(2A)); No. 23 of 2012 (Commercial Arbitration Act 2012) clarifying that the Commercial Arbitration Act does not apply to the arbitrator (s 77) and setting its commencement; and No. 25 of 2013 (Electricity Corporations Amendment Act 2013) affecting references and functions (compilation table).

• Deletion of prior provisions. The Act’s historical notes show extensive deletions of earlier parts, divisions and sections by a series of amending Acts between 2001 and 2009 (marginal notes under Part 6 and elsewhere). Those deletions indicate prior institutional forms were replaced or consolidated.

• Phased commencements. Several amendments took effect on different dates, for example: National Gas Access (WA) Act 2009 provisions commenced on 1 January 2010; Gas Supply (Gas Quality Specifications) Act 2009 provisions commenced on 27 March 2010; Commercial Arbitration Act 2012 commenced on 7 August 2013 for the purposes relevant to this Act (see compilation table).

The compilation table in the source lists the amending Acts by short title, number and year, with assent and commencement dates. That table is the statutory record of the Act’s legislative history available in the source and shows that the current structure of Part 6 and many of the substantive features (panels, arbitrator office, financial provisions and interaction with newer energy statutes) result from successive amendments rather than the original 1998 text. Where the Act cross‑references amendments from other statutes (for example the Gas Services Information Act 2012 or the National Gas Access (WA) Act 2009), those statutes provide the substantive functions now exercised under the Act (s 50(2A); s 73(1)).

The legislation text supplied does not identify any judicial decisions, appeals, or reported litigation that interpret or apply the Energy Arbitration and Review Act 1998. There are no cases named in the Act or in the compilation table entries provided. The source does, however, record transitional and saving provisions in schedules of related statutes that bear on the continuity of decisions and records across institutional changes, which are relevant to potential litigation histories.

Notably, the Economic Regulation Authority Act 2003 Schedule 3 (reproduced in Other notes) contains transitional provisions intended to preserve the continuing effect of decisions and instruments made by predecessor regulators. Schedule 3 states that decisions of the Gas Pipelines Access Regulator or Rail Access Regulator that were in effect immediately before the commencement day continue as if made by the Authority (Schedule 3 clauses 3-4). It also saves licences and provides for completion of things begun by former officials and transfer of records and bank account moneys (Schedule 3 clauses 5, 6, 9-10). These provisions are expressly designed to limit disputes about continuity of regulatory decisions and records after institutional change, and they could feature in litigation about continuity of regulatory rights and liabilities arising before an institutional transition.

Because the Act permits regulations to make the arbitrator’s jurisdiction exclusive of courts for prescribed disputes (s 74(2)(b)), litigation history in those areas could be affected by whether regulations have been made under s 74 and whether aggrieved parties have other statutory appeal routes. The Act also expressly excludes the Commercial Arbitration Act 2012 from applying to the arbitrator’s processes (s 77), which affects procedural avenues for judicial review or enforcement normally available in the arbitration context and could alter litigation strategies.

Practical implications for litigation risk and strategy based on the statutory text include:

• Where the arbitrator’s jurisdiction has been made exclusive by regulation, parties may not be able to bring certain disputes to courts or other tribunals; the availability of judicial review of administrative decisions (for example on jurisdictional error) would depend on the content of the regulations and the nature of the arbitrator’s decision. The Act itself does not define appeal routes.

• The Board gives written reasons for decisions (s 59(6)), which creates an administrative record suitable for judicial review or further legal challenge where permitted by other laws. The Act’s procedural provisions (fresh hearing, minimal rules of evidence and document powers) will shape the factual record that a court reviews.

• The immunity and Crown substitution provisions (s 60; s 85(1)-(2)) reduce the likelihood of personal liability proceedings against Board members, arbitrators or delegates in civil courts for acts done in good faith, while shifting residual claims to the Crown.

• The Act’s penalties and criminalised conduct (s 53; s 58; s 79) create discrete enforcement exposure that would ordinarily be dealt with under statutory enforcement mechanisms rather than ordinary civil litigation.

Because the source does not name or summarise any judicial decisions, anyone seeking to understand the Act’s litigation history or judicial interpretation will need to search case law databases and tribunal records for decisions referring to the Act or to decisions made under the energy statutes that confer functions on the Board or arbitrator. The transitional provisions in the Economic Regulation Authority Act 2003, reproduced in the Act’s notes, are a statutory starting point for disputes arising from organisational transitions or continuity of regulatory decisions.

Several practical, procedural and jurisdictional features in the Act can produce traps for the unwary or create important strategic considerations. These are concrete mechanisms in the text that parties and advisers should notice.

1. “Person chosen to act” coverage. Section 53 imposes disclosure duties and penalties on any person chosen to act as a member of the Board. The language captures temporary or ad hoc appointees as well as full panel members. Failure to disclose or to secure party consent before participating attracts a $10,000 penalty (s 53(1)-(2)). Practitioners should note the duty applies at the moment of being chosen to act.

2. Ex parte determinations. The Board may make a determination in the absence of a party if satisfied that the party was given a reasonable opportunity to appear but failed to do so (s 59(5)). Parties who do not engage with the process risk losing the opportunity to present evidence or have submissions heard.

3. Broader investigatory powers and retention of documents. The Board may require production and retain documents for a reasonable period and make copies (s 58(1)(b)-(c)). Entities should be prepared for compulsory disclosure into Board proceedings and for document retention obligations originating in a statutory summons.

4. Penalties for non‑compliance and conduct before the Board. The Act criminalises refusal to attend, to produce documents, to be sworn or to answer relevant questions, and misconduct before the Board; each attracts a $10,000 penalty (s 58(2)). Parties should plan for compliance risk when called before the Board.

5. Arbitrator not covered by the Commercial Arbitration Act 2012. Section 77 precludes the Commercial Arbitration Act 2012 from applying to the arbitrator or to its dispute resolution processes. Common procedural and enforcement mechanisms available under the Commercial Arbitration Act will not apply in arbitrator proceedings under this Act; parties cannot assume familiarity with typical commercial arbitration remedies.

6. Regulations can make arbitration exclusive. Regulations under s 74(2)(b) may render the arbitrator’s function exclusive of courts and other tribunals for prescribed disputes. If regulations of that type are made, parties may lose access to ordinary court remedies for the covered disputes unless other statutory routes remain.

7. Ministerial directions limited to administration but public. The Minister can issue written directions constrained to general policies of administration and financial administration (s 75(2)-(3)). Such directions must be published and tabled in Parliament (s 75(4)-(5)). Although directions are limited in substance, the publication and tabling requirements create a transparent trail that may matter to stakeholders and oversight bodies.

8. Conflict reporting and Ministerial resolution/disqualification. The arbitrator must disclose interests to the Minister and may be directed to resolve conflicts; the Minister can disqualify the arbitrator from acting if not resolved satisfactorily (s 79). This means the Minister has an operational lever over arbitrator participation in particular matters short of directing outcomes.

9. Staffing limitations and potential capacity constraints. The arbitrator can use public sector staff but not officers or employees of an electricity corporation (s 80(1)). The exclusion of electricity corporation staff may limit available technical expertise in certain cases and requires administrative arrangements to be negotiated under public sector employment frameworks.

10. Financial recovery and fees. The arbitrator’s account accepts fees and charges payable to the arbitrator or the Board (s 82(3)(a)(ii)), and regulations can prescribe fees or methods for calculating fees, including cost‑based methods (s 74(3)-(4)). Parties should check the regulations for fee structures and for potential cost recovery rules that may allocate costs to disputing parties.

11. Immunities and Crown substitution. The Act grants immunity for good faith acts and transfers residual liability to the Crown in certain contexts (s 60; s 85(1)-(2)). That may affect insurance cover and recovery strategies against individual officials.

12. Appointment contingency and ministerial override. The Commissioner (Public Sector Commissioner) leads selection of arbitrator candidates but the Minister retains power to reject nominations and, where the Commissioner does not nominate or nominations are rejected, to recommend a named person to the Governor with Gazette notice and reasons (s 63(7)-(10)). The Minister’s power to recommend a named person is subject to procedural publicity requirements; however, it introduces a political element into appointments.

13. Acting arbitrator power to continue and potential overlap. Persons appointed to act as arbitrator can continue hearings even if the reason for acting has ceased and the arbitrator is simultaneously performing other functions (s 72). That can result in the same officeholder operating in overlapping decision contexts, which may be a procedural complexity for parties challenging capacity or impartiality.

14. Panel composition restrictions. Panel members cannot be public service employees or employees of certain public bodies (s 52(2)), which reduces the pool of eligible candidates and may affect the availability of legally qualified presiding members and domain experts, especially in specialised energy fields.

15. Written reasons but no specified judicial appeal route in the Act. The Board must give written reasons (s 59(6)). The Act does not specify appeal or review routes for Board or arbitrator decisions; those routes depend on the statute granting the substantive function or on broader administrative law. Parties should identify the enabling statute that confers a function to determine appealability.

These mechanisms create both procedural advantages for efficient fact finding and compliance burdens and political or administrative levers that can affect appointment and participation. Advisers should map the relevant enabling statute (for example the Electricity Industry Act 2004 or National Gas Access (WA) Act 2009) to understand substantive rights and appeal pathways, check current regulations for fee, jurisdictional and procedural prescription, and plan for robust conflict disclosure and document‑production compliance.

For regulated entities, counsel and advisers preparing to engage with the Board or the arbitrator, the Act sets out discrete and actionable compliance steps. The following are practical measures grounded in the statutory text.

1. Conflict of interest systems

• Board appointees and temporary members. Ensure that any person chosen to act as a member of the Board is subject to a standard conflict declaration procedure at the moment of appointment. The Act requires disclosure to each party of the nature of any conflict and prohibits participation without each party’s consent (s 53(1)-(2)). Maintain written records of disclosures and written party consents where participation is permitted.

• Arbitrator disclosures. The arbitrator must inform the Minister in writing of any direct or indirect interest that conflicts or may conflict with duties (s 79(1)). For advisers to the arbitrator or potential candidates, maintain a comprehensive register of interests and update it promptly to avoid the $10,000 penalty.

2. Responding to Board summonses and evidence obligations

• Document‑production readiness. Because the Board may summons production of books, papers or documents and may retain and copy them (s 58(1)(b)-(c)), entities should implement rapid legal review workflows to respond to summonses within statutory timeframes and with legally justified claims of privilege or protection where available. Non‑compliance attracts a $10,000 penalty (s 58(2)(b)).

• Witness availability and oath compliance. Arrange for identified witnesses to be available and prepared to take oath or affirmation; refusal to answer relevant questions or to be sworn is penalised (s 58(2)(d)). Train witnesses on the Board’s procedures and on what constitutes relevant questions.

3. Procedural engagement in Board hearings

• Fresh hearing preparation. Prepare a full evidentiary record and submissions because the Board conducts a fresh hearing and is not bound by the rules of evidence (s 57(1)-(2)). Where evidence will be oral, ensure witnesses are instructed and available; where evidence is to be proofed by affidavit, prepare affidavits consistent with Board practice.

• Representation and cross‑examination. Parties are entitled to appear by counsel or representative and may cross‑examine (s 59(3)-(4)). Budget for legal representation accordingly and plan cross‑examination strategies given the Board’s equity-oriented approach.

• Timely notice and ex parte risk. The Board must give reasonable notice of time and place (s 59(2)); however, the Board may proceed in the absence of a party after reasonable opportunity was provided (s 59(5)). Ensure receipt of notices and respond promptly to avoid ex parte determinations.

4. Financial and fees management

• Check applicable regulations and fee schedules. Section 74 empowers regulations to prescribe fees or methods for calculating fees and s 82 allows fees to be credited to the arbitrator’s account (s 74(3); s 82(3)). Verify current regulations for fee amounts, cost recovery mechanisms and invoicing procedures and allocate budget for possible cost orders or fee liabilities.

• Treasury and borrowing considerations. If acting in institutional roles that interact with the arbitrator’s account, note the account must be at a bank approved
