233 Exemption from liability to transmit or convey gas (1) Despite anything to the contrary in this or any other Act but subject to subsection (2) or in any contract— S. 233(1)(a) repealed by No. 23/2009 s. 32(a). (b) a gas distribution company is not liable to any penalty or damages for failing to convey gas through distribution pipelines if the failure arises out of any accident or cause beyond the control of the gas distribution company. S. 233(2) amended by No. 23/2009 s. 32(b). (2) A gas distribution company may enter into an agreement with a person varying or excluding the operation of subsection (1) and, to the extent of that agreement, that subsection does not apply. (3) Nothing in subsection (1) or (2) affects the liability of a gas company under the **Gas Safety Act 1997**.
