232 Gas retailer not liable for failure to supply (1) Despite anything to the contrary in this or any other Act or in any contract, a gas retailer is not liable to any penalty or damages for failing to supply gas if the failure arises out of any accident or cause beyond the control of the gas retailer. (2) A gas retailer may enter into an agreement with a person varying or excluding the operation of subsection (1) and, to the extent of that agreement, that subsection does not apply. (3) Nothing in subsection (1) or (2) affects the liability of a gas company under the **Gas Safety Act 1997**.
