What it does
This instrument, the Gas (Exemption) Order 2006, creates a narrowly tailored statutory exemption from specified provisions of the Gas Act 2000 and parts of the Gas (Safety) Regulations 2002 for particular pieces of equipment at a named site, subject to conditions. Mechanically, clause 4(1) removes the application of Division 5 of Part 4 of the Gas Act 2000 in relation to an “exempt gas installation” defined in Schedule 1. Clause 4(2) and (3) remove the application of Regulations 47 and 48 and Regulations 54(2) and 54(3) of the Gas (Safety) Regulations 2002 in relation to the same installation. Schedule 1 describes precisely which installations are covered by reference to named Pratt and Whitney FT8 Twin-Pac units and specific serial numbers. Schedule 2 sets out the conditions on which the exemption is available, and those conditions principally place the Director of Gas Safety at the centre of whether and when the exemption takes effect (see Schedule 2 clause 2). The order commences on the day its making is notified in the Gazette (clause 2); the instrument records that notification occurred on 15 February 2006.
Put simply, the Order narrows the regulatory perimeter for some gas-related rules by excepting specified equipment at the Bell Bay Power Station project from particular statutory and regulatory provisions, but only if the Director of Gas Safety has accepted the installation in writing and certain preconditions are met (Schedule 2 clause 2(d)-(f)). The exemption is not self-executing: acceptance by the Director, satisfactory statement of compliance and compliance with any specified conditions are preconditions to relying on the exemption (Schedule 2 clause 2(a)-(d)). The instrument also records that the exempt installations are to be installed by Hydro Tasmania for Bell Bay Three Pty Ltd into the greater complex gas installation at the Bell Bay Power Station (clause 3(1) definition of “exempt gas installation”, Schedule 1).
