#### 19 Administrative review of certain model approval decisions by Civil and Administrative Tribunal 19 Administrative review of certain model approval decisions by Civil and Administrative Tribunal > > (1) A person whose application for a model approval has been refused by the Secretary may apply to the Civil and Administrative Tribunal for an administrative review under the [Administrative Decisions Review Act 1997](/view/html/inforce/current/act-1997-076) of that refusal. > > > (2) A holder of a model approval may apply to the Civil and Administrative Tribunal for an administrative review under the [Administrative Decisions Review Act 1997](/view/html/inforce/current/act-1997-076) of a decision of the Secretary suspending or cancelling the model approval given to the holder. > > > (3) For the purposes of an application under subsection (1), an application for a model approval is taken to have been refused if it is not determined by the Secretary— > > > > > (a) except as provided by paragraph (b)—within 60 days after the date on which the application was lodged with the Secretary, or > > > > > (b) if the applicant and the Secretary agree on a longer period—within the longer agreed period after the date on which the application was lodged with the Secretary.
