Gaming Offences Regulations 2021

The Regulations rest on a small set of statutory concepts: poker tournament exemptions from the Act’s definition of unlawful gaming, specific conditions distinguishing general tournaments from trade promotion tournaments, and the concept of an amusement machine with the characteristics of a gaming machine.

• Poker tournaments: Regulation 4(1) prescribes three circumstances in which playing poker does not constitute unlawful gaming for the purposes of the Act’s paragraph (ab). Two of those circumstances are tournament exemptions, with the tournaments required to be conducted in accordance with the detailed requirements in regs 4(2) (general poker tournaments) and 4(3) (trade promotion poker tournaments). The third circumstance is essentially a free‑to‑play exemption: where no participant could win any money or other prize (reg 4(1)(c)).

• Equality of entry and chips: Both tournament strands impose an equality rule on entry fees and initial chips. For general tournaments, if participation is contingent on a fee each participant must pay the same fee (reg 4(2)(a)), and all participants must be given an equal number and value of poker chips at the start (reg 4(2)(b)). Trade promotion tournaments have the same equal fee and initial chips rule, but add specific permitted exceptions for additional chips (reg 4(3)(a), 4(3)(c)‑(d)).

• Rules availability and prize pre‑determination: In both tournament types a copy of the rules applicable to participants must be available for inspection at the premises at any time during the tournament (reg 4(2)(c), 4(3)(f)). Prizes must generally be determined before the tournament starts and specified in those rules (reg 4(2)(d), 4(3)(g)), with certain limited flexibility allowing prizes to be divided among participants in specified circumstances (reg 4(2)(f), 4(3)(i)).

• Prize allocation methods: Both tournament types prescribe permissible prize allocation mechanics. Prizes are to be awarded either by ranking of poker chips accumulated (highest chips wins first prize, next highest second prize, and so on), or by a process of elimination specified in the rules (reg 4(2)(e), 4(3)(h)).

• Trade promotion constraints: Trade promotion tournaments introduce three principal regulatory constraints that differ from general tournaments. First, the fee cap of $50 per person when participation is contingent on payment (reg 4(3)(a)(i)). Second, the requirement that all fees collected must be used to pay prizes (reg 4(3)(b)). Third, limited circumstances in which extra poker chips may be supplied, namely early entry bonuses or exchange for purchasing food and beverage at the premises, with a cap that any such chips do not exceed 20% of the initial chip value (reg 4(3)(d)).

• Re‑entry and chip replacement: Trade promotion rules allow eliminated participants to re‑enter only where no additional fee is payable and re‑entering participants are not provided with chips exceeding the initial allocation (reg 4(3)(e)). General tournaments may allow prize division under rules but otherwise do not include explicit re‑entry mechanics in the text.

• Amusement machines as instruments of unlawful gaming: Regulation 5(1) declares an amusement machine that has the characteristics of a gaming machine (as defined in the Gaming Machines Act 1992) to be an instrument of unlawful gaming under section 59A of the Act. The Regulations then define an amusement machine broadly as any device designed or adapted to enable a person to participate in a game of amusement (reg 5(2)(a)), and list three non‑exclusive indicia by which an amusement machine will be taken to have the characteristics of a gaming machine (reg 5(2)(b)(i)‑(ii)(A)‑(C)). Those indicia include: being a gaming machine but not an approved gaming machine under the Gaming Machines Act 1992; being coin, note or token operated and simulating a gaming machine via spinning reels; being marked or described as a gaming machine or pokie; or using gambling words such as gamble, bet, jackpot in instructions or operation (reg 5(2)(b)).

• Revocation: Schedule 1 revokes the Lottery and Gaming Regulations 2008. The text does not specify transitional arrangements; the Schedule simply states revocation (Schedule 1).

The Regulations therefore combine prescriptive procedural requirements for poker tournaments with definitional, per‑device prohibitions for amusement machines. The central regulatory instruments are the lists of mandatory and permitted actions in reg 4(2) and reg 4(3), and the machine indicia in reg 5(2).

The Regulations affect a defined set of actors by name and by implication. Who pays, who decides, and who changes behaviour are explicit in the text.

• Tournament organisers and venue operators: Any person who organises or hosts a poker tournament and makes participation contingent on payment or supplies poker chips must comply with the general tournament requirements in reg 4(2) or the trade promotion requirements in reg 4(3) depending on the tournament’s character. Organisers decide entry fees, chip allocation, rules, prize structure, and whether early entry bonuses or food/beverage chip exchanges are supplied; these decisions are the central regulatory touchpoints where regulation imposes constraints and generates compliance costs (see reg 4(2)(a)‑(f), 4(3)(a)‑(i)). Organisers also must ensure that copies of participant rules are available for inspection on premises at all times during the tournament (reg 4(2)(c), 4(3)(f)).

• Participants in poker tournaments: Players are the payers of entry fees where such fees are imposed; in trade promotion tournaments the Regulations cap that fee at $50 per person (reg 4(3)(a)(i)). Participants receive an equal number and value of poker chips at the start (regs 4(2)(b), 4(3)(c)); their right to buy additional chips is restricted , they may only receive additional chips by winning in play, with limited exceptions in trade promotion tournaments (reg 4(2)(b); reg 4(3)(d)). Participants are also bound by the rules the organiser must make available.

• Businesses supplying food and beverage, and promoters using poker as a trade promotion mechanism: The trade promotion strand specifically contemplates poker used to promote trade, as it allows chips to be supplied in exchange for purchasing food and beverage, subject to the 20% cap (reg 4(3)(d)(ii), 4(3)(d) proviso). Those businesses will be the decision-makers about offering incentive chips in order to drive sales, subject to the cap.

• Suppliers and operators of amusement machines, and persons who import, market, or advertise such devices: Regulation 5 declares certain amusement machines to be instruments of unlawful gaming. Manufacturers, importers, venue operators and retailers who supply or operate amusement machines need to check whether a device is a gaming machine but not an approved gaming machine under the Gaming Machines Act 1992 (reg 5(2)(b)(i)), whether the device is coin/token operated and simulates a gaming machine (reg 5(2)(b)(ii)(A)), is labelled or marketed as a gaming machine or pokie (reg 5(2)(b)(ii)(B)), or uses gambling words in its instructions or operation (reg 5(2)(b)(ii)(C)). Those attributes trigger the declaration in reg 5(1) and thereby expose the machine to being treated as an unlawful instrument.

• Regulators and enforcement agencies: The Regulations tie back to the Gaming Offences Act 1936 (reg 3). Regulators operating under the Act are the decision-makers for enforcement and prosecutions under the Act’s relevant provisions, including s 59A referenced in reg 5(1). The Regulations provide the criteria that enforcement agencies will apply when assessing whether poker play is unlawful or whether a machine is an unlawful instrument; they do not themselves set out enforcement procedures beyond those embedded in the Act.

• Persons who previously relied on the Lottery and Gaming Regulations 2008: Those persons are affected by the revocation in Schedule 1. Revocation means prior regulatory frameworks, exemptions, or approval processes contained in the 2008 Regulations are no longer operative, so affected actors must rely on the new rules, where relevant.

Who bears costs: Organisers bear compliance costs of preparing, displaying and sticking to rules; ensuring equal chip allocation; segregating fees into prize pools for trade promotions; limiting bonus chips to 20% where applicable (reg 4(3)(d)); and policing re‑entry and the ban on buying chips. Businesses supplying amusement machines may bear costs in modifying device labelling, marketing, instructions and mechanisms to avoid the indicia in reg 5(2)(b) if they want to avoid the instrument being deemed unlawful. Participants bear the direct expense of entry fees and indirectly the opportunity cost of foregone alternative promotions if organisers alter business models to comply.

Who decides: Organisers and venue operators decide tournament structure, chip values, price of entry subject to caps, early entry incentives, and whether to use poker for trade promotion. Regulators decide whether a particular device meets the reg 5(2) indicia and whether conduct falls within the exemptions or is unlawful under the Act.

Behavior changes induced: Organisers may redesign tournament terms to comply with chip allocation rules and prize determination; trade promotions may adjust food and beverage incentives to ensure chips provided remain below the 20% cap; vendors of amusement machines may avoid marketing language or simulated reel displays that would cause their devices to be declared unlawful instruments.

The Regulations impose a set of duties on tournament organisers and on persons who supply or operate amusement machines, and they create the right for participants to play poker without it being treated as unlawful gaming when the specified conditions are met. The duties and rights are textually specific; summarised below with section references.

Duties on tournament organisers

• Equal fee rule: If participation is contingent on the payment of a fee, the organiser must ensure each person participating in the tournament pays the same fee (reg 4(2)(a) for general tournaments; reg 4(3)(a)(ii) for trade promotion tournaments). Trade promotion tournaments additionally cap that fee at $50 per person where it is contingent on payment (reg 4(3)(a)(i)).

• Equal chip allocation: All participants must be given an equal number and value of poker chips on commencing participation in the tournament (reg 4(2)(b); reg 4(3)(c)). For general tournaments no participant may purchase or be supplied with additional chips except by winning them in play (reg 4(2)(b)). Trade promotion tournaments allow limited additional chips as early entry bonuses or in exchange for purchasing food and beverage, subject to a cap (reg 4(3)(d)).

• Rules availability: A copy of the rules applicable to participants must be available for inspection by any person at the premises at which the tournament is held at any time during the tournament (reg 4(2)(c); reg 4(3)(f)). This imposes a duty to create and display rules and to ensure their availability throughout the event.

• Prize pre‑determination and specification: Subject to limited exceptions, prizes must be determined before the tournament commences and specified in the rules (reg 4(2)(d); reg 4(3)(g) for trade promotions). Monetary prizes in trade promotions may be specified as money or as a percentage of fees collected, or as money plus a percentage (reg 4(3)(g) proviso).

• Prize awarding method: Except where rules provide otherwise in specified circumstances, prizes may only be awarded based on the poker chips won by participants (highest chip value wins) or by a process of elimination prescribed in the rules (reg 4(2)(e); reg 4(3)(h)). The rules may, however, provide for prizes to be divided among participants in specified circumstances (reg 4(2)(f); reg 4(3)(i)).

• Use of fees for prizes in trade promotions: For trade promotion tournaments, all fees collected must be used in the payment of prizes to participants (reg 4(3)(b)). This creates a ring‑fencing obligation on collected fees for prize payment, rather than other commercial uses.

• Re‑entry constraints in trade promotions: The rules for trade promotions may allow eliminated participants to re‑enter, but only where no additional fee is payable for re‑entry and re‑entering participants are not provided with more chips than the initial allocation (reg 4(3)(e)).

Duties and constraints on amusement machine suppliers and operators

• The Regulations declare, under section 59A of the Act, that an amusement machine with characteristics of a gaming machine is an instrument of unlawful gaming (reg 5(1)). They then set out the criteria by which an amusement machine will be taken to have those characteristics (reg 5(2)(b)). An amusement machine is broadly defined as any device designed or adapted to enable a person to participate in a game of amusement (reg 5(2)(a)). The practical duty for suppliers and operators is to ensure devices do not meet the indicia in reg 5(2)(b) unless they are an approved gaming machine, or to take the risk that their device will be treated as unlawful.

Rights created or clarified

• Right to play poker without contravening the Act: Participants in a tournament that is conducted in accordance with the relevant general or trade promotion requirements are not, by reason of that play, committing unlawful gaming under the Act’s paragraph (ab) (reg 4(1)(a)‑(b)). Also, play in games where no participant could win money or any other prize is exempted from being unlawful gaming (reg 4(1)(c)).

• Right to inspect rules: Any person at the premises has the right to inspect a copy of the tournament rules during the tournament (reg 4(2)(c); reg 4(3)(f)).

State discretion and non‑delegated choices

• The Regulations themselves are prescriptive and leave limited room for administrative discretion within the tournament framework. Organisers choose the fee and prize structures within the statutory bounds, and they decide whether to implement early‑entry or food/beverage incentive chips consistent with the caps. Enforcement discretion, including whether to treat a particular device as an unlawful instrument or whether to prosecute alleged unlawful gaming, rests with the authorities acting under the Gaming Offences Act 1936, as the Regulations reference the Act (reg 3; reg 5(1) invokes s 59A). The Regulations do not specify approval or exemption processes under these rules; they set bright‑line operational requirements.

Interaction of duties and rights

• Duties are tightly linked to the right to a lawful exemption. Compliance with the specified duties is the mechanism by which organisers and players access the right not to be treated as engaging in unlawful gaming. Failure to meet the listed conditions will remove the statutory safe harbour and leave conduct subject to the Act’s prohibitions and enforcement mechanisms.

The Regulations do not themselves set out penalty amounts, a new enforcement apparatus, or a schedule of fines. Rather, enforcement and penalties are to be delivered under the Gaming Offences Act 1936 and section 59A is specifically referenced in reg 5(1). The Regulations therefore operate by clarifying what conduct is exempt from the Act’s definition of unlawful gaming and by declaring particular devices to be instruments of unlawful gaming; the Act contains the enforcement machinery that applies when conduct or devices fall outside the prescribed exemptions.

What the text shows about enforcement mechanics

• Reference to the Act: Regulation 3 defines "Act" as the Gaming Offences Act 1936, establishing that the Regulations are subordinate to, and operate through, the Act (reg 3). Regulation 5(1) expressly invokes s 59A of the Act to declare an amusement machine with the characteristics of a gaming machine to be an instrument of unlawful gaming. That means any enforcement action, seizure, or penalties relating to instruments declared unlawful under reg 5 must proceed under the Act’s enforcement provisions; the Regulations do not add additional bespoke criminal or civil penalties in their own text.

• No new sanctions in the Regulations: The Regulations impose substantive requirements for token allocation, fee caps, prize pre‑determination and rules availability, but they do not attach a separate sanction within the Regulations for a breach of those requirements. The consequence of non‑compliance is that play or a device will not meet the statutory exemption and therefore may be treated as unlawful under the Act. The precise criminal or civil consequences are therefore contingent on the Act’s provisions and prosecutorial or regulatory decisions under the Act.

• Enforcement focus for machines: Reg 5(1) is a declaration under s 59A that certain amusement machines are instruments of unlawful gaming. That classification is an enforcement trigger: a machine that meets the reg 5(2) indicia falls within the Act’s instrument prohibition and therefore can be the focus of seizure, prohibition or prosecution under the Act’s enforcement provisions. The Regulations give the enforcement agencies criteria they can apply when assessing machines, which can reduce uncertainty about enforcement thresholds.

Practical enforcement implications

• Burden of proof and compliance: The Regulations set out objective elements such as equal chip allocations, fee caps, availability of rules, and machine indicia that can be used by enforcement officers to determine compliance. Because the Regulations align the safe harbour to demonstrable features (e.g., rules displayed on premises), organisers can use documentary evidence to show compliance. Conversely, enforcement agencies have clear markers for non‑compliance, such as unequal chip distributions, sale of additional chips, absence of pre‑determined prizes, or amusement machine labelling that uses gambling words.

• Discretion remains: The Regulations provide criteria but do not remove enforcement discretion. Authorities will still decide whether to investigate, seize machines, or prosecute, and those decisions will be governed by the Act’s enforcement policy and procedures which are not reproduced in these Regulations.

• Revocation effects: The revocation of the Lottery and Gaming Regulations 2008 (Schedule 1) may shift enforcement priorities or remove previously available administrative processes. The Regulations do not specify transitional enforcement approaches, so regulated parties and enforcement agencies must work from the new text and the Act to determine practical enforcement consequences after revocation.

In short, these Regulations define exemptions and a class of unlawful instruments; the Act remains the source of penalties and enforcement. Organisers and machine suppliers who do not meet the Regulations’ criteria risk exposure to the Act’s enforcement provisions.

The Regulations operate explicitly as subordinate legislation to the Gaming Offences Act 1936, and they interact by reference with the Lotteries Act 2019 and the Gaming Machines Act 1992. The document itself provides the cross‑references and revocation actions that create the legal relationships.

Key cross‑references in the text

• Gaming Offences Act 1936: Regulation 3 defines "Act" as the Gaming Offences Act 1936, anchoring the Regulations to that primary statute. The exemptions specified in reg 4(1) are expressly for the purposes of paragraph (ab) of the definition of unlawful gaming in section 4 of the Act. Regulation 5(1) expressly applies section 59A of the Act to declare amusement machines with certain characteristics to be instruments of unlawful gaming. Thus the Regulations supply interpretive and application detail to the Act, setting out when poker play is exempt and what devices qualify as unlawful instruments, while leaving enforcement and penalties to the Act.

• Lotteries Act 2019: Regulation 2 ties commencement of these Regulations to the day the Lotteries Act 2019 comes into operation. The Regulations therefore depend on the Lotteries Act 2019’s commencement timetable. The legislative history entry records a commencement reference (10.12.2021). The linkage is a temporal interaction; it does not create substantive cross‑operational rules between the two Acts in the text of these Regulations, but the timing connection may reflect a larger statutory reform package in which gaming and lotteries elements are coordinated.

• Gaming Machines Act 1992: The Regulations use the concept of a "gaming machine" within the meaning of the Gaming Machines Act 1992 as part of the test for whether an amusement machine will be taken to have the characteristics of a gaming machine (reg 5(2)(b)(i)). That creates a definitional dependency: whether a device is "a gaming machine, but not an approved gaming machine" requires application of the Gaming Machines Act 1992’s definitions and approval regimes. The Regulations therefore import definitional and approval distinctions from the 1992 Act to determine whether an amusement machine becomes an unlawful instrument under the Gaming Offences Act 1936.

• Revocation of earlier subordinate legislation: Schedule 1 revokes the Lottery and Gaming Regulations 2008. That revocation severs any continuing operation of definitions, exemptions or administrative processes in the 2008 Regulations. Regulated parties must therefore look to these 2021 Regulations and the parent statutes for current rules.

Implications of those interactions

• Chain of decision‑making: The Regulations create rules that must be interpreted alongside the parent Acts. For example, a device might be a "gaming machine" under the Gaming Machines Act 1992 but also be subject to licensing or approval under that Act; the Regulations declare that a gaming machine that is not approved will be taken to be an unlawful instrument under the Gaming Offences Act 1936. That creates an interlocking regime where compliance with one Act’s approval processes affects enforcement under another Act.

• Timing and transitional uncertainty: Because commencement is tied to the Lotteries Act 2019, and the Regulations revoke the 2008 instrument, there is a sequencing effect. The regulatory landscape for lottery and gaming activities may have shifted at the time of commencement. The Regulations do not include transitional provisions specifying how matters in progress under the 2008 Regulations are to be treated; the absence of transitional detail means stakeholders must map existing approvals and processes across the Acts and new Regulations.

• Administrative burden across regimes: Organisers and machine operators must navigate at least three distinct statutes and these Regulations to establish whether particular conduct is permitted, requires approval, or is unlawful. For instance, an amusement machine manufacturer will need to consider the machine’s status under the Gaming Machines Act 1992 and then assess reg 5(2) criteria to understand exposure under the Gaming Offences Act 1936 via these Regulations.

• No superseding of enforcement powers: The Regulations do not curtail or expand the enforcement powers in the cited Acts; they provide clarifying definitions and exemptions that affect how enforcement is applied. Therefore enforcement remains dependent on the parent Acts’ powers, procedures and penalties.

All cross‑references are explicit in the Regulations’ text. The Regulations do not purport to alter the substantive operation of the referenced Acts beyond supplying exemptions and device‑tests that will be applied under those Acts.

The Regulations are a short instrument with limited amendment history recorded in the provided text. The legislative history section and the Schedule provide the record of enactment and revocation:

• Instrument identification and Gazette notice: The principal regulations are recorded as Year 2021, No 163, Gazette 28.10.2021 p 3900 (Legislative history). The Regulations are cited as the Gaming Offences Regulations 2021 (reg 1).

• Commencement: Regulation 2 states that the Regulations come into operation on the day on which the Lotteries Act 2019 comes into operation. The legislative history entry records "10.12.2021: r 2", indicating the operational commencement date. The Regulations therefore commenced in late 2021, linked to the Lotteries Act 2019’s commencement timetable.

• Revocation of previous subordinate instrument: Schedule 1 revokes the Lottery and Gaming Regulations 2008. That is the only express revocation or repeal contained within the instrument.

• No internal amendments recorded in the text: The provided document does not list subsequent amending instruments, saving provisions, or transitional arrangements beyond the single revocation. The legislative history notes the principal regulations but does not list subsequent amendments.

What the record implies for stakeholders

• The Regulations appear to be a replacement subordinate instrument to the Lottery and Gaming Regulations 2008 in respect of the topics covered. Revocation in Schedule 1 removes the 2008 Regulations; there is no transitional text in the 2021 Regulations themselves.

• The commencement linkage to the Lotteries Act 2019 suggests the Regulations were intended to be part of a coordinated statutory update to gambling and lotteries regulation. The legislative history confirms the date reference in 2021.

• Because the Regulations are short and their recorded history shows single enactment and revocation action only, stakeholders should treat the instrument as a discrete, self‑contained set of rules adopted at that time. Any later changes, exemptions, or guidance would appear in subsequent amending instruments or administrative guidance not contained in this text.

The text contains no further amendment or revocation entries beyond Schedule 1, and the legislative history section provides the single Gazette and commencement reference cited above.

The Regulations themselves do not record any litigation history and the provided text lists no cases, judicial interpretations, or administrative determinations. Consequently, there is no litigation precedent included in this instrument to guide interpretation.

What the absence of litigation history in the text means

• No recorded cases are cited: The instrument does not refer to judicial or tribunal decisions that interpret its provisions or the sections of the Act it supplements. Without cited judgments in this text, practitioners must rely on the statutory language and on the parent Acts for interpretive frameworks.

• Interpretive issues likely to arise: Although the Regulations are prescriptive, several textual elements invite factual or legal disputes that could generate litigation, administrative review or enforcement challenges. Examples of potential interpretive issues inherent in the text include:

  • Measurement of "value" of poker chips: The Regulations require equal number and value of poker chips on commencement (reg 4(2)(b), 4(3)(c)) and cap additional chips to 20% of the value of initial chips when given as a bonus or in exchange for purchases (reg 4(3)(d)). Disputes could arise about how "value" is to be measured and evidenced, whether nominal denominations or purchasing power is the relevant metric, and how bundled prizes interact with chip values.

  • What counts as "a prize" and whether a tournament is truly free of monetary or other prizes: The free‑play exemption depends on there being no possibility of winning money or other prize (reg 4(1)(c)). A dispute could focus on whether non‑monetary items, vouchers, or indirect commercial benefits constitute a "prize" for the purposes of the exemption.

  • Whether additional chips supplied for food and beverage purchases are within the 20% cap and how to calculate that cap across different methods of valuation (reg 4(3)(d)).

  • Interpretation of machine indicia: Reg 5(2)(b) lists several indicia for an amusement machine to be taken as having the characteristics of a gaming machine. Legal disputes could focus on the threshold for "simulates the operation of a gaming machine by the use or depiction of a spinning reel", whether marketing or labelling amounting to description as a "pokie" is factual or legal, and how the content of instructions or operation is to be assessed.

• Enforcement discretion may lead to challenge: Because the Regulations do not themselves set out enforcement procedures or sanctions but rely on the Act, affected parties may challenge enforcement actions under the Act as misapplied or disproportionate where the facts arguably meet the exemptions in regs 4(2) or 4(3), or where a machine’s characteristics fall into a borderline factual area under reg 5(2)(b).

What practitioners should expect

• Early litigation or administrative determinations are possible on close questions of fact and definition. The Regulations’ prescriptive elements supply clear factual markers that are likely to be focal points in any dispute; absent authoritative cases in this text, litigants will need to litigate the application of those markers to concrete facts.

• The Regulations’ silence on case law means that lawyers should prepare to develop factual records and arguments on measurement of chip value, the nature of prizes, the meaning of "simulates" and "designed or adapted", and the application of the 20% chip cap in trade promotions.

Because the instrument itself contains no litigation history, this section serves to identify the kinds of disputes the text is likely to generate and to flag interpretive issues for counsel and compliance officers to anticipate.

The Regulations are compact but contain multiple points where compliance traps and practical ambiguities may arise. The following are text‑grounded pitfalls and interpretive traps that organisers, venue operators, machine suppliers and counsel should note, with direct references to the relevant provisions.

Equality and value of chips

• "Equal number and value" requirement: Both general and trade promotion tournaments require that all participants be given an equal number and value of poker chips on commencing participation (reg 4(2)(b); reg 4(3)(c)). This is a two‑fold requirement: numerical equality and value equality. Organisers setting up multi‑tiered buy‑ins, or providing different chip denominations or stacks for differing categories of entrants, risk stepping outside the safe harbour.

• Measuring chip "value": The Regulations do not define how to calculate the "value" of chips. That opens a compliance hazard where organisers use novel denominations, time‑banking prizes, vouchers or convertible chip‑equivalents. If an organiser distributes chips with different purchasing powers (for instance by attaching different prize equivalences), that may breach the equality rule.

Restrictions on purchasing additional chips

• General tournaments prohibit purchase or supply of additional chips except by winning them in play (reg 4(2)(b)). For trade promotions the prohibition is relaxed only in narrowly specified ways: early entry bonus or exchange for food and beverage purchases, capped at 20% of initial chip value (reg 4(3)(d)). Organisers who monetise chips mid‑event (for example, by selling additional chips or selling re‑entries for a fee in general tournaments) risk losing the exemption.

Trade promotion fee and prize rules

• $50 fee cap: Trade promotion tournaments have a statutory cap of $50 per entrant when participation is contingent on a fee (reg 4(3)(a)(i)). Organisers who charge more than $50 per entrant for a trade promotion style event cannot rely on the trade promotion exemption and must instead look to general tournament rules or risk violating the Act.

• Use of fees for prizes: All fees collected in trade promotion tournaments "must be used in the payment of prizes" (reg 4(3)(b)). That ring‑fencing requirement means fees cannot be diverted for operational overheads, marketing or other purposes without risking loss of the exemption.

Early entry and food/beverage chips cap

• The 20% cap: Trade promotion tournament rules allow bonus chips for early entry or chips exchanged for food and beverage, but the total value of such chips must not exceed 20% of the value of chips initially given to participants (reg 4(3)(d) proviso). Organisers offering generous incentives tied to purchases may inadvertently exceed the cap if they fail to aggregate and calculate values properly across multiple incentive channels.

Re‑entry and fee rules

• Re‑entry without fee only: Trade promotion tournaments may allow eliminated participants to re‑enter provided no additional fee is payable and re‑entering participants are not provided with more chips than the initial allocation (reg 4(3)(e)). This prevents organisers from using re‑entry fees as revenue while still claiming the trade promotion exemption. For general tournaments the text does not authorise paid re‑entry; organisers permitting re‑entry for a fee in a general tournament risk invalidating the exemption.

Rules visibility and specification

• Rules must be available for inspection at the premises at any time during the tournament (reg 4(2)(c); reg 4(3)(f)). It is not sufficient to publish rules online only; the text requires availability at the premises during the event. Failure to display or make rules available may amount to non‑compliance.

Prize determination and variability

• Pre‑determination requirement with limited exception: Prizes must be determined prior to commencement and specified in the rules (reg 4(2)(d); reg 4(3)(g)), but the rules may provide for prizes to be divided in specified circumstances (reg 4(2)(f); reg 4(3)(i)). Organisers offering open‑ended prize structures or promising discretionary prizes risk losing the exemption if the prize cannot be shown to have been determined and specified in the rules.

Amusement machines traps

• Broad definition of "amusement machine": Reg 5(2)(a) defines an amusement machine as any device designed or adapted for enabling a person to participate in a game of amusement. That is wide; novelty devices, hybrid machines and mechanical/digital devices may fall within it.

• Multiple indicia for unlawfulness: A device will be taken to have the characteristics of a gaming machine if it meets any of the listed tests in reg 5(2)(b). Even if not an unapproved gaming machine under the Gaming Machines Act 1992, a device that is coin, note or token operated and simulates a spinning reel, is marked as a pokie in packaging or advertising, or uses gambling words in its instructions or operation will be treated as an unlawful instrument (reg 5(2)(b)(ii)). Designers and marketers of amusement machines must be attentive to labelling, packaging copy and on‑machine wording.

Revocation consequences

• Loss of prior regulatory expectations: The revocation of the Lottery and Gaming Regulations 2008 (Schedule 1) may remove prior exemptions or operating practices that operators relied on. Absence of transitional provisions in the instrument creates a compliance risk where operators mistakenly assume continuity of prior rules.

Proof and evidentiary burdens

• Document retention not prescribed: The Regulations require availability of rules at premises but do not specify record retention, audits or proof standards. Organisers should nonetheless maintain documentary evidence of chip allocation, fee collection and prize determination to demonstrate compliance if enforcement action is taken.

Borderline scenarios likely to trigger enforcement scrutiny

• Events that combine entry fees with sponsorship or commercial benefits, or that use poker as a marketing device without strict adherence to the trade promotion caps and rules, are likely to provoke closer scrutiny.

These "gotchas" are concrete, text‑derived compliance traps. Practitioners should treat them as focal points for operational controls, record‑keeping and legal review.

The Regulations set out specific, measurable conditions for lawful poker tournaments and for avoiding amusement machines being treated as unlawful instruments. Compliance therefore requires translating the legal text into operational controls. The following is a practical, text‑grounded compliance checklist; each recommended action maps to the relevant regulation.

1. Classify the event: Determine whether the poker event is a general poker tournament under reg 4(2), a trade promotion poker tournament under reg 4(3), or a non‑prize game where no participant could win money or other prize (reg 4(1)(a)‑(c)). The set of applicable duties differs depending on classification.

2. Fees and fee structure

• For trade promotion tournaments, confirm that any entry fee contingent on participation does not exceed $50 per person (reg 4(3)(a)(i)). If you charge a fee greater than $50, do not claim the trade promotion exemption.

• For all tournaments where a fee is charged, ensure each participant pays the same fee (reg 4(2)(a); reg 4(3)(a)(ii)). Implement point of sale systems or ticketing that enforce equal fees.

3. Chips allocation and value

• At commencement, give every participant an identical number and value of poker chips (reg 4(2)(b); reg 4(3)(c)). Document the nominal value associated with each chip type and maintain starting chip count records.

• In general tournaments, do not permit sale or supply of additional chips except through winning during play (reg 4(2)(b)). For trade promotion tournaments, only supply additional chips as permitted: early entry bonuses or in exchange for purchasing food and beverage (reg 4(3)(d)), and ensure any such additional chips do not exceed 20% of the initial chip value (reg 4(3)(d) proviso).

• If offering early entry bonuses or food/beverage exchange chips in trade promotions, compute the aggregate value of such chips relative to the initial chip value and document calculations to evidence compliance with the 20% cap (reg 4(3)(d)).

4. Rules and prize determination

• Prepare comprehensive tournament rules that specify entry conditions, chip values, prize determination, prize allocation method (chip ranking or elimination process), permitted re‑entry (if any), and any circumstances under which prizes may be divided (reg 4(2)(c)‑(f); reg 4(3)(f)‑(i)).

• Determine prizes prior to the tournament and specify them in the rules, subject to the limited rule‑based exceptions that allow prize division (reg 4(2)(d); reg 4(3)(g)). For trade promotions, if monetary prizes are used, specify them either as amounts or percentages of fees collected (reg 4(3)(g) proviso).

• Make a physical copy of the rules available for inspection at the premises at all times during the tournament (reg 4(2)(c); reg 4(3)(f)). Consider posting a prominently visible notice and having printed copies available at each table or a rules desk.

5. Re‑entry and prize mechanics

• For trade promotion tournaments, if you allow eliminated participants to re‑enter, ensure no additional fee is charged for re‑entry and that re‑entry chip allocations do not exceed the initial allocation (reg 4(3)(e)).

• Award prizes only by the permitted methods: chip accumulation ranking or process of elimination as specified in the rules (reg 4(2)(e); reg 4(3)(h)), except where rules expressly provide for prize division (reg 4(2)(f); reg 4(3)(i)).

6. Fee accounting for trade promotions

• Ring‑fence fees collected in trade promotion tournaments and ensure they are used exclusively for payment of prizes (reg 4(3)(b)). Maintain accounting records showing fee collections and prize payments. Avoid diverting entry fees to operational costs, marketing, or other non‑prize uses.

7. Machine compliance

• Review any amusement machines on premises against the criteria in reg 5(2). Do not operate devices that are gaming machines but not approved under the Gaming Machines Act 1992, or that simulate a gaming machine by use or depiction of a spinning reel, or are labelled as gaming machines or pokie, or use gambling words in instructions or operation, unless you accept that such devices will be instruments of unlawful gaming under s 59A as applied by reg 5(1).

• For devices at risk, take corrective steps: remove or alter labelling or marketing describing the device as a gaming machine or pokie; remove gambling words from instructions; alter operation to avoid simulation of spinning reels; or seek any necessary approvals under the Gaming Machines Act 1992 where appropriate.

8. Documentation and evidence

• Keep contemporaneous records demonstrating compliance with the core elements: entry lists showing equal fee payments; chip distribution logs showing equal number and value of chips; signed copies of rules; prize lists and payout records; accounting records demonstrating the use of fees for prizes in trade promotions; receipts for any food and beverage purchases used to provide chips and calculations supporting the 20% cap.

• Retain photographic or video evidence of rules displayed at the premises during the tournament, and of chip stacks at commencement, to address any retrospective enforcement inquiries.

9. Training and signage

• Train staff on the equal fee and chip rules, the prohibition on selling chips in general tournaments, the early entry and food/beverage chip rules for trade promotions, and re‑entry rules. Ensure staff can produce or point to the rules available for inspection.

• Display signage at the entrance and playing area indicating that rules are available for inspection and giving the location of the rules copy, to ensure accessibility for any person at the premises (reg 4(2)(c); reg 4(3)(f)).

10. Legal review and liaison

• Perform a pre‑event legal review to confirm classification of the event, the sufficiency of rules and prize specification, and the accuracy of chip valuations. Where machines are present, have a technical assessment against the reg 5(2) indicia.

• Engage with enforcement agencies or seek formal advice where an organiser is uncertain whether a particular format qualifies as a trade promotion or general tournament, or whether a device may be an unlawful instrument, given that the Regulations feed into enforcement under the Gaming Offences Act 1936 (reg 3; reg 5(1) invokes s 59A).

These steps map directly to the regulatory text. The Regulations do not prescribe document retention periods or reporting obligations, but operationalising these compliance steps will provide the evidence base necessary if enforcement authorities examine an event or a machine under the Act.
