#### 84 Manufacturing or assembling of gaming machines 84 Manufacturing or assembling of gaming machines > > (1) A person who manufactures or assembles a gaming machine is guilty of an offence unless the person— > > > > > (a) holds a dealer’s licence, or > > > > > (b) is a director or secretary of a corporation that holds a dealer’s licence, or > > > > > (c) is an employee of the holder of a dealer’s licence and is doing work as such an employee. > > > > Maximum penalty—100 penalty units or imprisonment for 12 months, or both. > > > (2) The holder of a dealer’s licence who manufactures or assembles a gaming machine otherwise than in accordance with the authority conferred by the licence is guilty of an offence. > > > > Maximum penalty—100 penalty units or imprisonment for 12 months, or both. > > > (3) Subsection (2) does not apply to the manufacture or assembly of a gaming machine by the holder of a dealer’s licence if— > > > > > (a) the Authority has agreed to the making of an application by the licensee to have the gaming machine declared as an approved gaming machine, and > > > > > (b) the manufacture or assembly of the gaming machine is for the purposes of the application and its investigation. > > **s 84:** Am 2011 No 72, Sch 3 \[3\] \[75\]–\[77\].
