55 Other conditions of club licences Each of the following is a condition of a licence for a club: (a) the proceeds from the conduct of gaming are used in a way that promotes the objects of the licensee; (b) the licensee follows its objects or purposes honestly and seriously;
(c) payments made under the licensee’s objects are in the best interests of the licensee’s members; (d) salaries, wages, allowances or benefits paid or payable by the licensee to the licensee’s executive officers and employees are reasonable; (e) payments for services provided to the licensee are reasonable and necessary, particularly in relation to the scale of the licensee’s licensed business; The licensee has 4 gaming machines and pays $150 000 a year for gaming machine advice. This payment is not reasonable because the payment is disproportionately large given the revenues from the 4 machines in relation to which the advice is being given. (f) only members, temporary members and signed-in guests can play gaming machines in the club. Note Signed-in guest—see s 54A. Temporary member—see s 54A.
