GAMING CONTROL (COMMUNITY GAMING) REGULATIONS 2006

Definitions and classification: The Regulations pivot on a suite of defined terms (r 2). Key definitions include approved association (an association granted approval under Part 4), organiser (a person who promotes or conducts gaming), permit (a permit to conduct gaming under Part 3), and several monetary thresholds: major lottery (total ticket value > $20,000), minor lottery ($5,001-$20,000), raffle (≤ $5,000), major trade lottery (prize value > $5,000), and minor trade lottery (prize value ≤ $5,000) (r 2).

Director’s discretion to classify: The Director may determine that a game of chance is a lottery and then apply the lottery classifications prescribed in r 3(1)-(2). The Minister may override by determining a game is not a lottery under s 53 of the Act (r 3(3)), so a game’s regulatory path depends on both the Director’s classification and the statutory backstop in the Act.

Permits versus approvals: The regime separates organisational approval from event permits. Associations must be approved under Part 4 to be “approved associations” (r 42 ff). Some community games may be run without individual event permits but only by an approved association and subject to its conditions of approval , for example, sweepstakes, calcuttas and bingo (r 4), free entry lotteries and attendance lotteries (r 5), raffles (r 6), mini‑lottos and tipping competitions (r 7). By contrast, major and minor lotteries require a permit under Part 3 (r 10), and major trade lotteries also require a permit (r 11).

Trade lotteries and entry fees: The Regulations distinguish between community lotteries and trade lotteries. Minor trade lotteries may be conducted by a person in trade without a permit, but r 18 prohibits charging an entry fee for a minor trade lottery unless entry is incidental to a commercial transaction that has occurred (r 18(1)-(2)). Major trade lotteries require a permit and have a specific condition that no entry fee or valuable consideration be charged except where entry follows and is incidental to a commercial transaction (r 41(1)(e)(ii)).

Prohibited games and prizes: The Schedule lists games that are not to be conducted by persons unless licensed or otherwise permitted under the Act or the Gaming Machine Act 1995 (r 12). The Schedule explicitly names games such as American Roulette, Blackjack, Keno, Poker (all versions), Poker machines, and Two Up. Prizes are also regulated; r 20(1) prohibits prizes that are firearms, ammunition, tobacco products, solely liquor, or solely money and liquor. Liquor may be part of a prize only as a minor component, and cannot be advertised as the major component (r 20(2)-(3)). Additional youth protections require organisers not to award liquor to persons under 18 and provide monetary compensation if a prize cannot be awarded for that reason (r 20(4)-(5)).

Integrity, records and finance: The Regulations impose recordkeeping and financial controls. Organisers must keep full records of entries, prize allocation, income and expenditure, receipts and invoices, and maintain these for set periods (r 24). Specific retention rules require unsold tickets and ticket butts from major or minor lotteries to be kept for 12 months (r 25(1)) and organisers to lodge a statement with the Director within two months of the draw (r 25(2)). Approved associations must have financial records audited annually by a registered company auditor or approved person (r 26). Proceeds must be banked to an ADI as soon as practicable (r 27).

Director’s supervisory powers: The Director may direct the organiser to conduct a draw (r 28), validate or invalidate a draw, order a re‑draw under supervision, or rescind a lottery and require refunds or payment into the Community Benefit Fund (r 29). The Director must investigate complaints (r 30) and has powers to grant, vary or cancel permits (rr 31-35), and to approve or suspend associations (rr 42-47), including immediate suspension where integrity and participant interests are threatened (r 47).

Decision criteria for permits: Applications for major/minor lotteries and major trade lotteries must include detailed particulars (rr 36, 39). In considering applications for major or minor lottery permits the Director must assess good faith, agent or promoter fees, the prize to ticket value ratio (whether prizes exceed one third of total ticket value, r 37(d)), whether entries have equal probability, display of prizes, viability, consistency with the association’s constitution and objects, previous compliance and public interest considerations (r 37).

Administrative sanctions: The Regulations authorise administrative controls rather than criminal penalties for many breaches, but several offences do carry a maximum penalty of 17 penalty units (examples: r 17, r 19, r 20(6), r 24; see specific provisions). The Director’s powers to validate, rescind and demand refunds create concrete remedial outcomes if a lottery is conducted contrary to permit, approval or the Regulations (r 29).

Together, these concepts create a compliance framework where monetary thresholds, the Director’s classifications and discretion, formal approvals, recordkeeping, and specified operational constraints determine who may conduct what games and on what terms.

Primary regulated parties: The Regulations most directly affect associations that wish to run community gaming, persons carrying on trade or business who propose trade lotteries, and organisers who promote or conduct gaming. The definitions in r 2 make the terms precise: an “association” is an entity (religious, charitable, recreational, or otherwise) carrying on activities in the Territory, or any body certified in writing by the Director to be an association for the Act (r 2). An “approved association” is one granted approval under Part 4 (r 2). “Organiser” includes approved associations and authorised persons (r 2).

Authorised persons and governing bodies: The governing body of an association must authorise a member to act as the authorised person before applying for approval (r 42(2)). The authorised person has operational responsibilities: for example, the authorised person must ensure prize‑winners in attendance or membership lotteries are determined within four weeks once the prize amount is reached (r 13). Approved associations must notify the Director of changes affecting the authorised person, the constitution or governance (r 44(1)(b)-(d)).

The Director and administrative actors: The Director holds the decisive supervisory role throughout. The Director may determine whether a game is a lottery (r 3), give directions to persons running interstate trade lotteries (r 9), approve changes to draw details (r 14), validate or rescind draws and direct refunds (r 29), investigate complaints and give directions to resolve them (r 30), grant or refuse permits (r 32), impose or vary conditions on permits and approvals (rr 34-35, 45), and suspend or revoke approvals including immediate suspension in exceptional circumstances (rr 46-47). The practical effect is that most contested or borderline issues (classification, conditions, integrity concerns) fall to the Director.

Third parties: Auditors, banks (ADIs), and agents used by associations are also implicated. Approved associations must ensure their financial records are audited by a registered company auditor within the meaning of the Corporations Act 2001 or by a Director‑approved person (r 26(1)). Proceeds of gaming must be deposited with an authorised deposit‑taking institution (ADI) as soon as practicable (r 27). Agents conducting a lottery on behalf of an association must be disclosed in permit applications and will be considered as to whether disproportionate proceeds are paid to an agent (r 36(1)(i); r 37(c)).

Beneficiaries and fund flows: The Regulations direct unclaimed or refunded amounts to the Community Benefit Fund in specific circumstances. If tickets are unsold due to exclusion from the draw or lotteries are rescinded and purchasers cannot be located, the authorised person must pay amounts to the Director for payment into the Community Benefit Fund (r 16(2); r 29(3)(b)). If unclaimed prizes are not monetary, the Director must sell them and pay proceeds into the Community Benefit Fund (r 23(2)). Thus the Community Benefit Fund is a residual beneficiary of unclaimed or refunded sums under specified conditions.

Who pays: Costs fall to organisers and approved associations. They carry compliance costs , permit and approval application preparation (r 31, r 42(3)), advertising statements where publicity precedes a permit (r 17, penalty), recordkeeping (r 24), retaining unsold tickets and ticket butts (r 25(1)), auditing costs (r 26), banking and administration of proceeds (r 27), and potential refunds if the Director rescinds a lottery (r 29(3)). If the Director orders a refund and purchasers cannot be found, the organiser must pay into the Community Benefit Fund (r 29(3)(b)).

Who decides: Legally, the Director decides classification, permit and approval outcomes, conditions, enforcement steps and remedial directions (rr 3, 31-35, 37-38, 40-41, 42-47, 28-30). Associations’ governing bodies decide whether to apply for approval, nominate the authorised person (r 42(2)), and run gaming within the constraints imposed. Courts and other statutory regulators are not directly invoked in these Regulations; however, offences are specified and could lead to prosecution under the Act or the Regulations (r 29(4) notes this does not affect liability under the Act).

Geographic and cross‑jurisdictional reach: The regime applies to gaming conducted “entirely or partly in the Territory” by associations carrying on activities “in the Territory” (r 2 definition of association). Interstate trade lotteries conducted under a permit in another State or Territory may be run in the Territory without a Territory permit but are subject to Director directions and the interstate permit conditions (r 9).

In summary, the Regulations allocate obligations to organisers and approved associations as primary payers of compliance costs, vest operational and supervisory decision‑making in the Director, and involve auditors, banks and agents as operational third parties. The Community Benefit Fund is the designated repository for certain unclaimed or refunded moneys.

Duties imposed on organisers and approved associations

• Obtain approval and nominate an authorised person: The governing body must apply for approval to the Director and, before applying, must authorise and obtain a signed notice of consent from a member to act as the authorised person (r 42(1)-(3)). Conditions of approval require prompt replacement of the authorised person if they cease to act and timely notification of governing body membership and certain events (r 44(1)(b)-(d)).

• Permit applications where required: An approved association proposing a major or minor lottery, and any person proposing a major trade lottery, must apply for a permit under Part 3 (rr 10-11, 36, 39). Applications must be in an approved form and supply particulars specified in regs 36 or 39, and the Director may request further information (r 31(1)-(3); r 36(1); r 39(1)).

• Conduct draws and publicise results: Draws must be conducted per the rules and permit conditions. If a major or minor lottery draw is held, the association must publish results per the rules and permit conditions or, absent those, in a newspaper circulating locally within 14 days; prizes valued $1,000 or more require publication of the prize‑winner’s name (r 15).

• Preserve and maintain prizes: Organisers must carefully preserve all prizes until awarded or disposed of under the Regulations; real property prizes must be maintained, insured for full market value, and the organiser is liable for outgoings until transfer (r 21(1)-(3)).

• Substitution, unclaimed prizes and refunds: Substitution of a prize requires the Director’s approval, with specified particulars and evidence to accompany an application; where a ticket sold by an approved association is not included in the draw, the authorised person must take reasonable steps to refund the purchaser within 60 days, or remit the payment to the Director for the Community Benefit Fund if the purchaser cannot be located (r 16; r 22; r 23).

• Records, audits and banking: Full written records in English of entries, prize allocation, income and expenditure must be kept; classification‑specific retention periods apply (r 24). Unsold tickets and butts for major/minor lotteries must be kept 12 months (r 25(1)); approved associations must lodge a post‑draw statement within two months (r 25(2)); and approved associations must ensure annual audits of gaming financial records by a registered company auditor or Director‑approved person, and lodge qualified reports promptly (r 26). Proceeds must be banked with an ADI as soon as practicable (r 27).

• Equality of chance and conduct integrity: The Regulations require each entry to have equal probability of winning the major prize in lotteries (r 38(f)(iii); r 41(1)(e)(iii); r 18(3) for minor trade lotteries). The Director will consider whether the lottery will be conducted in good faith and whether disproportionate amounts will be paid to agents (r 37(b)-(c)).

• Advertising and pre‑permit publicity: If an organiser publicises a lottery before a permit is granted, the publicity must state that the lottery is subject to the grant of a permit and will not proceed without it; failure to do so carries a maximum penalty of 17 penalty units (r 17).

Rights and administrative protections

• Rights to apply and be heard: Applicants for permits and approvals have procedural rights: the Director must provide written reasons for a refusal to grant a permit or to refuse approval (r 32(2); r 43(4)). For proposed suspension or revocation of approval the Director must give notice of the proposal and allow the governing body 14 days to make written submissions; the Director must consider submissions (r 46(2)-(3)).

• Director’s discretion with reasons: When the Director refuses approval or varies conditions, written notice stating reasons is required (r 32(2); r 45(1)). Where the Director refuses a change of draw particulars, the Director must give reasons (r 14(2)).

• Remedies where a lottery is conducted improperly: If a lottery has been conducted contrary to the Regulations, a permit or approval, the Director may validate the draw, invalidate and direct a supervised re‑draw, or rescind the lottery and direct the organiser to take remediating action including refunds (r 29(2)-(3)). These are administrative remedies rather than immediate criminal sanctions, although liability for offences under the Act or the Regulations can still be pursued (r 29(4)).

• Complaint and investigation process: A dissatisfied person may lodge a written complaint (r 30(1)); the Director must take reasonable steps to investigate (r 30(2)) and may direct remedial action consistent with the Act and Regulations to resolve the complaint (r 30(3)).

• Immediate suspension in exceptional cases: The Director may immediately suspend an association’s approval where an act or omission threatens the integrity of a game and the interests of participants; notice must be given with reasons and an opportunity for the governing body to make submissions within 14 days (r 47(1)-(3)).

Operational constraints that function as duties

• Prohibited games: A person must not conduct a game listed in the Schedule unless otherwise permitted by the Act or the Gaming Machine Act 1995 (r 12), including casino games and poker machines.

• Prohibited prizes and age restrictions: Prizes comprising firearms, ammunition, explosives, tobacco products, solely liquor, or solely money and liquor are forbidden (r 20(1)). Liquor can be included only as a minor element and cannot be advertised as a major prize component (r 20(2)-(3)). Organisers must not award liquor or otherwise prohibited goods to under‑18s and must instead pay a monetary equivalent (r 20(4)-(5)).

• Equal probability requirement and advertising: Organisers must ensure equal probability of winning major prizes and must adequately display or describe prizes in permit applications and advertising (r 36(1)(h); r 37(e); r 38(e)).

Sanctions and penalties

• The Regulations specify a maximum penalty of 17 penalty units for a number of contraventions (see r 17, r 19, r 20(6), r 24(3), r 26(3), r 27, r 30(4), r 47(5), among others). The Director’s administrative powers , validation, rescission, suspension and revocation , are additional enforcement tools (rr 29, 46-47).

In sum, duties are operational and administrative (applications, records, audits, banking, prize maintenance) and substantively aim to protect integrity (equal probability, prohibited games/prizes). Rights are primarily procedural , notifications, reasons, and short windows to make submissions before suspension or revocation.

Sanction framework in the Regulations

• Specified monetary penalties: Several provisions expressly state offences with a maximum penalty of 17 penalty units for contraventions, for example the requirement to state a lottery is subject to permit when publicised early (r 17), restrictions on advertising and entry for certain clubs (r 19), prohibited prizes in calcutta/sweepstake/bingo (r 20(6)), failure to keep records (r 24(3)), failure to produce qualified audit reports to the Director (r 26(3)), failure to bank proceeds (r 27), failure to comply with Director directions (r 30(4)), and contravening conditions in an immediate suspension notice (r 47(5)). These are the specified criminal or regulatory penalties in the Regulations.

• Residual liability under the Act: The Regulations note that action under r 29 (draws conducted contrary to the Regulations, permit or approval) does not affect liability to be prosecuted for offences against the Act or the Regulations , so enforcement can be both administrative and criminal as per the Act (r 29(4)).

Administrative enforcement and remedial powers

• Director’s supervisory and remedial powers: The Director is provided with several administrative tools:

  • Direction to conduct a draw: If circumstances require, the Director may direct an organiser to conduct the draw and award prizes (r 28).

  • Validation, invalidation and re‑draws: If a lottery was conducted contrary to these Regulations, a permit condition or an approval, the Director may validate the draw or invalidate it and direct a further draw under conditions the Director considers appropriate, including supervision (r 29(2)(a)-(b)).

  • Rescission and refunds: The Director may rescind a raffle, major or minor lottery and direct the organiser to take certain actions, including refunding purchasers within 60 days or paying the amounts to the Director for deposit into the Community Benefit Fund if purchasers cannot be located (r 29(2)(c); r 29(3)).

  • Complaint investigation and directions: The Director must investigate written complaints and may direct parties to adopt, vary or cease practices in conduct of a game, and give directions to resolve complaints, including directions about awarding prizes consistent with the Act and Regulations (r 30(1)-(3)). Failure to comply with a Director’s direction is an offence carrying a maximum penalty (r 30(4)).

• Conditions, variation, suspension and revocation: The Director may impose, vary or revoke conditions on permits and approvals, cancel permits, and suspend or revoke an association’s approval where specified grounds exist (materially false information, contraventions, integrity concerns, acting contrary to constitution or public interest, inconsistent constitutional alterations) (rr 34, 45-46). The Director must notify the governing body of proposals to suspend or revoke and allow 14 days for submissions; after considering submissions the Director decides (r 46(2)-(3)). Suspension can be immediate in exceptional circumstances where integrity and participant interests are threatened (r 47).

Procedural protections and timing

• Notices and reasons: The Regulations require the Director to give written notice stating reasons when refusing permits or approvals (r 32(2); r 43(4)), for variations or revocations of approvals (r 45(1)), and for proposed suspension or revocation (r 46(2)). For immediate suspension the Director must give a notice of reasons and provide 14 days to make submissions (r 47(3)).

• Timelines for remedial steps: If the Director rescinds a lottery the organiser must take specified steps within fixed timeframes , for example, make refunds within 60 days or pay the sums to the Director (r 29(3)). If a raffle/lottery ticket sold by an association is not included in a draw, the authorised person must take all reasonable steps to refund within 60 days or pay to the Director (r 16(1)-(2)).

Financial consequences and fund flows

• Community Benefit Fund as sink for unclaimed/refunded sums: The Regulations provide that where refunds cannot be completed or prizes remain unclaimed and are money, or sale proceeds of non‑monetary prizes, they must be paid into the Community Benefit Fund via the Director (r 16(2); r 23(2); r 29(3)(b)).

• Audit consequences: If an audit report issued to an approved association is qualified, the association must submit a copy of the report to the Director within 14 days (r 26(3)). The Director can require copies of audit reports by written notice (r 26(4)). Failure to comply with these audit and reporting duties is an offence with a maximum penalty (r 26(3)).

Enforcement modalities and practical impact

• Combination of administrative control and monetary penalties: The enforcement model favours administrative control , the Director can validate/void draws, rescind lotteries, impose conditions, suspend approvals and direct refunds. Monetary sanctions (17 penalty units) are attached to a range of breaches typically of recordkeeping, advertising, prize and procedural duties. Criminal prosecution under the Act remains available. The Regulations thereby create immediate administrative levers for harm‑limitation and restoration (re‑draws, refunds, suspension), while allowing prosecutorial responses for serious or repeat breaches.

• Low thresholds for administrative action: Several provisions permit immediate suspension where integrity is threatened (r 47), and the Director has broad discretion in classifying games and imposing conditions (r 3(1); r 37(f); rr 34-35). This creates a compliance environment where the Director’s supervisory interventions can be used to prevent ongoing harm before prosecutions are pursued.

In short, enforcement mixes administrative remedies (validation, rescission, direction, suspension) and prescribed monetary penalties, with a default route to the Act for prosecution. The Director’s range of actions is broad and backed by specified timeframes, notice and submission rights to provide procedural safeguards.

Direct textual cross‑references

• The Regulations operate under the Gaming Control Act 1993 (the Act). They regularly cross‑reference the Act for the Director’s powers and limits. For example, reg 3(3) notes the Minister may determine under s 53 of the Act that a game is not a lottery. Reg 29(4) expressly states that the Director’s actions do not affect liability to be prosecuted for an offence against the Act or the Regulations. The base statutory authority for permits and approvals sits in the Act; these Regulations implement details under that enabling Act.

• The Schedule and r 12 reference the Gaming Machine Act 1995: conduct of games listed in the Schedule is prohibited “for section 47(b) of the Act”, but r 12(2) permits conduct of a Schedule game where allowed by the Act or the Gaming Machine Act 1995. Thus licensed casino or machine operators operating under that separate regulator can be excluded from the Schedule’s general prohibition where their licence or the other Act permits the games.

• Corporations Act 2001: Auditors must be “registered company auditors within the meaning of the Corporations Act 2001” or be otherwise approved by the Director (r 26(1)). That links auditor qualifications to the federal Corporations Act licensing and registration regime.

• Associations Act 2003: In r 44(1)(d)(vi) the Regulations reference “the Director as defined in section 4 of the Associations Act 2003” when listing a ground for notifying the Director (that the Director of the Associations Act or a court orders dissolution). Thus the associations’ corporate status, incorporation and dissolution processes under the Associations Act interact with approvals under these Regulations.

Money flows and funds under broader public law

• Community Benefit Fund: The Regulations prescribe payment of certain unclaimed or refunded monies to the Community Benefit Fund (rr 16(2), 23(2), 29(3)(b)). The Community Benefit Fund is a Territory instrument for distribution of certain gaming proceeds; the Regulations feed funds into that public mechanism. The broader governance, use and audit of that Fund will be governed by other Territory laws or administrative rules not contained in these Regulations, but the Regulations establish one source of inflows.

Interstate permits and extraterritorial activity

• Interstate trade lotteries: Reg 9 allows a person carrying on trade in the Territory to conduct an interstate trade lottery without holding the Territory’s permit, provided a permit was granted in another State or Territory and the result is determined there. However, the person remains subject to directions by the Director and must not contravene the Director’s directions, these Regulations or conditions of the interstate permit (r 9). That creates a coordination point between State/Territory permits and Territory oversight.

• Potential conflicts: The Regulations give the Director the power to direct persons conducting interstate trade lotteries (r 9(2)) and to act if a lottery is conducted contrarily to these Regulations (r 29). This means, in practice, that interstate permit holders operating in the Territory must comply with Territory direction and may be required to remedy conduct even if their permit was granted interstate. The Regulations themselves do not resolve differences of substance between jurisdictions’ permit conditions; they impose Territory oversight and remedial authority.

Regulatory layering and corporate law interactions

• Corporate auditing standards: By tying audit qualifications to the Corporations Act, the Regulations ensure that audits of associations’ gaming records will meet nationally recognised standards where a registered company auditor is used (r 26(1)-(2)). Associations that are corporations may therefore use existing corporate governance frameworks to satisfy these Regulations.

• Licensing and repeals: Endnotes record the Licensing (Repeals and Consequential Amendments) Act 2014 and later amendments including the Licensing (Director‑General) Repeal Act 2020 and the Justice and Licensing Legislation Further Amendment Act 2022 as part of the legislative history. These connected Acts changed administrative structures (for example deleting a Director‑General role) and required textual updates; the Regulations’ Endnotes list which regs were amended (Endnotes 2-4). Practitioners should read the primary enabling Act and related Territory legislation for any cross‑cutting licensing or administrative changes.

Criminal law and age restrictions

• Offences in other Territory laws: The Regulations enforce certain age restrictions with a civil/regulatory remedy (r 20(4)-(5) requires monetary compensation if a prize including liquor cannot be awarded to a person under 18). However, sale and supply offences under the Territory’s liquor, tobacco or weapons laws remain independently applicable; the Regulations do not displace those prohibitions but supplement them with gaming‑specific rules about prizes.

Administrative law and natural justice

• Procedural safeguards: The Regulations require written reasons for refusals or proposed suspensions and provide 14 days to make submissions for proposed suspensions or revocations (r 46). Immediate suspension requires notice and an opportunity to submit within 14 days (r 47). Those requirements reflect administrative law principles; however, the Regulations also confer broad discretion to the Director in classifying games (r 3) and in varying conditions (r 34) subject to procedural notice.

Taken together, the Regulations are not standalone: they operate inside a matrix of Territory Acts (the Gaming Control Act, Gaming Machine Act, Associations Act), federal law for corporate auditors, and interjurisdictional permit regimes for interstate lotteries. They create Territory‑specific controls and remedies while relying on external statutes for certain qualifications and for parallel licensing frameworks.

Statutory timeline in the Regulations’ Endnotes

• Initial instrument and commencement: The Gaming Control (Community Gaming) Regulations (SL No. 6, 2006) were notified 15 February 2006 and commenced 15 February 2006 (Endnote 2).

• Penalties Amendment (Justice and Treasury Legislation) Act 2010 (Act No. 38 of 2010): Assented 18 November 2010 and commenced 1 February 2011. The Regulations record amendments to multiple provisions following this Act, for example rr 17, 19-20, 26, 27, 29-30, 47 among others (Endnotes 2 and 4 list rr 17, 19-20, 24, 26, 27, 29-30, 47 as amended by Act No. 38, 2010).

• Licensing (Repeals and Consequential Amendments) Act 2014 (Act No. 44 of 2014): Assented 5 December 2014 and commenced 1 January 2015. This amending Act produced numerous textual amendments across the Regulations; Endnote 4 lists many regs amended by Act No. 44, 2014 including rr 2-3, 9, 14, 16, 22-23, 25-29, 31-32, 34, 36-37, 39-40, 42-46 (see list for exact regs). These changes likely corrected cross‑references and administrative titles following the repeal of certain licensing instruments.

• Gaming Control (Community Gaming) Amendment Regulations 2017 (SL No. 38, 2017): Notified and commenced 29 November 2017; reg 5 was amended by this instrument (Endnote 2 and 4 list r 5 amended No. 38, 2017 r 4).

• Licensing (Director‑General) Repeal Act 2020 (Act No. 4 of 2020): Assented 9 March 2020 and commenced 14 April 2020 (Gaz G13, 1 April 2020). Endnote 4 records that many regulations were amended by Act No. 4, 2020 to remove references to Director‑General or to adjust administrative roles (rr 2-3, 9, 14, 16, 22-23, 25-29, 31-32, 34, 36-37, 39-40, 42-46 among others).

• Justice and Licensing Legislation Further Amendment Act 2022 (Act No. 21 of 2022): Assented 31 October 2022. Commencement: part 3 commenced 1 February 2023; remainder commenced 21 December 2022 (Gaz G50, 21 December 2022). Endnote 2 records the commencement dates and Endnote 4 shows that r 44 was amended by Act No. 21, 2022 s 50.

• General amendments of a formal nature: The Interpretation Legislation Amendment Act 2018 (Act No. 22, 2018) made general amendments of a formal nature to rr 1, 2, 12, 44 and 48 (Endnote 3).

Regulatory items amended and their apparent focus

• Administrative title changes and cross‑references: The 2014 and 2020 licensing Acts, plus the 2018 interpretation amendments, appear to have modernised or corrected references to administrative offices (for example Director‑General) and adjusted cross‑statute references. The Endnotes list which regulations were formally amended. Practitioners should consult the consolidated, current reprint (the version at 1 February 2023 in the materials) for the operative text.

• Penalty adjustments: The Penalties Amendment Act 2010 (Act No. 38, 2010) amended penalty provisions in several regs (Endnote 4 lists rr 17, 19-20, 24, 26, 27, 29-30, 47). The Reprint reflects those updated penalty formulations (for example many regs record a maximum penalty of 17 penalty units).

• Specific operational provisions: The 2017 Amendment Regulations (SL No. 38, 2017) amended r 5 (free entry lotteries), which likely adjusted the attendance or membership lottery rules, cap amounts or administrative requirements. Endnotes identify which regs were subject to that Regulations instrument.

Reprints and currency

• The Regulations as provided are “As in force at 1 February 2023” and include Endnotes that identify the successive amending Acts and statutory instruments. The Endnotes give specific citation and commencement data for each amendment, and list which regs each amending instrument altered (Endnote 4 provides a mapping of regs to amending Acts).

Gaps and where to check original instruments

• The Endnotes record the SL (Subordinate Legislation) numbers and dates for the Regulations and the amending legislative Acts. For historical versions or to trace the effect of a particular amendment on a specific paragraph, practitioners should review the original amending instruments or the Territory’s legislation database to view the tracked changes across versions.

• The Explanatory Note and Gazette references given in Endnote 2 (for commencement dates) provide the official commencement notices and should be consulted where timing of obligations matters for transitional compliance.

Takeaway for practitioners

• The Regulations have been amended multiple times since enactment in 2006 for reasons largely administrative (administrative office name changes and penalty structure) and substantive (penalty adjustments, procedural clarifications). The current operative text in the reprint consolidates those amendments to 1 February 2023. For compliance, approvals, or historical challenges, check the relevant amending Act(s) listed in the Endnotes and the legislative reprint to ensure obligations and rights are interpreted against the correct statutory version and commencement dates.

What the instrument itself records

• The Regulations as reprinted do not record any case law, judicial decisions, or litigation outcomes. There are no named cases, corrective judicial pronouncements, or annotated judicial history included in the text. The Endnotes provide only the statutory amendment history and formal commencement details; they do not record litigation.

Implication for legal research

• The absence of litigation references in the Regulations means the Regulations’ text must be read alongside external sources to locate any judicial interpretation, administrative tribunal decisions, prosecutions or appeals that might interpret the Director’s discretion, the classifications in r 3, the scope of prohibited games in the Schedule, or the application of penalty provisions. This is a common gap: subordinate regulations rarely contain litigation annotations.

Recommended next steps (procedural, not legal advice)

• Search Territory and Federal law reports, the Northern Territory Courts and Magistrates Court databases, and administrative review records for decisions mentioning the Gaming Control (Community Gaming) Regulations 2006, the Director under the Gaming Control Act 1993, or prosecutions under the Act. Also check decisions about the Community Benefit Fund and about approvals or suspensions under r 46-47.

• Check enforcement notices, public registers and the Director’s published decisions (if any), because the Director’s validation or rescission of a lottery (r 29) or suspension of an approved association (r 46-47) could have produced administrative decisions or reviews that illuminate how those powers are applied.

Caveat

• The Regulations themselves do not enumerate litigation history; absence here is not evidence that no litigation exists. For authoritative statements about litigation, consult legal databases and Territory court and tribunal registers.

Classification by the Director: r 3(1) permits the Director to determine that a game of chance is a lottery and then to apply the defined class thresholds in r 3(2). That means organisers cannot assume classification; the Director’s view can shift a game into a higher regulatory band (major/minor/raffle) with attendant permit requirements and obligations. Practically, a game that looks like a casual raffle could be treated as a minor or major lottery if ticket value calculations exceed the thresholds.

Monetary thresholds and their operational consequences: The thresholds in r 2 and r 3 are mechanical but can be sensitive to how “total value of tickets available for sale” and “value” are calculated (r 2 value definitions refer to retail, market value, etc.). Small changes in ticket price or number available can move an event from a no‑permit to a permit category, triggering application timelines (r 36), retention rules (r 25(1)), and audit obligations (r 26).

Free entry and attendance lotteries: While r 5 allows attendance or membership lotteries without a permit, r 5(2) caps prizes for such free entry lotteries at $10,000. Organisers must ensure a genuine free entry construct , if entry requires purchase or other valuable consideration, the free‑entry exemption is lost and a permit may be required. The Regulations also require prize determination within four weeks for attendance or membership lotteries once the prize reaches the offered amount (r 13).

Minor trade lottery entry fee trap: r 18(1) states a person conducting a minor trade lottery must not charge an entry fee, but r 18(2) allows entry as conditional on a commercial transaction where the chance to win is secondary. Structuring commercial promotions to fit r 18(2) requires careful design: the chance to win must be genuinely secondary and occur after and as a result of the transaction. Mis‑structuring risks classification as a prohibited charged raffle or trade lottery and enforcement action.

Equal probability requirements: Multiple provisions demand that each entry have equal probability of winning the major prize (r 18(3), r 38(f)(iii), r 41(1)(e)(iii)). That applies operationally to ticket numbering, draw methodology and any promotional discounts. For example, offering discounted bulk ticket bundles with preferential draw treatment could breach equal probability obligations.

Prize composition and advertising: r 20 bans prizes of certain goods entirely and restricts liquor as part of prizes to a minor component; liquor must not be advertised as a major component. Organisers advertising a prize bundle that includes liquor prominently may breach r 20(3) even if liquor is a small element. Also r 20(4)-(5) require monetary compensation if an under‑18 wins a prize including liquor; event organisers must have age verification and substitution processes ready.

Substitution and Director approval: r 22 requires Director approval to substitute prizes, with documentary evidence and notification steps where prize value is $500 or more. Substituting without approval, or advertising a prize that cannot be awarded as described, can lead to Director remedies or rescission (r 29). This is operationally significant where donated prizes may become unavailable.

Recordkeeping and ticket retention: r 24 requires that records be kept in English and retained for set periods (7 years for major or trade lotteries > $20,000 in prizes, 2 years for others). r 25 requires unsold tickets and butts for major/minor lotteries be kept for 12 months. Failure to maintain these documents may lead to penalties and weaken the organiser’s position if the Director investigates or validates a draw.

Audit obligations: r 26 requires annual audits by a registered company auditor (Corporations Act) or Director‑approved person; a qualified audit report must be supplied to the Director within 14 days. Associations should budget for audit fees and ensure internal records can support an unqualified report. The Director can require copies of audit reports (r 26(4)); non‑compliance is an offence.

Director’s broad remedial powers and timing: r 29 gives the Director power to validate, invalidate, order re‑draws under supervision, or rescind lotteries. Where rescission occurs, organisers must refund purchasers within 60 days or pay to the Community Benefit Fund if purchasers cannot be located (r 29(3)). Organisers should have funds available to make refunds promptly to avoid the reputational and financial fallout of rescission.

Immediate suspension and integrity standard: r 47 allows immediate suspension if an act threatens the integrity of a game and participants’ interests. The immediacy can disrupt ongoing events and create urgent operational risk. The authorised association has 14 days to make submissions but must comply with any conditions in the suspension notice (r 47(3)-(5)).

Interstate trade lottery oversight: Although r 9 allows interstate trade lotteries with an interstate permit to be conducted in the Territory without a Territory permit, the organiser remains subject to Territory direction. That means interstate permit holders must watch for Territory direction and potential inconsistencies with their interstate permit’s conditions.

Prohibited games list: The Schedule lists specific games that cannot be conducted unless permitted by the Act or the Gaming Machine Act 1995 (r 12). Practitioners must check whether a game falls within a listed name or is “substantially similar” (definition for calcutta and sweepstake includes “or a substantially similar manner” in r 2), because a game labelled differently but functionally equivalent to poker or keno could be treated as a Schedule game.

Advertising before a permit: r 17 requires that organisers state publicity before a permit is granted includes a statement that the lottery is subject to grant of permit and will not proceed if not granted. Failure to do so carries a penalty (17 penalty units). This is an easy compliance gap for promoters used to pre‑selling tickets.

Banking proceeds and ADI requirement: r 27 requires that proceeds be paid into an account at an ADI “as soon as practicable” after conducting a game. Cash handling risks and banking lag can create procedural breaches; associations must have processes to bank proceeds promptly.

Unclaimed prizes and perishable goods: r 23 provides specific handling rules. Non‑perishable unclaimed prizes must be paid or delivered to the Director after 3 months and will be sold for the Community Benefit Fund (r 23(1)-(2)). Perishable goods may be disposed of by the approved association to bring a reasonable price and applied to the association’s aid and support (r 23(3)). Organisers should manage prize claims actively to avoid turnover to the Director.

Procedural timelines: There are many short deadlines (e.g. lodge a statement within 2 months of draw r 25(2); submit a qualified audit report within 14 days r 26(3); 60 days for refunds r 16(1)). Failure to meet these timelines can trigger penalties, Director intervention, or administrative notices.

In short, the gotchas are practical and procedural: classification risk, threshold‑driven permit exposure, strict recordkeeping/audit/retention rules, prize composition constraints, pre‑permit publicity requirements, Director’s immediate intervention powers, and the financial consequences of rescission or forced refunding. Each of those matters has a clear textual anchor in the Regulations referenced above.

Preliminary steps: structure and approvals

1. Decide whether the organiser is an association or a person in trade and, if an association, apply for approval under Part 4 (r 42). Before applying, the governing body must authorise a member to act as the authorised person and obtain a signed notice of consent (r 42(2)-(3)). Prepare the application in the approved form and attach incorporation documents, the constitution, governing body member identification and the authorised person’s consent (r 42(3)(a)-(d)). Expect the Director to request additional information (r 42(4)).

2. Review and, if necessary, amend the constitution prior to approval if the Director requires it (r 43(2)). Ensure the constitution authorises fundraising in the manner proposed (r 37(h)) and that the objects and purposes align with the lottery purpose (r 37(i)).

Classification and permit planning

3. Determine the classification early by calculating the total value of tickets available for sale and total prize value using the definitions in r 2. If ticket value could exceed $5,000 or $20,000, plan for a minor or major lottery permit and allow time for the Director’s decision (r 3(2), r 36). For trade lotteries, check whether prize total exceeds $5,000 (major trade lottery) which triggers a permit (r 2 definitions; r 11).

4. If conducting a raffle, sweepstake, calcutta, bingo, free entry lottery, mini‑lotto or tipping competition and you are an approved association, confirm you comply with conditions of approval rather than seeking a permit (rr 4-7). For minor trade lotteries conducted by a person in trade, ensure no entry fee is charged unless entry is genuinely incidental to a commercial transaction (r 18).

Prepare permit applications properly

5. For major/minor lottery permits, assemble the particulars required by r 36(1): name/address of association and authorised person, purpose of the lottery, full rules and method of determining winners, ticket numbers and prices, sale period, draw details, draft ticket layout, prize descriptions and values, display locations, and whether an agent will conduct the lottery and the expected impact of agent fees on proceeds (r 36(1)(a)-(i)). The Director may require extra particulars (r 31(3), r 36(2)). Consider the Director’s assessment criteria (r 37) and preemptively address questions about good faith, agent remuneration, prize to ticket value ratios (r 37(d)), viability (r 37(g)), prior compliance (r 37(j)), and public interest (r 37(l)).

6. For major trade lottery permits, include the particulars in r 39(1). For both permit types, ensure rules make clear that each entry has equal probability of winning the major prize (r 38(f)(iii); r 41(1)(e)(iii)).

Operational compliance: draws, advertising and prizes

7. Conduct draws per the rules and permit conditions. For attendance or membership lotteries, determine winners within four weeks after the prize amount is reached (r 13(1)). If an unexpected event prevents the draw, apply to the Director to change date, time or place (r 14(1)-(3)) and satisfy any public notice requirements (r 14(3)).

8. When publicising a lottery prior to permit grant, include the explicit statement that the lottery is subject to grant of a permit and will not proceed without it (r 17). Non‑compliance carries a penalty (r 17).

9. Ensure prize composition complies with r 20. Do not offer firearms, ammunition, tobacco, solely liquor or solely money and liquor as prizes. If liquor forms part of a prize it must be a minor component and not advertised as the major component (r 20(1)-(3)). Implement age verification procedures and a monetary compensation mechanism if a person under 18 wins a prize that cannot lawfully be supplied (r 20(4)-(5)).

Records, audits and financial controls

10. Maintain full written records in English of entries, prize allocations, income and expenditure (r 24(1)-(2)). Retention periods: for a major lottery or a trade lottery where total prizes exceed $20,000 retain records for at least 7 years after prizes are awarded; for all other games retain for 2 years (r 24(3)). Keep unsold tickets and butts from major or minor lotteries for 12 months unless the Director approves a shorter period (r 25(1)).

11. Lodge with the Director a post‑draw statement within 2 months after the draw in a major or minor lottery detailing unclaimed prizes, money received, sources, and expenses (r 25(2)). Prepare to supply documentary evidence of prize values and steps to inform participants when applying to substitute a prize in cases involving prizes valued at $500 or more (r 22(2)-(4)).

12. Ensure approved associations secure an annual audit of gaming financial records by a registered company auditor under the Corporations Act or Director‑approved person, and obtain an unqualified opinion where feasible. If an audit report is qualified, lodge it with the Director within 14 days (r 26(1)-(3)). Keep accounting systems reconciled and document discounts, rebates or allowances for items offered as prizes (r 24(2)(c)).

13. Bank proceeds into an account at an ADI “as soon as practicable” after conducting a game (r 27). Implement cash control and banking procedures to make this process auditable and timely.

Operational risk controls and contingency planning

14. Prepare contingency plans for prize substitution and unclaimed prizes. For prize substitution apply in writing to the Director with required particulars and documentary evidence (r 22). For unclaimed prizes, follow r 23: after 3 months, approved associations must deliver non‑perishable unclaimed prizes to the Director; the Director will pay money into the Community Benefit Fund or sell non‑monetary prizes and pay proceeds into the Fund (r 23(1)-(2)). Perishable goods may be sold and proceeds used by the association (r 23(3)).

15. Maintain participant‑facing disclosure and ticket layout documentation that matches permit particulars (r 36(1)(g)-(h); r 38(a), (d)). Ensure the prize display and description in promotional materials accurately reflect permit information (r 37(e); r 38(e)).

Responding to Director interventions

16. If the Director proposes to vary conditions, suspend or revoke approval, use the statutory windows for submissions: 14 days to make written submissions against a proposed suspension or revocation (r 46(2)). For immediate suspensions, the Director must give reasons and allow 14 days for submissions (r 47(3)).

17. If a draw is invalidated or a lottery rescinded, act promptly to make refunds within 60 days or, if purchasers cannot be located, remit the amounts to the Director for payment into the Community Benefit Fund (r 29(3); r 16(1)-(2)). Establish a purchaser tracing and refund process , maintain purchaser contact details and records of all ticket sales to minimise the risk of funds being paid to the Community Benefit Fund.

Operational checklist summary (short form)

• Pre‑approval: authorise authorised person, assemble incorporation/constitution documents, apply to Director (r 42).
• Classification: calculate ticket and prize totals, determine permit need under r 3 and r 2.
• Permit application: prepare r 36 or r 39 particulars, anticipate Director’s assessment criteria (r 37).
• Advertising: include pre‑permit statement if publicising early (r 17).
• Draw conduct: follow rules, publish results per r 15, ensure equal probability.
• Prize handling: preserve, insure and maintain real property prizes (r 21).
• Substitution/unclaimed prizes: follow r 22 and r 23.
• Records and audits: keep records in English, retain per r 24, r 25, audit under r 26.
• Banking and proceeds: bank to ADI promptly and document receipts (r 27).
• Compliance readiness: plan for Director directions, have submission pack ready for any proposed suspension or revocation (rr 46-47).

Documentary evidence and ongoing governance

• Maintain a permit file containing the permit notice, conditions, application materials, ticket proofs, advertising materials, prize valuation documents, and audit reports. This file supports both compliance with the Director’s post‑draw statement requirement (r 25(2)) and rapid response to complaints or Director investigations (r 30).

• Train the authorised person(s) and governing body members on specific obligations: timelines for draws and refunds, retention periods, audit obligations, and the Director’s remedial powers. That reduces operational slip risks that frequently trigger administrative remedies or penalties.

Following this mapped checklist and aligning operations to the specific textual duties in the Regulations (rcitations detailed above) substantially reduces the likelihood of regulatory intervention, and places the organiser in a position to satisfy the Director’s reasonable informational and remedial requests.
