78Forfeiture

78 Forfeiture (1) Where a person is found guilty of an offence against this Act, then, whether or not a conviction is entered or a penalty imposed, an instrument of gaming, amusement machine, ticket dispensing machine or any other instrument, article, equipment, device or thing used in or in relation to the commission of the offence is forfeited to the Crown and may be kept, sold, destroyed or otherwise disposed of as the Director thinks fit. (2) A forfeiture under subsection (1) is in addition to and not in substitution for any other penalty imposed by a court in relation to the offence. (3) Money forfeited under this section is to be paid into the Community Benefit Fund.
