60 Place for unlawful gaming (1) Subject to this section, a place is used for unlawful gaming if it or a part of it: (a) is used for or in connection with: (i) a lottery, calcutta, sweepstake or game of bingo which is not authorised by this Act or, being authorised, is not conducted in accordance with this Act; or (ii) an unlawful game; or (b) is opened, kept or used for the purpose of the owner, occupier or keeper of it, or a person using it, or a person procured or employed by or acting for or on behalf of the owner, occupier or keeper, or person using it, or of a person having the care or management or in any manner conducting the business thereof, conducting or participating in unlawful gaming with persons resorting to the place. (2) A casino is not a place used for unlawful gaming in respect of operations conducted in the casino that are permitted under this Act.
