Compliance requires a two‑strand approach: (1) identify and comply with the substantive applied Commonwealth provisions as they operate in Tasmania, including any textual modifications in the Schedules; and (2) follow the procedural and transactional obligations this Act imposes at the Tasmanian level, especially in relation to fees, lodgments and evidentiary proof.
Step 1 , establish whether the activity falls within the applied provisions: Start by determining whether your person or entity and the activity you undertake are within the scope of the Commonwealth Act as it was in force on 31 December 1990, bearing in mind any changes made by Schedule 1. Section 5 imports the Commonwealth Act as at that date (s 5). You must read the applied provisions themselves and the Schedule 1 modifications to confirm capture.
Step 2 , consult Schedule modifications and the Companies and Securities interpretative framework: Read Schedules 1-3 to identify Tasmanian textual changes to the Commonwealth Act, Regulations and Fees Schedule respectively (s 5; s 6; s 7). Also consult the Companies and Securities (Interpretation and Miscellaneous Provisions) (Application of Laws) Act 1981 because that Act expressly applies to the Futures Industry (Tasmania) Code and will affect interpretation and operation (s 4).
Step 3 , confirm operative versions and monitor state updates: Because the Act adopts a particular historical version of the Commonwealth instrument, confirm the operative Tasmanian text before acting. Check whether the Governor has made any regulations under s 8 or s 14 implementing Ministerial Council-approved changes. Also verify whether the Minister has authorised a published Futures Industry (Tasmania) Code, Regulations or Fees Schedule under ss 9-12, and inspect those published documents as prima facie evidence of operative provisions and dates (ss 9(3), 10(3), 11(3), 12(3)).
Step 4 , pay and reconcile fees correctly: If the relevant action attracts a fee under the applied provisions, identify the applicable fee item in the Commonwealth Fees Regulations and map it against Schedule 3 modifications (s 7(1)). Submit lodgments only with the correct fee payment; a document submitted without payment is deemed not to have been lodged until the fee is paid (s 7(2)), and the Commission or Ministerial Council will not perform an act involving their doing of any act until the fee has been paid (s 7(3)). Where the fee is disputed or creates hardship, consider applying to the Commissioner for a waiver, reduction or refund under s 7(5).
Step 5 , plan for subpoenas and production costs: For subpoena-driven production of registers and documents held by the Commission, anticipate that fees may be payable for production (s 7(1)(c)) and that production may be withheld until payment is made (s 7(3)). Factor fee payment into timelines and client advice when seeking compelled documents.
Step 6 , rely on published Tasmanian Code/Regulations as prima facie proof: Use published Futures Industry (Tasmania) documents authorised under ss 9-12 as a starting point for evidentiary proof of what is in force in Tasmania and when. Ensure the published document includes the headings and operative dates required by Schedules 4-6, and retain certified or printed copies of the Government Printer’s publication for evidentiary purposes (ss 9(2), 10(2), 11(2), 12(2)).
Step 7 , draft Tasmanian instruments with clear intentions about references: If drafting Tasmanian legislation, regulations, instruments or private documents that reference the Futures Industry (Tasmania) Code, record an express contrary intention if you do not intend the default mapping in s 13 to apply. Section 13 will otherwise cause references to map to the applied provisions.
Step 8 , coordinate across jurisdictions: If operating in multiple Australian jurisdictions, do not assume federal and Tasmanian requirements are identical. The Act fixes the Tasmanian text to a historical version and updates only through state mechanisms tied to Ministerial Council approvals. Maintain a jurisdictional compliance matrix that maps Commonwealth current law, the applied Tasmanian version and any state regulations implementing Ministerial Council-approved changes.
Step 9 , keep records and seek confirmation from the Commissioner and Minister: Because the Commissioner for Corporate Affairs collects fees and can waive or refund them, instruct clients to obtain written confirmation of fee amounts, payment receipts and any waivers or refunds. For interpretative certainty about operative Tasmanian provisions, seek the Minister’s published documents authorised under ss 9-12 or obtain written confirmations or copies from the relevant Tasmanian statutory office.
Step 10 , where appropriate, obtain legal opinion and monitor regulatory bodies: Because the Act does not itself set out substantive penalties and enforcement procedures, obtain legal advice addressing the applied provisions and any Tasmanian modifications before acting on significant regulatory points. Monitor the Commission, the Ministerial Council and Tasmanian regulation-making activity for Ministerial Council approvals and for Tasmanian regulations made under ss 8 or 14.
Following these steps will place a regulated person or adviser in a position to identify the precise Tasmanian rulebook in force, satisfy procedural fee and lodgment obligations created by this Act, and manage evidentiary and timing risks arising from its mechanics.
