#### 91 Offences generally 91 Offences generally > > (1) All proceedings for offences against this Act or the regulations shall be disposed of summarily in the Local Court. > > > (2) A reference in this Act or the regulations to a daily penalty in relation to an offence is a reference to the additional penalty that may be imposed for each day the offence continues. > > > (3) A person who contravenes, whether by act or omission, a provision of this Act is, if no other penalty is provided therefor, liable to a penalty not exceeding 10 penalty units and, in addition, in the case of a continuing offence, a daily penalty not exceeding 1 penalty unit. > > > (4) Where a pre-paid funeral fund which is comprised of a group of individuals contravenes, whether by act or omission, a provision of this Act, each of those individuals shall be deemed to have contravened that provision. > > **s 91:** Am 1992 No 112, Sch 1; 1999 No 31, Sch 4.34; 2007 No 94, Sch 4.
