#### 73 Liability for losses incurred during administration 73 Liability for losses incurred during administration > > (1) An administrator of a funeral fund is not liable for any loss incurred by that fund during the administrator’s term of office unless the loss was attributable to the administrator’s— > > > > > (a) wilful misconduct, > > > > > (b) gross negligence, > > > > > (c) wilful failure to comply with any provision of this Act or the regulations, or > > > > > (d) in the case of the administration of a funeral contribution fund, wilful failure to comply with any rules of the fund so far as those rules are applicable to the directors or the board of directors of the fund. > > > (2) Neither the Crown, the Minister nor the Secretary is liable for any loss incurred by a funeral fund during the term of office of an administrator, whether or not the administrator is so liable.
