Fuel Tax Regulation 2016

The regulation uses three main regulatory concepts: packaging-based eligibility, tariff-classification referencing, and blend-percentage limits.

1. Packaging-based eligibility (s 6(1))

   • The regulation prescribes two cumulative conditions for the regulated category of “fuel to be sold or packaged” under paragraph 41‑10(2)(a) of the Act. First, the packages must be “each having a volume of 20 litres or less” (s 6(1)(a)). Second, the packages must be “without any markings that suggest or imply that the fuel can or should be used in an internal combustion engine” (s 6(1)(b)). These are objective, product‑packaging rules intended to define a subcategory of packaged fuel eligible under the Act provision the regulation references.

2. Tariff-classification referencing (s 6(2))

   • The regulation prescribes kinds of fuel by reference to specific subitems in the Schedule to the Excise Tariff Act 1921 (s 6(2)(a)-(d)). It also expressly covers “imported equivalents” to those subitems. The regulation therefore relies on the tariff nomenclature as a technical classification mechanism. The accompanying note to s 6(2) maps the cited subitems to familiar fuel types: subitems 10.1-10.12 (some petroleum products, gasoline, diesel and some blends), 10.17 (aircraft kerosene), 10.20 (denatured ethanol for internal combustion use), 10.21 (biodiesel), 10.25 (some liquid aromatic hydrocarbons), 10.28 (some petroleum products other than blends), and 10.30 (some blends usable in internal combustion engines). Subsection 6(2)(c) imposes a negative condition: certain blends are prescribed only if they do not contain fuels covered by listed subitems (10.1-10.12, 10.17, 10.20, 10.21) nor imported equivalents thereof (s 6(2)(c)(ii)-(iii)).

3. Blend-percentage caps (s 7)

   • The regulation prescribes numeric thresholds for two common blends when treating them for the purposes of paragraph 43‑7 of the Act. For petrol/ethanol blends, the ethanol component must be 10% or less of the total fuel (s 7(1)); the note explicitly identifies E10 as an example. For diesel/biodiesel blends, the biodiesel component must be 20% or less of the total fuel (s 7(2)); examples given include B10 and B20. These caps operate as definitional cut‑offs for when the Act’s blend‑treatment provision applies.

Cross-references and mechanics

• The regulation is entirely expressed as prescription or definition for particular paragraphs of the Act (paragraphs 41‑10(2) and 43‑7). It does not restate those Act provisions nor create new tax liabilities; it narrows or specifies eligibility and treatment rules within the framework of the Fuel Tax Act 2006 (s 3). The regulation also preserves the concept of “imported equivalent” in multiple places (s 6(2)(a), (b), (d) and (c)(iii)), thereby making the rule applicable to both domestically produced and imported fuels that match the tariff classifications.

Scope limits

• By relying on package size, labelling/marking and tariff subitems, the regulation confines the set of fuels and packaging circumstances in which the referenced Act paragraphs operate. The quantitative blend thresholds are explicit ceilings; the regulation does not create sliding mechanisms or partial credits where the threshold is exceeded, it simply prescribes the qualifying configuration.

The regulation affects persons and entities whose eligibility for fuel tax credits or particular fuel tax treatments depends on the two Act paragraphs identified in the regulation: paragraph 41‑10(2) (fuel to be sold or packaged) and paragraph 43‑7 (effective fuel tax for fuel blends). The text itself does not list stakeholders by name, but the regulatory mechanics identify the classes of economic actors that must adjust behaviour or satisfy conditions to rely on the specified tax treatments.

Primary affected parties

• Entities packaging fuel in small containers for sale or distribution will be affected because s 6(1) prescribes that packages must be “each having a volume of 20 litres or less” and must be “without any markings that suggest or imply that the fuel can or should be used in an internal combustion engine.” Anyone who packages fuel for sale in small containers, including manufacturers or retailers of portable fuel containers, will need to ensure the size and markings of their packages meet these regulatory limits if they seek to bring the packaged fuel within paragraph 41‑10(2) of the Act.

• Fuel importers, manufacturers and wholesalers are affected by the tariff-based prescriptions in s 6(2). The regulation prescribes fuels by reference to subitems in the Excise Tariff Act 1921 and to “imported equivalents” of those subitems. Parties that import fuels must therefore determine whether imported products map to the cited subitems (for example subitems 10.25, 10.28, and 10.30) to rely on paragraph 41‑10(2)(b) of the Act as prescribed here.

• Producers and distributors of petrol/ethanol and diesel/biodiesel blends, including blended fuel suppliers and retailers of E10, B10 and B20 products, are affected by s 7(1)-(2), which sets maximum bio-component proportions for those blend categories if the fuel is to be treated as specified under paragraph 43‑7 of the Act.

Secondary affected parties

• Downstream purchasers who claim fuel tax credits (for example, businesses that use certain small-packaged fuels in their operations and claim fuel tax credits under the Act) will need to rely on supplier compliance with the packaging and labelling rules; otherwise eligibility may be disputed.

• Legal, accounting and compliance advisers who support fuel businesses and importers will need to advise clients on how to align packaging, labelling and product composition with the regulation’s technical prescriptions.

• Customs and excise officers or tax auditors operating under the Fuel Tax Act 2006 will receive these regulations as operative criteria they must apply when assessing whether a fuel meets the Act’s prescribed conditions (s 3: instrument made under the Act).

Who does not appear to be covered

• The regulation neither creates an exemption nor extends credit rules beyond paragraph 41‑10(2) or paragraph 43‑7 of the Act. Fuels and packaging outside those narrow technical prescriptions are not brought within the regulation’s definitions by this instrument alone. The regulation also does not itself create new taxable categories or penalty regimes.

Geographical and product scope

• The regulation applies to fuels captured by the referenced excise tariff subitems and to their imported equivalents. It is therefore product‑specific and tied to the tariff classification system. The regulation’s packaging rule (20 litres or less and no markings suggesting internal combustion engine use) is product-agnostic in geography but directly applies to physical packages wherever supplied, subject to the linked Act provisions.

The regulation itself prescribes conditions, rather than setting broad duties or conferring novel rights. It modifies the operation of particular paragraphs of the Fuel Tax Act 2006 by specifying what counts as qualifying fuel for the purposes of fuel tax credits and blend treatment. The practical duties and rights therefore arise from the combination of the Act’s provisions and the regulation’s prescriptions. The regulation should be read as setting required conditions that must be satisfied for the linked Act paragraphs to apply.

Primary duties (as drawn from the regulation’s prescriptions)

• Duty to package within size limits: For fuel to be treated as “for packaging” under paragraph 41‑10(2)(a) of the Act, the fuel must be in packages “each having a volume of 20 litres or less” (s 6(1)(a)). Actors packaging fuel for sale who wish to rely on the Act’s packaging-related credit provisions must ensure each separate package does not exceed 20 litres.

• Duty to avoid particular markings: The same paragraph requires that packages be “without any markings that suggest or imply that the fuel can or should be used in an internal combustion engine” (s 6(1)(b)). Suppliers must therefore ensure that package text, graphics or other indicia do not suggest or imply internal combustion engine use if they intend to qualify under paragraph 41‑10(2)(a).

• Duty to ensure product class mapping: Under s 6(2) the kind of fuel is prescribed by reference to specified subitems in the Excise Tariff Act 1921 and to imported equivalents. Entities must therefore identify whether their fuel corresponds to the relevant excise tariff subitems (10.25, 10.28, 10.30, and by exclusion the subitems listed in the note and in s 6(2)(c)) to establish eligibility under paragraph 41‑10(2)(b). This is an administrative requirement: the regulation fixes classification as the determinant.

• Duty to control blend proportions: For the purpose of paragraph 43‑7 of the Act, petrol/ethanol blends are prescribed only if the ethanol is 10% or less of the total fuel (s 7(1)); diesel/biodiesel blends are prescribed only if the biodiesel is 20% or less (s 7(2)). Producers, blenders or suppliers must therefore ensure bio-component percentages remain at or below those caps to secure the relevant treatment in the Act.

Rights and entitlements

• Right to the Act’s specified treatment when conditions met: If the prescribed conditions in the regulation are met, the linked paragraphs of the Fuel Tax Act 2006 will apply as intended by the Act and regulation (s 6 and s 7 operate “for paragraph 41‑10(2)(a)/(b)” and “for paragraph 43‑7(1)(b)/(2)(b)” respectively). The regulation thus creates a clear entitlement to the Act’s treatment for fuels that satisfy the packaging, labelling, tariff-classification and blend-percentage rules.

• Right to treat E10, B10, B20-style fuels as the regulation exemplifies: The notes to s 7 indicate that E10 (ethanol ≤10%) and B10/B20 (biodiesel ≤10% or ≤20%) are examples of the prescribed blends. Parties producing or selling those blends have the regulative guidance that these formulations fit within the regulation’s thresholds.

Limits and negative obligations

• Exclusion where blends include listed fuels: s 6(2)(c) prescribes fuel that is not a blend containing fuels listed under certain excise subitems (10.1-10.12, 10.17, 10.20, 10.21) nor imported equivalents. Where a blend contains any fuel falling within those listed subitems, the particular prescription in s 6(2)(c) does not apply. Practically, this is a negative obligation,do not blend with specified fuels if the intention is to rely on the s 6(2)(c) prescription.

Delegated implementation and administrative application

• The regulation itself does not specify granting mechanisms, forms, or recordkeeping requirements; those procedural details are governed by the Fuel Tax Act 2006 and administrative practice under it. The regulation does, however, fix objective criteria that administrative officers and taxpayers must apply when determining eligibility for the Act benefits referred to in the regulation (s 3).

The regulation contains no express penalty provisions and does not itself set out enforcement mechanisms. It is made under the Fuel Tax Act 2006 (s 3), and its role is to prescribe technical conditions that determine when particular paragraphs of the Act apply. Enforcement, audit activity, penalties for non‑compliance and offence provisions, where relevant, therefore remain matters for the Fuel Tax Act 2006 and any other applicable laws rather than for this instrument.

Observable consequences from the regulation’s text

• The regulation establishes compliance conditions that will be applied by administrators when assessing eligibility for treatments under the Act. Non‑satisfaction of the prescribed conditions (for example, packaging exceeding 20 litres or markings that suggest internal combustion engine use, or a blend exceeding the cap percentages) will mean the linked paragraphs in the Act do not apply. The direct legal consequence in such a case is that a claimant will not be able to rely on the Act provision as prescribed by the regulation; any downstream tax assessment, adjustment or recovery would be undertaken under the processes set out in the Fuel Tax Act 2006.

• Because the regulation prescribes objective tests (package size, presence or absence of markings, classification to specific excise tariff subitems, bio-component percentages), those tests provide an administrable basis for audit and review. Tax administrators assessing claims under the Act will use the regulation’s criteria in their determinations.

What the regulation does not do

• The instrument does not create any new criminal or civil penalties, does not specify infringement notice schemes, and does not modify the enforcement powers available under the Fuel Tax Act 2006. It therefore leaves the existing enforcement, assessment and penalty architecture of the Act intact, but it supplies specific factual predicates that will determine eligibility under the Act provisions it references.

Implementation and practical enforcement risk

• Because the regulation uses terms that may require factual interpretation (for example “markings that suggest or imply” or “imported equivalent”), there is an enforcement risk tied to how administrative officers interpret those phrases in audits or reviews. The regulation’s objective thresholds (20 litres; ethanol ≤10%; biodiesel ≤20%) are clearer and more straightforward to apply.

The regulation is explicitly tied to, and designed to be read in the context of, two other statutory instruments: the Fuel Tax Act 2006 (the parent Act under which the regulation is made) and the Excise Tariff Act 1921 (via references to subitems in its Schedule). The regulation neither supersedes nor replaces those Acts; it operates as a subordinate instrument that supplies technical prescription for specific paragraphs of the Fuel Tax Act.

Direct statutory references

• Authority: The instrument is made under the Fuel Tax Act 2006 (s 3). Consequently, its legal effect is as a regulation under that Act and it must be interpreted in light of the Act’s provisions, including the paragraphs the regulation cites (paragraph 41‑10(2) and paragraph 43‑7).

• Tariff cross-reference: s 6(2) prescribes kinds of fuel by reference to specific subitems of the Schedule to the Excise Tariff Act 1921 and to “imported equivalents” of those fuels. Thus, the Excise Tariff Act’s classification regime is imported into the Fuel Tax regulatory test. The regulation’s note clarifies what those subitems relate to (e.g. 10.1-10.12: certain petroleum products; 10.21: biodiesel; 10.30: some blends usable in internal combustion engines).

Practical interactions and dependency

• Classification dependency: Eligibility under paragraph 41‑10(2)(b) of the Fuel Tax Act depends on whether fuel corresponds to the excise tariff subitems cited in s 6(2) or their imported equivalents. This means classification work under the Excise Tariff Act (and possibly customs/tariff processes for imported fuels) becomes material to fuel tax treatment under the Fuel Tax Act as clarified by the regulation.

• Packaging and labelling controls vs. consumer protection, trade practices and product standards: The regulation’s labelling prohibition in s 6(1)(b) is narrowly framed to exclude markings that suggest or imply internal combustion engine use. While the regulation does not refer to other laws, in practice package labelling will engage industrial product and consumer labelling norms, and may overlap with obligations under other statutory regimes. The regulation does not modify those regimes; it simply sets a tax‑eligibility condition that interacts with them.

Transitional and repeal interaction

• Schedule 1 repeals the Fuel Tax Regulations 2006 in full. The regulation does not contain transitional provisions in the text provided; it does contain a commencement table (s 2(1)) that states the instrument commenced on 1 October 2016 and a note that the table relates only to the instrument as originally made. The repeal therefore replaces the prior subordinate regime (Fuel Tax Regulations 2006) with this new regulatory regime from the stated commencement date. Administrators and taxpayers had to reconcile prior administrative positions under the 2006 regulations with the new technical requirements as at the commencement date.

Limits of interaction described in the regulation

• The instrument does not amend the Fuel Tax Act’s substantive tax base, nor does it amend the Excise Tariff Act. It merely links the tariff classifications from the Excise Tariff Act into the Fuel Tax Act’s regulatory test and supplies precise packaging and blend thresholds. Enforcement, recordkeeping, record retention, and audit powers remain those provided by the Fuel Tax Act and any other relevant Commonwealth laws; the regulation is silent on procedure.

The text supplied is the entire instrument as made in 2016. The instrument contains an internal commencement table (s 2) and a Schedule that repeals the Fuel Tax Regulations 2006 (Schedule 1, item 1). The regulation itself does not record any prior amendments within the provided text; instead it replaces the previous Fuel Tax Regulations 2006 in their entirety.

What the instrument records about commencement and amendments

• Commencement: s 2(1) states that “The whole of this instrument” commenced on 1 October 2016. The commencement table is presented as relating only to the provisions of the instrument “as originally made” (s 2 note). There are no subsequent amendment entries within the provided text.

• Repeal of prior regulations: Schedule 1, titled “Repeals,” contains a single item: “Fuel Tax Regulations 2006 , 1 The whole of the Regulations , Repeal the Regulations.” That is a complete statutory repeal of the 2006 Regulations effected by the 2016 regulation.

No amendment trace in the instrument text

• The instrument as supplied does not record any amending instruments, saved transitional provisions, or later consolidations. The regulation is therefore the operative version as originally made and as it commenced on 1 October 2016. Any subsequent amendments, if they exist, do not appear in the supplied text and thus cannot be referenced here.

Implications for historical compliance

• Entities that previously relied on the Fuel Tax Regulations 2006 had to transition to compliance with the new prescriptions from 1 October 2016. Because the 2016 regulation repealed the 2006 Regulations in full (Schedule 1), the technical tests for packaged fuels and prescribed blends changed to those set out in ss 6-7 of the new instrument.

Record of explanatory material

• The provided text contains internal explanatory notes (for example the note to s 6(2) identifying what the tariff subitems relate to, and notes giving examples such as E10, B10, B20 in s 7). Those notes are part of the regulation text supplied, but the instrument does not include an extrinsic explanatory memorandum or second‑reading speech in the provided text. Any explanatory materials external to the instrument are not included here.

The regulation text provided contains no references to case law, judicial interpretation, or litigation. It does not name any cases, and no judicial decisions are cited or summarised in the instrument. The supplied instrument therefore contains no internal litigation history.

What this absence means for practitioners reading the regulation

• Because the instrument is a short, technical regulation with clearly stated thresholds (20 litres; ethanol ≤10%; biodiesel ≤20%; specified tariff subitems), there may be no significant judicial history recorded within the instrument itself. However, the regulation’s application in disputes (for example, audit assessments under the Fuel Tax Act where a taxpayer contends that a product maps to a tariff subitem or that markings do or do not “suggest or imply” internal combustion engine use) would generate litigation only if decisions under the Act that apply the regulation are appealed to administrative or judicial bodies. The provided text does not report any such outcomes.

Practical advice where litigation risk exists

• Because the regulation imports tariff classification questions and contains potentially interpretive phrases (for example “imply” or “suggest”), disputes arising under the Fuel Tax Act that reference these regulations could involve fact‑sensitive and classification questions. In the absence of reported judicial guidance within the instrument, taxpayers and advisers should be prepared for administrative determinations to be the first venue of contest and for the lack of precedent to increase uncertainty in borderline cases.

Several practical and interpretive issues in the regulation could catch practitioners and taxpayers if not carefully addressed. The regulation is concise, but its brevity leaves scope for borderline factual issues and classification disputes.

1. “Markings that suggest or imply that the fuel can or should be used in an internal combustion engine” (s 6(1)(b))

   • The regulation uses imprecise language,“suggest or imply”,to exclude packages with indicia of engine use. This phrasing is open to interpretation and can raise disputes about whether text, symbols, graphics, colour schemes, product names, or even supplier logos “suggest” engine use. The regulation does not define the measurement for “suggest or imply,” nor does it provide examples of permissible versus impermissible markings beyond the negative framing. Parties that sell small packaged fuels must therefore be cautious about marketing materials and container design; apparently innocuous wording or imagery could be read by an administrator as implying engine use and thus disqualify the packaged fuel from the prescribed category.

2. “Each having a volume of 20 litres or less” (s 6(1)(a))

   • The regulation specifies package volume but does not say whether the measurement is by labelled capacity, nominal capacity, or actual fill volume at time of sale. The phrase “each having a volume of 20 litres or less” appears straightforward, but practical edge cases arise for containers with removable spouts, multi-component packs, or containers advertised in both litres and other units. Complying parties should note that the regulation appears to include packages exactly at 20 litres (i.e. 20 L is within “20 litres or less”) unless administrative guidance says otherwise.

3. “Imported equivalent” language (s 6(2)(a), (b), (d), (c)(iii))

   • The regulation repeatedly captures “imported equivalents” to certain Excise Tariff subitems. Determining whether an imported product is the “equivalent” of a tariff subitem can require technical analysis of composition, intended use and tariff classification practice. Importers should be aware that the tariff classification process, customs rulings and product technical data may be relevant evidence when asserting that an imported fuel is an “imported equivalent.”

4. Blend exclusion complexity in s 6(2)(c)

   • Subsection 6(2)(c) prescribes fuel to which subitem 10.30 applies but then requires that fuel not be a blend that contains a fuel to which any of subitems 10.1-10.12, 10.17, 10.20, or 10.21 applies. This is a double condition: a fuel can be covered by s 6(2)(c) only if it is of the 10.30 type and it does not contain any component classed under the listed subitems. Any small presence of such a component appears to exclude the blend from the s 6(2)(c) prescription. Taxpayers dealing in blends that contain multiple components must be alert to even minor component inclusions that could disqualify them.

5. Measurement of “amount” in blend caps (s 7)

   • s 7 uses the term “amount” of ethanol or biodiesel that is “10% or less” or “20% or less” of the total amount of the fuel. The regulation does not specify whether that amount is measured by volume, mass, energy content or another metric. The lack of a stated measurement basis may be material in close cases where ethanol and petrol have different densities or where sampling/analytical methods produce different reported percentages by mass or volume. Practitioners should note this potential measurement ambiguity.

6. Repeal of earlier regulations without explicit transitional provisions (Schedule 1)

   • The regulation repeals the Fuel Tax Regulations 2006 in full (Schedule 1). The instrument’s commencement statement shows the new regulation started on 1 October 2016. The supplied text does not include transitional provisions addressing actions taken under the 2006 Regulations prior to repeal. Taxpayers who structured transactions or product lines to rely on the 2006 Regulations should have reviewed the new regulation for changed technical thresholds effective from the commencement date.

7. No procedural detail in the regulation

   • The regulation sets substantive technical criteria but is silent on recordkeeping, testing protocols, acceptable evidence for classification or labelling decisions, or forms/processes to be used in administrative claims. Those procedural gaps mean administrative practice, rulings, or guidance under the Fuel Tax Act 2006 will be important, and absence of guidance can increase compliance risk.

The regulation sets out clear, discrete technical requirements. Compliance consists largely in ensuring that packaging, labelling, fuel composition and classification meet the prescribed conditions where taxpayers intend to rely on the relevant paragraphs of the Fuel Tax Act 2006. Below are concrete steps drawn from the regulation text to reduce risk and align products and processes with ss 6-7.

1. Packaging and labelling checks (s 6(1))

   • Ensure each retail or wholesale package intended to meet paragraph 41‑10(2)(a) is physically capable of holding no more than 20 litres. If containers are sold in multiple sizes, segregate and document which product SKUs are 20 L or less.

   • Audit all package labelling, marketing text and graphics for statements or images that could suggest or imply internal combustion engine use. Remove or modify any markings that could be reasonably read as advising engine use. Because the regulation uses the language “suggest or imply,” prefer conservative design choices: avoid engine pictures, fuel‑use instructions referencing vehicle operation, or product names that explicitly reference engines or motorists.

   • Keep records of label designs, internal approvals, and the rationale for labelling decisions to show contemporaneous steps taken to comply with s 6(1)(b) in case of audit.

2. Product classification (s 6(2))

   • For domestic products, map product specifications to the Excise Tariff Act 1921 subitems cited in s 6(2). For example, determine whether a product falls within subitem 10.25, 10.28, or 10.30. Use technical specifications (composition, intended use, and production process) to support the classification.

   • For imported fuels, obtain and retain customs/tariff classification documents and supplier technical specifications demonstrating that the product is an “imported equivalent” to the relevant subitem. Keep import documentation and any customs rulings that support your classification.

   • Where dealing with blends, confirm whether any component corresponds to subitems 10.1-10.12, 10.17, 10.20 or 10.21. If a blend contains any such component, s 6(2)(c) will not apply.

   • Maintain a contemporaneous classification file for each fuel SKU including product data sheets, supplier statements, customs paperwork and, where available, binding rulings or prior administrative determinations.

3. Managing blend percentages (s 7)

   • For petrol/ethanol blends that you intend to treat under paragraph 43‑7(1)(b), ensure the ethanol proportion is 10% or less of the total fuel (s 7(1)). For diesel/biodiesel blends under paragraph 43‑7(2)(b), ensure the biodiesel proportion is 20% or less (s 7(2)).

   • Institute laboratory testing and quality control procedures to measure bio-component percentages. Given the regulation speaks in terms of “amount” without specifying the measurement basis, record the testing methodology (test type, whether result is by mass or volume, sampling approach) and use consistent testing protocols across batches.

   • Keep batch records that demonstrate compliance with the percentage caps and include test certificates, production logs and supplier declarations where relevant.

4. Interaction with excise tariff and import documentation

   • Where eligibility depends on mapping to Excise Tariff subitems, ensure the technical file includes the relevant tariff descriptions and a reasoned explanation mapping product characteristics to the subitem language. If uncertain, obtain a formal customs/tariff classification ruling or seek an administrative determination where such avenues exist.

   • For imported products, ensure customs declarations and bills of lading, and any analytical certificates accompany shipments and are retained for audit.

5. Administrative preparedness

   • Because the regulation does not detail procedural formality for making claims or presenting evidence, be prepared to present a clear factual case in audits: packaging dimensions, labelling images, product technical specifications, blend composition testing, and customs classification evidence should all be accessible.

   • Consider obtaining written advice or private rulings from relevant administrative agencies in ambiguous or high‑value situations, particularly where the meaning of “suggest or imply” or “imported equivalent” could materially affect tax treatment.

6. Transitional assessment

   • If activities were undertaken under the Fuel Tax Regulations 2006 prior to 1 October 2016, review those arrangements against the 2016 regulation’s conditions to confirm whether any changes are necessary. The 2016 regulation repealed the 2006 Regulations (Schedule 1), and the new technical requirements apply from the commencement date.

7. Record retention and audit readiness

   • Maintain records sufficient to demonstrate compliance with ss 6-7 for the statutory period applicable under the Fuel Tax Act 2006 and any relevant recordkeeping rules. Records should include packaging specifications, label artwork and approvals, product composition analyses, customs/tariff documentation, and supplier declarations.

8. Seek specialist advice where classification or labelling is borderline

   • Borderline cases, particularly about whether a marking “suggests or implies” engine use, or whether an imported product is an “equivalent” to a tariff subitem, are fact‑sensitive and may warrant formal advice, documentation of administrative submissions, or pre‑emptive clarification from revenue/customs authorities.

Following these steps will align operational practice with the regulation’s objective criteria (s 6 and s 7) and reduce the risk that a claim to the Fuel Tax Act’s treatments will be denied for failure to meet the regulatory prescriptions.
