Fuel Tax (Correcting Fuel Tax Errors) Determination 2023

The Determination pivots on a small set of defined concepts found in s 4 and cross-references definitions in section 110-5 of the Act. Those concepts determine eligibility and the mechanics of correction.

Key defined terms in this instrument:

• Act: the Fuel Tax Act 2006 (s 4).
• Commissioner: the Commissioner of Taxation (s 4).
• fuel tax return: given the cross-reference to section 995-1 of the Income Tax Assessment Act 1997, the term has that broader statutory meaning and is used here as the return through which corrections are made (s 4).
• credit error: a mistake in working out a net fuel amount for an earlier tax period that, if it were the only mistake, would have overstated the assessed net fuel amount for that earlier period (s 4). The definition expressly excludes (a) a fuel tax credit to the extent entitlement has ceased under Division 47 of the Act and (b) an omission of a fuel tax credit in its entirety where that omission would have been attributable under subsections 65-5(1), (2) or (3) of the Act (s 4).
• debit error: a mistake that, if the only mistake, would have resulted in an understatement of the assessed net fuel amount for the earlier tax period (s 4).
• debit error amount and credit error amount: quantified magnitudes of the respective errors (s 4).
• net sum of the debit errors: the sum of any debit error amounts less the sum of any credit error amounts included in the net fuel amount for the tax period in which the taxpayer seeks to correct a debit error for an earlier tax period (s 4).

The Determination distinguishes between correcting credit and debit errors only to the extent the conditions differ. Section 6 lists the generic conditions applicable to correcting an error in working out your net fuel amount for a later tax period. Those include the requirement that the earlier tax period started on or after 1 July 2012 (s 6(b)), that you lodge the later-period fuel tax return within the period of review for the assessment of the earlier tax period (s 6(c)), and that you are registered for GST (s 6(g)). The instrument defines "compliance activity" for the purpose of the eligibility rules and specifies when a compliance activity begins and ends (s 4).

For debit errors only, section 7 adds conditions. The error must not be the result of recklessness or intentional disregard of a fuel tax law (s 7(a)). The correction must be made in a fuel tax return lodged within a time limit tied to your current GST turnover, and the net sum of debit errors included in the return must be below the monetary value limit tied to that same turnover bracket (s 7(b)-(c) and the table in s 7). The Determination also clarifies how current GST turnover is calculated for GST groups, by reference to subsection 188-15(2) of the A New Tax System (Goods and Services Tax) Act 1999 (note after the table in s 7).

Finally, the Determination removes the pathway of correcting an earlier-period error by seeking amendment of a later-period assessment: s 8 expressly prevents correction by amendment of a fuel tax return for a later tax period.

Each of these concepts is procedural and definitional; the Determination does not itself attach tax liabilities, interest or penalties, but controls the permitted method and timing of correcting earlier misstatements of net fuel amounts when lodging a later period return (see s 6, s 7 and s 8).

The Determination affects taxpayers who lodge fuel tax returns and who are registered for GST, because correction under this instrument is available only to persons who satisfy that registration requirement (s 6(g)). More precisely, it applies to any person who:

• has made a credit error or debit error in working out their net fuel amount for an earlier tax period that began on or after 1 July 2012 (s 4, s 6(b)); and
• intends to correct that earlier-period error through the process of working out the net fuel amount in a later tax period's fuel tax return (s 6).

The instrument also has consequences for GST groups. For the purpose of the debit error time and value limits, the current GST turnover for a GST group is to be calculated for the group by including supplies made by the group members in accordance with subsection 188-15(2) of the A New Tax System (Goods and Services Tax) Act 1999 (note in s 7). That means entities that are members of a GST group must treat turnover on a group basis for the s 7 thresholds.

The Commissioner of Taxation is a decision-maker under this Determination. The Commissioner initiates and concludes a "compliance activity" and may notify taxpayers that a matter is, or is not, a compliance activity for the purposes of this Determination; the Commissioner also may give written permission to correct an error that would otherwise be precluded because it relates to a matter under compliance activity (s 4, s 6(d)). The Commissioner is the named maker of the instrument (s 3) and the Deputy Commissioner signed the instrument on 6 September 2023.

Who pays: the primary economic effect falls on taxpayers who have made net fuel amount miscalculations and who wish to correct them by adjusting a later-period return (s 6). The Determination allocates the administrative burden of ensuring eligibility and calculating net sums and turnover to those taxpayers. The Commissioner bears administrative discretion in deciding whether a compliance activity applies and whether an error related to a compliance activity may nonetheless be corrected under the Determination (s 4, s 6(d)).

The Determination does not on its face create new monetary penalties or change general assessment powers elsewhere in the Act. It affects the availability of the particular correction pathway where the statutory conditions are met.

The Determination imposes procedural duties on taxpayers who wish to correct errors in earlier tax periods when lodging later-period fuel tax returns, and it creates conditional rights to make those corrections.

Key duties:

• Ensure the earlier tax period to be corrected started on or after 1 July 2012. Corrections under this instrument are limited to earlier tax periods with that start date (s 6(b)).
• Lodge the fuel tax return for the later tax period within the period of review for the assessment of the net fuel amount of the earlier tax period (s 6(c)). The instrument relies on the statutory concept "period of review" as defined in section 110-5 of the Act (s 4 note).
• Be registered for GST at the time of lodging the return in which the correction is made (s 6(g)).
• For debit-error corrections, ensure the return is lodged within the debit error time limit corresponding with your current GST turnover and the net sum of the debit errors included in that return is less than the debit error value limit corresponding to your turnover band (s 7(b)-(c) and the table in s 7).
• For GST groups, calculate current GST turnover for threshold purposes in accordance with subsection 188-15(2) of the GST Act, as noted in s 7.

Key constraints and conditional rights:

• Right to correct a credit error or a debit error exists only if the error relates to fuel tax credits or adjustments under the Act (s 6(a)) and the other conditions in s 6 are satisfied.
• A taxpayer cannot correct an error if the error relates to a matter that the taxpayer has been notified is subject to a compliance activity, unless the Commissioner has provided written notice that the error may be corrected under this instrument (s 6(d)(i)-(ii)). The Determination defines "compliance activity" and sets the start and end points for that activity (s 4).
• A debit error cannot be corrected under this instrument if it was caused by recklessness as to the operation of a fuel tax law or intentional disregard of a fuel tax law (s 7(a)). That operative disqualification is a substantive limit on the right to correct.
• You may not correct an earlier-period error by requesting amendment of a fuel tax return for a later tax period. Section 8 eliminates amendment of later-period returns as a route to correction.

Other procedural duties arise from definitions. For example, the definition of "net sum of the debit errors" requires taxpayers to calculate and disclose the arithmetic aggregate of debit and credit error amounts included in the later period's net fuel amount (s 4). The definition of "compliance activity" places on taxpayers the duty to track whether the Commissioner has advised an examination is to be made and whether the examination has been finalised or resulted in an assessment or amended assessment, because those timings determine whether correction under this Determination is permitted (s 4).

Rights include the limited right to correct qualifying earlier-period errors through a later-period fuel tax return when all the conditions in s 6 and, if applicable, s 7 are met. That right is conditional and subject to the Commissioner’s compliance-activity notifications and the time and value thresholds for debit errors.

This Determination does not itself specify criminal or civil penalty amounts, nor does it create new enforcement powers. It establishes conditions under which the administrative corrective pathway of adjusting a later-period net fuel amount is available or unavailable. The instrument therefore shapes enforcement by permitting or denying a taxpayer the administrative convenience of correcting earlier errors in a later return; it does not expressly set out the consequences if a taxpayer breaches a fuel tax law. Those consequences remain matters of the Act and other instruments outside this Determination.

The Determination does, however, incorporate enforcement-related constraints:

• It disallows correction of an error that was caused by recklessness as to the operation of a fuel tax law or by intentional disregard of a fuel tax law (s 7(a)). The Determination denies the correction pathway where the taxpayer’s state of mind (recklessness or intentional disregard) is specified. The instrument does not define the substantive consequences beyond denying the correction under this Determination.
• It prevents correcting an error by requesting amendment of a fuel tax return for a later tax period (s 8). That procedural prohibition channels taxpayers away from that amendment route, leaving other statutory assessment and amendment mechanisms in the Act as the means for addressing such errors.
• It uses the concept of "compliance activity" to exclude from this correction pathway matters already under examination, unless the Commissioner allows otherwise in writing (s 6(d), s 4). The Determination defines when a compliance activity begins and ends, tying the availability of the correction pathway to the Commissioner’s active review processes (s 4). That creates an administrative control for enforcement: once an examination is underway, the Commissioner may prevent taxpayers from using this particular correction mechanism to alter the earlier-period position without the Commissioner’s written consent.

Enforcement powers such as issuing notices of assessment or amended assessments are referenced in the definition of "compliance activity" as events that end the compliance activity (s 4). The Determination does not displace the Commissioner’s statutory powers to assess or amend under the Act; rather, it governs a specified administrative correction method available when lodging later-period returns (s 6 and s 7). Any penalties, interest or other consequences for non-compliance with the fuel tax laws are not created or altered by this Determination and therefore continue to be matters for the Act and other relevant instruments.

In short, the Determination enforces compliance indirectly by gating access to the correction pathway on particular factual and temporal conditions and by excluding errors arising from specified culpable conduct, while leaving substantive enforcement sanctions to be found in the Act.

The Determination operates as an instrument under the Fuel Tax Act 2006 and cross-references concepts defined in that Act and in other federal tax statutes. It is made under subsection 60-10(1) of the Act (s 3). The instrument intentionally relies on statutory definitions and regimes external to itself rather than replicating them.

Direct cross-references in the instrument include:

• Section 110-5 of the Act: the instrument notes that a number of expressions used in the instrument are defined in section 110-5 of the Act, and it lists several examples (assessed net fuel amount; assessment; fuel tax law; GST group; net fuel amount; period of review; tax period) (s 4 note). That signals that the Determination uses the Act’s definitions for many operative concepts and therefore is dependent on the Act’s substantive and procedural regimes.
• Division 47 of the Act and subsections 65-5(1), (2) and (3) of the Act: the definition of "credit error" expressly excludes certain matters to the extent they are governed by Division 47 or omissions attributable under the specified subsections (s 4). The Determination defers to the Act’s treatment of those specific situations, excluding them from the correction pathway it provides.
• Income Tax Assessment Act 1997 (section 995-1): the instrument borrows the definition of "fuel tax return" from section 995-1 of that Act (s 4).
• A New Tax System (Goods and Services Tax) Act 1999 (subsection 188-15(2)): the Determination’s note to the debit error table directs GST groups to calculate current GST turnover using the method set out in subsection 188-15(2) of the GST Act (s 7 note).

The Determination therefore functions as an adjunct to those statutory regimes, imposing procedural rules that operate within the broader statutory architecture for fuel tax and GST. It does not override definitions or substantive rules in the Act; instead, it specifies when a taxpayer may use a later-period fuel tax return to correct qualifying earlier errors consistent with the Act’s definitions and assessment windows.

Because the Determination ties eligibility to the Act’s "period of review" concept, the window for making corrections under this Determination intersects with the Act’s assessment and review mechanics (s 6(c) and s 4 note). The instrument also preserves the Commissioner’s compliance and audit activity boundaries by defining "compliance activity" and excluding errors under active examination from automatic correction under the Determination absent written permission (s 4, s 6(d)). That creates an operational interface between compliance processes under the Act and the administrative correction pathway this instrument creates.

Finally, the Determination repeals the prior Fuel Tax: Correcting Fuel Tax Errors Determination 2013 in full (Schedule 1). The repeal replaces the earlier instrument’s provisions with the rules now contained in this Determination. The Determination’s commencement timing is stated (s 2), and its authority under the Act is asserted (s 3), embedding it squarely within the statutory framework of fuel tax and related tax laws.

The Determination itself is short and self-contained, and its internal amendment history as presented in the instrument is limited. The instrument was signed by Ben Kelly, Deputy Commissioner of Taxation, and dated 6 September 2023. Section 2 sets out commencement mechanics: the whole instrument commences the day after it is registered (s 2). The instrument contains a Schedule that deals with other instruments; Schedule 1 effects a repeal.

Schedule 1,Repeals records a single entry: the whole of the Fuel Tax: Correcting Fuel Tax Errors Determination 2013 is repealed (Schedule 1, item 1). The text of Schedule 1 therefore formally removes the 2013 Determination and replaces it with the 2023 Determination’s terms. Section 5 further confirms that each instrument specified in a Schedule is amended or repealed as set out in the applicable items and that any other item in a Schedule has effect according to its terms (s 5).

The commencement table in section 2 includes a standard publishing note that the table relates only to provisions as originally made and will not be amended to reflect later amendments of the instrument (s 2(1) and note). Section 2(2) also includes the usual statement that information in the third column of the table is not part of the instrument and may be edited in published versions (s 2(2)).

No other amendments are recorded in the instrument text supplied. The Determination therefore represents a single-instrument update replacing the 2013 Determination, effective the day after registration. There is no textual record inside this instrument of any intervening amendments between 2013 and 2023; the instrument as presented is self-contained and effectuates the repeal and replacement.

Users should treat Schedule 1 as the formal vehicle by which the 2013 Determination was removed and the 2023 Determination established. Any subsequent amendments to the 2023 Determination or to the Act that would affect the operation of this instrument would be found in later instruments or legislative amendments, none of which are recorded in the instrument text provided.

The instrument text provided contains no references to litigation, cases, or judicial interpretation. It does not cite any court decisions, nor does it record any contested determinations or appeals. The Determination therefore has no litigation history recorded within this source.

Nonetheless, the instrument contains several provisions and fact patterns that create potential points of legal contest that would likely be the focus of disputes if they arose in practice. Those potential contestable areas are set out in the instrument and therefore are the locus where litigation or objection could occur:

• Whether an error is or was subject to a "compliance activity". The Determination excludes from its correction pathway errors that relate to matters the taxpayer has been notified are subject to a compliance activity, unless the Commissioner authorises correction in writing (s 6(d)). The instrument defines when a compliance activity begins and ends (s 4). Disputes could arise about the timing and content of the Commissioner’s advice that an examination is to be made, whether an activity qualifies as a compliance activity for the instrument’s purposes, and whether the examination was properly finalised for the purposes of the definition (s 4, s 6(d)).
• The interpretation of "recklessness as to the operation of a fuel tax law" or "intentional disregard of a fuel tax law" for the purpose of s 7(a). The Determination removes the correction pathway for debit errors caused by those states of mind. Adjudication could be required to determine whether a particular factual matrix satisfies either disqualification ground (s 7(a)).
• Calculation of "current GST turnover" for GST groups when applying the debit error thresholds. The instrument’s note refers to subsection 188-15(2) of the GST Act for this calculation (s 7 note). Disagreements could arise about which supplies are includible for threshold purposes and whether the turnover calculation has been correctly performed on a group basis.
• The arithmetic calculation of the "net sum of the debit errors", which requires counting debit error amounts and offsetting credit error amounts included in the later period’s net fuel amount (s 4). Challenges could concern whether particular items qualify as debit or credit errors within the instrument’s definitions, and whether the taxpayer has correctly allocated and aggregated amounts.
• Whether a particular fuel tax credit is excluded from the "credit error" definition because it has ceased under Division 47 of the Act or because an omission would have been attributable under subsections 65-5(1), (2) or (3) of the Act (s 4).

Any litigation or objections would therefore be targeted at statutory interpretation and fact findings grounded in the Act and the Determination. The Determination itself does not provide a record of past disputes or judicial treatment, so any litigation history would need to be sourced from court files, tribunal records, or external reporting, none of which are contained in this instrument.

This Determination contains several specific, potentially costly traps for taxpayers attempting to correct earlier net fuel amount errors by using a later-period fuel tax return. The following practical pitfalls are grounded in the instrument’s text:

• Earlier tax period start date requirement. The instrument permits correction only for an earlier tax period that started on or after 1 July 2012 (s 6(b)). Errors occurring in periods that started before that date are outside this correction pathway.
• GST registration required. The correction is available only where you are registered for GST at the time of lodging the later-period return that contains the correction (s 6(g)). Unregistered persons cannot use this mechanism.
• Period-of-review constraint. You must lodge the later-period fuel tax return within the period of review for the assessment of the earlier tax period (s 6(c)). The instrument relies on the Act’s "period of review" concept; failure to stay within that window precludes correction under the Determination.
• Compliance activity exclusion. If the Commissioner has advised you that a matter is subject to a compliance activity, you cannot correct an error relating to that matter under this Determination unless the Commissioner has given written permission to do so (s 6(d)(i)-(ii)). The Determination also defines when a compliance activity begins and ends (s 4). Taxpayers should track any such notices carefully because an active examination will block the correction pathway.
• Single-correction rule. You may not correct an earlier error if you have already corrected that error, to any extent, in working out your net fuel amount for another tax period (s 6(e)). Double counting or partial prior corrections will defeat the ability to make further corrections under this instrument.
• Debit error culpability bar. Debit errors that were the result of recklessness or intentional disregard of fuel tax law cannot be corrected under this Determination (s 7(a)). The instrument turns on subjective or high-culpability conduct for disqualification; taxpayers should scrutinise the facts to determine whether correction is permitted.
• Time and value limits for debit errors. The ability to correct debit errors is subject to both a time limit and a value threshold tied to current GST turnover (s 7(b)-(c) and the table). For taxpayers with current GST turnover under $20 million, the time limit is 18 months after the due date of the fuel tax return for the period in which the error occurred and the value limit is $12,500. For larger turnover bands the time limit is generally 12 months and the value limits increase up to $560,000 for turnover $1 billion and over (s 7 table). Miscalculating turnover or the net sum of debit errors can lead to an attempted correction being invalid.
• GST group aggregation. If you are part of a GST group, your current GST turnover for threshold purposes must be calculated on a group basis in accordance with subsection 188-15(2) of the GST Act (s 7 note). Treating turnover on an entity basis when a group calculation is required will produce incorrect threshold results.
• Restrictions on amendment of later returns. The Determination expressly prevents correcting an earlier error by requesting amendment of a later tax period’s return (s 8). Attempting that route will not achieve correction under this instrument and may produce procedural complications.
• Narrow definition of credit error. The definition of credit error excludes certain fuel tax credits where entitlement has ceased under Division 47 and some omissions where the omission would have been attributable under subsections 65-5(1)-(3) of the Act (s 4). Taxpayers cannot assume all understatements or overstatements of credits qualify as "credit errors" for correction.
• Reliance on Commissioner notifications. Multiple provisions turn on whether the Commissioner has given written notice or otherwise advised an examination is to be made (s 4, s 6(d)). The taxpayer’s ability to correct may therefore depend on administrative communications; record-keeping and careful attention to correspondence are essential.

Each of these items is anchored in the Determination’s text. Taxpayers seeking to use the correction pathway should audit their facts against each listed requirement and monitor any correspondence or active compliance activity from the Commissioner.

If you intend to correct an error in an earlier tax period by including the correction in a later-period fuel tax return, the Determination sets out a discrete compliance checklist. The following steps follow directly from the instrument and should be used as a source-grounded procedure.

1. Confirm the earlier tax period’s start date. Ensure the earlier tax period you wish to correct started on or after 1 July 2012 (s 6(b)). Corrections under this Determination are limited to those periods.

2. Verify GST registration. Confirm that you are registered for GST at the time you plan to lodge the fuel tax return that will include the correction (s 6(g)).

3. Check for compliance activity. Determine whether the matter to which the error relates is, or has been, the subject of a compliance activity. A "compliance activity" begins when the Commissioner advises you that an examination is to be made and ends when the Commissioner gives a notice of assessment or amended assessment in relation to the tax period under examination or advises you that the examination has been finalised (s 4). If you have been notified the matter is subject to a compliance activity, you cannot use this Determination to correct the error unless the Commissioner gives written notification that the error can be corrected under this instrument (s 6(d)).

4. Ensure the correction has not already been made. Do not attempt to correct an error that you have already corrected, in whole or in part, in another tax period’s net fuel amount (s 6(e)).

5. Distinguish credit errors from debit errors. Use the instrument’s definitions to classify the mistake as a credit error or a debit error (s 4). Remember that certain items are excluded from the credit error definition, specifically fuel tax credits to the extent entitlement has ceased under Division 47 of the Act, and some omissions otherwise attributable under subsections 65-5(1)-(3) of the Act (s 4).

6. For debit errors, establish absence of culpable conduct. Confirm that the debit error was not the result of recklessness as to the operation of a fuel tax law or intentional disregard of a fuel tax law (s 7(a)). If it was, the Determination does not permit correction via a later-period return.

7. For debit errors, calculate the current GST turnover and applicable thresholds. Determine your current GST turnover and identify the corresponding debit error time limit and debit error value limit from the table in s 7. If you are part of a GST group, calculate current GST turnover for the group using subsection 188-15(2) of the GST Act, as the instrument notes (s 7 note). Then:

   • Ensure the later-period fuel tax return in which you seek to correct the debit error is lodged within the relevant debit error time limit (s 7(b)); and
   • Confirm the net sum of the debit errors you propose to include is less than the applicable debit error value limit (s 7(c) and s 4 definition of "net sum of the debit errors").

8. Observe the period of review requirement. Lodge the later-period fuel tax return within the period of review for the assessment of the net fuel amount of the earlier tax period (s 6(c)). The "period of review" is a concept defined in section 110-5 of the Act; ensure your timing complies with that statutory window.

9. Compute the net sum of debit errors. Where a debit-error correction is being made, compute the net sum of the debit errors as the sum of debit error amounts less the sum of any credit error amounts that you include in the net fuel amount for the tax period in which you seek to correct the earlier-period debit error (s 4). Ensure your arithmetic and classifications are documented.

10. Keep records and correspondence. Document the factual basis for the error classification, your calculation of debit and credit error amounts, any GST group turnover calculations, and any Commissioner communications concerning compliance activities or written permissions. The Determination ties availability to administrative notices and the Commissioner’s advice (s 4, s 6(d)); retaining records will assist in demonstrating that the conditions were met.

11. Do not attempt correction by amendment of a later-period return. Section 8 explicitly prevents correcting an earlier-period error by requesting amendment of your fuel tax return for a later tax period. Use the later-period return’s working out of the net fuel amount as the vehicle for correction only if you meet the Determination’s conditions (s 8).

12. If uncertain, seek clarification from the Commissioner. Because the Determination’s availability can depend on the Commissioner’s designation of a compliance activity and potential written authorisation to permit correction, consider seeking written confirmation from the Commissioner where an active examination or borderline fact pattern exists (s 4, s 6(d)).

Following these steps will align the taxpayer’s process with the Determination’s textual requirements. The Determination does not set out filing forms or the exact line-item mechanics; compliance requires applying these eligibility and timing rules to the preparation and lodgment of the fuel tax return in accordance with the Act and any administrative practice of the Commissioner.
