Fuel Quality Standards (Ethanol E85) Determination 2024

The Determination is structured around a small set of legal-technical concepts. These are:

• E85 as a regulated product: The instrument defines E85 as a mixture of petrol and ethanol that is supplied or represented as E85 fuel (Definitions). It also notes explicitly that section 5 requires the fuel to be 70-85% v/v ethanol (Definitions note and Schedule item 5).

• Parameter-based standards: Compliance is defined parameter-by-parameter. The Schedule lists parameters (acidity, benzene, copper, distillation final boiling point, ethanol, ethers with 5+ carbon atoms, inorganic chloride, lead, methanol, MON, oxidation stability, pHe, phosphorus, RON, solvent-washed gum, sulphate, sulphur, vapour pressure (DVPE) at 37.8°C, water) and prescribes limits or ranges for each (s 5(1) and Schedule). Each parameter is a discrete compliance point.

• Specified testing methods for enforcement: For each listed parameter the Schedule names a testing standard (for example ASTM D6839 for ethanol content, ASTM D5191 for DVPE) and s 5(2) states that compliance for the purposes of the Determination is determined using the testing method specified in column 3 of the table.

• Interim targets and method development: The instrument recognises the absence of validated test methods for certain parameters in E85 (MON and RON) and labels the MON 87 and RON 100 minima as interim targets pending the development of testing methods (Schedule note).

• Component compliance linkage: The Determination does not operate in isolation; it requires any petrol component of E85 to meet the petrol fuel standard and any ethanol component to meet the ethanol fuel standard set out in the Fuel Quality Standards (Petrol) Determination 2024 (s 5(3)-(4)). The instrument therefore establishes both composite-product limits and component-level obligations by reference.

• Temporal variation in standards: The sulphur standard changes by operation of the Schedule: a higher cap applies at commencement and a tighter cap applies from 15 December 2025 (Schedule item 17).

• Authority and enforcement context: The Determination is made under section 21 of the Fuel Quality Standards Act 2000 (cl 3) and uses defined terms from section 4 of the Act (cl 4). The instrument contemplates use of inspectors and other authorised persons under the Act to carry out testing using the specified methods (s 5(2) note).

These concepts together create an instrument that is technical in content but legal in force: it sets precise compositional and performance thresholds for a specified fuel product, assigns the laboratory/field methods that will be used to adjudicate compliance, links to component standards in another Determination, and stages at least one temporal tightening of a limit.

The Determination’s language,E85 "must comply" (s 5(1)) and references to inspectors and persons authorised to conduct tests under the Act (s 5(2) note),identifies the parties on whom obligations and enforcement will fall, and the parties likely to bear the costs.

• Suppliers of E85: Entities that supply or represent mixtures as E85 are the primary group affected because the instrument prescribes that E85 must comply with the listed specifications (s 5(1)). Those suppliers will be responsible for ensuring each batch meets the parameter limits in the Schedule because non-compliant E85, when supplied, would fall outside the Determination.

• Manufacturers and blenders: Parties that blend petrol and ethanol into E85 or supply components to blenders will be affected through the compositional requirements and the component-linkage in s 5(3)-(4). The Determination requires any petrol component to meet the petrol standard and any ethanol component to meet the ethanol standard in the Fuel Quality Standards (Petrol) Determination 2024, so blenders must source compliant components or undertake additional processing.

• Fuel distributors, wholesalers, and retailers: Downstream holders and distributors of fuel labelled or represented as E85 will face operational and compliance checks because the product in their custody must meet the standard. They may need to obtain and hold certificates of analysis or batch testing records showing compliance with the specified parameters and test methods.

• Test laboratories and inspectors: The Determination prescribes specific test standards (ASTM, EN, CEN/TS) for inspectors and others authorised under the Act to use for enforcement testing (s 5(2) and Schedule). Accredited laboratories performing these tests will therefore undertake the actual conformity assessments for enforcement purposes. The instrument also contemplates inspectors empowered under the parent Act will use these methods in enforcement testing.

• Engine manufacturers and fleet operators (indirect): The instrument sets ethanol content at 70-85% v/v (Schedule item 5 and definition note), and contains interim octane targets to allow engine calibration. While not obligatorily regulated by this Determination, engine calibrators and vehicle fleet operators have an interest in the published limits because fuel composition influences engine performance and calibration choices. The Determination’s note on MON and RON signals future testing method development that could affect calibration and warranty regimes.

• Regulators and policy advisers: The Minister and the Department administering the Act will be responsible for implementation and operationalisation of testing, monitoring and the staged sulphur reduction. The Determination gives them the technical specification to apply.

Who pays: the direct compliance costs,testing, quality control, possible re-formulation, component purchase at different prices, record-keeping,will fall on the supply chain (blenders, importers, distributors and retailers). The Determination itself does not quantify costs; it prescribes standards that will create those compliance obligations for the groups above.

Who decides: the Minister made the instrument under s 21 of the Act (cl 3). Implementation and enforcement will be exercised by inspectors and authorised persons under the parent Act, who will use the specified testing methods for enforcement tests (s 5(2) note). Suppliers may use other methods for their own assurance (s 5(2) note), but enforcement tests will rely on the listed methods.

The Determination creates specific duties and establishes certain procedural rules for determining compliance. It also signals limited rights of suppliers to use their own testing methods for assurance.

Primary duties

• Product-level duty to meet parameters: E85 "must comply" with each specification listed in the Schedule for the corresponding parameter (s 5(1)). This is the core duty: when the product is supplied or represented as E85 it must, as a product, fall within the numerical and range limits set out.

• Component-level duties by reference: The petrol component of any E85 must meet the requirements of the fuel quality standard for petrol in the Fuel Quality Standards (Petrol) Determination 2024; likewise, the ethanol component must meet the ethanol fuel standard set out in that Determination (s 5(3)-(4)). This imports other obligations onto component suppliers and blenders.

• Specified testing method for enforcement: For the purpose of compliance under the Determination, the test method listed in column 3 for each parameter is to be used by inspectors and other authorised persons to determine compliance (s 5(2)). That makes the listed methods the official enforcement methodologies.

Limited rights and procedural clarifications

• Use of other test methods for internal assurance: The Determination expressly states that subsection (2) does not prevent other persons, including suppliers, from using other test methods to ensure compliance (s 5(2) note). In practice this provides suppliers with discretion over internal quality assurance methods, although results from those methods will not be the authoritative evidence for enforcement testing.

• Interim targets for MON and RON: The Determination sets interim minima for MON (87) and RON (100) while noting testing methods for MON and RON of E85 are not yet available (Schedule note). The note describes these minima as interim targets to allow engine calibration. The effect is a stated objective rather than an immediately enforceable measurement for those parameters until test methods are developed.

Duties of regulators and inspectors (implicit)

• Use specified methods for enforcement: Inspectors and authorised testers under the Act are signposted to the specified methods as the enforcement standard (s 5(2) note). The Determination thereby channels enforcement testing to particular standards organisations and methods.

Other procedural matters

• Commencement mechanics: The whole instrument commences the day after registration (cl 2(1) table). The commencement table is part of the instrument; the instrument warns that the table pertains to the instrument as originally made and will not be amended in the commencement column for later amendments (cl 2(2) note). This fixes the start date from which duties and rights under the Determination take effect.

What the Determination does not do

• It does not itself lay out enforcement sanctions or administrative processes; those remain part of the Fuel Quality Standards Act 2000 under which the Determination is made (cl 3). The Determination confines itself to naming technical specifications, testing methods and cross-referencing component standards.

The Determination contains no independent penalty schedule or operational enforcement regime. It is framed as a standard-setting instrument made under the Fuel Quality Standards Act 2000 (cl 3) and therefore presupposes enforcement, inspection and sanctioning powers provided by that Act rather than by the Determination itself.

What the Determination says about enforcement mechanics

• Designation of enforcement testing methods: The instrument specifies which testing methods enforcement agents will use: "For subsection (1), compliance with the specification for a parameter is determined by using the testing method for that parameter specified in column 3 of that item of the table" (s 5(2)). The accompanying note clarifies that these testing methods are "the methods that will be used by inspectors and other persons authorised to conduct tests on fuel under the Act to determine whether the fuel complies with the relevant fuel standard" (s 5(2) note). That language identifies who will perform enforcement testing (inspectors and authorised persons under the Act) and fixes their laboratory or field test standards.

• Supplier testing permitted but not authoritative for enforcement: The note to s 5(2) gives suppliers and other persons the right to use other test methods for their own assurance, but it also makes clear those alternate methods do not displace the specified methods for enforcement testing. This creates a de facto two-track testing environment: supplier/industry QA can use other validated or practical methods, but enforcement will turn on the specified standards.

What the Determination does not specify

• The Determination does not set out infringement notices, penalties, criminal offences, seizure powers, or procedures for suspension or recall. It therefore delegates all enforcement mechanisms, evidentiary rules, administrative remedies, and penalties to the parent Act and its enforcement instruments. Any practitioner or compliance officer will need to consult the Fuel Quality Standards Act 2000 to identify the specific powers, penalties and procedural safeguards available to regulators and affected parties.

Operational consequences

• Evidentiary certainty: Because enforcement testing is tied to named standards (ASTM D6839, ASTM D5191, etc.), enforcement outcomes will likely rest on laboratory reports prepared to those methods. That creates a predictable evidentiary baseline for inspector-led testing, but also a potential source of dispute where supplier internal tests use different methods that produce divergent results.

• Transitional enforcement risk on MON/RON: MON and RON minima are described as interim targets in the absence of testing methods. Until validated test methods for E85 MON/RON are available, inspectors will not have the specified method to determine compliance for those parameters. That may create uncertainty about enforcement action in relation to MON/RON while a testing method is being developed.

Practical implication for affected parties

• Parties should assume that compliance determinations will be made using the listed standards and prepare to produce or obtain test results in those formats for regulatory interactions. The Determination places that testing norm at the centre of enforcement even though enforcement powers themselves are provided by the parent legislation.

The Determination operates within the statutory framework created by the Fuel Quality Standards Act 2000 and by parallel Determinations, and it also refers to external technical standards bodies. The instrument references and imports obligations by reference.

Primary statutory link

• Parent Act: The Determination is made under s 21 of the Fuel Quality Standards Act 2000 (cl 3). It relies on definitions in s 4 of the Act, and it contemplates enforcement by inspectors and authorised persons under the Act (s 5(2) note). Consequently, liability, inspection powers, enforcement procedures and penalties will be those set out in the parent Act and not in this Determination.

Relationship with other Determinations

• Fuel Quality Standards (Petrol) Determination 2024: The Determination explicitly requires that any petrol component of E85 meet the requirements of the fuel quality standard for petrol and that any ethanol component meet the fuel quality standard for ethanol as set out in the Fuel Quality Standards (Petrol) Determination 2024 (s 5(3)-(4)). That cross-reference imports component-level standards and creates an operational dependency: compliance with the E85 Determination necessarily requires compliance with the separate Petrol Determination for the petrol component and with the ethanol standard for the ethanol component. Practitioners must read the Petrol Determination to identify the full set of obligations that apply to components.

Interaction with technical/standards bodies

• Testing standards: The Schedule lists test methods developed by ASTM International (ASTM codes), the European Committee for Standardization (EN and CEN/TS codes) and others (for example ASTM D6839 for ethanol; ASTM D5191 for DVPE; EN 15837 as modified in CEN/TS 15293 for copper). By naming these specific standards, the Determination aligns regulatory enforcement with the technical protocols of international standards bodies. In practice this means that laboratories and inspectors will need to follow those external standards when producing compliance evidence.

Temporal interaction

• Sulphur reduction timeline: The instrument stages the reduction in permitted sulphur levels: 52 mg/kg maximum from commencement, tightening to 10 mg/kg from 15 December 2025 (Schedule item 17). That staged provision interacts with supply chain planning, procurement contracts and potential transitional provisions under other regulatory frameworks, but the Determination itself governs only these numeric limits and their dates.

Scope and possible ambiguities

• Definition of petrol: The Determination imports the definition of petrol from the Fuel Quality Standards (Petrol) Determination 2024 (Definitions). That means the classification of what constitutes the petrol component for the purposes of s 5(3) will depend on that other Determination. Any dispute about whether a component is "petrol" for the crossover obligation must be resolved by reference to that text.

• Enforcement under the parent Act: Because the Determination does not set out enforcement mechanisms, its interaction with criminal, administrative and evidence law flows from the parent Act and relevant administrative law remedies. Practitioners should therefore treat this instrument as a technical standard that is enforced through the Act’s general regime.

The Determination contains only its original text and a commencement table. It includes explicit notes about the commencement table and its status but does not itself record any amendments having been made since its creation.

• Commencement: The whole instrument commences the day after registration (cl 2(1) table). The instrument contains a note that the commencement table "relates only to the provisions of this instrument as originally made" and that it "will not be amended to deal with any later amendments of this instrument" (cl 2(2) note). That caveat applies specifically to the presentation of the commencement table and signals that subsequent consolidated or published versions may not reflect later amendments within that commencement column.

• No amendment entries: The instrument provides no entries recording any past amendments, repeal, or replacement of clauses. The text as provided should be read as the original Determination text in force from its commencement date.

• Staged standards included within the original instrument: The only temporal change embedded in the original text is the staged sulphur requirement in Schedule item 17: 52 mg/kg maximum "From commencement" and 10 mg/kg maximum "From 15 December 2025". That is part of the instrument as originally made rather than the result of amendment.

Practical note for users

• To determine whether any later amendments have been made after the version supplied here, users must consult the official register of instruments or the legislative database; the instrument itself does not record post-enactment amendments or a revision history in its text. The commencement table’s note cautions users that the table will not be updated to reflect possible future amendments in published versions of the instrument. In short, the Determination as presented contains no recorded amendment history.

The Determination text contains no reference to litigation, judicial review or prior court rulings. There are no cases, decisions, or administrative appeals cited in the instrument itself. The instrument does, however, sit under the Fuel Quality Standards Act 2000 and any enforcement or challenge to its provisions would, in practice, proceed under the procedures and remedies available under that Act and the Administrative Decisions (Judicial Review) Act 1977 or equivalent judicial review frameworks where applicable. The Determination does not specify the forum, procedures, or past decisions.

What the instrument contains:

• No cases named or referenced anywhere in the text.
• No mention of challenges, appeals, or dispute-resolution mechanisms specific to this Determination.
• No judicial interpretation guidance or transitional dispute protocols.

Practical implication

• Any party seeking to challenge an enforcement action, test result or the validity of the Determination will need to rely on the parent Act’s statutory appeal and review mechanisms and on general administrative law principles. Because the Determination sets technical standards, litigation is likely to centre on evidentiary matters (for example, whether specified test methods were correctly applied, or whether a party’s product conforms) and on statutory construction (for example, interpretation of the cross-reference to the Petrol Determination). None of those litigation pathways is described in the instrument itself.

This section flags technical and legal features of the Determination that can catch practitioners and compliance teams if overlooked. These are grounded in the instrument’s text and concern measurement units, test methods, component links, timing, and evidentiary protocol.

1. Units and mixed units across parameters

• The Schedule uses different unit conventions: % v/v (volume per volume), % m/m (mass per mass), mg/kg, mg/L, kPa, minutes and pHe. For example acidity is expressed as 0.006% m/m (Schedule item 1) while benzene is 0.35% v/v (item 2) and lead is 5 mg/L (item 8). Misreading or mis-converting units (mass vs volume) during sampling, labelling or reporting can lead to apparent non-compliance. The Determination’s unit choices are part of the legal specification.

2. Ethanol percentage mandate and labelling implications

• The instrument fixes ethanol at 70-85% v/v (Schedule item 5 and Definitions note). Suppliers must ensure the declared product composition sits within that range if the product is supplied or represented as E85. Any product outside that band but labelled E85 will be non-compliant.

3. Component-level obligations by reference to the Petrol Determination

• The petrol and ethanol components must meet the Petrol Determination’s standards (s 5(3)-(4)). This means a batch meeting all composite parameters could nonetheless fail if the petrol component or ethanol component separately contravenes their respective Determination. The Determination does not reproduce the petrol or ethanol component standards , practitioners must look up the Petrol Determination text to confirm component compliance.

4. Specified enforcement testing methods and supplier QA options

• Enforcement testing will use the methods specified in column 3 of the Schedule (s 5(2) and note). Suppliers are allowed to use different methods for their own assurance, but such alternative results may not be determinative in enforcement scenarios. This creates potential evidentiary conflicts if internal QA uses a different method that gives different results to an inspector’s test under the specified method.

5. Interim MON and RON targets without enforcement methods

• The Schedule notes that testing methods for MON and RON of E85 are not yet available and that the stated minima are interim targets. Until a validated testing method is prescribed for MON and RON of E85, enforcement agents will lack the specified method for those parameters. This introduces uncertainty about enforcement action in relation to octane numbers and raises the possibility of disputes over what constitutes compliance with these parameter minima while the testing method remains unavailable.

6. Staged sulphur reduction

• Sulphur maximum moves from 52 mg/kg at commencement to 10 mg/kg on 15 December 2025 (Schedule item 17). Suppliers must plan procurement and blending arrangements to meet the tighter cap by the specified date; failure to do so will mean non-compliance after 15 December 2025 even if batches complied before then.

7. Specific test standards and version control

• The Schedule lists standards by code (for example ASTM D6839) but does not specify versions or editions. Parties should ensure the versions used by testing laboratories are consistent with what inspectors expect; ambiguity about standard revisions can be a practical source of dispute. The Determination itself does not identify edition years.

8. Testing for copper reference (EN 15837 as modified in CEN/TS 15293)

• The Schedule’s copper test references an EN standard with a modification in CEN/TS 15293 (item 3). Laboratories must apply the combined specification correctly; misapplication of only the base EN standard or only the CEN/TS specification could lead to inconsistent outcomes.

9. Diverse contaminant limits with potential supply-chain implications

• Limits for contaminants such as benzene (0.35% v/v maximum), methanol (0.5% v/v), inorganic chloride (10 mg/kg), phosphorus (1.3 mg/L), sulfate (4.0 mg/kg), copper (0.10 mg/kg) and water (1.0% m/m) may require upstream controls, different feedstock selection, or additional processing steps. The Determination does not prescribe how to meet these levels; suppliers must assess technical means and costs.

10. Distillation final boiling point and volatility controls

• The final boiling point cap is 210°C maximum (Schedule item 4) and DVPE vapour pressure at 37.8°C is required to be 38-63 kPa (item 18). These parameters affect storage and handling, and might interact with fuel system compatibility, but any compliance dispute will turn on tests performed to the specified ASTM methods.

Recognising these specific traps and the instrument’s reliance on external standards and a separate Petrol Determination is essential when advising clients, building compliance programs or negotiating supply contracts.

Compliance with the Determination requires an operational programme that aligns product formulation, component procurement, testing and record-keeping with the technical specifications and the enforcement testing methods the instrument prescribes.

1. Confirm product definition and labelling

• Ensure any product supplied or represented as E85 meets the instrument’s definition and ethanol content: E85 must be a petrol/ethanol mixture and the ethanol proportion must be 70-85% v/v (Definitions note and Schedule item 5). If a product falls outside that range, it should not be labelled or represented as E85.

2. Source compliant components

• Because s 5(3)-(4) requires the petrol and ethanol components to meet the standards in the Fuel Quality Standards (Petrol) Determination 2024, confirm through supplier declarations, certificates of analysis and procurement contracts that component suppliers meet those component standards. Obtain and retain the supplier’s test certificates that reference the relevant standards in the Petrol Determination.

3. Establish a testing protocol that maps to the Schedule

• For each parameter in the Schedule, ensure there is a corresponding testing step in QA workflows that either uses the specified enforcement method or uses an internally validated alternative method with a clear conversion or equivalency protocol. For enforcement purposes, inspectors will rely on the methods listed in column 3 (s 5(2)). Therefore:
  • Arrange for periodic testing by laboratories accredited to perform the specified methods (ASTM D6839 for ethanol; ASTM D5191 for DVPE; ASTM D5453 for sulphur; etc.).
  • If using internal methods different from the specified methods for cost or speed reasons, document method validation and be prepared to procure results to the specified method at short notice for regulatory interactions.

4. Monitor and plan for the sulphur timeline

• Manage procurement, blending and stock rotation to ensure that from 15 December 2025 onwards the sulphur content of E85 does not exceed 10 mg/kg (Schedule item 17). This may require negotiations with crude/ethanol suppliers, different feedstocks, or use of desulphurisation technologies.

5. Implement record-keeping and batch traceability

• Maintain accessible records for each batch of E85 including:
  • Batch composition data showing ethanol % v/v (ASTM D6839 results or equivalent);
  • Certificates of analysis for petrol and ethanol components showing compliance with the Petrol Determination;
  • Test reports for the other parameters using the specified methods or documented internal test results with method descriptions and validation data;
  • Dates and times of production and dispatch to align with the sulphur staging requirement. These records will be the primary evidence in any inspector encounter, and the instrument’s emphasis on specified test methods makes authenticated laboratory reports especially important.

6. Engage accredited laboratories and verify method versions

• Use testing laboratories accredited for the listed methods and confirm which edition or version of each method the lab applies. The Determination lists standards by code (for example ASTM D6839) but does not specify particular editions; ensure that the laboratory’s edition is acceptable to enforcement authorities and that the lab can produce results in that form.

7. Prepare for MON/RON uncertainty

• The Determination sets MON and RON minima as interim targets while test methods are unavailable. For product specification and engine warranty discussions, document the approach to octane (for example, in blending tolerances and engine calibration information) and monitor developments for an authoritative test method. Once a method is prescribed, plan to incorporate MON/RON testing into routine QA.

8. Test for contamination and impurities according to the Schedule

• Ensure testing and control for benzene, methanol, inorganic chloride, copper, phosphorus, sulfate, lead, solvent-washed gum, water and acidity follow the Schedule’s stated limits and are supported by supplier QA and in-house or contracted testing.

9. Audit supply chain and contractual clauses

• Update procurement contracts to require suppliers to certify compliance with the Petrol Determination for petrol components and with relevant ethanol standards for ethanol components. Include warranty and indemnity language for non-compliant components, and consider audit rights enabling access to supplier QA data and test certificates.

10. Prepare for inspector interactions

• Because inspectors and authorised persons under the parent Act will use the listed test methods to determine compliance (s 5(2) note), be ready to:
  • Produce batch records, certificates of analysis and lab reports referencing the specified methods;
  • If internal tests used different methods, be prepared to commission tests to the specified methods promptly;
  • Document chain of custody for samples to avoid evidentiary disputes should an enforcement test be carried out.

11. Keep regulatory liaison and watch for technical updates

• Monitor official updates for:
  • Publication of an official test method for MON and RON of E85;
  • Any published guidance or amendments to the Determination (the instrument itself does not include an amendment history);
  • Clarifying guidance about versions of specified standards to be used in enforcement testing. Maintain a contact point with the administering agency to receive technical guidance and to seek advance clarity on method editions.

By mapping each Schedule parameter to a practical control, documentation and testing action and by aligning procurement contracts with the component-level references, suppliers and distributors can create a defensible compliance programme aligned with the Determination’s enforcement expectations.
