Fuel Quality Standards (Conventional Diesel) Determination 2025

The instrument deploys a compact set of concepts to create a closed technical regime for "conventional diesel" and for blends of conventional diesel with paraffinic diesel. These core concepts appear in the Definitions and in the substance of s 6.

• Conventional diesel. Defined as all fuel supplied or represented as automotive diesel, excluding paraffinic diesel (s 4). The instrument therefore targets fuels that market participants call automotive diesel, and excludes fuels that meet the separate definition of paraffinic diesel, which is governed by the separate Parraffinic Diesel Determination 2025 (s 4; s 6(6) cross-reference).

• Conventional diesel/paraffinic diesel blend. Defined by composition and, importantly, by density: a fuel that is a blend of conventional diesel and paraffinic diesel and has a density between 765 kg/m3 and less than 820 kg/m3 at 15°C (s 4, and note that density is to be determined under item 7 of the s 6 table).

• Parameterised specifications. The instrument lists 18 parameters, each with a hard numerical specification and a mandated testing method (s 6(1)-(2) and the table). The presence of a specific test standard next to each parameter makes the testing method part of the legal compliance rule, not guidance.

• Pre-blend compliance obligation. The instrument requires that biodiesel components meet the Biodiesel Determination 2025 (s 6(3)-(4)); that conventional diesel components of blends already meet this Determination before blending (s 6(5)); and that paraffinic diesel components meet the Parraffinic Diesel Determination 2025 and the s 6(6) table requirements before blending (s 6(6)). The instrument thus treats components as regulated inputs which must be certified as compliant prior to blending.

• Distinct cetane metrics. The instrument uses two related but distinct metrics: a cetane index and a derived cetane number. Item 4 requires a cetane index minimum of 46 for conventional diesel not containing biodiesel. Item 8 requires a derived cetane number minimum of 51 for conventional diesel and conventional/paraffinic blends containing biodiesel, and 46 minimum for blends not containing biodiesel. This creates different testing and compliance thresholds depending on biodiesel presence.

• Testing-method determinacy. Section 6(2) explicitly makes the specified testing method in the table the determinant of compliance for each parameter. The instrument also defines the nomenclature for testing methods (s 4 defines "ASTM followed by an alphanumeric code", "EN followed by a numeric code", "IP followed by a numeric code"), tying the legal rules to international standards.

• Component-specific parameter table for paraffinic diesel components. Section 6(6) supplies a small table with density, derived cetane number and distillation recovery/T95 requirements that a paraffinic diesel component must meet prior to blending.

These concepts create a regulatory architecture that distributes regulatory obligations by product type, by component status, and by the measurement method to be used. The instrument therefore converts technical quality control into legal obligations conditioned on measurable laboratory outputs using enumerated international standards.

The instrument’s text identifies the regulated object as "conventional diesel" and "conventional diesel/paraffinic diesel blends" and refers repeatedly to fuel "supplied or represented as automotive diesel" (s 4, s 6(1)). From that textual foundation the following categories of actors are directly affected by the Determination.

• Refiners and terminals. The instrument contains a specific conductivity requirement that applies to conventional diesel and blends "held by a terminal or refinery for sale or distribution" (item 5 of the s 6 table). The use of that phrase explicitly places duties and testing obligations on operators of terminals and refineries who hold stock for sale or distribution, because the conductivity specification is defined in respect of fuels held by those operators.

• Suppliers and distributors who supply or represent product as automotive diesel. Because the defined term "conventional diesel" is all fuel supplied or represented as automotive diesel, excluding paraffinic diesel (s 4), any person or entity that supplies, sells, markets, labels or otherwise represents a fuel as automotive diesel will be within scope of the technical requirements in s 6(1).

• Blenders. Entities that blend biodiesel with conventional diesel, or blend paraffinic diesel with conventional diesel, are directly affected by the pre-blending obligations in s 6(3)-(6). The instrument requires that biodiesel components and paraffinic diesel components meet other Determinations or the component-specific parameters before they are blended, so blenders must ensure component compliance prior to producing and supplying blends.

• Biodiesel and paraffinic diesel producers and suppliers. Although the Biodiesel Determination 2025 and the Parraffinic Diesel Determination 2025 are separate instruments, this Determination makes those instruments legally relevant: biodiesel and paraffinic diesel components must meet those Determinations prior to blending with conventional diesel (s 6(3)-(4), s 6(6) second paragraph). Producers and suppliers of those components therefore bear obligations in order to be marketable inputs for blending into supplies labelled as conventional diesel.

• Testing laboratories and quality assurance providers. Each parameter in the s 6 table mandates a specific testing method (s 6(2) and the table). Laboratories that perform compliance testing will need to use the referenced methods (for example ASTM D1298, ASTM D5453, EN 14078), and documentation of test results using those methods will be the determinative evidence of compliance under this instrument.

• Downstream users, fleet owners and end users (indirect). While the instrument regulates fuel quality upstream in the supply chain, the specified limits on parameters such as sulfur (10 mg/kg maximum, item 16) and water content (item 17; item 18 for biodiesel-containing fuel) are characteristics that affect combustion, engine wear and emissions. The instrument therefore indirectly affects purchasers and operators of diesel-fuelled equipment because the products they receive must meet the specified parameters, but the text does not impose direct obligations on end-users.

• Persons representing fuels in the market. Because the definition of conventional diesel is tied to fuels "supplied or represented as automotive diesel" (s 4), parties that label, market or present fuel as automotive diesel will be affected; misrepresentations could place the supply outside of the instrument’s intended product class or lead to compliance claims under the parent Act.

The instrument does not itself list enforcement agencies, penalty regimes or registration/licensing requirements. Those operational matters are outside its text and remain matters of the Fuel Quality Standards Act 2000 and associated administrative arrangements (s 3 signals the enabling Act but provides no further enforcement details).

This instrument primarily creates strict technical duties on product quality, pre-blend validation and the testing method to be used. It does not create explicit administrative rights such as appeal or review within its own text, nor does it set out monetary penalties. The principal duties and the limited "rights" implied by the instrument are as follows, with the supporting provisions identified.

Duties

• Comply with parameter specifications. Conventional diesel and conventional diesel/paraffinic diesel blends must meet the specifications listed in the s 6 table for each parameter (s 6(1)). The specifications are expressed as maxima, minima, ranges or thresholds for each parameter (items 1-18).

• Use the specified testing method to determine compliance. Section 6(2) makes the testing method named in the table the method by which compliance is determined. Laboratories and suppliers must therefore test using the exact standard cited for each parameter rather than an alternative method, unless the Act or another instrument provides otherwise (s 6(2)).

• Ensure pre-blend compliance. Sections 6(3)-(6) impose duties on parties supplying components for blending:

  • Biodiesel components used in conventional diesel must meet section 6 of the Fuel Quality Standards (Biodiesel) Determination 2025 before blending (s 6(3)).
  • Biodiesel blended into a conventional/paraffinic blend must meet section 6 of the Biodiesel Determination 2025 before blending (s 6(4)).
  • Conventional diesel components used in blends must meet this Determination prior to blending (s 6(5)).
  • Paraffinic diesel components used in blends must meet the Parraffinic Diesel Determination 2025 definition and the specific parameter requirements listed in s 6(6) prior to blending (s 6(6) and its table).

• For conductivity, maintain minimum conductivity for fuels held by terminals/refineries. Item 5 sets a 50 pS/m minimum at ambient temperature specifically for fuels held by a terminal or refinery for sale or distribution.

• For density, measure at 15°C using ASTM D1298. The definition of a conventional/paraffinic blend is density-based and item 7 sets density bands for conventional diesel and the blends, with the measurement standard specified.

Implied rights and operational matters

• Right to rely on specified tests as determinative evidence of compliance. Because s 6(2) ties compliance to the testing methods named in the table, persons who can show test results produced using those methods have the instrument’s allocated method as the relevant legal benchmark for compliance. That is an operationally important right: the instrument makes the test method the operative compliance trigger.

• Right to supply fuels meeting the definitions. If a fuel meets the numerical specifications and has been tested by the specified methods, the supplier can treat it as compliant with this Determination. The instrument does not create separate registration or approval processes for compliant products within its text.

Limitations and lacunae

• No enforcement provisions or penalties in the instrument itself. The Determination does not state who enforces the rules, the civil or criminal sanctions for non-compliance, monitoring regimes, or appeal mechanisms. Those matters fall to the primary Act or to other instruments and administrative arrangements (s 3).

• External dependencies. Several duties require compliance with other instruments (Biodiesel Determination 2025; Parraffinic Diesel Determination 2025). Rights and obligations therefore depend on the content of those other determinations, which the instrument incorporates by reference. The instrument thereby delegates substantive content to instruments not reproduced in its text (s 6(3)-(4), s 6(6)).

In sum, the instrument converts technical fuel characteristics and internationally recognised test methods into legally binding duties for suppliers, blenders and holders of fuel stocks. It does not itself provide enforcement details, but it gives test methods a central legal role by making them the determinative mechanism for compliance (s 6(2)).

The Determination contains no express penalties, sanction schedules, inspection powers, or enforcement procedures within its own text. The instrument is a standards-making instrument and is made under section 21 of the Fuel Quality Standards Act 2000 (s 3). Therefore, all matters about who enforces the requirements, what sanctions apply for non-compliance, the procedures for inspection, seizure, remedial directions, infringement notices, prosecutions, or appeals are not set out in this Determination itself and must be found in the Fuel Quality Standards Act 2000 or in other administrative instruments and arrangements under that Act.

What the Determination does specify that is relevant for enforcement mechanics is the compliance measurement rule. Section 6(2) makes compliance with each parameter subject to the testing method stated in the table. That design feature has two enforcement implications drawn directly from the instrument:

• Determinative test methods. Enforcement will, by operation of this instrument, rely on test results produced using the standards cited in the table (for example ASTM D86 for distillation T95, ASTM D5453 for sulfur). If an enforcement action is contemplated, the assessor will need to apply those methods to demonstrate a parameter is out of specification or to demonstrate compliance.

• Pre-blend compliance as a potential evidentiary trigger. The instrument makes it a duty to ensure biodiesel and paraffinic components meet their respective determinations before blending (s 6(3)-(6)). In an enforcement context, records or test certificates showing pre-blend compliance could be central evidence to show that a blender took the required steps under this Determination.

Because the instrument is silent on enforcement agencies or penalties, regulated entities must look to the Fuel Quality Standards Act 2000 for those mechanisms (s 3 refers to the enabling Act). The Determination therefore creates a legal duty whose breach is likely actionable under the enabling Act, but the instrument itself does not provide the penalty or enforcement text to specify consequences.

Practically, parties subject to this Determination should assume that non-compliance will be tested against the specific methods listed in s 6 and that demonstration of compliance will require test results using those methods. Operators holding fuel at terminals or refineries should be aware that item 5 imposes a minimum conductivity requirement for stored stocks, and that non-compliance with that parameter would be a discrete measurable breach of the Determination if enforcement procedures under the parent Act were invoked.

In short, enforcement processes and penalties are not in the Determination; the document supplies the technical standards and the precise testing methods that an enforcing authority will apply under the broader statutory framework of the Fuel Quality Standards Act 2000.

The Determination sits as a standards instrument made under a parent statute. The instrument itself specifies cross-instrument dependencies and a statutory authority; beyond those textual links it contains no direct modifications to other legislation. The interactions that are explicit in the instrument are the following.

• Authority under the Fuel Quality Standards Act 2000. The Determination is made under s 21 of the Fuel Quality Standards Act 2000 (s 3). That places it within the hierarchy of subordinate instruments authorised by that Act. The practical consequence in legal terms is that the Determination’s obligations operate as delegated regulatory requirements under the enabling Act rather than as freestanding primary legislation.

• Dependence on Biodiesel and Parraffinic Diesel Determinations 2025. The Determination expressly requires compliance with other Determinations:

  • Biodiesel components must meet section 6 of the Fuel Quality Standards (Biodiesel) Determination 2025 before blending with conventional diesel (s 6(3)).
  • Biodiesel blended into a conventional/paraffinic blend must meet the Biodiesel Determination 2025 before blending (s 6(4)).
  • Paraffinic diesel components must meet the definition of paraffinic diesel in the Fuel Quality Standards (Parraffinic Diesel) Determination 2025 and the table in s 6(6) prior to blending (s 6(6)).

These references make substantive content in other instruments legally relevant for compliance with this Determination. Compliance therefore requires cross-referencing and harmonisation across multiple subordinate instruments.

• Repeal of the 2019 Determination. Schedule 1 repeals the Fuel Quality Standards (Automotive Diesel) Determination 2019 in its entirety (Schedule 1,Repeals, item 1). That repeal means that the 2019 instrument no longer governs the technical standards for automotive diesel; the 2025 Determination replaces it. The instrument does not reproduce or save transitional provisions from the repealed instrument beyond the formal repeal.

• Incorporation by reference of testing standards. The Determination does not restate test procedures; instead it adopts established international or industry test standards by referencing their identifiers (s 4 defines "ASTM followed by an alphanumeric code", "EN followed by a numeric code", "IP followed by a numeric code"). This effectively imports those test protocols into the legal rulebook for compliance. Any interaction between trade marks, standards licencing or accreditation regimes applicable to those testing standards is not addressed in this instrument.

• No explicit conflict or saving clauses. The instrument contains no express clauses describing how it interacts with state or territory law, other Commonwealth instruments, import/export measures, consumer protection law, or tax law. Any overlaps or conflicts would therefore be resolved by the general statutory hierarchy and the Fuel Quality Standards Act 2000, which is the only statutory anchor mentioned in this Determination (s 3).

• Practical cross-regulatory interfaces. While not stated, the Determination’s parameters (for example sulfur, water content, cetane number) intersect with other regulatory regimes in practice , for example environmental law, vehicle emission standards, product liability and labelling , but the instrument itself does not assert or define those intersections. The only explicit statutory interactions in the instrument are with the enabling Act and with the Biodiesel and Parraffinic Diesel Determinations 2025 (s 3; s 6(3)-(6); Schedule 1).

Regulated parties therefore must treat this Determination as part of a suite of subordinate instruments under the Fuel Quality Standards Act 2000, and must consult the Biodiesel and Parraffinic Diesel Determinations 2025 for component compliance obligations. Where broader enforcement or cross-jurisdictional issues arise, the enabling Act and intergovernmental or administrative arrangements outside this instrument will determine the legal interface.

The instrument itself sets a simple amendment history: it is a new Determination, commenced the day after registration, and it repeals the earlier Fuel Quality Standards (Automotive Diesel) Determination 2019 in full (s 2; Schedule 1). There are no other amendments to subordinate instruments recorded within its text.

Key temporal and textual points contained in the instrument are:

• Commencement timing. Section 2 provides the commencement matrix. The instrument states that "the whole of this instrument" commences "the day after this instrument is registered" (s 2(1) and the table in s 2). The instrument also contains a standard note that the commencement table relates only to the provisions as originally made and will not be amended in later versions (s 2 note). There are no staged commencements, transitional periods or grandfathering provisions included in the instrument.

• Repeal of the 2019 Determination. Schedule 1,Repeals contains a single item: the whole of the Fuel Quality Standards (Automotive Diesel) Determination 2019 is repealed (Schedule 1). The instrument therefore replaces the prior Determination as the operative subordinate instrument for automotive/conventional diesel specification. The instrument does not include transitional provisions preserving certain stocks, contracts or licences arising under the 2019 Determination; it simply repeals the previous instrument.

• No other amendments recorded. Section 5 establishes that each instrument specified in a Schedule is amended or repealed as set out in the applicable items in the Schedule concerned (s 5). Schedule 1 contains only the repeal; there are no amendment items for other instruments. The instrument therefore records no incremental amendments to other standards instruments beyond the single repeal.

• No legislative history beyond the instrument. The Determination does not contain an explanatory memorandum, statement of compatibility, or legislative history notes within the text provided. There is no record in the instrument of consultations, regulatory impact statements, or transitional compliance timetables. The only administrative metadata is the signature and date: Chris Bowen, Minister for Climate Change and Energy, dated 16/02/2025 (cover text).

• Definitions and cross-references as structural elements. The instrument creates dependencies on other 2025 Determinations (Biodiesel and Parraffinic Diesel) and on internationally recognised test methods. Those cross-references effectively bind the Determination to the contents and future amendment history of the referenced instruments and standards, but the instrument itself does not track or record amendments to those referenced instruments.

As a result, the amendment history contained within the instrument is minimal: it is a complete replacement of the 2019 Determination, commencing the day after registration, with no staged implementation or saving provisions recorded in the instrument text.

The Determination does not record or reference any litigation, court decisions, tribunal determinations, or prior disputes. There are no cases, judgments, or administrative law decisions cited in the instrument. The text contains only statutory drafting and technical standards; it lists the Minister’s signature and date and then sets out the regulatory content.

Consequences of that absence:

• No documented judicial interpretation in the instrument. Because the instrument is new and contains no litigation history, there is no precedential interpretation of its provisions contained in the instrument. Any legal uncertainties about the meaning of particular clauses, definitional boundaries or the application of testing methods will therefore be unresolved by prior court decisions within the text of the Determination.

• Enforcement and adjudication would be located in the parent Act and general administrative law. The instrument was made under s 21 of the Fuel Quality Standards Act 2000 (s 3). Any disputes over compliance, enforcement measures, admissibility of test results, or the interplay with other instruments will be dealt with under the processes and dispute-resolution mechanisms provided by the enabling Act, and ultimately by the courts or tribunals, but no litigation history is present in the Determination itself.

• Potential areas for litigation (not recorded here). The instrument creates several discrete areas where legal challenges or disputes could arise in practice, though none are mentioned in the text:

  • Proper application of the mandated testing methods and whether a particular lab result is conclusive evidence of compliance (s 6(2)).
  • Classification disputes about whether a fuel falls within "conventional diesel" or is instead "paraffinic diesel" per definitions and cross-references (s 4; s 6(6) cross-reference).
  • Pre-blend compliance obligations and their evidentiary implications where blended products are later found out of specification (s 6(3)-(6)).

Because the instrument does not itself record litigation or prior adjudication, practitioners and affected parties must look to external sources , the enabling Act, agency guidance, or future case law , to find how disputes under this Determination will be resolved. The Determination provides precise technical tests and thresholds, but not adjudicative or interpretive history within its text.

This section flags points in the instrument that commonly cause compliance uncertainty, confusion or implementation difficulty based solely on the instrument’s text. Each "gotcha" is grounded in the Determination’s provisions and the way those provisions allocate obligations, tests and definitions.

• Product classification is density-sensitive and cross-referenced. A "conventional diesel/paraffinic diesel blend" is defined by density: between 765 kg/m3 and less than 820 kg/m3 at 15°C (s 4). Item 7 of the s 6 table prescribes density ranges: for conventional diesel, 820-850 kg/m3 at 15°C; for conventional/paraffinic blends, between 765 and less than 820 kg/m3. Because the blend classification is density-based, small variances in density measurement can change the applicable parameter set. The instrument requires ASTM D1298 for density testing (s 6 table, item 7), so the measurement method is prescriptive; using a different density method will not satisfy the instrument’s compliance test (s 6(2)).

• Different cetane metrics apply depending on biodiesel content. The instrument uses a cetane index for conventional diesel not containing biodiesel (46 minimum, item 4 using ASTM D4737 Procedure A), but uses a derived cetane number for fuels containing biodiesel (51 minimum, item 8(a) using ASTM D6890). Blenders and suppliers must track biodiesel content and ensure the correct cetane test and threshold is used. Failure to apply the right metric may produce a false compliance result because the instrument ties compliance to the specified testing method and parameter (s 6(2); items 4 and 8).

• Lubricity standards vary by blend composition. Item 13 sets different lubricity maxima depending on whether the fuel is pure conventional diesel, a blend with 50% or more conventional diesel, or a blend with less than 50% conventional diesel (IP 450). That means the same fuel stream could be subject to different lubricity requirements depending on the blend ratio. Parties that alter blend ratios during production or in different batches must ensure each batch meets the lubricity specification applicable to its composition.

• Mandatory pre-blend compliance for components. Sections 6(3)-(6) require biodiesel and paraffinic diesel components to meet separate determinations or component-specific parameters prior to blending. This creates a sequential compliance responsibility: component testing must occur before blending, not after. Failure to hold or produce pre-blend compliance evidence for components can create an evidentiary gap if the blended product is later found out of specification.

• Testing-method determinacy. Section 6(2) makes the named testing method the determinative mechanism for compliance. Therefore, even if a different modern or otherwise reputable method produces the same numerical result, the instrument’s text does not authorise its use for legal compliance purposes. Parties must use the exact test standard cited in the instrument for the relevant parameter.

• Conductivity obligation limited to fuel held at terminals or refineries. Item 5 requires a conductivity of 50 pS/m minimum for conventional diesel and blends "held by a terminal or refinery for sale or distribution". That phrasing limits the duty to those holding fuel for sale or distribution, but leaves ambiguous whether conductivity must be maintained in retail tanks, transport tanks, or on-board vehicles. The instrument does not define the scope of "held" beyond the terminal/refinery context. That could produce uncertainty for downstream storage.

• Water specifications differ by test units. Item 17 uses % v/v maximum for water and sediment (0.05% v/v) with ASTM D2709, whereas item 18 gives a water limit in mg/kg (200 mg/kg maximum) for fuels containing biodiesel using ASTM D6304. Parties must ensure they apply the correct parameter and test depending on whether biodiesel is present, and understand conversions between % v/v and mg/kg if needed. The instrument itself does not provide conversion guidance.

• Reliance on external Determinations. The instrument requires compliance with section 6 of the Biodiesel Determination 2025 and the Parraffinic Diesel Determination 2025 for components (s 6(3)-(4), s 6(6)). The content of those referenced instruments determines substantial elements of what is acceptable as a blend input. If those instruments differ in approach, produce conflicting test methods, or are amended separately, the practical compliance obligations for blenders will shift. The instrument does not reconcile or harmonise potential divergences.

• No administrative detail for records, sampling frequency or certification. The Determination is silent on sample sizes, frequency of testing, who is the authorised sampler, record retention, and chain-of-custody. Those procedural items are typically crucial in enforcement but are not specified, leaving potential disputes about whether particular test results are admissible or representative.

• Repeal without transitional provisions. The instrument repeals the 2019 Determination in whole (Schedule 1) but contains no transitional saving or grandfathering clause for existing stocks, contracts or compliance plans under the 2019 instrument. Entities that have compliance systems built to the 2019 specifications must transition immediately upon commencement (s 2), and there is no transitional grace period stated in this instrument.

Each of these points flows directly from the instrument’s wording and choices about measurement, thresholds, product definition and cross-references. Parties should treat them as concrete implementation constraints rather than hypothetical issues.

Compliance under this Determination requires translating the parameter table and pre-blend obligations into operational quality-assurance, testing and procurement procedures. Below are concrete steps, strictly grounded in the instrument’s requirements, that an operator in the supply chain should adopt to achieve compliance.

1. Identify the product category for each fuel stream.

   • Determine whether each fuel is "conventional diesel" or a "conventional diesel/paraffinic diesel blend" by applying the density definition at 15°C using ASTM D1298 (s 4; s 6 table item 7). Density at 15°C is the defining metric for blend classification.

2. Apply the correct set of parameters for that product category.

   • For every batch, confirm compliance with each parameter listed in the s 6 table (items 1-18). Each parameter has a numerical threshold or range, for example sulfur 10 mg/kg maximum (item 16), kinematic viscosity 2.0-4.5 mm2/s at 40°C (item 12), and biodiesel 5.0% v/v maximum (item 2).

3. Use the specified test method for each parameter.

   • Section 6(2) requires use of the testing method named in the table. For example, test sulfur using ASTM D5453, density at 15°C using ASTM D1298, and derived cetane number using ASTM D6890. Ensure laboratories are accredited and competent in these specific methods.

4. Pre-blend verification of components.

   • Obtain and retain evidence that biodiesel components meet section 6 of the Fuel Quality Standards (Biodiesel) Determination 2025 before blending them into conventional diesel or conventional/parraffinic blends (s 6(3)-(4)).
   • Ensure any paraffinic diesel component meets the Parraffinic Diesel Determination 2025 definition and the parameter table in s 6(6) before blending (s 6(6)). For example, verify density 765-810 kg/m3 and derived cetane number 51 minimum using ASTM D1298 and ASTM D6890 respectively.

5. Maintain blending controls and batch records.

   • Because some specifications and tests (for example lubricity, derived cetane number and biodiesel content) depend on blend ratios, maintain strict batch-level blending records and test results for each blended batch. Item 13 (lubricity) imposes different limits based on whether the blend contains 50% or more conventional diesel.

6. For fuels held at terminals or refineries, ensure conductivity and related parameters are met.

   • Item 5 requires conductivity at ambient temperature of 50 pS/m minimum for conventional diesel and conventional/parraffinic blends held by a terminal or refinery for sale or distribution, tested by ASTM D2624. Terminals and refineries should incorporate conductivity monitoring into their holding protocols.

7. Monitor parameters that diverge by biodiesel presence.

   • If biodiesel is present, ensure the derived cetane number is at least 51 (item 8(a)) and conduct water testing by ASTM D6304 where relevant (item 18). For conventional diesel not containing biodiesel, use the cetane index minimum 46 per ASTM D4737 Procedure A (item 4).

8. Establish a testing programme and chain-of-custody.

   • Given the instrument ties compliance to specific tests (s 6(2)), ensure sample collection, preservation and laboratory analysis are documented to demonstrate that the testing method specified was used and that results are attributable to the batch in question. Although the Determination does not specify sampling procedures, a defensible chain-of-custody will be essential if the compliance record is challenged under the enabling Act.

9. Update procurement and supplier contracts to reflect component pre-blend obligations.

   • Include contract clauses requiring suppliers of biodiesel and paraffinic diesel components to certify and provide documentary evidence that their product meets the relevant Determination requirements prior to delivery and blending (s 6(3)-(4), s 6(6)).

10. Convert and reconcile test units where necessary.

    • The instrument uses different units for water: water and sediment 0.05% v/v maximum by ASTM D2709 (item 17) and water in mg/kg maximum 200 mg/kg for biodiesel-containing fuels by ASTM D6304 (item 18). Ensure laboratory reports clearly state which test was performed and the applicable parameter, and avoid informal conversions without documented methodology.

11. Prepare for immediate effect on commencement.

    • The instrument commences the day after registration for the whole instrument (s 2). There is no transitional grace period in this text; entities should be operationally ready to meet the new requirements from commencement.

12. Cross-reference other Determinations.

    • Because the Determination requires compliance with parts of the Biodiesel Determination 2025 and the Parraffinic Diesel Determination 2025, obtain and incorporate the relevant provisions of those instruments into compliance procedures (s 6(3)-(4), s 6(6)).

13. Plan for record retention and audit-readiness.

    • Although the instrument does not prescribe record retention periods, keep test certificates, batch records, pre-blend compliance certificates and chain-of-custody documents in case enforcement action under the Fuel Quality Standards Act 2000 is initiated. The instrument’s reliance on test standards means documentary proof will be central to demonstrating compliance.

14. Anticipate lab accreditation issues.

    • Ensure chosen laboratories are competent in the specified ASTM, EN or IP methods named in the table (s 4, s 6 table). Confirm that lab reports explicitly state the standard used and the test conditions so that results are admissible as the compliance measure required by s 6(2).

Following these concrete steps, grounded in the instrument’s specific provisions, will align operational practices with the Determination’s legal requirements. The critical compliance pillars are correct product classification by density, use of the named testing methods as the compliance determiners, pre-blend verification of biodiesel and paraffinic inputs, and comprehensive batch-level documentation.
