The Bill introduces and recasts a handful of core legal concepts. Define these as they appear in the inserted and amended provisions.

• Relevant instrument (s 56(1); s 54(1)): For compensation and protection purposes the Bill defines "relevant instrument" to mean emergency regulations made under the Part or an order or direction made or given under such emergency regulations (see s 56(1) and the definition in new s 54(1)). This ties compensation and liability protection specifically to emergency regulatory instruments and associated orders or directions.

• Protected action and protected entity (s 54(1)-(2)): A protected action is any act or omission done in good faith by a protected entity in performing or purportedly performing a function under the Part or a relevant instrument, assisting another protected entity in such performance, or otherwise administering the Act (s 54(1)). A protected entity includes the State, the Governor, Ministers, public service officers, and authorities, departments, instrumentalities or persons/bodies to which a direction under s 42 applies, and their members, officers or employees (s 54(1)). The statutory effect is absolute: no tort liability attaches to protected actions (s 54(2)). Subsection (3) extinguishes certain pre-existing tort liabilities from 5 May 2026, and subsection (4) extends the protection to former protected entities in prescribed circumstances.

• Modified penalties and infringement notices (s 49A): The Act is declared a "prescribed Act" for the Criminal Procedure Act 2004 Part 2 and is prescribed under the Fines, Penalties and Infringement Notices Enforcement Act 1994 s 12(1) so Part 3 of that Act applies (s 49A(1)). The Governor may make regulations to implement matters that Part 2 authorises (s 49A(2)). An authorised officer must serve infringement notices within two statutory time-limits: 21 days after forming an opinion that there is sufficient evidence, and within six months of the date the alleged offence is believed to have been committed (s 49A(4)-(5)). The Criminal Procedure Act Part 2 is modified to the extent necessary to give effect to these windows (s 49A(5)). Regulations under this section are expressly not emergency regulations, and s 45 (a procedural limitation in the parent Act) does not apply (s 49A(6)-(7)).

• Approved officers, investigations and prosecutions (s 49B): The Governor may make regulations enabling a prescribed person to approve public service officers as "approved officers" (s 49B(2)). An approved officer may investigate and commence prosecutions for offences under the Act (s 49B(3)). The approval is treated as an appointment for Criminal Investigation Act 2006 s 9(1) purposes (s 49B(4)) and the office and specified powers may be prescribed by the Act or regulations (ss 49B(5)-(7)). Regulations controlling or restricting exercise of Criminal Investigation Act powers may be made and are not emergency regulations; s 45 does not apply (ss 49B(8)-(10)).

• Compensation framework (ss 56-56E): A person may apply to the Minister for compensation for loss or damage caused as a direct result of complying with a relevant instrument (s 56(2)-(3)(a)(i)-(ii)). The Minister's power to pay is discretionary and conditional: the Minister must be of the opinion that the applicant complied with a relevant instrument and incurred the loss as a direct result; that the application is timely or that it is just and reasonable to consider a late application; and that it is just and reasonable to pay the amount (s 56(3)). Applications must contain specified detailed evidentiary material (s 56A). The Minister may require further information via an "information notice" and failure to comply within the stated period (21 days or a longer ministerially-determined period) causes the application to lapse and bars further applications for that loss (s 56B(1)-(4)). The Minister must provide written reasons and amounts if compensation or interest is paid (s 56C). Regulations for applications, verification and prescribed information/docs may be made by the Governor (s 56D). Payments and interest are charged to the Consolidated Account and appropriated accordingly (s 56E(1)); s 52 does not apply (s 56E(2)).

• Transitional cut-off dates (s 63): The Bill sets fixed dates affecting operation and retroactivity. Several core operative cut-offs are keyed to 5 May 2026: liabilities and application of older s 54 and s 55 are modified so that the new s 54 and compensation regime (ss 56-56E) apply, subject to carve-outs and savings, in the manner set out in s 63(2)-(9). The Bill also applies s 50(6) and (6A) to orders made on or after 1 April 2026 (s 63(2)).

Those are the main statutory constructs and their operating mechanics as enacted in the Bill.

The Bill affects four principal groups of legal and economic actors, directly and indirectly.

• The State and its agencies: The Bill expressly treats the State, the Governor and Ministers as "protected entities" (s 54(1)(a)-(c)). It supplies a standing appropriation to the Consolidated Account to fund compensation payments under s 56 (s 56E(1)), and it removes tort liability for protected actions done in good faith relating to administration of the Act or performance of functions under emergency instruments (s 54(2)). The effect on the State is that financial exposure for certain emergency actions is placed within the public budget and managerial discretion of the Minister and Governor through compensation and regulatory design (ss 56, 56D, 49A, 49B).

• Public service officers and approved/authorised officers: The Bill empowers public service officers to become approved officers, who may investigate and commence prosecutions (s 49B(3)). It separately contemplates authorised officers serving infringement notices under the Criminal Procedure Act Part 2 (s 49A(3)-(4)). Individuals appointed or approved under regulations will therefore gain investigatory, enforcement and prosecutorial authorities for offences under the Act. The Bill also extends protection from tort liability to public service officers for protected actions in good faith (s 54(1)(d)).

• Businesses and other private parties subject to emergency regulations, orders or directions: Entities required to comply with emergency regulations or orders made under them are the primary subjects of the enforcement, penalty and compensation regimes. Fines are increased: individual fines go from $10,000 to $50,000 and corporate fines are specified at $250,000 for the section targeted by the Bill (s 49(3), as amended by s 5(1)). These private parties are exposed to infringement notices (time-limited service windows, s 49A(4)) and to prosecution by approved officers (s 49B(3)). They also face a new compensation architecture where losses directly caused by complying with relevant instruments can, in principle, be compensated by the Minister but only under strict evidentiary and temporal rules (ss 56-56C, 56A-56B). Businesses will therefore carry both enforcement risk and a regulatory-dependence risk: compliance may generate losses that are in some cases compensable but only on the Minister's view that it is just and reasonable (s 56(3)).

• Insurers, creditors and the community: The compensation provisions require applicants to disclose insurance recoveries or entitlements and steps taken to claim them (s 56A(1)(f)-(g)). The Bill expressly excludes compensation where loss "directly or indirectly results from" permits, rationing or restrictions on sale or supply of fuel, energy or power (s 56(5)(a)) and where loss is incurred "in like manner by the community at large or by any substantial portion of the community" (s 56(5)(b)). Those exclusions mean insurers and creditors will often be first-order stakeholders in any recovery strategy, and community-level losses are carved out from the ministerial compensation pool.

Secondary effects: legal advisers, accountants and compliance officers managing records, mitigation steps and applications will see increased administrative and evidentiary burden (ss 56A-56B). Parliamentary oversight is reduced in specific respects because several regulation-making powers are explicitly stated not to be emergency regulations and s 45 does not apply to them (see ss 49A(6)-(7), 49B(9)-(10), 56D(2)-(3)). The Bill’s transitional provisions (s 63) also affect parties with pre-5 May 2026 claims: some older rights and liabilities are preserved for acts before that date while claims for losses arising on or after that date fall under the new regime (s 63(3)-(9)).

In short, the Bill shifts enforcement tools and discretionary compensation mechanics from the courts and private law into the executive sphere, affecting regulated businesses, public service officers given investigatory powers, and the State’s fiscal exposure.

This section sets out the principal statutory duties and rights the Bill creates or alters, and identifies who decides and what standard must be met.

Duties and obligations imposed on regulated persons:

• Compliance with "relevant instruments" (emergency regulations and associated orders/directions) is the predicate for compensation eligibility (s 56(3)(a)(i)-(ii)). The applicant must show they "is or was required to comply" and that loss was a direct result of that compliance (s 56(3)(a)). That is both a duty (to comply where required) and a precondition for any statutory right to seek compensation.
• Victims/applicants must lodge an application in writing that includes a detailed statement of the amount claimed, day the loss was incurred, a detailed calculation, a detailed causal explanation linking compliance to loss, mitigation steps taken, insurance information, and any prescribed documents (s 56A(1)(a)-(h)). Applications must accord with any regulations about manner and verification (s 56A(3)(a)-(c)). These are strict evidentiary and procedural obligations on applicants.

Ministerial discretions and statutory standards:

• The Minister has a conditional but wide discretion to pay compensation: the Minister may pay an amount "as determined by the Minister" if satisfied the application meets the statutory conditions and that it is "just and reasonable" to pay (s 56(3)). The Minister may adapt the amount from the claimed figure or make partial payments (s 56(7)). The Minister may pay interest at a rate determined by the Minister if "just and reasonable" (s 56(8)). The statutory standard is expressly subjective and discretionary: "is of the opinion" and "just and reasonable" recur as thresholds (s 56(3), 56(8)). The Bill requires the Minister to give a written notice of decision and reasons "as soon as practicable" (s 56C), but it does not set out an appeal or merits-review mechanism within the inserted provisions.

Time limits and procedural duties:

• For compensation applications, the Bill creates two temporal limits that make an application late if made later than 12 months after the day the applicant incurred loss or 12 months after the state of emergency to which the relevant instrument related ceased to subsist (s 56(4)). A late application can nonetheless be considered if the Minister thinks it is "just and reasonable" to do so (s 56(3)(b)(ii)).
• For information required by the Minister after lodgement, the Minister may give an "information notice" and must specify a period within which the information must be provided: either 21 days or a longer period determined by the Minister (s 56B(2)(a)). Failure to comply within the specified or extended period causes the application to lapse and bars further applications for that loss (s 56B(4)(a)-(b)). The Minister may extend periods or revoke/amend the notice but cannot amend it to make compliance more difficult (s 56B(3), (5)).

Enforcement rights and timelines:

• An authorised officer may serve an infringement notice under Criminal Procedure Act Part 2, but the Bill imposes strict service windows: the notice must be served within 21 days of the officer forming an opinion there is sufficient evidence, and within six months of the alleged offence date (s 49A(4)). The Governor may make regulations to enable application of Criminal Procedure Act Part 2 to the Act (s 49A(2)). The Criminal Procedure Act Part 2 is modified as necessary to give effect to these service windows (s 49A(5)). These are legislative limits on enforcement action timing.

Investigatory and prosecutorial powers:

• Approved officers, as prescribed by regulation, are authorised to investigate offences and to commence prosecutions (s 49B(3)). The approval is treated as an appointment for Criminal Investigation Act purposes (s 49B(4)), and regulations may prescribe Criminal Investigation Act powers an approved officer may exercise (s 49B(6)). The Governor may limit or otherwise regulate exercise of those powers (s 49B(8)). These provisions create statutory investigatory duties and prosecutorial rights vested in named public servants subject to regulations.

Protections from liability:

• Protected entities have no tort liability for protected actions taken in good faith in performing or administering functions under the Part or a relevant instrument (s 54(2)). Liabilities in tort that existed before s 54 was replaced are extinguished if they arose on or after 5 May 2026 (s 54(3)). Former protected entities retain those protections in certain circumstances (s 54(4)). Those are statutory rights to immunity from tort claims in defined circumstances.

Financial obligations on the State:

• Payments of compensation or interest under s 56 are charged to the Consolidated Account and the Bill appropriates them accordingly (s 56E(1)). Section 52 does not apply to compensation or interest under s 56 (s 56E(2)). Thus the State bears the ultimate financial obligation for ministerially authorised compensation.

In summary, the Bill imposes procedural duties on applicants, grants broad ministerial discretion to pay or refuse compensation, creates time-limited administrative enforcement tools, extends investigatory and prosecutorial roles to approved public servants, and limits private-law liability for protected state actors while placing compensation payments on public funds.

The Bill adjusts the enforcement landscape in concrete ways: higher monetary penalties, a time-limited infringement-notice regime, and a regulated cohort of public investigators/prosecutors.

Penalty increases:

• The statutory maximum monetary fines in s 49 are amended. The individual maximum in paragraph (a) is increased to $50,000 and paragraph (b) is replaced to set a corporate fine at $250,000 (s 5(1) amending s 49(3)). Those figures are now the express maximum fines in the identified subsection.

Infringement notices and time limits:

• The Act is declared a "prescribed Act" for Criminal Procedure Act 2004 Part 2 purposes and is prescribed under the Fines, Penalties and Infringement Notices Enforcement Act 1994 s 12(1) for Part 3 application (s 49A(1)). The Governor may make regulations to supply matters Part 2 authorises or requires (s 49A(2)). The Bill imposes two explicit timing constraints for service of an infringement notice by an authorised officer: 21 days after the officer forms the opinion that there is sufficient evidence for the allegation, and within six months after the alleged offence is believed to have been committed (s 49A(4)). The Criminal Procedure Act Part 2 is to be modified as necessary to give effect to those time-limits (s 49A(5)). The limitation on when an infringement notice must be served imposes an enforcement-window discipline on authorised officers.

Investigations and prosecutions by approved officers:

• The Bill allows the Governor to make regulations providing for a prescribed person to approve public service officers as approved officers for investigations and prosecutions (s 49B(2)). An approved officer is authorised to investigate offences and to commence prosecutions for offences under the Act (s 49B(3)). The approval is taken to be an appointment to an office under a written law for public purpose for Criminal Investigation Act 2006 s 9(1) purposes (s 49B(4)). The Act prescribes the office of approved officer under Criminal Investigation Act s 9(1)(a) and allows the Governor to prescribe powers under Crime Investigation Act that an approved officer may exercise where those powers may be exercised by a public officer (ss 49B(5)-(7)). The Governor may restrict the exercise of such powers or make other provision as necessary (s 49B(8)). These clauses vest investigatory and prosecutorial power in specified public officers, subject to regulation.

Other enforcement mechanics:

• Section 50(6) is replaced to specify that an order made under emergency regulations under this Part is subsidiary legislation and that the Interpretation Act 1984 s 42 applies to such an order as if it were regulations (s 7(1)). This treats emergency orders as subsidiary instruments in law, which has consequences for their form and for certain legal treatments under the Interpretation Act (s 50(6A)).
• Regulations under ss 49A, 49B and 56D are expressly not emergency regulations (49A(6), 49B(9), 56D(2)), and section 45 does not apply to the power to make those regulations (49A(7), 49B(10), 56D(3)). The Bill therefore creates categories of regulation-making powers that are excluded from the procedural requirements of s 45 of the parent Act.

Practical enforcement implications:

• The combined effect is to concentrate initial enforcement activity in authorised and approved officers who must operate within the statutory time windows for infringement notices, and to enable these public officers to investigate and bring prosecutions under the Act. The Bill also raises the financial penalties available on conviction or penalty imposition. The Governor’s regulation powers determine the precise scope and limits of approved officers’ investigatory powers and of the Criminal Procedure Act Part 2 application, but the Bill removes certain internal procedural checks by excluding s 45 from the regulation-making powers specified.

The Bill explicitly cross-references and integrates with multiple other statutes and existing provisions, altering inter-legislative operation in specific ways.

Interaction with Criminal Procedure Act 2004 and Fines, Penalties and Infringement Notices Enforcement Act 1994:

• The Act is declared to be a "prescribed Act" for the purposes of the Criminal Procedure Act 2004 Part 2 and is prescribed under the Fines, Penalties and Infringement Notices Enforcement Act 1994 s 12(1) as an enactment to which Part 3 applies (s 49A(1)). The Governor may make regulations prescribing matters Part 2 authorises or requires to be prescribed for a prescribed Act (s 49A(2)). The Criminal Procedure Act Part 2 is modified to the extent necessary to give effect to the statutory time-limits on infringement notice service (s 49A(5)). These provisions integrate the Act into the existing infringement-notice and enforcement machinery of those Acts while making tailored modifications to timing and procedural applications.

Interaction with Criminal Investigation Act 2006:

• For investigation powers, the Bill treats approval of public service officers as an appointment to an office under a written law for a public purpose for Criminal Investigation Act 2006 s 9(1) purposes (s 49B(4)). The office of approved officer is prescribed by this Act under Criminal Investigation Act s 9(1)(a) and the Governor may make regulations prescribing powers in the Criminal Investigation Act 2006 that an approved officer may exercise (s 49B(5)-(6)). Powers prescribed by regulation are prescribed by the Act under Criminal Investigation Act s 9(1)(b) (s 49B(7)). The Bill therefore creates an overlay that enables public service officers, once approved, to exercise specified Criminal Investigation Act powers for the purpose of investigating and prosecuting offences under the parent Act.

Interaction with the Interpretation Act 1984:

• The Bill clarifies that orders made under emergency regulations are subsidiary legislation (s 50(6) as replaced) and that Interpretation Act 1984 s 42 applies to such orders as if they were regulations (s 50(6A) inserted by s 7). That means emergency orders are to be treated consistently with interpretation rules that apply to regulations under the Interpretation Act; the text expressly brings those instruments into the category of subsidiary legislation.

Interaction with parent Act procedures and oversight:

• Several regulation-making powers in ss 49A, 49B and 56D are explicitly excluded from being emergency regulations and section 45 does not apply to the power to make a regulation under those sections (ss 49A(6)-(7), 49B(9)-(10), 56D(2)-(3)). While the Bill does not state in this text what s 45 requires (that is part of the parent Act and not supplied here), the result is that the usual procedural rule encapsulated in s 45 of the Act does not apply to the regulations contemplated, which changes the interrelation between ordinary regulation-making procedures under the parent Act and the powers newly granted.

Interaction with financial provisions:

• Compensation payments are charged to the Consolidated Account and the Bill appropriates them accordingly (s 56E(1)), and s 52 does not apply to compensation or interest under s 56 (s 56E(2)). The Bill therefore creates a standing appropriation and modifies the operation of existing appropriation or payment rules in the parent Act.

Transition and pre-existing claims and liabilities:

• The transitional provisions (s 63) provide detailed cross-Act effects. For example, s 63(3) treats s 54 as never having applied in relation to acts or decisions done on or after 5 May 2026 by the Minister or persons authorised by the Minister, while s 63(4) preserves older s 54 for acts or decisions made before 5 May 2026. Similarly, ss 56-56E apply only to loss or damage incurred on or after 5 May 2026 and older s 56 is taken never to have applied to loss/damage/injury suffered on or after 5 May 2026 (s 63(7)-(9)). The transitional clauses thus coordinate the Bill with prior rights and obligations under the parent Act.

Collectively, the Bill integrates the parent Act with criminal procedure and criminal investigation regimes, treats emergency orders as subsidiary legislation for interpretation, provides a public-funding mechanism for compensation, and sets detailed temporal transitional rules to determine when old and new regimes apply.

The Bill itself is an amending Act; the text supplied records the specific amendments and their operative sequencing. The key amendment steps in the Bill are:

• Short title and commencement (ss 1-2): The Bill becomes the Fuel, Energy and Power Resources Amendment Act 2026 and commences in two stages: sections 1 and 2 on Royal Assent day and the remainder on the following day (s 2). The Bill therefore has an immediate short-title provision and next-day operation for the substantive provisions.

• Formal amendment of the parent Act (s 3): The Bill amends the Fuel, Energy and Power Resources Act 1972. The remaining sections of the Bill specify the textual amendments to particular sections and insertion of new sections.

• Deleting and replacing specific subsections:

  • Section 47(2)(i) of the parent Act is deleted (s 4). The Bill does not reproduce the deleted text in the supplied instrument, but the deletion is recorded.
  • Section 49(3) is amended to increase penalties (s 5(1)). Section 49(5) is amended to modernise language (changing "given to him" to "made", s 5(2)).
  • New sections 49A and 49B are inserted after s 49 to establish the modified penalties/infringement-notice framework and the approved-officer investigation/prosecution scheme (s 6).
  • Section 50(6) is deleted and replaced, and s 50(6A) is inserted to treat orders under emergency regulations as subsidiary legislation and for Interpretation Act application (s 7).
  • Sections 54 and 55 are deleted and replaced by a new s 54 that defines protected action and protected entity and provides immunity from tort liability (s 8).
  • Section 56 is deleted and replaced with an extensive set of provisions (ss 56-56E) setting out the new compensation regime, including requirements for applications (56A), information powers (56B), notice of decision (56C), regulation-making (56D) and standing appropriation (56E) (s 9).
  • Section 58 is amended to carve out ss 56-56E from its operation (s 10).
  • Section 60 is deleted (s 11).
  • Section 63 is inserted to provide transitional provisions detailing how the amendments interact with pre-existing acts, decisions and claims and setting operative dates, notably referencing 1 April 2026 (for s 50(6) and (6A)) and 5 May 2026 (for liability and compensation transitions) (s 12).

• Operative and retroactive sequencing: The Bill’s transitional section (s 63) determines retroactivity and savings for specific provisions and dates. It treats certain earlier provisions as never having applied to acts or claims arising on or after 5 May 2026, preserves prior provisions for acts or rights arising before that cut-off, and applies replacement procedural clarifications to instruments made on or after 1 April 2026 (s 63(2)-(9)).

The text supplied contains no record of prior amending instruments or historical legislative changes to those sections; the amendment history recorded above is the Bill’s internal sequence of deletions, insertions and replacements as enacted by this Bill.

The Bill, as supplied, contains no litigation history, case citations or references to judicial decisions that interpret the amending provisions. There are therefore no named cases in the text to summarise.

That absence is itself consequential for practice: the Bill supplies novel or materially changed constructs that are likely to attract litigation and legal challenge once operative. Based on the statutory mechanics the Bill creates, areas where litigation is likely to arise include the following legal questions and procedural interfaces (these are descriptions of mechanisms in the Bill that generate potential legal controversy, not predictions of outcomes):

• Scope of "protected action" and "good faith" (s 54): The new s 54 provides that protected entities "have, and can have, no liability in tort for a protected action done or made by the protected entity or another protected entity" (s 54(2)). Courts will be required to construe what constitutes a protected action, what it means to act "in good faith" in the statutory context, and how the immunity interacts with common-law tort principles. The Bill applies the protection to former protected entities in specified situations (s 54(4)), and extinguishes certain liabilities arising on or after 5 May 2026 (s 54(3)). Those textual features embed questions of statutory interpretation that litigants may raise.

• Ministerial discretion and justiciability of compensation decisions (s 56): The compensation regime gives the Minister a broad "is of the opinion" and "just and reasonable" discretion to determine whether to pay, and if so how much (s 56(3), 56(7)-(8)). The Bill mandates written reasons (s 56C) but does not create an internal appeal route. Challenges over procedural fairness or reasonableness (judicial review) of ministerial decisions may arise, with courts invited to police the statutory standards the Minister must apply.

• Timing and service of infringement notices (s 49A): The statutory service windows (21 days after an opinion is formed; six months after the alleged offence) are exact. Disputes may arise over when an authorised officer "forms the opinion", when an offence is "believed to have been committed" and whether a served infringement notice was timely. The Bill modifies the Criminal Procedure Act Part 2 "to the extent necessary" to give effect to these limits (s 49A(5)), which may produce interpretative litigation about how the Criminal Procedure Act interacts with these statutory windows.

• Approved officers and Criminal Investigation Act powers (s 49B): The Bill allows regulations to prescribe Criminal Investigation Act powers that approved officers may exercise and treats approvals as appointments under s 9(1) (s 49B(4)-(7)). Litigation could address the lawfulness and limits of exercise of investigatory powers by approved public servants, and the interaction with procedural safeguards in the Criminal Investigation Act. The Governor may limit or restrict the exercise of such powers by regulation (s 49B(8)); disputes could therefore focus on whether particular regulatory limitations are consistent with the authorising statute.

• Transitional extinguishment and retroactivity (s 63): Section 63 contains detailed savings and transitional provisions with operative dates (notably 5 May 2026) and states that older s 56 does not apply to loss or damage suffered on or after that date (s 63(7)-(9)). Litigation may arise when claimants whose claims spanned the cutoff seek to assert older rights or when the State argues that pre-existing liabilities are extinguished.

The Bill itself provides no examples of case law that has already developed under these clauses; it is therefore silent on litigation history. Practitioners working with the Bill should note the substantive sources of potential disputes described above, because the statutory text creates points of legal uncertainty (for example, scope of immunity, discretionary standards, timing rules and investigatory authority). The Bill’s requirements for written decisions and prescribed evidential material (ss 56C, 56A) will be relevant in any judicial review or statutory-interpretation litigation that follows.

This Bill contains multiple procedural triggers, exclusions and timing traps that can defeat claims or materially affect liability and enforcement. The following are concrete "gotchas" drawn from the text.

1. Two strict windows for infringement notices (s 49A(4)):

   • An infringement notice must be served within 21 days after an authorised officer forms the opinion that there is sufficient evidence and within six months after the alleged offence is believed to have been committed. Missing either window would prevent service under the statutory scheme. The Criminal Procedure Act Part 2 is modified to accommodate this dual-window requirement (s 49A(5)). Practitioners should not assume longer detection or service periods.

2. Minister’s information notice can terminate an application (s 56B):

   • After an application is lodged, the Minister may issue a written information notice requiring further documents or information; the applicant has 21 days (or a longer period the Minister specifies) to comply (s 56B(2)(a)). If the applicant fails to comply within the period (or an extension), the application "lapses" and the applicant "cannot make another application under section 56 for compensation for the loss or damage or for any part of it" (s 56B(4)(a)-(b)). That is an unforgiving procedural sanction: a single failure to supply requested further material within the specified period can extinguish the applicant’s statutory opportunity.

3. Tight statute of limitations for compensation applications (s 56(4)):

   • An application is late if made later than 12 months after the day the applicant incurred the loss or 12 months after the state of emergency ceases to subsist in relation to the relevant instrument. A late application can only be considered if the Minister decides it is "just and reasonable" to do so (s 56(3)(b)(ii)). Relying on ministerial clemency for a late filing is therefore uncertain.

4. Certain categories of loss are excluded from compensation (s 56(5)):

   • The Minister "must not pay compensation" for loss that directly or indirectly results from a permit or rationing system, or any prohibition, limitation or restriction on sale or supply of fuel, energy or power, or for loss incurred in like manner by the community at large or a substantial portion thereof (s 56(5)(a)-(b)). Claims that are widespread or arise from rationing systems are categorically excluded.

5. Ministerial discretion over quantum and interest (ss 56(7)-(8)):

   • The Minister may pay an amount different from that claimed, or only partial compensation, and may set interest rates. Applicants cannot assume full recovery or statutory formulas for quantum; the statutory test is "just and reasonable" and the amount is "determined by the Minister" (s 56(3), 56(7)-(8)).

6. No internal appeal mechanism in the Bill:

   • The Bill requires the Minister to provide written reasons and a breakdown if compensation or interest is paid (s 56C) but does not create a statutory right of internal merits review or appeal against refusal or quantum in the text supplied. This absence is a procedural vulnerability for applicants seeking review avenues.

7. Broad immunity for protected entities (s 54):

   • The immunity from tort liability is broad. Protected entities include Ministers, public service officers and bodies subject to ministerial directions; immunity applies to acts done in good faith "in the performance, or purported performance, of a function" under the Part or a relevant instrument, in assisting others or otherwise in administering the Act (s 54(1)-(2)). This removes a common-law route to damages in many circumstances where an act is characterised as a protected action.

8. Standing appropriation charges payments to the Consolidated Account (s 56E):

   • Compensation payments are charged to the Consolidated Account, and s 52 does not apply to these payments (s 56E(1)-(2)). That makes compensation a public funding commitment once the Minister authorises payment.

9. Regulation-making powers excluded from s 45 and excluded as emergency regulations (ss 49A(6)-(7), 49B(9)-(10), 56D(2)-(3)):

   • Several regulation-making powers are not emergency regulations and are not subject to s 45. Whatever s 45 required in the parent Act (the Bill itself does not reproduce s 45) will not bind these new regulation-making powers. That affects the procedural envelope for the Governor and may influence the speed and oversight of regulatory changes.

10. Transitional deadlines and retroactive extinguishment (s 63):

• Transitional rules pivot on the 5 May 2026 cut-off. Section 63 states that older s 56 is taken never to have applied to loss/damage/injury suffered on or after 5 May 2026 and that any claim made before the amendment day in relation to such loss is taken never to have had any effect (s 63(8)). Simultaneously, ss 56-56E apply to loss/damage incurred on or after 5 May 2026 (s 63(7)). Practitioners must carefully trace dates to determine which regime applies and whether existing claims were nullified by the transitional scheme.

These are concrete statutory traps contained in the text that can end claims or alter enforcement prospects. They operate through tight procedural windows, ministerial discretions, categorical exclusions and retroactive transitional provisions.

For operators, compliance officers, insurers and legal advisers, the Bill imposes specific documentary, timing and evidentiary steps to preserve rights and reduce exposure. Compliance should be organised around the statutory prerequisites and the Minister’s information powers.

1. Maintain contemporaneous evidence of compliance and causation:

   • If a regulated entity is required to comply with a relevant instrument (emergency regulation, order or direction), organisations should document the compliance requirement, the actions taken to comply, the dates on which compliance occurred and the direct consequences or losses incurred. The compensation application must include a "detailed explanation of how the applicant’s compliance with a relevant instrument directly resulted in the loss or damage" (s 56A(1)(d)) and a "detailed calculation" (s 56A(1)(c)). Contemporaneous records will be essential to satisfy those documentary thresholds.

2. Preserve detailed mitigation and insurance records:

   • The applicant must provide details of mitigation steps taken and the status of any insurance or other payments (s 56A(1)(e)-(g)). Parties should compile correspondence with insurers, loss-adjuster reports, proof of claims made to insurers, and any denials or coverage limitations. The Minister may take into account whether the applicant took steps to avoid or mitigate loss and any amounts an insurer may pay (s 56(6)(c)-(d)).

3. Apply promptly and verify format:

   • File any compensation application within 12 months of the date the loss was incurred or within 12 months after the state of emergency ceases, unless exceptional circumstances justify a later application that the Minister considers "just and reasonable" (s 56(4), 56(3)(b)(ii)). Applications must be in writing with specified particulars (s 56A(1)) and must be made and verified in the manner prescribed by regulations if such regulations are made (s 56A(3)(a)-(b)). Check the Governor’s regulations under s 56D for prescribed forms or verification requirements and comply strictly.

4. React promptly to information notices:

   • If the Minister issues an information notice under s 56B, comply within 21 days or the period specified. Failure to comply within the period (or any extension) causes the application to lapse and bars subsequent applications for the same loss (s 56B(2)-(4)). Seek extensions promptly and be prepared to show cause for any delay; the Minister has a power to extend but it is discretionary (s 56B(3)).

5. Prepare for infringement notices and prosecution risk:

   • Record interactions with authorised officers and be ready for time-sensitive enforcement action. An authorised officer must serve infringement notices within two specific windows (21 days after forming the opinion and within six months after the alleged offence) (s 49A(4)). If served with an infringement notice or under investigation by an approved officer, obtain legal advice early because the Bill authorises public service officers to investigate and commence prosecutions (s 49B(3)).

6. Anticipate exclusion categories:

   • Claims arising from permit or rationing systems or from community-wide losses are excluded from compensation (s 56(5)). If losses are potentially in those excluded categories, do not rely on the Ministerial compensation scheme and consider alternative recovery routes (insurance or contract claims). Document why a loss falls outside the exclusions if making an application.

7. Track regulations and approvals:

   • The Governor’s regulations under ss 49A, 49B and 56D will flesh out many implementation details (s 49A(2), s 49B(6), s 56D(1)). The Bill disapplies s 45 to those regulation-making powers and declares those regulations not to be emergency regulations (ss 49A(6)-(7), 49B(9)-(10), 56D(2)-(3)), so watch for regulatory instruments being made without the procedural feature s 45 would otherwise require. Similarly, monitor who is named as the "prescribed person" to approve public service officers and which officers are approved under the regulations (s 49B(2)).

8. Document mitigation to preserve discretionary appeal arguments:

   • Because the Minister's decision is discretionary and contingent on whether it is "just and reasonable", establish strong factual grounds showing prompt mitigation, reasonable reliance on the relevant instrument’s demands, unavailability of insurer recovery and the quantum claimed. That factual record will be essential in any challenge by judicial review on procedural fairness or reasonableness if the decision is adverse.

9. Budget considerations for State-exposed payments:

   • For those advising public finance teams, any compensation payments are charged to the Consolidated Account and appropriated accordingly (s 56E(1)), and s 52 does not apply (s 56E(2)). Prepare public-budget forecasts and control frameworks for any contingent liabilities created under the new regime.

10. Reconciling pre- and post-cutoff rights:

    • If an act, loss, claim or right straddles the 5 May 2026 transitional cut-off in s 63, map the chronology carefully. The transitional provisions create different outcomes depending on whether acts or losses occurred before or after
