Fuel Emergency Act 1977

The Act introduces several key concepts that define its operation and scope.

Period of emergency. Defined in section 2 as “the time during which any proclamation of a state of emergency made under this Act in relation to a fuel is in force.” This is the trigger for all ministerial powers. The period begins on the date the proclamation is published in the Government Gazette and ends upon expiry of the three-month limit (unless revoked earlier) or upon revocation by the Governor in Council or either House of Parliament. A proclamation may be limited in time, place and circumstance (section 3(2)), so different parts of Victoria could be subject to different emergency periods. Because a new proclamation can be issued before the old one ends, the emergency could theoretically be extended indefinitely without further parliamentary approval, so long as the Governor in Council is satisfied the conditions still exist.

Fuel. The Act does not expressly define “fuel” beyond stating it must be “any kind of fuel” (section 3(1)). In practice this would cover petroleum products such as petrol, diesel, liquefied petroleum gas, natural gas, and potentially other energy sources used for transport, heating or industry. The Act does not limit fuel to a particular list, leaving the Governor in Council to determine what constitutes a “kind of fuel” for each proclamation. This breadth means the Act could conceivably be applied to biofuels, hydrogen or other alternative fuels if they become widely used, though historically it was enacted in the context of the 1970s oil crisis.

Services. Section 2 defines “services” as “anything done or necessary or expedient to be done for or with respect to the production supply distribution or sale of fuel.” This is an extremely wide definition, covering everything from extraction and refining to transport, wholesaling, retailing and perhaps even advertising or billing. The Minister’s powers in section 4(1) extend to providing, operating, controlling, regulating and directing any service, which means the Minister can effectively take over any function in the fuel supply chain, including by substituting a government-run operation for a private one.

Directions, prohibitions and requisitions. These are the legal instruments through which the Minister exercises powers. A direction is an order to do something; a prohibition forbids something; a requisition demands the use of property. They may be addressed to specific persons or bodies, or to the public generally (section 5(2)). They need not be in writing, though many of the powers listed in section 4(3) refer to “notice in writing”. The verbal nature of some directions creates serious compliance problems: a person may receive an oral instruction on the phone and must comply immediately, but will have difficulty proving later what was required. Section 7(1)(e) gives directions the force of an Act of Parliament - a concept that is constitutionally unusual but traditionally accepted during emergencies.

Compensation. The Act provides a right to compensation for loss, damage or injury caused by compliance with a direction, but only if the person is not otherwise indemnified (section 8(1)). The term “otherwise indemnified” is not defined; it could include insurance or common law indemnities. The claimant must follow a form and time approved by the Governor in Council. The arbitration mechanism uses the Commercial Arbitration Act 2011, with a County Court judge for claims over $1,000 and a magistrate for smaller claims. The $1,000 threshold, unchanged since 1986, means almost any claim today would be heard by a judge, adding cost and delay.

Corporations displacement. Section 11 declares the Act a Corporations legislation displacement provision for Chapter 2D and Chapter 5 of the Corporations Act. This means that during an emergency, normal rules about directors’ duties, officer liability, insolvency, voluntary administration, receivership and winding up are displaced to the extent they would be inconsistent with directions given under the Fuel Emergency Act. For example, a director who complies with a ministerial direction to continue supplying fuel to a particular buyer, even if that makes the company insolvent, may be protected from liability for insolvent trading under Chapter 5. However, the displacement is only “to the extent necessary to avoid the inconsistency”, so the ordinary corporate law continues to apply where the direction does not conflict.

The Act potentially affects every person and body in Victoria, but the practical impact falls most heavily on those directly involved in the fuel industry: producers, suppliers, distributors, transporters, retailers and major consumers. When a state of emergency is proclaimed, the Minister’s power under section 4 can apply to “any service”, which is broadly defined. That means any business that produces, extracts, transports, distributes or sells the affected fuel is directly subject to directions. The directions may be targeted at a specific company (e.g., “direct a person who extracts produces transports or distributes the fuel to extract it for or produce it transport or distribute it to a person specified in the direction” - section 4(3)(b)) or may apply to an entire class of businesses.

Owners of property used in connection with fuel services are also affected. Section 4(3)(i) allows the Minister to “requisition the use of property of any kind which is used or may be used for or in connexion with the operation or maintenance of any service.” This could extend to storage tanks, pipelines, trucks, service stations, refineries or even computer systems used for booking fuel deliveries. The requisition is a forced taking of use, not ownership, but it deprives the owner of control and potential profit. The compensation provision under section 8 applies, but as discussed, the amount is uncertain and the process may be slow.

Consumers are affected indirectly through supply constraints and price controls (if the Minister chooses to restrict prices). The Minister may direct “at what times and places and upon what terms and conditions and in what manner services may be used or availed of” (section 4(3)(g)). That could mean rationing, queuing requirements or prohibitions on certain uses (e.g., recreational boating). Households and businesses reliant on the fuel for heating, transport or production face uncertainty and potential disruption.

The Minister’s delegates under section 6 can include public servants, local government officials or even private persons (the Act does not restrict who may be a delegate). Those delegates exercise the same extensive powers, so a ministerial delegate could issue directions binding on others. The delegate’s actions are attributable to the Minister, but the person receiving the direction must comply regardless of who issued it.

Employees of affected businesses may be directed to work: section 4(2) allows the Minister to employ persons at not less than award rates. This appears to empower the Minister to hire people directly, though it does not explicitly compel existing employees to continue working. However, if the Minister directs an employer to maintain services, the employer must ensure employees work; failure to do so could lead to the employer’s liability for the offence under section 9.

Parliament itself is affected in a limited way: a proclamation can be revoked by resolution of either House (section 3(4)(b)), and if sufficient members petition during a recess, Parliament must be summoned (section 3(5)). But these checks only operate after the proclamation is already in force. During the three-month period, the Minister’s directions have immediate legal effect without any ongoing parliamentary oversight.

The Corporations displacement under section 11 directly affects directors, officers, shareholders and creditors of corporations that are subject to emergency directions. Directors who follow a direction that causes the company to trade while insolvent may be protected from insolvent trading liability (Chapter 5), but they may also find themselves in conflict with their fiduciary duties to shareholders (Chapter 2D). The Act does not expressly override the general law duty of care; it only displaces the Corporations Act provisions. So a director could still face a common law claim for negligence from creditors, even if the statutory liability is removed.

The central duty imposed by the Act is the obligation to comply with any direction, prohibition or requisition made under its authority. Section 5(1) states unequivocally: “Every body and every person to which or to whom any direction prohibition or requisition is addressed or directed under this Act shall comply with such direction prohibition or requisition.” This duty is immediate and absolute. There is no defence of impracticality, impossibility or good faith mistake, though impossibility might be a factor in sentencing for an offence. The duty extends to compliance with “any regulation under this Act” (section 9(1)) - though the Act itself does not provide a regulation-making power, so that phrase may be a remnant or intended to cover future regulations made under other Acts that reference this one.

The duty may be imposed on specific entities or on the public generally. Section 5(2) allows directions to be “addressed or directed to bodies and persons generally or particularly, in writing or verbally, by publication or advertisement or by any other means”. This creates a duty even for persons who never receive actual notice. A published direction in the Government Gazette may be deemed to bind everyone, regardless of whether they read it. The Minister’s choice of means must only appear “practicable appropriate or expedient in the circumstances” - a highly subjective standard that is unlikely to be challenged successfully.

The counterpart right is the right to compensation under section 8. Any person who suffers loss, damage or injury as a result of compliance with a direction, and who is not otherwise indemnified, is entitled to compensation. The right is not automatic; it must be claimed in a form and within a time approved by the Governor in Council. The Act does not set a time limit within which the Governor in Council must approve such forms, so a period of uncertainty could arise. If the claim is denied or no agreement is reached, the claimant can compel arbitration, but the Minister initially directs the matter to arbitration. That suggests the Minister may have a gatekeeping role: if the Minister refuses to refer a claim to arbitration, the claimant may need to sue for breach of statutory duty or seek judicial review. The Act does not provide a direct right to go to court.

The right to compensation is limited to loss, damage or injury “for which he is not otherwise indemnified.” That phrase could exclude losses covered by insurance, contractual indemnities or statutory compensation schemes. Claimants may find their insurance policies seek to avoid liability on the ground that the loss resulted from compliance with a lawful direction. There is no guarantee that insurers will pay, and the exclusion of “otherwise indemnified” may prevent double recovery, but it also creates a trap where the claimant believes they are covered but the insurer denies liability, leaving them without compensation and unable to claim under the Act because they are “otherwise indemnified” in theory.

Another right is the ability to seek revocation of a direction or proclamation by resolution of either House of Parliament (sections 3(4)(b) and 7(1)(d)). However, this is a political right, not a legal one; individual affected persons cannot directly force a parliamentary vote.

The Act does not confer any right to prior notice, a hearing, or reasons for a direction. The Minister is not required to consult with anyone before issuing a direction. The lack of procedural fairness is typical of emergency legislation, but it imposes a heavy burden on those subject to orders, who have no opportunity to argue against the direction’s necessity or terms before it takes effect.

Section 9 creates the primary enforcement mechanism. Any person or body who contravenes or fails to comply with any direction, prohibition or requisition, or any regulation under the Act (though no regulation-making power is present in the current text), is guilty of an offence. The penalty is a fine of up to 50 penalty units (section 9(2)). In Victoria, as of 2024-25, one penalty unit is $192.31, so the maximum fine is approximately $9,615.50 for an individual. For a body corporate, the usual rule is that the maximum penalty is multiplied by a factor (typically 10 under Victorian sentencing provisions), though the Act itself does not specify a different amount for corporations, so the standard Sentencing Act 1991 (Vic) provisions on corporate liability would apply.

The offence is a strict liability offence? The Act does not specify a mens rea element, so it is likely a strict liability offence under the common law presumption for regulatory offences. A defendant would have a defence of honest and reasonable mistake of fact, but not a defence of ignorance of the direction. Given that directions may be verbal or published in obscure ways, this creates a significant risk. A person who genuinely did not hear of a direction could still be convicted if a court finds the Minister’s chosen means of communication was reasonable.

Enforcement actions are not detailed in the Act. Presumably, the offence is prosecuted by Victoria Police or by the relevant department (e.g., the Department of Energy, Environment and Climate Action). The Act gives no explicit power to enter premises to enforce compliance, beyond the Minister’s power under section 4(3)(k) to authorize a person to “enter any land building or structure used for or in connexion with the provision of services.” That entry is for the purpose of exercising powers under section 4, not necessarily for investigation of offences. For enforcement, general criminal investigation powers would apply.

Injunctions or other civil remedies are not mentioned, but because directions have the force of an Act (section 7(1)(e)), non-compliance may also be treated as a contempt of Parliament or similar, though that is untested. Practically, the threat of a fine and the risk of further direction (such as a requisition of property) are the main enforcement levers.

The Act does not provide for personal liability of directors or officers for a corporation’s failure to comply, unlike modern corporate offences. However, a direction can be addressed personally to a director, in which case the director must comply in their personal capacity, not just as a representative of the company. Section 5(1) uses “every body and every person”, suggesting natural persons and corporate entities are both bound. If the direction is addressed to “ABC Co”, the company is liable; if to “John Smith as director of ABC Co”, then John Smith is personally liable. Delegates of the Minister can also be personally liable if they fail to exercise delegated powers properly, but the Act does not create any personal liability for delegates beyond the general law.

The compensation provision under section 8 might be enforced through the arbitration mechanism, but failure to pay compensation is not itself an offence; the claimant’s remedy is to enforce the arbitration award in the usual way.

The Act specifically addresses its interaction with the Corporations Act via section 11, which declares the Act a Corporations legislation displacement provision for Chapter 2D (officers and employees) and Chapter 5 (external administration) of the Corporations Act. This means that during an emergency, the normal rules about directors’ duties, insolvency, and administration are overridden to the extent of any inconsistency with directions issued under the Fuel Emergency Act. For example, if a direction requires a company to continue supplying fuel at below cost, the directors will not be liable for insolvent trading under section 588G of the Corporations Act if that supply causes the company to become insolvent. However, the displacement is limited: it only applies “to the extent necessary to avoid the inconsistency.” Directors still owe common law and equitable duties, and the Act does not displace those. So a director might be safe from a statutory penalty for insolvent trading but could still face a claim from creditors for breach of fiduciary duty at common law. The displacement also does not affect the operation of the Corporations Act in relation to other chapters, such as fundraising or continuous disclosure, unless those provisions become inconsistent in some unforeseen way.

The Act does not explicitly interact with the Essential Services Act 1958, though the long title of the Fuel Emergency Act states it amends that Act. No amendment provisions are shown in the current version, so it is unclear what amendments were made. Possibly the Fuel Emergency Act was designed to supplement the Essential Services Act, which covers broader essential services (electricity, gas, water, transport). In practice, a fuel emergency could overlap with a broader essential services emergency, but the Fuel Emergency Act is fuel-specific.

The compensation provisions incorporate the Commercial Arbitration Act 2011 (section 8(4)). That Act provides the procedural framework for arbitration, including powers of the arbitrator, confidentiality, and court supervision. The Minister’s direction to refer a claim to arbitration is deemed to be the arbitration agreement. This limits the claimant’s ability to take the matter to court directly; arbitration is the default forum. The right to appeal an arbitral award is restricted by the Commercial Arbitration Act.

The Act does not contain any provision overriding the Victorian Charter of Human Rights and Responsibilities Act 2006. That Charter applies to all Victorian statutes, and the Fuel Emergency Act, as a pre-2006 Act, is subject to the Charter’s interpretative principles. A court would be required to interpret the Act’s provisions (especially the broad discretionary powers) compatibly with human rights, including the right to property (section 20) and the right to a fair hearing (section 24). However, the Charter does not give courts the power to invalidate incompatible legislation; it only requires interpretative compatibility. So a direction that clearly authorises a taking of property without just terms would likely be invalid if it violates the Charter, but only if the Act itself cannot be read down.

The Act may also interact with Commonwealth legislation such as the Competition and Consumer Act 2010 (Cth). Directions that restrict supply or fix prices could be authorised by the state emergency, but the Commonwealth Act generally applies to conduct in trade or commerce. The Fuel Emergency Act, being a Victorian statute, cannot override Commonwealth law. However, if the Victorian direction is made under a valid emergency proclamation, it may be argued that the conduct is required by law, creating a defence under competition law. This has never been tested.

The Act does not mention any interaction with the Victorian Fair Trading Act or other consumer protection laws. Directions that require a fuel supplier to prioritise certain customers may breach contractual obligations, but section 7(1)(e) gives directions the force of law, which would provide a defence to breach of contract claims.

The Fuel Emergency Act 1977 received Royal Assent on 3 May 1977 and commenced the same day. It has been amended by six subsequent Acts, all reflected in the current version (Version No. 015 as at 27 September 2012).

The first amendment was by the Penalties and Sentences Act 1981 (No. 9554/1981), which came into effect on 1 September 1981. This amendment substituted references to penalty amounts with the new penalty unit system introduced by that Act. Specifically, section 9(2) was amended to refer to “50 penalty units” instead of a fixed dollar amount, pre-empting later inflation.

The Statute Law Revision (Repeals) Act 1982 (No. 9863/1982) repealed original section 11, which is not reproduced in the current version but likely dealt with transitional or repealing matters. The current section 11 (Corporations displacement) was inserted much later.

The Commercial Arbitration Act 1984 (No. 10167/1984), commencing 1 April 1985, amended section 8(4) to update the reference to the Commercial Arbitration Act (from the earlier 1984 Act to the current 2011 Act in a later amendment). The 1984 Act modernised arbitration procedures.

The Courts Amendment Act 1986 (No. 16/1986), effective 1 July 1986, substituted references in section 8(3) to reflect the then-current court names, likely changing “County Court” to its present title.

The Energy Legislation (Miscellaneous Amendments) Act 2005 (No. 33/2005) amended section 3(1) and (3) on 22 June 2005. The exact wording changes are not given, but the amendment appears to have refined the description of when a state of emergency may be proclaimed, possibly to align with modern drafting standards.

The Commercial Arbitration Act 2011 (No. 50/2011), effective 17 November 2011, updated the reference in section 8(4) from the 1984 Commercial Arbitration Act to the 2011 Act, which adopted the UNCITRAL Model Law.

The most recent amendment is the Energy Legislation Amendment Act 2012 (No. 51/2012), which on 27 September 2012 repealed the existing section 11 (which had been a placeholder since 1982) and inserted the current section 11, which declares the Act a Corporations legislation displacement provision for Chapter 2D and Chapter 5. This was likely a response to the recognition that emergency directions could conflict with corporate law obligations, and was intended to remove uncertainty for directors and officers.

Notably, the Act has not been amended to include any modern accountability mechanisms such as a requirement to table directions in Parliament, a sunset clause on the Act itself, or a review process. Its compensation provisions remain tied to a $1,000 threshold that has not been indexed since 1986. The Act is a product of its era, relying on broad ministerial discretion with limited checks.

The Act has generated virtually no reported litigation. A search of Victorian case law (up to the present) reveals no substantive judicial decisions interpreting the Fuel Emergency Act 1977. This is likely because the Act has rarely, if ever, been invoked. No proclamation of a state of emergency under section 3 appears to have been made since the Act’s enactment, at least not any that sparked legal challenge. The 1970s oil crisis that prompted the Act ended before the Act was passed (it received assent in May 1977, by which time the most acute shortages had passed). Subsequent fuel supply disruptions in Victoria (such as the 1990s petrol price spikes, the 2021 fuel shortage following the Colonial Pipeline cyberattack in the US, or the 2022 Russian invasion of Ukraine) have been managed through market mechanisms or voluntary industry cooperation rather than by invoking emergency powers.

The absence of litigation means the scope of ministerial powers under section 4 has never been judicially tested. Key questions remain unresolved: What limits, if any, exist on the Minister’s ability to requisition property? Can a direction be challenged as ultra vires if it goes beyond what is “necessary” for the emergency? Does section 7(1)(e) granting directions the force of an Act oust all judicial review, including for jurisdictional error? The compensation provision has also never been tested; the meaning of “loss, damage or injury” and “otherwise indemnified” remains untested. The Corporations displacement provision from 2012 has not been the subject of any reported case.

The lack of litigation could also be interpreted as a sign that the Act is not used. This creates a double-edged sword: if the Act were ever invoked, the parties would be in completely uncharted legal territory, with no precedent to guide the Minister, industry participants, or the courts. The risk of litigation would be high, and the outcome uncertain. Industry participants would face difficulty predicting how the courts would view the reasonableness of directions or the adequacy of compensation.

The Act’s potential interaction with the Victorian Charter has not been tested. A challenge based on the Charter’s protection of property (section 20) could arise if a requisition takes property without just terms. However, the Charter only permits a court to declare that the Act is incompatible in some respect, not to invalidate it. So litigation might result in a declaration of incompatibility but not in a remedy for the affected person.

Several features of the Act create traps for the unwary.

Directions have the force of an Act. Section 7(1)(e) is the most dangerous provision. It means that a ministerial direction, published perhaps in a newspaper or announced on radio, becomes as binding as any statute. There is no opportunity to challenge its validity except by judicial review on narrow grounds (e.g., jurisdiction, procedural error). Even then, the Act gives no indication that a court can suspend the direction pending review. A person who inadvertently contravenes a direction because they did not believe it was valid can still be convicted under section 9.

Verbal directions are binding. Section 5(2) explicitly allows directions to be given verbally. A phone call from a departmental officer claiming to act under delegated authority may constitute a binding direction. The recipient has no way to verify the delegation or the authority on the spot, but must comply immediately. Later, proving what was said may be difficult, especially if the direction is disputed.

Compensation is not guaranteed. The right to compensation under section 8 is conditional on the claimant not being “otherwise indemnified.” This phrase is not defined. If the claimant has any insurance or contractual indemnity that might cover the loss, even if the insurer refuses to pay, the government could argue the claimant is not entitled to compensation. Additionally, the claim must be made in a form and within a time approved by the Governor in Council. No such form or time has been publicly issued (as far as known), so the procedure is uncertain. The arbitration process, while available, may be slow and costly, and the Minister can refuse to refer the matter to arbitration, forcing the claimant to take legal action. The $1,000 threshold for a County Court judge arbitrator has not been updated since 1986, meaning even small claims proceed to a higher-cost forum.

No prior notice or hearing. The Minister can issue a direction without any consultation or notice to those affected. This is typical of emergency legislation but creates real compliance challenges for businesses that may have to change operations instantly.

Delegation of powers. Section 6 allows the Minister to delegate all powers (except the power to delegate) to any person, including private individuals. A delegate’s direction is as binding as the Minister’s own. The delegate is not required to have any expertise in the fuel industry. There is no obligation to publish the delegation, so a person who receives a direction from a delegate may have no way to verify that the person has authority.

The three-month limit can be circumvented. Section 3(3) says no proclamation can be in force for more than three months, but it expressly allows another proclamation to be issued before, at or after the end of that period. So the emergency can be extended indefinitely by a series of rolling proclamations. There is no requirement that a new proclamation be based on fresh circumstances, only that it appears to the Governor in Council that the condition still exists.

Parliamentary check is reactive and weak. Parliament can revoke a proclamation by resolution of either House (section 3(4)(b)), but only after it is already in force. If Parliament is not sitting, a petition of at least twenty Legislative Assembly members or thirty MPs including Legislative Council members is required to summon Parliament (section 3(5)). That is a high bar; many emergencies might be over before Parliament can be assembled.

Corporations displacement is limited. Section 11 only displaces Chapter 2D (officers’ duties) and Chapter 5 (external administration) of the Corporations Act. It does not displace other chapters, such as Chapter 2E (related party transactions) or Chapter 6 (takeovers). More importantly, it does not displace the general law duties of directors (fiduciary duties, duty of care at common law). So a director who complies with a ministerial direction that causes loss to creditors could still face a common law claim, even if the statutory penalty for insolvent trading is displaced.

Industry-specific risks. The Act does not exempt fuel retailers from the usual consumer protection laws, but a direction that requires a retailer to sell fuel at a specific price could conflict with those laws. The Act does not provide any defence for such conflicts, leaving the retailer potentially exposed to multiple claims.

If the Fuel Emergency Act were ever invoked, compliance would require rapid action.

Identify whether a state of emergency has been proclaimed. The proclamation must be published in the Government Gazette. All fuel industry participants should monitor the Gazette and official announcements from the Department responsible for energy. Because directions may be communicated verbally or by advertisement, companies should designate a person responsible for receiving official communications and ensure that person has authority to act immediately. Industry associations should set up communication channels with government.

Know who is the Minister and delegates. The Minister is designated by the Premier (section 2). Delegates may be appointed under section 6. A company should request written confirmation of any person’s authority to issue directions, but must comply even if authority cannot be verified immediately. Keep a log of all communications with government officials during the emergency, including times, names and details of instructions.

Respond immediately to directions. Section 5(1) requires immediate compliance. If a direction is impossible to perform (e.g., requires physical delivery that is logistically impossible), the company should immediately inform the Minister and seek a variation. Failure to comply because of impossibility is still an offence, but the Minister may treat non-compliance leniently if the company can show it did its best.

Document all compliance actions. This is crucial for a potential compensation claim under section 8. Record the direction (text, source, time), the action taken, and the resulting loss or damage. Maintain financial records showing incremental costs. At the same time, check whether any insurance or contractual indemnities might cover the loss; if they do, notify the insurer promptly and seek a coverage determination. The existence of other indemnification may bar a compensation claim, but it is better to know early.

If compensation is sought, follow the prescribed form. The Governor in Council must approve a form and time for claims (section 8(2)). If no form has been approved, the claimant should seek clarification from the Department. Do not delay: the Act does not set a limitation period, but the Governor in Council may set one. If the Minister refuses to refer a disputed claim to arbitration, consider seeking judicial review or a declaration that the refusal is invalid.

Review corporate governance. Directors and officers should note the Corporations displacement under section 11. They should seek legal advice on whether a particular direction creates an inconsistency with their duties under Chapter 2D or Chapter 5. If it does, the displacement may protect them from liability under those chapters, but not from common law claims. The board should document its reasons for complying with a direction and any impact on solvency, creditors or shareholders.

Engage with the Minister. The Act does not require consultation, but the Minister can revoke or vary a direction at any time (section 7(1)(d)). Businesses should make representations if a direction is causing disproportionate harm, is technically flawed, or can be implemented less disruptively. There is no formal right to be heard, but ministerial discretion may be exercised more favourably with persuasive evidence.

Prepare for the expiry of the emergency. Directions cease to have effect when the proclamation expires or is revoked, but section 7(2) provides that expiry does not affect previous operation, validity of actions taken, or penalties incurred. So compliance obligations end, but past non-compliance can still be prosecuted. Companies should retain records for at least the limitation period for summary offences (usually one year in Victoria unless extended). Immediate post-emergency, businesses should resume normal operations as quickly as possible but may face transitional issues if fuel supply has been disrupted.

Seek legal advice early. The Act’s broad language and limited precedent mean any direction could have unpredictable consequences. A lawyer experienced in emergency powers and regulatory compliance should be engaged as soon as a proclamation is made. The cost of legal advice is likely to be a necessary business expense, and may itself be compensable under section 8 if incurred as a result of compliance (though that is untested).

No standard compliance procedure exists. The Act does not prescribe any licences, approvals, or reporting requirements. Compliance is entirely reactive: respond to whatever direction is given. The best preparation is to have robust business continuity plans that include the ability to rapidly reallocate fuel supplies, prioritise customers, and document decisions. Individual businesses should not assume they will be exempt, even if their operations are small or remote.
