What it does
These regulations remake the list of agencies and classes of information that are exempt from the Freedom of Information Act 1991 (SA) (the Act). They repeal and replace the 2008 regulations on the same subject. The core effect is to withdraw certain government information from the FOI access regime, meaning an agency that is declared an exempt agency (either wholly or in respect of specified information) has no obligation to process or disclose that information in response to an FOI application.
The regulations operate through the statutory definition of “exempt agency” in section 4(1) of the Act. That definition allows the Governor to declare, by regulation, that an agency is an exempt agency for the purposes of the Act. Once declared, the agency is not required to deal with FOI requests for the information covered by the declaration. The 2023 regulations consolidate and update the exemption list. Regulation 4 creates full exemptions for four agencies: the Inspector under the ICAC Act schedule 4, the three electricity lessor corporations (Generation, Distribution, Transmission), the Commission of Inquiry into Children in State Care and Children on APY Lands, and each agency established under the Health and Community Services Complaints Act 2004. Those agencies are completely outside the FOI regime for all information they hold.
Regulations 5 through 13 create partial exemptions. They declare certain agencies to be exempt in respect of only specific classes of information or functions. For example, regulation 5 exempts education ministers and the Department for Education from FOI requests for “comparative student performance information”, a term defined in subregulation 5(2) to include aggregated results, tertiary entrance ranks, and aggregated exemption data. Regulation 8 gives the SACE Board an exemption for ten detailed classes of information, from student results and comparative school performance to marking standards, examination papers, assessment of students with disabilities, and the identity of board members. Regulation 9 exempts the Small Business Commissioner from all information except its own financial and administrative information and non-identifying statistical data. Regulation 10 exempts the Department of Treasury and Finance for information formerly held by the defunct RESI Corporation. Regulation 11 exempts the CTP Regulator for information relating to motor vehicle claims and confidential information gained under Part 3 of the CTP Insurance Regulation Act. Regulation 12 extends the exemption to any agency that holds or has exchanged information with the now-dissolved Parliamentary Budget Advisory Service. Regulation 13 exempts the Public Advocate when exercising guardian functions, conducting investigations of affairs under the Guardianship and Administration Act, or performing dispute resolution functions under the Advance Care Directives Act or the Consent to Medical Treatment and Palliative Care Act.
