Free TAFE Act 2025

FT (Free TAFE) is shorthand for the program under which the Commonwealth provides financial assistance to States to deliver free places. The Act does not define “free” in absolute terms; instead, the definition of “FT place” in section 5 is “a free place in a course at a TAFE institution or a course provided by another VET provider.” A note immediately following the definition clarifies: “An FT place may not be free of all fees. The fees covered will depend on the terms and conditions of the relevant FT agreement.” This is a critical nuance: “free” is a label applied to a place that may still attract some fees, depending on the agreement. The concept of “free” is therefore a matter of contractual definition, not statutory guarantee.

FT agreement is defined in section 7 as an agreement (as amended from time to time) that: (a) is entered into and in force between the Commonwealth and one or more States; (b) sets out the terms and conditions on which financial assistance is to be provided for the delivery of FT places; (c) relates to delivery during the calendar year starting 1 January 2027 or a later calendar year; and (d) is expressed to be an FT agreement for the purposes of the Act. This limits the temporal scope: no FT agreement can cover years before 2027. The agreement may be bilateral (Commonwealth and a single State) or multilateral (Commonwealth and multiple States). The agreement is the sole vehicle through which financial assistance flows; no State can receive a grant under section 6 unless it is a party to an FT agreement.

FT place means a free place in a course at a TAFE institution or a course provided by another VET provider. The term “TAFE institution” is not further defined in the Act, but TAFE is defined as “technical and further education.” “Other VET provider” is likewise undefined, leaving scope for the FT agreement to specify which providers (e.g., private registered training organisations) are eligible. The note clarifies that not all fees may be waived; the agreement defines which fees (e.g., tuition fees, material fees) are covered.

VET means vocational education and training. Ministerial Council means a body (however described) consisting of the Commonwealth Minister and each State Minister responsible for skills and training. State includes the ACT and the Northern Territory. Rules are legislative instruments made by the Minister under section 11, subject to the limitations in section 11(2). The Rules cannot create offences, civil penalties, powers of arrest/detention/entry/search/seizure, impose a tax, set an appropriation amount, or amend the Act directly. The Rules may prescribe matters required or permitted by the Act, or necessary or convenient for carrying out the Act.

The Act directly affects the Commonwealth, each State (including the ACT and Northern Territory), TAFE institutions, other VET providers that receive funding for FT places, and students (or potential students) who enrol in those places. Indirectly, the Act affects employers and industry bodies that rely on the VET system for skilled labour, and taxpayers who fund the grants.

For the Commonwealth, the Act imposes a duty to make grants under section 16 of the Federal Financial Relations Act if a State is a party to an FT agreement. The Commonwealth must also negotiate and enter into FT agreements (though there is no statutory duty to reach agreement) and must consult the Ministerial Council before seeking to amend the Act. The Minister may make Rules, but those Rules are limited in scope.

For States, the Act offers access to Commonwealth funding but conditions that funding on entering into an FT agreement. The State must spend the grant in accordance with the agreement, provide information to the Commonwealth on enrolment numbers, completion numbers, funding amounts, priority groups, and other matters listed in section 8(1)(l), and comply with any performance milestones. Failure to comply with the agreement could result in withholding or clawback of funds, depending on the agreement’s terms. States must also decide what proportion of funding goes to TAFE institutions versus other VET providers (section 8(1)(h)), and which groups are prioritised for access (section 8(1)(e)). The Act does not mandate a minimum or maximum proportion for TAFE versus other providers, leaving that to negotiation.

TAFE institutions are explicitly recognised in the object (section 3(b)) as “key pillars of the VET sector.” They are likely to be the primary recipients of funding under FT agreements, but the Act does not guarantee any particular share. Other VET providers (private RTOs, community providers) are eligible to receive funding for FT places if they are listed in the agreement or belong to a class of providers specified in the agreement (section 8(1)(i)). This means private providers can be included or excluded at the discretion of the parties to the agreement.

Students are the intended beneficiaries: they may access a course without paying some or all fees, depending on the FT agreement. The Act focuses on “priority cohorts” (section 8(1)(e)), which may include people experiencing economic disadvantage, women in non-traditional trades, Indigenous Australians, people with disability, young people, job seekers, or others. The Act does not create any enforceable right for an individual student to demand a free place; it operates entirely through agreements between governments. Students have no statutory right of action under this Act.

Industry and employers are affected insofar as the FT places are directed to “areas of high workforce demand, with emerging skills needs or that are otherwise a national or State priority” (section 3(e)). The Act may influence the supply of skilled labour in certain sectors, but the selection of priority areas is left to the FT agreements.

Duty of the Commonwealth to make grants: Under section 6(2), if a State is a party to an FT agreement, “[t]he Commonwealth is to make a grant of financial assistance under section 16 of the Federal Financial Relations Act 2009.” This appears mandatory once the agreement is in force. The grant is for the purpose of making payments in accordance with the FT agreement.

Condition on the grant: Section 6(3) provides that the financial assistance is payable on condition that it is spent in accordance with the FT agreement. Section 6(4) adds that the grant is subject to such additional terms and conditions as set out in the FT agreement. This means the Commonwealth can impose conditions beyond those in section 8, and the State must comply or risk the grant not being payable.

Duty of the Minister to consult before amendment: Section 9(1) requires the Minister to consult the Ministerial Council if the Minister proposes to introduce a Bill to amend the Act. Section 9(2) requires the Minister to table in the House a report on that consultation when the Bill is introduced. This is a procedural duty; it does not require the Minister to follow the Council’s views.

Duty of the State to provide information: Section 8(1)(l) and (m) require the FT agreement to include a requirement for the State to provide information on total funding, Commonwealth funding, courses, enrolments, completions, and priority group enrolments, in a specified form, manner, and period. The State must comply with these reporting obligations.

Rights of the State: A State that is party to an FT agreement has the right to receive grant payments under section 6, subject to the conditions in that agreement. The State also has a right to be consulted via the Ministerial Council on proposed amendments (section 9), though that right is procedural rather than substantive.

No right to a grant without an agreement: Section 6 only applies if a State is a party to an FT agreement. A State cannot compel the Commonwealth to enter into an FT agreement; the Act does not create a right to be a party. Similarly, a State that is not a party receives no grant under this Act.

Rights of VET providers and students: The Act itself confers no rights on VET providers or students. Any rights they have will derive from the FT agreements (e.g., a provider’s right to be paid for delivering FT places, a student’s right to a free place) as implemented through State law or contract. The Act does not create a direct cause of action for a provider or student against the Commonwealth or a State.

Power to make Rules: Section 11 gives the Minister power to make legislative rules, but those rules cannot create offences, civil penalties, powers of arrest/detention/entry/search/seizure, impose a tax, set an appropriation amount, or amend the Act. This limits the scope for ministerial overreach through delegated legislation.

The Act contains no specific penalty provisions, enforcement mechanisms, or dispute resolution procedures. Enforcement is left entirely to the contractual terms of each FT agreement and to the general law governing Commonwealth grants. The Act does not create any offences or civil penalties for non-compliance. Section 11(2)(a) explicitly provides that the Rules cannot create an offence or civil penalty, so no penalty can be introduced by delegated legislation.

The primary enforcement tool is the condition attached to the grant. Under section 6(3), the financial assistance is payable “on condition that the financial assistance is spent in accordance with the FT agreement.” If a State breaches that condition (e.g., by spending funds on non-FT places or failing to report information), the Commonwealth could withhold future payments or seek repayment of funds already provided, depending on the terms of the FT agreement. The FT agreement may also include performance milestones (section 8(1)(g)), financial consequences for non-performance, or audit clauses. The Act does not specify any recovery mechanism, so the Commonwealth would need to rely on the contract, the Federal Financial Relations Act, or general law remedies such as debt recovery or damages for breach of contract.

The Federal Financial Relations Act 2009, under which the grants are made, may contain its own enforcement provisions. However, the Free TAFE Act does not cross-reference those provisions beyond stating that sections 6(2)-(4) do not limit the operation of that Act (section 6(5)). The Commonwealth could potentially suspend or terminate an FT agreement for breach, but that would operate under the agreement’s terms, not under this Act.

There is no provision for private enforcement. No individual student, provider, or third party can sue under this Act for failure to deliver FT places or for misuse of funds. Students who are denied a free place have no statutory remedy; they would need to rely on State law, administrative law, or the terms of the FT agreement if those terms are incorporated into State law.

Accountability to Parliament is limited to the Minister’s obligation to table a consultation report when amending the Act (section 9). There is no requirement to report annually on the number of FT places delivered, the amount spent, or the outcomes. The reporting duty is on States to provide information to the Commonwealth (section 8(1)(l)), but the Act does not require that information to be made public or tabled.

Federal Financial Relations Act 2009: This is the primary law under which grants are made. Section 6(2) of the Free TAFE Act provides that the grant is to be made “under section 16 of the Federal Financial Relations Act 2009.” Section 16 of that Act allows the Commonwealth to make grants to a State to support the delivery of specified outputs or projects. The Free TAFE Act effectively directs the use of that grant power for FT places, subject to an FT agreement. Section 6(5) clarifies that nothing in the Free TAFE Act limits the operation of the Federal Financial Relations Act, meaning the general provisions of that Act (e.g., on terms and conditions, recovery of overpayments, reporting) continue to apply unless inconsistent. The Federal Financial Relations Act itself contains no specific penalties but provides that grants are subject to terms and conditions determined by the Minister.

Constitutional grants power: The Act operates under the Commonwealth’s power to grant financial assistance to the States under section 96 of the Constitution. The Act does not attempt to legislate directly on vocational education; it simply attaches conditions to grants. This is consistent with the traditional federal framework: the Commonwealth provides funding, and States deliver services in accordance with agreements. The Act does not restrict other Commonwealth grant-making powers; section 10 expressly states that the Act does not limit the Commonwealth’s power to make other grants for FT places. This means the Commonwealth could make grants outside this Act (e.g., through specific purpose payments or agreements with individual providers) without being constrained by the Free TAFE Act.

State laws on VET regulation: The Act does not override or interact directly with State VET regulatory laws, such as those governing registration of training organisations, quality standards, or student fees. The FT agreements may require States to comply with certain national standards, but that is a contractual matter. The Act does not create any new regulatory obligations for VET providers; those obligations remain under State and Commonwealth laws such as the National Vocational Education and Training Regulator Act 2011 (for registered training organisations) and the Australian Skills Quality Authority’s standards.

Other Commonwealth VET funding laws: The Act does not repeal or amend any other law dealing with VET funding, such as the Vocational Education and Training Funding Act or annual appropriations. It operates alongside those laws. A State could receive funding under this Act and under other Commonwealth programs for the same or different purposes, provided the FT agreement permits it. The Act does not purport to be the exclusive source of Commonwealth funding for TAFE.

Legislative rules: Section 11 allows the Minister to make rules by legislative instrument. These rules are subject to disallowance and are legislative instruments under the Legislation Act 2003. The rules cannot amend the Free TAFE Act or override Federal Financial Relations Act. They must be consistent with the Act and cannot create offences or civil penalties. The rules power is limited to prescribing matters required or permitted by the Act, or necessary or convenient for carrying out or giving effect to the Act. This means rules could prescribe details such as the form of information reporting, definitions of “priority groups,” or procedures for variation of agreements, but not the core policy choices that are reserved for the FT agreements.

The Free TAFE Act 2025 received Royal Assent on 27 March 2025 and commenced on 28 March 2025 (the day after Royal Assent) per section 2. There have been no amendments to the Act since its enactment, as it is a new statute. The explanatory materials (second reading speech) indicate the Bill was introduced in the House of Representatives on 7 November 2024 and passed the Senate on 6 February 2025. The Act is only a few months old at the time of this writing.

Future amendments would require legislation passed by both Houses of Parliament and would be subject to the consultation requirement in section 9. The Minister must consult the Ministerial Council before introducing a Bill to amend the Act, and must table a report on that consultation. This creates a procedural hurdle but not a veto; the Commonwealth could proceed without the Ministerial Council’s consent. The consultation requirement applies only to amendments to the Act itself, not to changes in FT agreements or the Rules.

Given the Act’s design, most of the substantive policy (which courses are free, which providers, which priority groups, funding amounts) is not in the Act but in the FT agreements, which can be varied by the parties without amending the Act. The Act’s durability depends on whether future governments wish to maintain the “Free TAFE” brand and the commitment to 100,000 places per year. The object in section 3 is aspirational, not enforceable, so a government could reduce funding or change the structure without breaking the law, as long as it continues to enter into FT agreements. The Act does not guarantee a minimum number of places or a minimum funding level; the 100,000 figure is stated as an object (“support the delivery of at least 100,000 FT places”), not a duty.

Amendments could be made to expand the scope (e.g., to include non-TAFE providers without restriction, to cover earlier years, to impose stronger conditions on States) or to restrict it. The consultation requirement may be removed by later amendment (since it is part of the Act). Any amendment must comply with the normal legislative process; there is no entrenchment.

As of this writing (shortly after enactment), there is no litigation history directly under the Free TAFE Act 2025. The Act has not been judicially considered. No cases have been reported involving its interpretation, and no constitutional challenge has been filed. The Act is designed to operate through bilateral agreements, which are typically not justiciable by third parties. However, potential grounds for future litigation can be identified.

Constitutional validity: The Act relies on the Commonwealth’s grants power (section 96 of the Constitution) and the Federal Financial Relations Act. A challenge could be mounted on grounds that the conditions in FT agreements are so onerous as to be coercive or that they infringe on State autonomy in the field of education. However, the High Court has traditionally given a broad reading to the grants power, and conditions that are not disproportionate to the purpose of the grant are usually upheld. The Act does not mandate any particular policy; it merely provides a framework for agreements. A challenge would likely fail, but cannot be ruled out if future agreements impose conditions that effectively dictate State policy in areas beyond VET.

Contractual disputes between Commonwealth and a State: The most likely litigation would be between the Commonwealth and a State over the interpretation or enforcement of an FT agreement. For example, a dispute could arise over whether a State spent funds in accordance with the agreement, whether it met performance milestones, or whether it provided required information. The Act does not provide for dispute resolution, so the parties would need to rely on the agreement’s terms, which may include arbitration, expert determination, or litigation in a court (likely the Federal Court or a State Supreme Court). The Act itself would be relevant to the extent that it defines the meaning of “FT agreement” and incorporates the agreement by reference. A court would interpret the agreement in light of the Act’s object and definitions.

No private right of action: Students, VET providers, or taxpayer groups have no standing under the Act to enforce its provisions. A student denied a “free” place cannot sue for breach of statutory duty because the Act creates no such duty to individuals. A provider excluded from funding cannot challenge the Act directly; they would need to rely on State law or administrative review of the State’s decisions. Class actions or representative proceedings are unlikely.

Judicial review of ministerial decisions: The Minister’s power to make Rules under section 11 is subject to judicial review under the Administrative Decisions (Judicial Review) Act 1977 if the Rules are legislative in character (which they are, as legislative instruments). A challenge could argue that a Rule exceeds the power in section 11 or conflicts with the Act. Similarly, a decision to enter or not enter an FT agreement may be subject to review if it is deemed a decision under an enactment, but this is highly uncertain given the broad discretion.

1. “Free” does not mean free of all fees. The note to the definition of “FT place” in section 5 states clearly that an FT place “may not be free of all fees” and that the fees covered depend on the FT agreement. A student who enrols expecting zero cost may still face charges for materials, administration, or other fees not covered by the agreement. The Act does not require that tuition fees be fully waived. The word “free” in the Act’s short title and object is therefore a marketing term, not a guaranteed outcome. Practitioners advising clients should check the relevant FT agreement for exactly what is covered.

2. The Act does not guarantee 100,000 places. The object in section 3(a) states the Act is to “support the delivery of at least 100,000 FT places across Australia each year.” This is an objective, not a statutory duty. The Act does not require the Commonwealth to fund that many places, nor does it give any person a right to demand that number. The actual number of places depends on the FT agreements and available appropriations. A State may negotiate fewer places; the Commonwealth may provide less funding.

3. No funding before 2027. Section 7(c) requires that FT agreements must relate to delivery in the calendar year starting 1 January 2027 or later. This means the Free TAFE Act has no application to the 2025 and 2026 calendar years. Any “Free TAFE” programs announced for those years are funded under other legislative authorities, not this Act. The Act provides a framework for the future, not the present.

4. Key matters can be missing without invalidating the agreement. Section 8(2) says an FT agreement is not invalid merely because it does not deal with one or more of the matters listed in paragraphs (a) to (k). Those matters include the period, priority areas, number of places, priority groups, payment schedule, performance milestones, proportion of funding to TAFE versus other providers, eligible providers, review arrangements, and variation process. An agreement could omit all of these and still be a valid FT agreement under the Act, as long as it meets the four elements in section 7. This gives the parties enormous flexibility but also creates uncertainty: there is no statutory floor for what must be included. A State could sign an agreement that lacks any detail and still receive grants, which carries a risk of misuse or lack of accountability.

5. The Ministerial Council consultation requirement is weak. Section 9(1) requires the Minister to consult the Ministerial Council before introducing a Bill to amend the Act. But “consult” does not require agreement; it merely requires the Minister to listen to the Council’s views. The Minister must table a report on what consultation took place, but not the Council’s response or reasons for ignoring it. This creates a procedural formality that can be satisfied with minimal engagement.

6. Rules cannot create penalties, but they can impose significant obligations. Section 11(2) prohibits the Rules from creating offences or civil penalties, but the Rules can prescribe many other matters. For example, the Rules could define what constitutes a “priority group,” set out the form and manner of reports, or impose additional requirements on States or providers. Because the Rules are legislative instruments, they are subject to disallowance, but disallowance requires parliamentary action, which is often difficult in practice.

7. The Act does not limit other Commonwealth grant-making power. Section 10 preserves the Commonwealth’s ability to make other grants for FT places outside this Act. This means the Commonwealth could bypass the FT agreement framework entirely and make direct grants to providers or to States on different terms. This creates the risk of double funding or inconsistent conditions for States that receive both this grant and another grant for the same places. It also means the Act is not the exclusive vehicle for Free TAFE policy.

8. No individual enforcement rights. As noted, no student, provider, or taxpayer can sue under the Act for failure to deliver. The only parties with standing are the Commonwealth and a State, and enforcement relies on the FT agreement’s terms. If a State misuses funds, the Commonwealth can withhold future payments, but there is no mechanism for individual redress.

For the Commonwealth (Department of Skills and Training, and Minister): The Minister must ensure that any FT agreement meets the requirements of section 7: it must be in force with a State, set out terms and conditions for financial assistance, relate to a calendar year starting on or after 1 January 2027, and be expressed to be an FT agreement. The Minister must also ensure that the agreement deals with the key matters in section 8(1) to the extent desired (though omission does not invalidate the agreement). Before introducing any Bill to amend the Act, the Minister must consult the Ministerial Council and table a report on that consultation. Rules made under section 11 must comply with the limits in section 11(2) and be made by legislative instrument. The Commonwealth must make grants under section 16 of the Federal Financial Relations Act for each State that is a party to an FT agreement; refusal to make a grant despite an existing agreement would be a breach of section 6(2). The Commonwealth should also establish internal procedures for monitoring State compliance with the agreement’s terms, including receiving information required under section 8(1)(l), and for taking action if conditions are breached.

For a State (including ACT and NT): The State must first enter into an FT agreement with the Commonwealth if it wishes to receive grants under the Act. The State should ensure the agreement covers the matters in section 8(1) to the extent it wants clarity, but agreement is not required to cover all matters. The State must spend the grant money in accordance with the FT agreement (section 6(3)) and comply with any additional terms and conditions (section 6(4)). This means the State must apply the funds only to approved courses and FT places, and must not divert them to other purposes. The State must also provide required information to the Commonwealth: total and Commonwealth funding amounts, courses, enrolments, completions, and breakdown by priority groups, in the form and within the period specified in the agreement. The State must comply with performance milestones and review arrangements. If the State varies the agreement, it must follow the process set out in the agreement. The State should also ensure that its own allocation of funding to TAFE institutions versus other VET providers (if specified in the agreement) is respected, and that only eligible providers receive funding for FT places.

For TAFE institutions and other VET providers: Providers do not deal directly with the Commonwealth under this Act; they are funded by their State under the FT agreement. Providers should ensure they understand the terms of the relevant State’s FT agreement as it applies to them. They should confirm that the courses they deliver are approved as FT places under the agreement, that the fees they charge conform to the fees covered by the agreement, and that they provide any data or reports required by the State for the State to meet its reporting obligations. Providers should also be aware that the Act does not give them a statutory right to funding; their funding depends on the State’s allocation decisions and the agreement’s terms.

For students: Students have no direct compliance obligations under the Act. They should check with their prospective TAFE or VET provider whether the course is an FT place, and which fees (if any) are still payable. The Act does not create rights for students, so any complaint about fees or denial of a place must be pursued through the provider’s complaints process or through State consumer or education laws. Students can contact the relevant State training authority to verify the priority groups and eligibility criteria.
