Forests (Licences and Permits) Regulations 2019

The Regulations organise forest use around a few recurring legal concepts: authorised written authority, licences and permits under s 52 of the Act, specified conditions enforceable as criminal offences via the Act, branding of forest produce, and administrative discretion vested in the Minister and the Secretary.

Authorised written authority and delegated authorisation. Regulation 6 makes a range of basic activities within State forest unlawful without the Secretary’s written authority (see reg 6(2)-(6)). The Secretary may grant such authority in writing and attach conditions (reg 6(7)-(8)). Elsewhere, the Secretary may issue temporary permits for cattle entry to reserved forest (reg 7(2)), and the Minister is the addressee for licence applications and many conditions. Thus the regulatory architecture distinguishes between powers exercisable by the Minister (licensing and conditions, regs 8-13) and certain operational authorities granted by the Secretary (reg 6 and reg 7(2), reg 17). Practitioners should note the Regulations create overlapping decision-makers rather than a single decision point.

Licences and permits under section 52 of the Act. The Regulations presuppose that licences and permits come from, and attach to, section 52 of the Forests Act 1958. The Regulations do not themselves grant licences; they prescribe the form, required contents of an application (reg 8), and a suite of mandatory conditions (regs 9-13). The instrument also reiterates that failure to comply with a prescribed licence condition is an offence under the Act (notes in regs 10-11 and reg 13).

Prescribed conditions and enforcement through the Act. The Regulations set binding duties on licence-holders: restore damage at their own cost to the Minister’s satisfaction (reg 9(1)-(2)); pay royalties, dues, fees and charges on demand or by specified date (reg 9(3)); obtain written authority before sowing, constructing, or using poisons (reg 9(4)-(6)); limit cutting to Minister-branded or specified trees (reg 10(1)); and comply with the Code of Practice for Timber Production 2014 if licensed to cut and take away forest produce (reg 11). The Regulations specify timeframes for production of information and declarations (reg 10(3); reg 12(4)) and attach criminal penalties for failure or for false or misleading statements (reg 12(3)-(5)).

Branding and identification. Regulations 14-17 identify two official brands , a crown brand with a number and a broad arrow , to be used by authorised officers under section 99 of the Act and list the authorised uses (reg 15-16). The crown brand signals authorisation to fell, release of seized produce, authorised removal, or grading (reg 15). The broad arrow marks trees not to be felled, seized produce, or produce not to be removed until the crown brand obliterates it (reg 16). The Secretary may require licence-holders to submit a distinctive brand for registration (reg 17). The Regulations therefore create a mechanical control over what may be cut and how produce is identified and traced.

Distinction between State forest and reserved forest. The instrument uses both terms in different contexts: the prohibitions in reg 6 are framed within a "State forest", whereas cattle-entry controls in reg 7 and grazing/ agistment conditions in reg 13 refer to "reserved forest". The text does not define those terms within the Regulations themselves; they must be read with the Forests Act. That terminological split produces different operational rules depending on the statutory land classification.

Applied external standard. Regulation 11 makes compliance with the Code of Practice for Timber Production 2014 a condition of licences permitting cutting and removal. The Endnotes confirm that Code is applied in full. This imports an external document as a regulatory standard without reproducing its content in the Regulations.

Penalties by reference to penalty units. The offences carry specified penalty units (10 or 20), with the Endnotes explaining the statutory mechanics for converting units to dollars (Sentencing Act 1991; Monetary Units Act 2004) and giving the value for the 2019-20 year.

Collectively, these concepts establish a regulatory regime in which licences and temporary permits, written authorities, branded identification and procedural information flows operate to control timber harvesting, experimental areas, gatekeeping, and grazing in State and reserved forests.

The Regulations affect several discrete actor groups, with different obligations and potential penalties. Identify who pays, who decides, and who must change behaviour.

Primary regulated persons

• Licence and permit applicants and holders under section 52 of the Forests Act 1958: These persons must apply in the Minister’s approved form (reg 8) and comply with a broad suite of conditions (regs 9-13). Obligations include rectifying environmental and infrastructure damage at their own expense (reg 9(1)-(2)), paying royalties and charges on demand (reg 9(3)), not sowing seed or using poisons without written Ministerial authority (regs 9(4)-(5)), seeking written authority before constructing improvements (reg 9(6)), and complying with the Code of Practice for Timber Production 2014 where cutting/taking forest produce is authorised (reg 11). Licence-holders who cut/dig/take forest produce must also supply information and make declarations on request within 14 days or face penalties (regs 10(3), 12).

• Grazier/owner/person in charge of cattle: reg 7 makes it an offence for an owner or person in charge of cattle to enter or allow cattle into a reserved forest except under a licence or temporary permit (reg 7(1)). Holders of grazing and agistment licences have further mandatory operational conditions (reg 13), including prior notice to an authorised officer before admitting cattle (reg 13(1)), prohibition on admitting bulls (reg 13(2)), notification to the Minister within 14 days following removal (reg 13(3)), and obligations around identification records and mustering authority (reg 13(4)-(6)).

Secondary actors and administrative decision-makers

• The Minister: decides licence applications in the approved form (reg 8(1)); specifies additional information if requested (reg 8(2)(d)); sets the satisfaction standards and time for rectification of damage (reg 9(1)-(2)); determines royalties, dues and fees and may demand payment (reg 9(3)); grants written authorisations for sowing, poison use and construction where appropriate under reg 9(4)-(6); requests declarations from licence-holders (reg 12(1)).

• The Secretary: may give written authority for acts otherwise prohibited in a State forest (reg 6(7)); the written authority must state the acts and persons and may carry conditions (reg 6(8)). The Secretary may issue temporary permits for cattle entry into reserved forest (reg 7(2)). The Secretary may require a licence-holder to submit a distinctive brand for registration (reg 17). The Secretary’s powers include operational authorisations distinct from the Minister’s licensing function.

• Authorised officers: designated officers in the field have powers to use the prescribed brands under section 99 of the Act, to mark trees and forest produce (regs 14-16). The Regulations refer to "authorised officer" without defining the appointment mechanism; practitioners must consult the Act for definitions.

Affected public and marketplaces

• Buyers and transporters of forest produce: obligations around marking and consignment information (reg 12(3)(b)-(b)(iii)) and the brands’ uses (regs 14-16) affect traceability and lawful movement of logs and produce. Broad arrow marking can legally restrain removal until a crown brand obliterates it (reg 16(c)), creating an operational stop on consignments until authorised.

• Communities and research institutions using experimental areas: reg 6(4)-(5) criminalises unauthorised entry to fenced experimental areas and interference with experimental equipment within State forests, potentially affecting researchers and contractors; authorised entry requires the Secretary’s written authority.

Who bears costs and enforcement risk

• Licence holders bear rectification costs (reg 9(1)-(2)), costs associated with mustering or removing cattle (reg 13(6)), and must pay royalties and fees set by the Minister (reg 9(3)). They also face criminal exposure for failing to supply required declarations or making false statements (reg 12(3)-(5)).

• Owners/persons in charge of cattle face criminal penalties if they enter reserved forests without lawful licence/permit or temporary permit (reg 7).

• The Minister and Secretary bear decision-making discretion and administrative burdens: they must process approved forms, request further information, issue written authorities or temporary permits, and specify conditions and standards of repair. The Regulations confer margin-of-discretion choices to the Minister and Secretary but do not prescribe detailed procedural timeframes for decisions.

Actors not expressly covered by the Regulations

• The Regulations do not, in the text provided, set out approval timelines for processing applications, appeal or review routes, or fee schedules; such matters are either in the Act, in separate administrative instruments, or left to Ministerial determination. Practitioners should therefore read these Regulations alongside the Forests Act 1958 and any departmental administrative guides.

In short, the Regulations primarily target licence-holders under s 52 and cattle owners/persons in charge of cattle, while vesting operational authority and discretionary administrative powers in the Minister and the Secretary, and creating duties that transfer direct costs and compliance burdens to the licence-holders and graziers.

This section sets out the principal affirmative duties imposed on regulated persons and the specific rights or discretions the instrument creates for decision-makers. Citations are to regulation numbers in the text.

Key duties on licence and permit applicants and holders

• Application content duty. An application must be made to the Minister in the form approved by the Minister and must include the applicant’s name and address, the purpose, the area, and any additional information the Minister requests (reg 8(1)-(2)). This creates an administrative duty to supply prescribed particulars and to comply with ad hoc information demands.

• Rectification and remediation duty. Licence-holders must ensure that any damage or obstruction they or their employees cause to listed infrastructure within the licensed area is rectified at their own expense to the Minister’s satisfaction and within the time the Minister specifies (reg 9(1)). The list includes roads, tracks, fire breaks, culverts, drains, water races, dams, buildings, bridges and other structures. This places financial responsibility for repair and gives the Minister evaluative control over remediation standards and timing.

• Pollution and watercourse duty. Licence-holders must rectify any obstruction or pollution of reservoirs, rivers, streams or watercourses caused by them or their employees at their own expense, to the Minister’s satisfaction and within any time specified (reg 9(2)). The duty addresses water quality and hydrological infrastructure.

• Payment duty. Licence-holders must pay royalties, dues, fees or charges determined by the Minister on demand or by any date the licence specifies (reg 9(3)). The Minister determines the amount; the Regulations do not cap or fix royalties. Payment is a condition of the licence.

• Prohibitions on land improvement and chemical use. Licence-holders may not sow seed, attempt cultivation or pasture improvement, or use poisons/insecticides/agricultural spray except with the Minister’s written authority (regs 9(4)-(5)). These regulatory constraints restrict land-use intensification absent Ministerial consent.

• Construction duty. Licence-holders must not construct or alter landings, buildings, fences, gates, ramps, dams or other improvements without written authority from the Minister; if authority is given, construction must follow the Minister’s directions (reg 9(6)(a)-(b)).

• Targeted cutting duty and debris removal. Holders of licences authorising cutting, digging or taking away forest produce may only fell those trees or groups of trees that the Minister has branded or otherwise specified (reg 10(1)). They must meet Ministerial requirements about removal/disposal of structure, debris, material or residue arising from cutting, to the Minister’s satisfaction and within the time specified (reg 10(2)).

• Information and declaration duties. If the Minister requests in writing, licence-holders must provide information relating to cutting, digging and removal within 14 days (reg 10(3)). The Minister may require licences to make declarations in a Minister-approved form for specified periods; the declaration must set out quantity and description of forest produce cut/dug/taken, marking/identification, location of removal and consignment destinations (reg 12(1)-(4)). False or misleading statements in such declarations are penalised (reg 12(5)).

• Code of Practice duty. Holders of licences to cut and take away forest produce must comply with the Code of Practice for Timber Production 2014 as approved under the Conservation, Forests and Lands Act 1987 (reg 11). The Endnotes confirm the Code is adopted in full.

• Grazing-specific duties. Grazing and agistment licence-holders must give prior notice to an authorised officer before admitting cattle (reg 13(1)), must not admit bulls (reg 13(2)), must notify the Minister within 14 days of cattle removal (reg 13(3)), must advise the Minister in writing of number, sex and identification marks before admitting cattle (reg 13(4)), must obtain written authority before mustering cattle depastured in reserved forest (reg 13(5)), and must meet costs of mustering or removal (reg 13(6)).

Duties imposed by criminal prohibitions

• State forest operational prohibitions. Within State forest, persons must not, without the Secretary’s written authority, leave gates open or damage gates/fences (reg 6(2)); fell or deface trees with inscribed survey marks (reg 6(3)); enter fenced experimental areas, tree nurseries or plantations where entry is known or ought to be known to be prohibited (reg 6(4)); damage or interfere with experimental equipment (reg 6(5)); or sell goods, things or services (reg 6(6)). Each carries the penalty recorded at the foot of the subregulation (20 penalty units).

• Reserved forest cattle prohibition. Owners or persons in charge of cattle must not enter or allow cattle to remain in reserved forest except under a licence/permit issued under the Act or a temporary permit from the Secretary (reg 7(1)-(3)). Non-compliance attracts the stated penalty (20 penalty units).

Rights and discretions for decision-makers

• Minister’s discretion to request more information and to set licence conditions: the Minister approves application forms, can require additional information (reg 8(1)-(2)(d)), specify the time and satisfaction standard for rectification (reg 9(1)-(2)), determine fees/royalties (reg 9(3)), grant or withhold written authorisations for sowing/poisons/construction (reg 9(4)-(6)), request declarations and specify periods (reg 12(1)-(2)).

• Secretary’s discretion to authorise prohibited acts in State forest and to issue temporary permits for reserved forest cattle entry: the Secretary may give written authority for otherwise prohibited acts (reg 6(7)-(8)) and may issue temporary permits for cattle entry to reserved forest subject to conditions (reg 7(2)). The Secretary may also require registration of a licence-holder’s distinctive brand (reg 17).

• Authorised officers’ operational use of brands: authorised officers are entitled to use the prescribed crown or broad arrow brands for the stated operational purposes in regs 15-16, under the Act’s s 99(8) and s 99(24) cross-references.

Mechanics of enforcement

• Failure to comply with prescribed licence conditions is an offence under section 52(4) of the Act, as the Regulations note in multiple places (see notes appended to regs 10, 11 and 13). The Regulations therefore convert many administrative conditions into enforceable criminal conditions through the Act.

• Penalties are expressed in penalty units which convert to monetary amounts under the Sentencing Act 1991 and Monetary Units Act 2004 (Endnotes). For the financial year commencing 1 July 2019, the unit value given is $165.22, making a 20 unit penalty $3,304.40 and a 10 unit penalty $1,652.20 before rounding rules.

In summary, the Regulations create precise duties for applicants and licence-holders,largely operational, recordkeeping, remediation and payment obligations, while vesting significant discretion in the Minister and Secretary to impose conditions, require information, and authorise or restrict activities.

The Regulations use two interlocking enforcement mechanisms: (1) specific criminal offences set out in the Regulations with penalties expressed in penalty units, and (2) conversion of prescribed licence conditions into offences under section 52(4) of the Forests Act 1958, as the Regulations’ notes state.

Penalties specified in the Regulations

• Offences within State forest (regulation 6): most of the prohibitions in reg 6 carry a penalty of 20 penalty units stated at the foot of the subregulation. Those include leaving gates open or damaging fences (reg 6(2)), felling or defacing trees bearing inscribed survey marks (reg 6(3)), entering fenced experimental areas or nurseries where entry is or should be known to be prohibited (reg 6(4)), damaging or interfering with experimental equipment (reg 6(5)), and selling goods or services without written authority (reg 6(6)). The text explicitly attaches "1. 20 penalty units" to these subregulations.

• Reserved forest cattle offences (regulation 7): reg 7(1) makes it an offence to enter reserved forest with cattle or allow cattle to remain there except under a licence/permit or a temporary permit; reg 7(3) penalises non-compliance with temporary permit conditions. These are each accompanied by "1. 20 penalty units".

• Declarations and information offences (regulation 12): failing to provide a requested declaration within 14 days and making false or misleading statements in declarations each carry a penalty noted as "1. 10 penalty units" (reg 12(3)-(5)).

Mechanics of monetary penalties and conversion

• The Endnotes explain that penalties are by reference to penalty units as defined in the Sentencing Act 1991 and are converted to dollars by multiplication by the value fixed under the Monetary Units Act 2004. For the financial year commencing 1 July 2019, the value of a penalty unit is given at $165.22; the Endnotes note the amount may be rounded to the nearest dollar and that the Treasurer fixes future values (Endnotes, Explanatory details).

• Using the 2019-20 unit value printed in the Endnotes, a 20 penalty unit offence equates to $3,304.40 prior to rounding, and a 10 penalty unit offence equates to $1,652.20 prior to rounding. The Regulations themselves do not provide dollar equivalents.

Enforcement actors and delegated discretion

• The Secretary and the Minister exercise enforcement-related rights in different ways. The Secretary may give written authority for otherwise prohibited acts (reg 6(7)-(8)) and issue temporary permits for cattle entry (reg 7(2)). The Minister specifies satisfaction standards for rectification/remediation and may demand royalties, dues and fees (reg 9(1)-(3)). Both the Minister and Secretary therefore possess discretionary administrative instruments that affect whether a person commits an offence.

• Authorised officers operate at the operational enforcement level through the use of prescribed brands to mark trees and forest produce (regs 14-16). These brands are tools for indicating approval to fell, the status of seized produce, or to restrain removal until authorised. The broad arrow brand expressly signals that produce not be removed until obliterated with a crown brand (reg 16(c)), which is an on-the-ground enforcement lever.

Interaction with section 52 of the Forests Act 1958

• The Regulations repeatedly note that failure to comply with a prescribed licence condition is an offence under section 52(4) of the Act (see notes in regs 10, 11 and 13). The Regulations therefore rely upon the Act for secondary criminal enforcement, converting the breach of conditions into offences under primary legislation. The Regulations themselves do not set imprisonment or other non-monetary penalties; those must be read against the Act and sentencing law.

Procedural enforcement gaps and administrative discretion

• The Regulations do not detail enforcement procedure such as inspection powers, timeframes for Ministerial or Secretary decisions, or appeal/review avenues for administrative decisions under the Regulations themselves. Enforcement therefore depends on the Act and departmental practice for process. The Minister’s control over standards ("to the satisfaction of, and within the time specified by, the Minister",see reg 9(1)-(2)) creates discretion about what constitutes compliance and when, giving the Minister a central enforcement posture.

• The Secretary’s power to issue written authorities and temporary permits (regs 6(7) and 7(2)) is a positive compliance pathway but also a mechanism that concentrates operational discretion within the Department.

In practical terms, regulated persons face monetary penalties set by reference to penalty units for specified breaches, face criminal liability for breaching conditions that are prescribed under the Act as offences, and must navigate discretionary Ministerial and Secretary authorisations that control lawful activity in State and reserved forests.

The Regulations are expressly constructed to operate in tandem with the Forests Act 1958 and to adopt an external Code of Practice; they are also tied into broader statutory machinery for penalty units and subordinate legislation. The Endnotes and in-text cross-references make the dependencies explicit.

Primary legislative connection: Forests Act 1958

• Authorising provision. The Regulations are made under section 99 of the Forests Act 1958 (regulation 2). Many operative provisions in the Regulations reference functions, offences and licences under section 52 of the Act (see regs 8-13). The Regulations do not displace or supplant the Act; they prescribe the manner of application, conditions and brands for licences and permits granted under the Act.

• Offence conversion. The notes appended to regulations 10, 11 and 13 explicitly state that failing to comply with a prescribed condition of a licence or permit is an offence against the Act: "see section 52(4) of the Act." The Regulations therefore create prescribed conditions which, if breached, trigger offences under the primary Act.

Code of Practice and Conservation, Forests and Lands Act 1987

• Regulation 11 requires licence-holders who cut and take away forest produce to comply with the Code of Practice for Timber Production 2014, a Code approved under the Conservation, Forests and Lands Act 1987. The Endnotes include a Table of Applied, Adopted or Incorporated Matter confirming the Code is applied in full. That means a licence condition imports the Code’s content as operational regulatory standard, and licence compliance is measured against both the Regulations and the Code.

Penalty unit and sentencing law

• The Endnotes cross-reference the Sentencing Act 1991 for the definition and use of penalty units and the Monetary Units Act 2004 for conversion of penalty units to dollar amounts and annual updates. Practitioners must therefore combine the Regulations’ penalty-unit figures with the current monetary unit value fixed by the Treasurer under the Monetary Units Act 2004.

Subordinate Legislation Act 1994 and interpretation law

• The Endnotes note that the Regulations will sunset ten years after making under section 5 of the Subordinate Legislation Act 1994. Practitioners should track the sunset date (3 December 2029) and any replenishment or re-making processes required under that Act.

• The Endnotes further reference the Interpretation of Legislation Act 1984 in relation to style changes, the legal status of headings, notes and diagrams, and location of legislative items. That means internal Notes and pictorial illustrations (such as the brands in regulation 14) form part of the instrument where published according to the ILA rules.

Administrative law and review context

• The Regulations vest decision-making discretion in the Minister and the Secretary but do not in the text set out administrative review or appeal mechanisms. Remedies and review routes therefore will be governed by the Forests Act 1958 and general administrative law principles (judicial review, merits review if available under other statutes or tribunal rules). The Regulations themselves do not prescribe application-processing timeframes, refusal reasons, or appeal windows.

Interplay with land classification and other statutes

• The Regulations use both "State forest" and "reserved forest" terminology (reg 6 vs reg 7 and reg 13). Definitions and the legal differences between these land categories are likely set out in the Forests Act or other Crown land statutes; the Regulations do not define them. Compliance and scope therefore requires cross-reference to the Act and possibly other land-management instruments.

Operational documents and departmental policy

• The Regulations leave several operational specifics to Ministerial or Secretary directions,e.g., the Minister can specify remediation timeframes and issue written authorities for construction or chemical use (reg 9). Those directions and any departmental fee schedules or administrative policies will shape how the Regulations operate in practice. Such policies will sit outside the Regulations but remain crucial for compliance.

In summary, the Regulations operate as subordinate rules that implement, detail and in part operationalise the Forests Act 1958, import an external Code under the Conservation, Forests and Lands Act 1987, and rely on the statutory penalty-unit machinery. Practitioners therefore must read the Regulations alongside the Act, the Code of Practice, the Monetary Units Act 2004 and the Sentencing Act 1991, and should check departmental guidance for operational detail that the Regulations leave to Ministerial or Secretary discretion.

The text of the Regulations and the printed Endnotes set out a concise amendment record: at the date of the version provided there are no subsequent statutory-rule amendments recorded and no amendments not in operation.

Key points in the amendments and instrument lifecycle

• Revocation and replacement. The Regulations expressly revoke the Forests (Licences and Permits) Regulations 2009 (regulation 4). The Endnotes identify the revoked instrument as S.R. No. 166/2009. In practical terms, the 2019 Regulations replace the 2009 instrument with the new provisions from 7 December 2019 (regulation 3).

• No recorded amendments. The Table of Amendments in the Endnotes states "There are no amendments made to the Forests (Licences and Permits) Regulations 2019 by statutory rules, subordinate instruments and Acts." The "Amendments Not in Operation" section similarly states there are none. That means the instrument, as at that printed version, stands in its original made form.

• Sunset provision under Subordinate Legislation Act 1994. The Endnotes state the Regulations will sunset 10 years after the day of making on 3 December 2029 in accordance with section 5 of the Subordinate Legislation Act 1994. Practitioners must note that the regulatory text is therefore temporary unless re-made or extended in accordance with subordinate legislation law.

• Applied documents and incorporated matter. The Endnotes contain a "Table of Applied, Adopted or Incorporated Matter" showing the Code of Practice for Timber Production 2014 is applied by regulation 11. The inclusion of applied documents effectively updates the legal standard in force at the time the Regulations were made and ties future compliance to the version of the Code as amended from time to time (the table notes "as amended from time to time").

Practical implications of the amendment record

• Stability until re-made. With no recorded amendments, the text represents a stable baseline for compliance and enforcement until any statutory rule alters it. However, given the Regulations’ sunset date, administrative re-making or replacement may be required before 3 December 2029 to maintain continuity.

• External documents. Because the Regulations adopt the Code of Practice as amended from time to time (reg 11 and Endnotes), an amendment to the Code will alter licence-holder obligations without changing these Regulations directly. Practitioners should monitor amendments to the external Code for impacts on regulatory duties.

• Penalty-unit adjustments external to these Regulations. The Endnotes explain that penalty-unit values are fixed annually by the Treasurer under the Monetary Units Act 2004. Changes to penalty-unit values will alter the dollar quantum of the fault penalties in this instrument without any amendment to the Regulations themselves. The Endnotes give the 2019-20 unit value ($165.22), but that figure will change over time.

• Lack of explicit transitional provisions. The text does not include transitional clauses dealing with licences or permits issued under the revoked 2009 Regulations. The revocation is stated in reg 4 without transitional detail in the provided text; practitioners dealing with licences spanning the revocation date should check departmental records and the Act for transitional arrangements.

• Document versioning. The Endnotes note that headings, examples, diagrams and notes form part of the Statutory Rule under the Interpretation of Legislation Act 1984. The Regulations include illustrative brands in regulation 14; the Endnotes therefore indicate that visual material accompanying the published SR forms part of the instrument.

In sum, the 2019 Regulations replaced the 2009 Regulations, show no subsequent amendments in the printed record, adopt an external Code as a live reference, and will sunset in 2029 unless re-made. Users should maintain awareness of modifications to applied documents (the Code) and changes to penalty-unit valuation as the principal dynamic elements that will alter regulatory effect without a formal amendment to the Regulations themselves.

The Regulations as presented contain no case law citations and the printed Endnotes record no litigation history. There is no reference in the instrument or its explanatory materials to judicial decisions that interpret or apply these specific Regulations. The Table of Amendments confirms no statutory-rule amendments have occurred since making, and the Endnotes do not record judicial challenges or notable administrative-law disputes attached to this instrument.

What the absence of recorded litigation in the instrument implies for practitioners

• No reported statutory-rule litigation captured in the instrument. The Regulations themselves do not record or summarise judicial decisions. Where a statutory rule is the subject of litigation, legal research must extend beyond the instrument text to locate reported decisions applying or interpreting its provisions. The absence of such references in these Regulations means the instrument provides the textual framework but not judicial interpretation.

• Reliance on primary law for interpretive issues. Because the Regulations cross-reference the Forests Act 1958 (notably s 52 and s 99), many interpretive questions (for example the precise scope of "State forest" versus "reserved forest", the identity and functions of an "authorised officer", or the scope of s 52(4) offences) will likely be resolved by reference to the Act, administrative practice and, where developed, case law interpreting the Act rather than the subordinate instrument alone.

• No reported disputes over operational discretions in the printed record. The Regulations vest significant discretion in the Minister and Secretary in matters such as authorising otherwise prohibited acts, setting remediation standards, and determining royalties and charges. The lack of litigation signposted in the instrument does not mean such discretion will not later be the subject of review; rather, practitioners should expect operational decisions to be vulnerable to administrative law review or merits review processes available under the Act or general administrative law if aggrieved persons seek relief.

How to locate any existing litigation (practice note)

• Because the instrument itself gives no litigation history, if disputes arise practitioners must search case law databases, tribunal decisions, and administrative review records for decisions that have applied the Regulations or the Act in the context of licence conditions, brand disputes, or cattle entry matters. Also check departmental adjudications or internal review logs where merits-review avenues exist.

• If particular enforcement acts occur (for example, application of the crown or broad arrow branding, or prosecution for breaching a licence condition), anticipate that court or tribunal records will be the source of interpretive precedent. Until such decisions appear, enforcement practice will be guided primarily by the text of the Regulations, the Forests Act 1958 and departmental policy.

In short, the Regulations contain no embedded litigation history. Practitioners assessing enforcement risk or seeking authoritative interpretation should plan to consult the Forests Act, the Code of Practice, departmental guidance and any relevant case law databases for decisions that post-date the instrument.

This section flags technical traps, drafting frictions and operational risks that follow from the text. The focus is on concrete mechanisms in the Regulations rather than policy judgement.

Mixed decision-makers and inconsistent authorising language

• Different decision-makers for similar activities. The Regulations allocate authority between the Secretary and the Minister in a way that can be operationally confusing. Regulation 6 requires the Secretary’s written authority for a range of basic acts in State forest; regulations 8-13 frame application and licence conditions around Ministerial approvals. Practitioners should not assume a single point of approval: for example, entering a fenced experimental area requires the Secretary’s written authority (reg 6(4)), while making structural changes to a licensed area requires the Minister’s written authority (reg 9(6)). Compliance practice must therefore identify whether the relevant authorisation is Ministerial or Secretary-issued.

Penalties expressed as penalty units, variable monetary impact

• Monetary exposure varies over time. Penalties are expressed in penalty units (10 or 20 units). The Endnotes give the 2019-20 unit value ($165.22), but that value changes yearly by Treasurer determination under the Monetary Units Act 2004. Practitioners should not rely on fixed dollar amounts; compliance and budgeting must accommodate future adjustments.

No procedural deadlines for administrative decisions

• The Regulations require applications to be made in the Minister’s approved form and allow the Minister to request additional information (reg 8), but the text does not set decision timeframes for granting or refusing licences, or for issuing the written authorities the Regulations make necessary. That creates legal and commercial uncertainty for applicants who may face operational dependency on an unbounded decision period.

High level of Ministerial satisfaction required for rectification

• Remediation standard and timing are to the Minister’s satisfaction and within the time specified by the Minister (reg 9(1)-(2)). The Regulations therefore leave remediation standards and deadlines to Ministerial discretion. Practitioners should note the absence of objective standards or appeal mechanism within the Regulations themselves.

Information and declaration short timeframes

• The Regulations require licence-holders to provide requested information about cutting, digging and removal within 14 days (reg 10(3)) and to provide declarations within 14 days following a Ministerial written request (reg 12(4)). These short statutory timeframes can be operationally demanding, especially for businesses that rely on third-party contractors or are processing large volumes of produce.

Ambiguity about branding illustrations in the published copy

• Regulation 14 refers to illustrated crown and broad arrow brands. The printed instrument in this supply shows image placeholders (), so legal users must refer to the official published version to see the actual pictorial brands. Under the Interpretation of Legislation Act 1984, diagrams and notes form part of the instrument where published; relying on a text-only copy risks missing the exact mark required by authorised officers.

Broad arrow brand effect on removal rights

• The broad arrow brand may lawfully prevent removal of cut or obtained forest produce until an authorised officer obliterates it with the crown brand (reg 16(c)). That creates an on-the-ground stoppage power which may interrupt supply chains unexpectedly; transporters and consignors must check for such brands before moving produce.

Overlap between State forest and reserved forest coverage

• The Regulations use "State forest" in reg 6 and "reserved forest" in regs 7 and 13. The distinctions are not defined in the Regulations. Misclassifying land may lead to inadvertent breaches: for instance, cattle rules apply specifically to "reserved forest" (reg 7), while experimental area rules apply in "State forest" (reg 6). Practitioners must cross-reference the Forests Act 1958 to determine which rules apply to a particular parcel.

No explicit appeal or merits-review terms in the Regulations

• The instrument does not set out appeal rights against Ministerial or Secretary decisions. Persons affected by refusal to grant written authority, temporary permits, or conditions will need to rely on procedural rights in the Act or general administrative law and any available tribunal review mechanism.

Delegated compliance costs and liability allocation

• The Regulations place remedial costs and mustering/removal costs squarely on licence-holders and cattle-owning parties (regs 9(1)-(2), 13(6)). That transfers significant financial risk to private actors without specifying caps or cost-sharing mechanisms.

Potential criminal exposure for informational errors

• Declarations required under regulation 12 and information under regulation 10 must be accurate and timely; false or misleading statements attract a separate penalty (reg 12(5)). The short production windows heighten the risk of inadvertent criminal exposure for record-keeping lapses.

Use these "gotchas" to design compliance checklists: confirm whether land is State or reserved forest; record all written authorities from Minister or Secretary; maintain rapid-declaration capability and audited marking records; budget for remediation and royalties; monitor annual penalty-unit changes; and verify the official brand illustrations in the published statutory instrument.

Practical compliance steps and an operational checklist for applicants, licence-holders, graziers and their advisers. The guidance below is grounded in the Regulations’ operative requirements (regs 6-17) and the Endnotes.

1. Before applying: confirm statutory land classification and licence type

• Determine whether the land in question is classified as a "State forest" or "reserved forest" under the Forests Act 1958. The applicable offences and procedures differ by classification (reg 6 vs reg 7 and reg 13). Do not rely solely on the subordinate instrument; consult the Forests Act and land records.

2. Prepare the application in the Minister’s approved form (reg 8)

• Obtain the Minister’s approved application form and ensure it includes the applicant’s name and address, the purpose of the licence/permit, and a clear specification of the area. Anticipate a request for additional information and plan to supply it promptly (reg 8(2)(d)).

3. Expect and manage discretionary information demands

• The Minister may request additional information and can require declarations about cutting/digging/taking forest produce (reg 12). Maintain organized records of quantities, descriptions, marking/identification, source locations, and consignment destinations so declarations can be produced within the 14-day periods set by regs 10(3) and 12(4).

4. Compliance systems for remediation and pollution obligations (reg 9(1)-(2))

• Implement procedures to promptly identify and remediate any damage to roads, tracks, fire breaks, culverts, drains, water races, dams, buildings, bridges or other structures in licensed areas.
• Establish budgeted contingency funds to pay for remediation at the licence-holder’s expense and timeline mechanisms to comply with the Minister’s specified deadlines and satisfaction standards.

5. Financial compliance: royalties, dues and charges (reg 9(3))

• Build processes to recognise and pay royalties, dues, fees or charges as determined by the Minister on demand or by specified dates. Maintain treasury contacts and ensure prompt payment to avoid licence breaches.

6. Controls for land improvement, chemicals and construction (regs 9(4)-(6))

• Prohibit sowing, cultivation, pasture improvement or use of agricultural chemicals in licensed areas unless there is written Ministerial authority. Any construction or alteration of landings, buildings, fences, gates, ramps or dams must have written Ministerial authorisation and be built to Ministerial directions. Maintain written authorisations on site.

7. Timber cutting operations: branding and Code of Practice (regs 10-11, 14-17)

• Do not fell or remove any trees other than those branded or otherwise specified by the Minister (reg 10(1)). Verify on-site branding before cutting.
• Ensure compliance with the Code of Practice for Timber Production 2014 as amended (reg 11). Integrate Code requirements into harvesting plans, environmental controls, crew training and record-keeping.
• Require transport and processing partners to check for broad arrow or crown brands: broad arrow marks may prevent movement until obliterated by a crown brand (reg 16(c)). Confirm the official appearance of the crown and broad arrow brands in the authoritatively published Regulations (see reg 14 and Endnotes re diagrams) and train crews in brand recognition.

8. Records, declarations and data controls (regs 10(3), 12)

• Prepare a declaration template in the Minister’s approved form or keep a ready-to-complete record consistent with reg 12(3)(a)-(b)(iv). Assign responsibility to a compliance officer to produce responses within 14 days of a Ministerial written request and to certify the accuracy of information to avoid false or misleading statement offences (reg 12(5)).

9. Grazing and agistment compliance (reg 13)

• Before admitting cattle to an area of reserved forest, give prior notice to an authorised officer (reg 13(1)).
• Do not include a bull among admitted cattle (reg 13(2)).
• Provide the Minister in writing, before admission, with the number, sex and identification marks of cattle (reg 13(4)).
• Notify the Minister within 14 days following the removal of cattle (reg 13(3)).
• Obtain written authority before mustering depastured cattle (reg 13(5)) and budget to meet mustering/removal costs (reg 13(6)).

10. Gate and experimental area protocols (reg 6)

• In State forest, do not leave gates unfastened and do not damage gates, panels, cattle ramps or similar infrastructure without the Secretary’s written authority (reg 6(2)). Keep gates closed and fastened as a matter of routine.
• Respect fenced experimental areas and tree nurseries: do not enter without the Secretary’s written authority (reg 6(4)) and avoid damaging experimental equipment (reg 6(5)).

11. Temporary permits and written authorities (regs 6(7)-(8), 7(2))

• Where an activity would otherwise be prohibited, seek written authority from the Secretary (reg 6(7)-(8)). For cattle entry to reserved forest where a section 52 licence is not in place, apply for a temporary permit from the Secretary and adhere to its conditions (reg 7(2)-(3)).

12. Branding registration (reg 17)

• If the Secretary requires submission of a distinctive licence-holder brand, provide it for registration promptly and maintain records of the registered brand.

13. Training, signage and on-site compliance

• Train field crews on the meaning and legal significance of crown and broad arrow brands and on obligations to avoid damaging survey marks (reg 6(3)).
• Ensure all site activities record the presence of authorised Officer brands and hold documents of Ministerial or Secretary written authorities on-site.

14. Audit and legal liaison

• Schedule periodic compliance audits to confirm that remediation obligations, payment of royalties, declaration capabilities and grazing records are current.
• Maintain a legal/compliance contact to interpret Ministerial directions, to request clarifications, and to manage disputes, bearing in mind that the Regulations do not themselves set administrative appeal processes.

15. Monitor external standards and rates

• Track amendments to the Code of Practice for Timber Production 2014 (applied matter) and the annual value of penalty units (Monetary Units Act 2004/Treasurer notices) because both affect obligations and monetary exposure without an amendment to these Regulations.

Implementing these steps will reduce the risk of contraventions under the Regulations and under section 52 of the Forests Act 1958. The overriding practical principle is to secure written authority for any activity that the Regulations identify as restricted, to document and certify all material movements and declarations, and to maintain budgeted reserves for remediation and royalty payments.
