Forests (Fire Protection) Regulations 2025

Several recurrent legal and operational concepts structure the Regulations. These concepts determine when prohibition applies, what qualifies as compliant conduct, and what tools authorised officers may use.

Fire protected area and prohibited period

• The Regulations repeatedly apply to "fire protected areas" and to the "prohibited period" (see regs 9, 15-20, 21-26). Those terms are not defined in the text of these Regulations; they derive from the Forests Act 1958 and related instruments. Because the trigger for many obligations is the prohibited period or location, practitioners must consult the Forests Act and any Ministerial declarations or notices under s 64 (see reg 6) to determine temporal or spatial application.

Written authority and authorised officers

• A central device is the requirement that, for many fires in the open air in State forests/protected public land/national parks and in other fire protected areas during the prohibited period, a person must have written authority from an authorised officer (reg 9). The Regulations set out limited exceptions to that requirement for particular types of campfires, barbeques, sawmill fires and bee‑farming smokers (regs 10-13).
• Authorised officers have a suite of administrative powers: to grant written authority to light fires (reg 14), to grant and revoke exemptions from Parts 3 and 4 (reg 8), to require sawmills/operations to provide firefighting equipment or to specify storage and disposal methods (regs 23-25), and to set minimum clearance distances (reg 22). Notices under these powers must be in writing and may specify reasonable conditions (regs 8(2), 14(2), 22(3), 23(1), 24(1), 25(1)).

Traditional owner group agreements

• Regulation 7 provides a targeted exemption: where a traditional owner group entity has a traditional owner group agreement, most offences in the Regulations do not apply to members of that traditional owner group who are carrying out agreed activities under the agreement on covered land. The exemption expressly does not apply to regulations 15, 16 and 17 (extinguishment duties and the offence to leave a campfire/barbeque), which remain applicable (reg 7(2)). The definition of "agreed activity" and "traditional owner group agreement" are drawn from the Traditional Owner Settlement Act 2010 and the Regulations adopt those terms (reg 5).

Equipment and technical standards

• The Regulations prescribe technical controls to manage ignition sources: spark arrestors on stationary or non‑stationary engines must comply with AS 1019-2000, knapsack spray pumps must comply with AS 1687-1991, and portable water extinguishers must comply with AS/NZS 1841.1:2007 and AS/NZS 1841.2:2007 (reg 5; regs 18-20). The Explanatory Details include a table of applied standards. Compliance with these technical standards is frequently a precondition for the narrow exceptions that allow use of equipment during the prohibited period.

Clearance distances and containment

• Clearance between a fire or piece of equipment and inflammable material is a recurring control: 3 metres for solid fuel campfires/barbeques in general (reg 10(2)(a) and reg 20(2)(a)), 1.5 metres for appliances that use liquid/gaseous/chemical solid fuel in some contexts (reg 11(2)) and for stationary and non‑stationary engines (regs 18(2)(b) and 19(2)(b)). For operations, authorised officers can require minimum clearance distances up to 40 metres (reg 22). For sawmills, fires must be "effectively contained in a pit or structure" (reg 12(1)) and dimensions may be ordered altered by authorised officers (reg 12(2)-(3)).

Firefighting readiness and resource requirements

• The Regulations link permission to operate with readiness to extinguish and resources on hand. Examples: during the prohibited period a bee farmer using a smoker must have a hose connected to an adequate water supply or, lacking that, a compliant knapsack pump plus a rakehoe (reg 13(1)(c)). For engines or equipment used without prohibition, a hose connected to an adequate water supply or specified alternatives (9-litre knapsack pump or 9-litre water extinguisher compliant with standards) must be immediately available (regs 18(2)(c), 19(2)(b), 20(2)(d)). The definition of "adequate water supply" is specific: reticulated supply or tank of at least 200 litres with pump engine rating not less than 3.7 kW (reg 5).

Operational duties and notices

• Persons in charge of an "operation" must maintain the outer perimeter of specified parts of the operation clear of inflammable material at all times (reg 21). Authorised officers may impose additional requirements by written notice about clearance distances, required firefighting apparatus and places where such equipment must be stored, and methods for storage and disposal of inflammable material at sawmills (regs 22-25). Failure to comply with notices attracts 50 penalty units in many instances.

Sanctioning and cross‑statutory limits

• Many contraventions attract 50 penalty units (see regs listed above). Regulations 15 and 16 (extinguishment duties and directions by authorised officers) are linked to penalties under sections 63(1) and 63(2) of the Forests Act (reg 16 note). Regulation 6 expressly prevents these Regulations from authorising conduct prohibited by other Acts, notably s 64 notices under the Forests Act, Country Fire Authority total fire bans, or prohibitions under the National Parks Act 1975.

Sunset and standards access

• The statutory rule will sunset in ten years (endnotes). Practitioners should note the Regulations incorporate external Australian Standards by reference; access to those standards may be required to establish compliance evidence (reg 5; Explanatory Details table).

These concepts map legal duties to specific technical conditions, delegated discretionary instruments (authorised officer notices), and fixed monetary sanctions. The Regulations centralise a risk‑control approach: prohibit or tightly condition ignition sources, require firefighting availability, and permit administrative tailoring of controls through written notices.

The Regulations allocate obligations and permissions across distinct groups and activities. Identify who must act, who may decide, and who bears compliance costs.

Persons in charge or users of fires in the open air

• Visitors, campers, and other members of the public who light campfires or barbeques in State forests, protected public land, national parks or other fire protected areas will be affected by the written authority requirement in reg 9 unless their fire fits an explicit exception in regs 10-13. Where exceptions apply, they still must satisfy technical conditions (for example, a properly constructed fireplace, clearance distances, or appliance design and stability).

Operators of industrial activities (sawmills, mining, quarries, brick makers, distillers, charcoal burners)

• "Operation" is defined to include sawmilling, mining, quarrying, brick making, eucalyptus oil distilling or charcoal burning (reg 5). Persons in charge of these operations must maintain clear perimeters around listed areas (log dumps, timber stacks, waste burners, pits, kilns, retorts, etc.) (reg 21) and must comply with notices from authorised officers about minimum clearance distances (up to 40 metres), firefighting apparatus and storage/disposal methods (regs 22-25). Sawmill managers face a specific duty to ensure sawmill fires are effectively contained in a pit or structure (reg 12(1)) and to comply with notices requiring dimensional changes (reg 12(2)-(3)).

Bee farmers

• Bee farming operations are singled out: a smoker used for beekeeping need not have written authority provided that the smoker is used with a clear area of 1.5 metres from each hive, placed in a fireproof receptacle when not in use, and during the prohibited period the person in charge has immediate access to a hose connected to an adequate water supply or the specified knapsack pump plus rakehoe (reg 13).

Users/operators of engines, equipment and hot‑work tools

• Stationary engines (including pumps and generators), non‑stationary engines (chainsaws, vehicles) and welding/grinding/gas‑cutting equipment are regulated: their use during the prohibited period is either prohibited or permitted only if specific safety devices are fitted (AS 1019 spark arrestor, turbocharger or aspirated air cleaner options) and firefighting resources and clearance requirements are met (regs 18-20).

Traditional owner group members

• Members of a traditional owner group bound by a traditional owner group agreement and carrying out agreed activities on land covered by the agreement are generally exempted from Regulations that create offences, except for regs 15, 16 and 17 (extinguishing duties and not leaving campfires) which continue to apply (reg 7). This affects traditional owner entities and their members conducting fire‑use activities under agreements created under the Traditional Owner Settlement Act 2010.

Authorised officers and administrative decision makers

• Authorised officers act as decision makers who grant written authorities to light fires (reg 14), grant or revoke exemptions from Parts 3 and 4 (reg 8), issue notices requiring clearance distances (reg 22), and specify firefighting apparatus, their storage locations (regs 23 and 24) and sawmill storage/disposal methods (reg 25). Authorised officers also have powers to direct immediate extinguishment and to require changes (reg 12(2), reg 16).

Equipment manufacturers, suppliers and maintenance providers

• The Regulations import Australian Standards for spark arrestors, knapsack pumps and portable water extinguishers. Suppliers and maintenance providers will be relevant where compliance requires certified items or records of maintenance ("proper working order") (reg 5; regs 18-20). Users relying on alternatives to reticulated water supplies must acquire and maintain tanks (minimum 200 litres), pumps (3.7 kW engine rating) or specified knapsack pumps and extinguishers.

Regulatory enforcers and legal advisers

• Enforcement agencies (those who designate authorised officers under the Forests Act), Crown counsel and advisers will be affected by the allocation of notice and penalty powers, by the incorporation of standards, and by the cross‑references to other Acts (reg 6).

Who pays and who bears the compliance burden

• Compliance costs are borne primarily by persons lighting fires, persons in charge of operations and sawmill managers, bee farmers, and persons using engines/equipment during prohibited periods. Costs include acquiring compliant equipment (spark arrestors, pump engines, compliant knapsack pumps, water extinguishers), maintaining that equipment in proper working order, staffing to ensure someone remains in charge of a campfire during prohibited periods (reg 17), constructing properly constructed fireplaces for solid fuel campfires on some land (reg 10(1)), establishing adequate water supplies (200‑litre tanks plus pump) where reticulated supply is unavailable (reg 5), and modifying physical infrastructure such as sawmill pits/structures if required by an authorised officer (reg 12(2)). Persons who fail to comply risk monetary penalties (typically 50 penalty units).

Decision rights and administrative discretion

• Authorised officers have broad discretion to tailor conditions by written notice, to grant exemptions limited to Parts 3 and 4, and to revoke authorities and exemptions (regs 8 and 14; regs 22-25). The Regulations do not set out an internal appeal path from notices; remedies and review procedures may be found in the enabling Act or general administrative law.

In sum, the Regulations affect a mix of recreational users, land managers, commercial operators, traditional owner groups, equipment suppliers and enforcement officers. The distribution of duties channels costs into equipment, staff, water supply and administrative interactions with authorised officers.

This section lists the principal legal duties imposed on persons and the administrative rights and discretions given to authorised officers, with the precise regulatory citations that practitioners will need to rely on.

Duties of persons lighting fires and persons in charge

• Written authority requirement (reg 9): A person must have written authority before lighting any fire in the open air in a State forest, on protected public land or in a national park unless one of the narrow exceptions in reg 9(1)(a)-(d) applies; similarly, written authority is required in other fire protected areas during the prohibited period except as allowed under reg 9(2).
• Extinguish before leaving (reg 15): A person who has lit, kindled or maintained a fire, or who is in charge of a fire in a fire protected area during the prohibited period, must completely extinguish it before leaving, or ensure another person with capacity and means to extinguish it remains in charge.
• Extinguish on direction (reg 16): Such a person must extinguish immediately when directed by an authorised officer.
• Offence not to remain in proximity (reg 17): In specified fire protected areas during the prohibited period, a person in charge of a solid fuel campfire or barbeque must not be outside the line of sight of the fire or more than 50 metres from its perimeter; penalty 50 penalty units.

Duties tied to specific fire types

• Solid fuel campfires/barbeques (reg 10): In State forests, protected public land or national parks, written authority is not required if the fire is lit in a properly constructed fireplace (reg 10(1)). In other fire protected areas during the prohibited period, written authority is unnecessary only if several conditions are met: 3‑metre clearance of ground/airspace, max area 1m^2, max dimension of any piece of fuel 1 metre, properly constructed fireplace and air movement no stronger than 10 km/h (reg 10(2)).
• Liquid/gaseous/chemical fuel appliances (reg 11): No written authority required when the appliance is a commercially manufactured device designed to use that fuel and is placed in a stable position (reg 11(1)). During the prohibited period in certain fire protected areas, a 1.5‑metre clearance is required (reg 11(2)).
• Sawmill fires (reg 12): Written authority is not required if the fire is effectively contained in a pit or structure; authorised officers may require alteration of pit/structure dimensions and persons in charge must comply or face 50 penalty units (reg 12(1)-(3)).
• Bee farming smokers (reg 13): Smokers within beekeeping are permitted without written authority if used with 1.5‑metre clear area, placed in a fireproof receptacle when not used, and during the prohibited period the operator has a hose connected to adequate water supply or the alternatives (compliant 9‑litre knapsack pump and rakehoe) available (reg 13(1)). "Inflammable material" for clearance does not include standing trees or the beehive (reg 13(2)).

Equipment and hot‑work duties

• Stationary engines (reg 18): Use in the open air during the prohibited period is prohibited unless exhaust discharges are suitably handled and the engine meets the exception conditions: spark arrestor complying with AS 1019-2000, 1.5‑metre clearance, and immediate availability of a hose connected to an adequate water supply or alternatives (9‑litre knapsack pump or compliant 9‑litre water extinguisher) (reg 18(1)-(2)). Penalty 50 penalty units for breach (reg 18(1)).
• Non‑stationary engines (reg 19): Must not be used in contact with vegetation during the prohibited period unless fitted with a compliant spark arrestor or turbocharger/exhaust aspirated air cleaner, clearance and immediate firefighting resource availability are satisfied (reg 19(1)-(2)). Penalty 50 penalty units for breach.
• Welding/grinding/gas‑cutting/soldering equipment (reg 20): Use in the open air during the prohibited period is prohibited unless the ground/airspace is clear/wetted within 3 metres, a fire‑resistant shield is used, hot materials are placed in a fireproof receptacle, and firefighting resources are available (reg 20(1)-(2)). Penalty 50 penalty units for breach.

Operational duties for "operations"

• Clearance obligations (reg 21): Person in charge of an operation must ensure the outer perimeter of specified areas (log dumps, timber stacks, timber products, waste burners, pits, winches, kilns, quarries, distilleries, retorts, or other parts of the operation) are maintained clear of inflammable material at all times. Penalty 50 penalty units.
• Authorised officer notices on clearances (reg 22): An authorised officer may require minimum clearance distances up to 40 metres, specifying the area and whether the clearance is at all times or at specified times. Person in charge must comply. Penalty 50 penalty units for non‑compliance.
• Firefighting equipment notices (regs 23-24): Authorised officers may specify firefighting apparatus, water supplies, related equipment and storage locations for sawmills and other operations. Persons in charge must provide, store as specified, ensure immediate availability, and maintain in proper working order. Penalties 50 penalty units.

Prohibitions on safety fuses (reg 26)

• A person must not use a safety fuse or fuse lighter in a fire protected area before sunrise or between 9.30 a.m. and midnight on any day in January, February, March, April, November or December. Penalty 50 penalty units.

Rights and discretions of authorised officers

• Grant and revoke exemptions (reg 8): Authorised officers may grant written exemptions from provisions of Part 3 or 4, must specify provisions, period and may impose reasonable conditions; may revoke those exemptions in writing. Compliance with conditions shields persons from committing the offence specified.
• Grant and revoke written authority to light fires (reg 14): Authorised officers may issue written authorities to light fires in fire protected areas, specifying period and any reasonable conditions; may revoke such authority by notice.
• Issue notices imposing clearance distances, specifying firefighting equipment and storage/disposal methods (regs 22-25): These notices are legally binding and carry penalties for non‑compliance.

Interaction with other Acts and limits on rights

• The Regulations do not authorise conduct prohibited by other Acts (reg 6(d)). Also, traditional owner exemptions are subject to an express carve‑out for certain duties (reg 7(2)).

Ancillary duties: standards, maintenance and availability

• Many of the exceptions and permissions depend on equipment being in "proper working order", compliance with named Australian Standards and immediate availability of firefighting apparatus. Maintenance and demonstrable compliance thus become ancillary legal duties where the Regulation relies on the quality or certification of equipment (regs 5; 18-20; 23-24). Records are not prescribed but will be relevant evidence of compliance.

Reporting, record and appeal pathways

• The Regulations set out what must be done and what authorised officers may order but do not prescribe record‑keeping requirements or internal appeal processes for notices and authorisations. Practitioners must look to the Forests Act and general administrative law for review mechanisms.

These duties establish a compliance regime that ties permission to operate and the safe use of ignition sources to specific technical conditions, material resources and administrative authorisations. The rights and discretions given to authorised officers are the key levers for local tailoring and operational enforcement.

The Regulations employ a combination of fixed monetary penalties (expressed in penalty units), statutory enforcement powers vested in authorised officers, and cross‑references to penalty provisions in the enabling Act.

Monetary penalties and how to interpret them

• The Regulations specify offences with associated penalties, predominantly expressed as 50 penalty units. Examples: failure to comply with a notice to alter a sawmill pit or structure (reg 12(3): 50 penalty units); breach of the prohibition to leave a campfire or barbeque (reg 17: 50 penalty units); using stationary or non‑stationary engines contrary to reg 18(1) or reg 19(1) (each 50 penalty units); welding/grinding/cutting equipment used contrary to reg 20(1) (50 penalty units); failing to maintain clearance per reg 21 (50 penalty units); failing to comply with a clearance notice under reg 22(4) (50 penalty units); failing to provide or maintain firefighting apparatus specified in notices under regs 23-24 (50 penalty units); failing to store/dispose inflammable material as required under reg 25 (50 penalty units); and breaching timing restrictions on use of safety fuses (reg 26: 50 penalty units).
• The Explanatory Details explain that penalty units are converted to dollar amounts under the Monetary Units Act and the Sentencing Act. The explanatory table states the value of a penalty unit for the financial year commencing 1 July 2024 is $197.59 and for the financial year commencing 1 July 2025 is $203.51. The Regulations tie the number of penalty units to the Sentencing Act 1991 (endnotes, explanatory details). Practitioners must therefore calculate dollar penalties by reference to the applicable penalty unit value for the relevant financial year.

Enforcement actors and powers

• Authorised officers are the principal enforcement actors under these Regulations. They can:
  • Direct a person to extinguish a fire immediately (reg 16).
  • Give or revoke written authority to light fires (reg 14).
  • Grant, condition and revoke exemptions from Parts 3 and 4 (reg 8).
  • Issue written notices requiring minimum clearance distances (reg 22), specifying firefighting apparatus and storage places for sawmills or other operations (regs 23-24), and specifying methods for storage and disposal of inflammable material at sawmills (reg 25). Notices must be complied with and breach attracts penalty units as above.
  • Require alteration of sawmill pit or structure dimensions (reg 12(2)).

Legal basis of sanctions

• Some extinguishment duties are linked to the enabling Act's penalty structure: note to reg 16 indicates contravention of regs 15 or 16 in State forest, protected public land or national parks is liable to a penalty under s 63(1) of the Forests Act (see s 63(1)(aa)), and contraventions in other fire protected areas are liable under s 63(2) (see s 63(2)(aa)). Practitioners should cross‑check the Forests Act for maximum fines, enforcement mechanisms and any criminal vs regulatory characterisation.

Evidence and compliance proof

• The Regulations often require equipment to be "in proper working order" and to comply with named Standards (AS 1019-2000, AS 1687-1991, AS/NZS 1841.*) (reg 5; regs 18-20). Enforcement will therefore turn on technical compliance and the existence of appropriate apparatus and maintenance. Evidence of compliance will likely involve production of equipment specifications, maintenance records, inspection reports and, where relevant, showing conformity with the Australian Standards incorporated by reference.

Discretion and administrative risk

• The enforcement architecture gives authorised officers substantial discretion to set conditions, specify equipment and clearance distances, and to grant or withdraw permissions and exemptions (regs 8, 14, 22-25). Because the Regulations do not set out appeal procedures for those notices, affected persons must consider administrative review under the Forests Act and general administrative law remedies. The Regulations’ silence on procedural steps for issuing notices, timeframes for compliance or administrative review increases the operational importance of record‑keeping and prompt legal advice when a notice is issued.

Operational enforcement scenarios

• Typical enforcement scenarios include on‑site inspections where authorised officers discover campfires that do not meet clearance or containment rules; engines or equipment used without specified spark arrestors or with exhausts discharging into open air during prohibited periods; sawmill pits judged by an authorised officer to be inadequate and subject to a notice to alter dimensions; operations lacking required firefighting equipment in specified locations; and bee smokers used without the specified water resources during the prohibited period.

Sanctions for failure to comply with notices

• Non‑compliance with a written notice from an authorised officer imposing clearance distances, specifying firefighting apparatus or storage/disposal methods generally attracts a 50 penalty unit fine (regs 12(3), 21, 22(4), 23(2)/(3), 24(2)/(3), 25(2)). In addition, immediate directions by authorised officers to extinguish must be obeyed (reg 16); failure intersects with the Forests Act penalty machinery (note to reg 16).

Interaction with other enforcement regimes

• The Regulations explicitly do not override prohibitions under other Acts (reg 6). Where Country Fire Authority total fire bans or National Parks Act prohibitions apply, the Regulations do not create an alternative or permissive regime. Enforcement action could therefore involve multiple statutory regimes and agencies.

In short, enforcement relies on authorised officers exercising inspection, notice and direction powers, backed by significant monetary penalties typically quantified as 50 penalty units. Compliance will require meeting technical standards and demonstrating that firefighting resources, containment and clearance requirements are in place and maintained.

The Regulations operate within a statutory network. They derive authority from, refer to, and expressly preserve obligations under several statutes and applied standards. This section explains those cross‑references and practical effects.

Enabling and primary statute: Forests Act 1958

• The Regulations are made under sections 99 and 99A of the Forests Act 1958 (reg 2). Many duties reference section 63 of the Forests Act: reg 9 is expressed "for the purposes of section 63(1)(a) of the Act" and reg 9(2) for s 63(2)(a). Notes to regulation 16 link contraventions to penalties under s 63(1) and s 63(2) of the Act. Practitioners must therefore read these Regulations alongside the Forests Act for definitions (for example of "fire protected area", "prohibited period", "authorised officer") and for the broader enforcement framework, including possible criminal or regulatory consequences under the Act.

Country Fire Authority Act 1958

• Regulation 6 expressly disapplies any permission in these Regulations where a declaration of a day or partial day of total fire ban exists under the Country Fire Authority Act 1958 (reg 6(b)). That creates an external stop‑switch: a CFA total fire ban overrides any narrow permissions these Regulations might otherwise grant. Any authority or exemption given under these Regulations remains subject to CFA total fire bans.

National Parks Act 1975 and other Acts

• Regulation 6(c) prevents operation of these Regulations where fires are generally prohibited or the type of fire is prohibited under the National Parks Act 1975. Regulation 6(d) also prevents the Regulations from authorising conduct in contravention of any other Act. In practice, land management rules under the National Parks Act, planning controls, environmental protection and Aboriginal cultural heritage law may impose additional constraints on fire use and operations in certain locations and contexts.

Traditional Owner Settlement Act 2010

• Regulation 7 relies on definitions and the concept of a "traditional owner group agreement" under the Traditional Owner Settlement Act 2010. Where a traditional owner group entity is bound by such an agreement, most offences in these Regulations do not apply when activities are "agreed activities" carried out under the agreement on covered land (reg 7(1)). However, the exemption expressly excludes regs 15-17 (extinguishment duties and the offence to leave a campfire) (reg 7(2)). Practitioners advising traditional owner entities must check the text of any traditional owner agreement to see how it frames agreed activities and whether the land to which it applies is within a fire protected area.

Land Act 1958 and licensed water frontages

• "Relevant licensed water frontage" in reg 5 is defined by reference to the Land Act 1958. Regulation 17 excludes certain licensed water frontages from its application (it applies to fire protected areas not being a State forest, protected public land, national park or a relevant licensed water frontage). Thus licensed water frontage status under the Land Act can change which specific obligations apply.

Standards and external technical instruments

• The Regulations incorporate Australian Standards by reference (reg 5). Compliance with AS 1019-2000, AS 1687-1991, AS/NZS 1841.1:2007 and AS/NZS 1841.2:2007 is required in several exceptions and duties (regs 5; 13(1)(c)(i), 18(2)(a), 18(2)(c)(ii), 19(2)(a), 19(2)(b)(ii), 20(2)(d)(ii)). The Explanatory Details include a table of applied documents. Practitioners should be aware that Australian Standards are privately published documents and that reliance on compliance will often require procuring and retaining certified equipment and records demonstrating conformity.

Sentencing Act 1991 and Monetary Units Act 2004

• Penalties are expressed in penalty units within the meaning of s 110 of the Sentencing Act 1991 (explanatory details). The Monetary Units Act 2004 and the Treasurer's determination fix the dollar value of a penalty unit each financial year, and the Explanatory Details set the values for the 2024 and 2025 financial years. Calculating monetary sanctions therefore requires cross‑reference to these Acts and the Gazette notices fixing penalty unit values.

Subordinate Legislation Act 1994

• The Explanatory Details state the statutory rule will sunset 10 years after making under s 5 of the Subordinate Legislation Act 1994 (endnotes). This imposes a finite regulatory life and implies potential legislative review or re‑making before 2035 if the regulatory regime is to remain.

Other governance and administrative law frameworks

• The Regulations do not set explicit appeal or review processes for notices, authorisations or exemptions issued by authorised officers. Administrative decisions made under the Forests Act and these Regulations will therefore be subject to the usual administrative law remedies and judicial review where available, and any appeal mechanisms provided by the Forests Act or other relevant statutes. Practitioners should check those Acts for internal review, merits review, or rights of challenge.

Practical interaction effects

• A written authority granted under these Regulations may be rendered ineffective by a Country Fire Authority total fire ban or by a National Parks Act prohibition (reg 6). Traditional owner group agreements can exempt members from most offence provisions (reg 7) but they do not override the extinguishment and remaining duties in regs 15-17. Equipment compliance requires access to private Australian Standards documents for verification and may implicate procurement and maintenance law (contracts to purchase compliant equipment and ongoing service contracts). Notices under these Regulations may create obligations that intersect with occupational health and safety duties and environmental obligations, requiring coordination across regulatory regimes.

In short, compliance requires reading these Regulations alongside the Forests Act, Country Fire Authority Act, National Parks Act, Traditional Owner Settlement Act, Land Act, the Sentencing and Monetary Units Acts and incorporated Australian Standards. The Regulations create a networked regulatory regime rather than a self‑contained code.

The Regulations are expressed to supersede the earlier Forests (Fire Protection) Regulations 2014 and state that the 2014 Regulations are revoked (reg 4). The Explanatory Details identify S.R. No. 52/2014 as the revoked instrument, which had been extended into operation by S.R. No. 40/2024 (endnotes, explanatory details). The statutory rule was made on 27 May 2025 and commenced on 7 June 2025 (reg 3; endnotes).

Table of amendments and current status

• The Table of Amendments included in the endnotes states there are no amendments made to the Forests (Fire Protection) Regulations 2025 by subsequent statutory rules, subordinate instruments or Acts (endnotes 2). That confirms the text provided is the current and initial version as at 7 June 2025 (Version No. 001).

Sunset provision and lifecycle

• The Explanatory Details note the Regulations will sunset 10 years after the day of making, on 27 May 2035, pursuant to the Subordinate Legislation Act 1994 (endnotes). That fixed lifespan means that unless re‑made, these Regulations lapse on that date. Practitioners should be aware that legislative review or re‑enactment may be required before the sunset date to maintain continuity.

Incorporation of standards and any updates

• The Regulations incorporate specific Australian Standards as published on particular dates (for example, AS 1019-2000 as published 1 August 2000; AS 1687-1991 as published 11 February 1991; AS/NZS 1841.*:2007 as published 31 August 2007) (reg 5; Explanatory Details). The Explanatory Details provide a Table of Applied, Adopted or Incorporated Matter to satisfy Subordinate Legislation Regulations requirements. The incorporation dates are fixed in the Regulations: unless the Regulations are amended, later revisions of those Standards are not automatically captured. If standards are updated after the dates cited, compliance proof will require attention to which version is required by the Regulation.

Transitional arrangements and revocation of 2014 Regulations

• The revocation in reg 4 removes the 2014 regulatory instrument and replaces it with the 2025 instrument. The Explanatory Details highlight the making date and the extension history of the 2014 instrument but do not specify transitional savings or transitional duties for activities underway at commencement. Practitioners handling activities in progress at the making date should examine whether any transitional provisions exist in the Forests Act or in instruments revoking the earlier rule.

Practical implications for future amendments

• Because the Regulations incorporate external standards, any future amendment that updates the referenced standard versions would require an amendment to the Regulations or a re‑issuing instrument to change the incorporated version. Similarly, changes to the Forests Act, Country Fire Authority Act, National Parks Act, Traditional Owner Settlement Act or the Sentencing and Monetary Units Acts will affect the operational meaning or penalties tied to these Regulations.

In short, the Regulations are newly made, replace the 2014 instrument, have no subsequent amendments to date, and carry a statutory sunset. The fixed incorporation of specific versions of Australian Standards anchors technical compliance to those versions until formally amended.

There is no litigation history contained in the text of these Regulations and the endnotes state no amendments have been made since making (endnotes 2). The document does not cite any cases or judicial decisions.

What the Regulations provide for litigation context

• The Regulations tie some obligations and sanctions to provisions of the Forests Act 1958 (for example s 63), and to penalty units defined in the Sentencing Act 1991. Any legal challenges about the meaning, application, or validity of notices, authorisations, or enforcement actions taken under these Regulations will therefore proceed through the litigation and review pathways applicable to decisions made under the Forests Act and administrative law generally.
• Because authorised officers have discretion to grant or revoke written authorities and exemptions, or to issue notices, affected persons may seek judicial review of administrative decisions where there is alleged unlawfulness, procedural unfairness, irrationality, or failure to follow statutory requirements. The Regulations themselves do not prescribe a merits review mechanism, so practitioners will need to consider whether the Forests Act or other statutes provide a specific non‑judicial review or appeal route.

Evidence‑based enforcement and standards compliance

• Enforcement disputes are likely to turn on technical facts (was spark arrestor AS‑compliant and in proper working order; was the 1.5‑metre or 3‑metre clearance maintained; was the equipment available and properly charged), and on the reasonableness of notices issued by authorised officers (for example a clearance of up to 40 metres under reg 22). Litigation, if it occurs, will likely involve technical expert evidence (equipment specification and maintenance), inspection reports, and contemporaneous records of compliance.

Absence of cases in the text

• This instrument contains no judicial decisions, case names, or references to litigation. It is therefore silent on any prior judicial interpretation of equivalent or predecessor provisions. Practitioners should be prepared for first‑instance disputes to establish interpretive precedent, particularly on terms not defined in the Regulations (for example "effectively contained", "proper working order", "properly constructed fireplace", and the scope of "prohibited period" and "fire protected area" as used).

Advisory approach in absence of litigation history

• Where there is no litigation history, caution is prudent: ensure authoritative evidence for compliance (equipment certificates, maintenance logs, water supply proof), prompt legal engagement when authorised officers issue notices, and consideration of administrative review options in the event of dispute. Keep in mind that cross‑statutory interactions (Country Fire Authority total fire bans, National Parks Act prohibitions, Traditional Owner Settlement agreements) may raise complex legal questions that could form the basis for litigation.

In summary, the Regulations include no litigation history or case law within the instrument itself. Where disputes arise, they will be litigated or reviewed against the Forests Act framework and general administrative law principles, with technical evidence likely central to enforcement and defence.

This section flags specific traps, drafting lacunae and practical pitfalls that arise from the Regulations’ wording and structure. Each item cites the relevant regulation or endnote so readers can check the text.

1. Reliance on undefined terms in these Regulations

• Key operational triggers , "fire protected area" and "prohibited period" , are not defined in the Regulations. They are concepts used throughout (for example regs 9, 15-20, 21-26). Practitioners must consult the Forests Act and any Ministerial notices under s 64 to know when and where obligations apply. Don’t assume uniform geographic or temporal application.

2. Traditional owner exemption is limited and excludes key duties

• Regulation 7 exempts traditional owner group members carrying out agreed activities under a traditional owner group agreement from many offence provisions, but explicitly excludes regulations 15, 16 and 17 (extinguishment duties and the offence to leave a campfire/barbeque). That means even if an activity is an agreed activity, extinguishment before leaving and compliance with authorised officer directions remain required. The exemption does not apply to Part 3 or 4 exemption-power limitation either: authorised officer exemptions in reg 8 are limited to Parts 3 and 4.

3. Exemptions under reg 8 are limited to Parts 3 and 4

• Authorised officers may grant exemptions in writing only from provisions of Part 3 (Engines and equipment) or Part 4 (Operations) (reg 8(1)). There is no power in these Regulations for authorised officers to grant exemptions from Part 2 (Fires in the open air). If a person needs relief from Part 2 restrictions, reg 8 will not help.

4. "Properly constructed fireplace" and "effectively contained" are not defined

• The Regulations use terms such as "properly constructed fireplace" (reg 10) and "effectively contained in a pit or structure" (reg 12(1)). Those are factual standards without technical definition in the text. Expect disputes over compliance to turn on competing expert or field evidence. Consider documenting construction and containment details proactively.

5. Equipment compliance depends on access to private Standards

• Many exceptions depend on equipment complying with named Australian Standards (reg 5). These Standards are published documents that usually require purchase. Enforcement will often require equipment certificates or maintenance records to demonstrate compliance. Budget and procurement for compliant equipment are therefore necessary.

6. The "adequate water supply" technical threshold is specific and may be costly

• "Adequate water supply" is defined to include a 200‑litre tank fully charged and capable of delivering a continuous steady stream by means of a hose connected to a pump with engine power not less than 3.7 kW (reg 5). For remote operations, acquiring and maintaining such a pump and tank is a concrete, non‑trivial cost. Alternative options exist (knapsack pumps or compliant extinguishers), but these alternatives have their own capacity limits (9 litres) and might be insufficient for larger incidents.

7. Air movement limit for solid fuel campfires (10 km/h) is a variable enforcement point

• Regulation 10(2)(e) allows small solid fuel campfires during prohibited periods only if air movement does not exceed 10 km/h. Measuring and proving wind speed on site is often imprecise; enforcement could rely on local weather data, and operators should be cautious about estimating compliance without contemporaneous objective data.

8. Many penalties are identical and substantial in dollar terms

• Numerous contraventions attract 50 penalty units (for example regs 12(3), 17, 18(1), 19(1), 20(1), 21, 22(4), 23-25, 26). The Explanatory Details set penalty unit dollar values for certain years; practitioners should calculate actual dollar exposure for the relevant year. The uniformity of 50 penalty units may mask different levels of conduct and harm; enforcement discretion will matter.

9. Authorised officers’ notices lack a statutory internal review mechanism in the Regulations

• The Regulations empower authorised officers to issue binding written notices (clearance distances, firefighting equipment, storage/disposal methods) but do not specify processes for appeal or review of those notices within the instrument. Affected persons must look to the Forests Act or general administrative law for remedies, which can delay resolution and introduce uncertainty. Timely legal advice is advisable upon receipt of a notice.

10. "Proper working order" is a recurring but undefined standard

• Obligations to maintain firefighting equipment "in proper working order" appear in several provisions (for example regs 23(3), 24(3), and the equipment exceptions in Parts 3 and 4). The Regulations do not provide inspection intervals, testing standards beyond referencing Australian Standards, or records requirements. This creates evidentiary risk in enforcement situations; operators should adopt formal maintenance and inspection records as a matter of good practice.

11. Safety fuse timing restriction is non‑intuitive

• Regulation 26 prohibits use of a safety fuse or fuse lighter before sunrise or between 9.30 a.m. and midnight in months Jan-Apr and Nov-Dec, but allows use between sunrise and 9.30 a.m. and between midnight and sunrise only in months not listed. The hours and month list are unusual and practitioners should map planned fuse use against this calendar rather than assume a simple day/night prohibition.

12. Sawmill containment dimensions can be changed by notice and carry a penalty

• Authorised officers may require a person in charge of a sawmill to alter pit or structure dimensions if the officer reasonably believes the containment is insufficient (reg 12(2)). Compliance is mandatory (reg 12(3)) and failure carries a 50 penalty unit fine. That can impose retrofit capital costs where existing pits are judged inadequate.

13. Reg 17 exceptions exclude certain locations

• The offence in reg 17 applies to campfires or barbeques in fire protected areas but expressly not to State forests, protected public land, national parks or a "relevant licensed water frontage". That means obligations can differ by small legal distinctions of location; verifying whether a particular site is a licensed water frontage under the Land Act could change duties in practice.

14. Sunset date requires legislative attention long before 2035

• The Regulations will sunset on 27 May 2035 (endnotes). If the policy is to be continued, attention should be given to renewal well in advance to avoid regulatory gap.

These "gotchas" reflect areas where the Regulations either leave material terms unspecified, allocate significant discretion to authorised officers without detailed procedural rules, or establish technical thresholds that create procurement and operational costs. Practitioners should document compliance proactively and clarify definitions and review rights with the relevant agency.

This pragmatic checklist sets out steps and documentation priorities for persons who must comply with the Regulations. It translates regulatory provisions into practical compliance actions, citing the relevant regulations.

1. Determine spatial and temporal triggers

• Confirm whether the land is a State forest, protected public land, national park or other fire protected area and whether the activity falls within the "prohibited period". These trigger points are essential because many duties, exceptions and prohibitions depend on them (reg 9; reg 6). Consult the Forests Act 1958, relevant Ministerial notices and Country Fire Authority declarations.

2. If lighting a fire in the open air, check whether written authority is required

• For State forests/protected public land/national parks, written authority is required unless the fire fits an exception in reg 9(1) (see regs 10-13). For other fire protected areas during the prohibited period, check reg 9(2) and the listed exceptions (regs 10-13) and whether any Country Fire Authority total fire ban applies (reg 6(b)). If written authority is required:
  • Apply to the relevant authorised officer for a written authority under reg 14, supplying the information necessary to allow the officer to set conditions.
  • Retain the written authority and any conditions; an authorised officer may revoke it in writing (reg 14(3)).

3. For campfires or barbeques using solid fuel

• If in a State forest/protected public land/national park, ensure the fire is in a "properly constructed fireplace" to avoid needing written authority (reg 10(1)). If in other fire protected areas during the prohibited period, ensure the 3‑metre clearance, max 1m^2 area, max fuel piece 1 metre, properly constructed fireplace, and wind not exceeding 10 km/h (reg 10(2)(a)-(e)). Document fireplace construction with photographs and materials specification.

4. For liquid/gaseous/chemical solid fuel appliances

• Use only commercially manufactured appliances designed for that fuel and place them stably (reg 11(1)). During prohibited periods in other fire protected areas ensure 1.5‑metre clearance around the appliance (reg 11(2)). Retain appliance manuals and proof of manufacture/design.

5. For sawmills, operations and bee farms

• Sawmill managers must ensure sawmill fires are effectively contained in pits or structures; expect to comply with any notice to alter dimensions (regs 12(1)-(3)). Keep plans, photos and engineering data of pits and containment structures.
• Bee farming smokers: ensure 1.5‑metre clear area from each hive, a fireproof receptacle for the smoker when not in use, and during prohibited periods keep a hose connected to an adequate water supply or a compliant 9‑litre knapsack pump and a rakehoe available (reg 13(1)). Document water supply capacity and pump engine rating if using tank + pump option (see reg 5 definition of "adequate water supply").

6. For engines, vehicles and hot‑work equipment during prohibited periods

• Stationary engines: fit spark arrestors compliant with AS 1019-2000, maintain 1.5‑metre clearance, ensure immediate availability of a hose connected to an adequate water supply or the specified alternatives (reg 18(2)). Non‑stationary engines: fit a compliant spark arrestor or turbo charger/exhaust aspirated air cleaner and ensure resource availability (reg 19(2)). Welding/grinding/cutting: maintain 3‑metre clearance or wet the area, use fire‑resistant shields, collect hot materials in fireproof receptacles, and have immediate firefighting resource availability (reg 20(2)). Keep certificates of equipment compliance, maintenance logs and inspection records.

7. Maintain firefighting equipment, stores and access per notices

• If an authorised officer issues notices under regs 23 or 24 specifying firefighting apparatus and storage locations, comply in full: provide, store, keep immediately available and maintain equipment in proper working order (regs 23(1)-(3), 24(1)-(3)). Create checklists, service schedules and logs showing equipment in situ and operational.

8. Clearance and perimeter duties for operations

• Maintain the outer perimeter of areas listed in reg 21 clear of inflammable material at all times. If a notice is issued specifying minimum clearance distances up to 40 metres, comply (reg 22). Maintain maps, photographs and maintenance logs to demonstrate ongoing clearance.

9. Respond promptly to notices, authorities and directions

• Authorised officers can impose conditions, revoke authorities, grant and revoke exemptions, require structural changes and direct immediate extinguishment. Ensure a process to receive and respond to written notices and maintain evidence of compliance (regs 8, 12, 14-16, 22-25). Non‑compliance with notices attracts 50 penalty units in many cases.

10. Document everything

• Because terms such as "proper working order", "properly constructed fireplace" and "effectively contained" are undefined, contemporaneous documentary evidence (photos, inspection records, maintenance logs, invoices for equipment compliant with indicated Standards, pump and tank capacity specifications) will be crucial in any enforcement or review context.

11. Safety fuse planning

• Avoid using safety fuses or fuse lighters before sunrise or between 9.30 a.m. and midnight in the months identified (Jan-Apr, Nov-Dec) (reg 26). Plan blasting or fuse operations outside these intervals or obtain written authority if necessary.

12. Traditional owner group agreement compliance

• If acting under a traditional owner group agreement, determine whether the activity is an "agreed activity" and whether the land falls within the agreement’s application (reg 7). Note that even where the exemption applies, extinguishment duties (regs 15-16) and the not‑leaving obligation (reg 17) still apply.

13. Prepare for authorised officer inspections and notices

• Establish clear lines of communication with the agency that designates authorised officers, designate a person in charge for incidents during the prohibited period, and prepare a standard response package for any notice (technical compliance evidence, work plans, remediation plans, timetable for physical works).

14. Review insurance and contractual arrangements

• Review contractual provisions with suppliers and contractors to ensure supply and maintenance of compliant equipment (spark arrestors, pumps, extinguishers), and check that insurance covers fines or operational interruptions resulting from enforcement. The Regulations’ penalties may be insurable but insurers may exclude fines for regulatory breaches; check policies.

15. Train staff and visitors

• Ensure staff know the extinguishment duties (reg 15), that they must extinguish immediately on authorised officer direction (reg 16), and that during prohibited periods a person in charge must remain within sight or within 50 metres of a solid fuel campfire/barbeque in specified locations (reg 17). For commercial or recreational sites, consider signage and operational procedures.

16. Legal review and administrative pathways

• Before implementing new operational activities that might interact with these Regulations, seek advice on whether a written authority or exemption is needed. If issued a notice, seek immediate legal advice about review options under the Forests Act and administrative law.

17. Budget for capital and maintenance costs

• Anticipate costs for compliant equipment (spark arrestors meeting AS 1019-2000, knapsack pumps, 200‑litre tanks and 3.7 kW pumps where reticulation is unavailable, compliant 9‑litre water extinguishers), physical modifications to sawmill pits if required, and ongoing maintenance and inspection to show "proper working order".

Compliance is a mix of preventive physical controls, equipment procurement and maintenance, administrative interaction with authorised officers, and robust documentation practices. Because many obligations hinge on precise technical and spatial thresholds, proactive planning and record‑keeping materially reduce enforcement risk.
