What it does
This Act authorises and governs payments from the Environmental Trust Fund (the Fund) to offset specified forestry-related expenditure that has been paid from the Consolidated Fund. Its operative mechanics, as retained in the text provided, are narrow and focussed. The principal payment power requires the Minister for Climate Change and the Environment to direct amounts from the Fund for payment into the Consolidated Fund to “offset the amounts paid from the Consolidated Fund” for particular forestry restructuring and assistance expenditure described in the Budget Papers or declared by the Treasurer (s 4(1)). The only substantive program item still present in the Act is expenditure for implementing forestry restructure and assistance schemes and programs in the Brigalow and Nandewar and adjacent areas, including business exit assistance, timber worker assistance and industry development assistance, described in s 4(1)(d) as “Brigalow and Nandewar areas expenditure” (s 4(1)(d)).
The Act sets procedural and certification conditions. The Treasurer must certify to the Minister from time to time the amounts paid from the Consolidated Fund for the relevant expenditure (s 4(2)). A payment from the Fund in respect of the Brigalow and Nandewar areas expenditure cannot be made unless the Minister for Climate Change and the Environment and the Minister for Mineral and Forest Resources jointly certify that the expenditure was incurred for implementing a scheme or program designed to assist persons affected by Government forest conservation initiatives in those areas (s 4(5)). The Act allows payments to be made from both capital and income of the Fund (s 9). The Minister for Climate Change and the Environment has express discretionary control over timing and amount of payments, subject to an express instruction to be mindful of the Fund’s need to earn income to meet projected commitments (s 5).
