Forestry Regulations 2013

The regulations are organised around a handful of core concepts. Each bears operational consequences that affect who may do what in a forest reserve and under what conditions.

• Lawful authority. The recurring phrase "without lawful authority" appears across many prohibitions and is the central legal pivot. The regulations define "lawful authority" broadly to include authority under the Forestry Act 1950, authority under these regulations, permits or other authority issued by the Corporation, and leases, licences, easements or other interests granted by the Corporation (reg 3). Practically, any permission given under the Act, an instrument issued by the Corporation, or an interest granted by the Corporation operates as "lawful authority". The effect is that conduct that would otherwise be an offence is lawful if covered by such authority. The non‑derogation clause preserves the Corporation’s power to deny access or authorise entry otherwise than by a permit under these regulations (reg 4).

• Forest reserve and native forest reserve. The regulations repeatedly differentiate between "forest reserve" and "native forest reserve". The interpretation section makes explicit that "forest reserve includes a native forest reserve" (reg 3). Several provisions place stricter or absolute bans on activities in native forest reserves, for example the blanket ban on lighting fires in a native forest reserve (reg 9(1)) and certain exceptions to chainsaw prohibitions that are limited to reserves other than native forest reserves (reg 13A(2)).

• Prohibitions with authorisation carve‑outs. Most retail prohibitions are framed as crimes "without lawful authority", so the default rule is prohibition but the Corporation can authorise via permits, leases or other instruments. Examples include lighting fires (reg 9), vehicle use (reg 10), boats (reg 11), drones and aircraft (reg 12), firearms and trapping devices (reg 13), chainsaws and generators (rr 13A, 13B), and a long list of commercial and organised activities that must be authorised (reg 23).

• Permit regime and conditions. The Corporation has discretion to issue written permits in forms it determines (reg 25(1)-(2)). Applications must follow the Corporation’s form and payment rules (reg 25(3)). Permits may be conditional and such conditions may include licensed personnel requirements, area limits, equipment restrictions, restoration obligations, and financial assurances (reg 25(6)). Permits generally have a maximum term of 12 months (reg 25(7)). The Corporation may vary or revoke permits where conditions are breached or where, in its opinion, variation or revocation is necessary to protect a forest reserve (reg 25(9)(a)-(b)). The Corporation may require financial assurances up to the estimated cost of rectifying damage (reg 28(1)-(3)) and may forfeit such amounts for non‑compliance (reg 28(5)).

• Enforcement mechanisms and recovery of costs. The regulations combine standard criminal penalties with expiation fees and specific recovery mechanisms. Most offences carry a maximum penalty of $750 and an expiation fee of $105 (see, for example, regs 5, 6, 7, 9(1)). The Corporation can recover reasonable costs of vehicle removal as a debt from owners (reg 10(4)). Abandoned property and seized property may be sold if costs are not paid within one month (reg 19). Costs of capturing, disposing of or destroying animals are recoverable from owners (reg 21(4)-(5)). These provisions convert certain operational costs into debts recoverable by the Corporation.

• Operational powers of wardens and authorised persons. Forest wardens and persons authorised by the Corporation have statutory powers to remove vehicles obstructing access (reg 10(4)), seize and impound abandoned property after 24 hours (reg 19(1)), sell impounded goods if costs are unpaid (reg 19(3)-(4)), and to capture, dispose of or destroy certain unprotected animals not under control or not authorised for presence in a reserve (reg 21(1)). Wardens can also require a person to leave a forest reserve and impose a re‑entry ban for at least 48 hours (reg 30).

• Cross‑statutory references and definitions. The regulations incorporate external legal regimes by reference. "Unprotected animal" is defined with reference to the National Parks and Wildlife Act 1972 (reg 3). The operation of total fire ban prohibitions imports the Fire and Emergency Services Act 2005 (reg 5). The meaning of "vehicle" is imported from the Road Traffic Act 1961 (reg 3). These cross‑references place the regulations within a wider legal ecosystem.

• Fee, bond and financial assurance constraints. The Corporation may charge prescribed fees for permits (reg 27). For commercial, scientific or organised events the Corporation determines the fee (reg 27(3)). It may waive fees based on purpose or applicant means (reg 27(4)). Bonds or pecuniary sums may be required by permit condition, but the amount must not exceed the Corporation’s opinion of the likely cost of rectifying damage (reg 28(2)). The Corporation must be satisfied a bond is justified before requiring it (reg 28(3)). On compliance the Corporation must discharge bonds and repay pecuniary sums with interest (reg 28(4)).

These concepts, read together, show the regulations are designed to make most potentially harmful activities in forest reserves unlawful without express authorisation, while providing a single administrative pathway for lawful activities through permits subject to conditions, fees and financial assurances.

The regulations affect multiple groups, with burdens and decision rights allocated across those groups. The primary actors named or implicated in the text are the Corporation, forest wardens and other persons authorised by the Corporation, visitors and recreational users of forest reserves, permit applicants and commercial operators, landholders with interests granted by the Corporation, and owners of vehicles, animals or property in reserves.

• The Corporation. The Corporation is the central decision‑maker. It has the power to approve notices that restrict entry (reg 6), to erect signs and direct conduct (reg 24), to issue, vary and revoke permits and determine their form (reg 25), to set or waive fees (reg 27), to require financial assurances and determine amount up to a specified cap (reg 28), and to recover costs for removal or remedial action (rr 10(4), 19(2), 21(4)). The regulations include an express non‑derogation clause preserving the Corporation’s powers to deny access or authorise entry otherwise than by permit under the regulations (reg 4). The Corporation therefore both prescribes the default prohibitions and controls the main authorisation channel.

• Forest wardens and authorised persons. Wardens have operational enforcement powers. They may remove obstructing vehicles (reg 10(4)), seize and impound abandoned property after 24 hours (reg 19(1)), capture, dispose of or destroy unprotected animals that are uncontrolled and without authority (reg 21(1)), and serve notices requiring removal of animals when claimed ownership is known or suspected (reg 21(2)). Wardens also enforce re‑entry bans imposed under reg 30.

• Visitors and members of the public. Ordinary users of forest reserves are subject to wide restrictions. A member of the public who enters or remains in a forest reserve without lawful authority in breach of rules will commit an offence carrying a maximum penalty of $750 and often an expiation fee of $105, for routine infractions such as entering on total fire ban days (reg 5), entering at night or camping overnight (reg 7), entering caves or sinkholes (reg 8), lighting fires (reg 9), driving or riding vehicles (reg 10) except on specified tracks, using boats (reg 11), flying drones (reg 12(2)), possessing firearms or trapping devices (reg 13), removing vegetation (reg 15), depositing rubbish (reg 18), and engaging in a large list of commercial activities without authorisation (reg 23). Visitors must also comply with posted notices and directions (reg 24).

• Commercial and organised operators. The regulations treat commercial and organised uses as potentially requiring permits and potentially subject to higher fees. Regulation 23 lists a range of activities that must be authorised, including commercial photography, tours for fee, organised competitions, sale or hire of goods, provision of services for fee, motor vehicle events, scientific experiments, beekeeping, fundraising or profit‑making activities, loudspeaker use, erection of structures, and public meetings or demonstrations. For commercial, scientific or organised events, the Corporation determines the permit fee (reg 27(3)), and may require bonds or assurances to cover likely rectification costs (reg 28).

• Owners of animals and property. Persons who own or control animals bear obligations to keep them out of reserves, unless authorised. Horses are specifically prohibited without lawful authority (reg 20(1)). Dogs may be permitted in certain reserves other than native forest reserves subject to leash or effective control conditions (reg 20(3)-(4)). Owners of vehicles or personal property left unattended for more than 24 hours risk seizure, impounding, cost liability and eventual sale if costs are unpaid (reg 19). Owners of animals whose animals are captured, disposed of or destroyed bear the costs of capture and disposal as a debt due to the Corporation (reg 21(4)-(5)).

• Applicants for permits and their financiers. Permit applicants face procedural obligations to apply in the manner and form determined by the Corporation and to pay prescribed fees (reg 25(3)). They may be required to lodge bonds or pecuniary sums secured by approved security or to meet restoration conditions and other obligations specified in the permit (regs 25(6), 28). If they fail to comply, the Corporation may forfeit bonds or apply pecuniary sums to cover costs (reg 28(5)), and may vary or revoke the permit (reg 25(9)).

• Intersecting regulatory agencies and licence holders. The regulations operate alongside other regulatory regimes. They import meanings and coordinate with legislation such as the Fire and Emergency Services Act 2005 (reg 5), the National Parks and Wildlife Act 1972 (reg 3), and the Road Traffic Act 1961 (reg 3). Persons whose activities also require licences or approvals under other Acts (for example firearm licences, environmental approvals, aviation licences) must obtain and maintain those permissions in addition to any permit from the Corporation. The regulations permit the Corporation to impose conditions that only licensed or otherwise qualified persons may engage in the permitted activity (reg 25(6)(a)).

Who pays. Costs flow to offenders, permit applicants, owners of impounded property and animals, and to permit holders where restoration or financial assurance obligations are imposed. The Corporation can recover vehicle removal costs as a debt from the owner (reg 10(4)), require payment for seizing and impounding property before return (reg 19(2)), sell impounded property where costs are unpaid after one month (reg 19(3)-(4)), and forfeit bonds or pecuniary sums to meet rectification costs when permit conditions are breached (reg 28(5)).

Who decides. The Corporation holds the central administrative decision power to permit, condition, charge fees, demand financial assurance and to vary or revoke permits in the public interest as defined by the Corporation (regs 25, 27, 28). Forest wardens and persons authorised by the Corporation exercise on‑the‑ground enforcement and operational decisions within the framework created by the Corporation and the regulations (rr 10(4), 19, 21, 30).

The regulations create a network of statutory duties for users and administrative rights for the Corporation. These are concrete and repeat across many activities.

Duties on individuals and permit holders

• Duty to obtain lawful authority for specified activities. A central duty imposed on persons is to refrain from entering or undertaking prescribed activities "without lawful authority". The list of activities requiring lawful authority is extensive, including entry on total fire ban days (reg 5), entry contrary to notices (reg 6), entry at night (reg 7), entry to caves and sinkholes (reg 8), lighting fires (reg 9), driving or riding vehicles (reg 10), using boats (reg 11), using aircraft or drones (reg 12), possession or use of firearms and trapping devices (reg 13), possession and use of chainsaws and generators (rr 13A, 13B), removal or disturbance of fauna and flora (rr 14, 15), taking water or damming watercourses (reg 16), digging or fossicking (reg 17), depositing rubbish (reg 18), bringing animals into reserves (reg 20), straying and grazing (reg 20A), and a long list of commercial and group activities that must be authorised (reg 23). The duty is negative in form, but it is satisfied by holding appropriate lawful authority, commonly in the form of a permit or another instrument from the Corporation.

• Duty to comply with permit conditions. Permit holders must comply with any conditions specified in the permit. Contravention of a permit condition is an offence carrying the standard maximum penalty and expiation fee and is grounds for variation or revocation of the permit by the Corporation (reg 25(8)-(9)). Conditions can require restoration, licensed personnel, equipment restrictions, and financial assurances (reg 25(6)).

• Duty to carry or make readily available the permit. Regulation 25(11) requires a person to carry the permit or ensure it is readily available while acting pursuant to it in a reserve, subject to regulation 26 which, per the legislative history, was later deleted. The duty requires evidence of authority to be capable of production.

• Duty to avoid leaving vehicles obstructing access. A person must not leave a vehicle obstructing other vehicles on a road or track in a reserve (reg 10(3)). A warden may remove obstructing vehicles and the Corporation may recover reasonable removal costs from the vehicle owner as a debt (reg 10(4)).

• Duty to remove animals when served notice. When a warden knows or has reason to believe someone claims ownership of an animal in a reserve, the warden must serve notice requiring removal within seven days before disposing of or destroying the animal (reg 21(2)). That obligation is placed on the warden but creates an implied duty on owners to respond.

• Duty not to make false or misleading statements in permit applications. Regulation 29(1) makes it an offence to make a statement that is false or misleading in a material particular in or in connection with a permit application. There is an available defence where the defendant proves belief on reasonable grounds in the truth of the statement (reg 29(2)).

Rights and administrative powers

• Right to apply for a permit and to be refunded fees if application refused. Applicants must apply in the manner and form determined by the Corporation and pay prescribed fees when required (reg 25(3)). Regulation 25(10) provides that a person whose application for a permit is refused must, on request, be refunded an amount equal to the fee that accompanied the application.

• Discretionary right of the Corporation to set fees, waive fees and impose bonds. Regulation 27 gives the Corporation a discretionary right to set and in some cases waive fees. Regulation 28 permits the Corporation to require financial assurances as a condition of permit issue, but bounds that power by requiring the amount not exceed the Corporation’s opinion of the likely cost of rectification and by requiring that the Corporation be satisfied the bond is justified by risk.

• Power to vary or revoke permits. The Corporation may vary or revoke permits where a permit holder contravenes or fails to comply with a condition, or where the Corporation considers it necessary to protect the reserve (reg 25(9)). That power may be exercised by instrument in writing served personally or by post on the permit holder or the person who contravened.

• Operational enforcement powers held by wardens. Wardens may seize abandoned property left unattended more than 24 hours, require payment for its return, and sell it after one month if costs are unpaid (reg 19). They may remove vehicles obstructing access and the Corporation may recover removal costs (reg 10(4)). They may capture, dispose of or destroy unprotected animals not under control and not present pursuant to lawful authority (reg 21(1)), subject to a notice obligation if ownership is claimed (reg 21(2)-(3)). Wardens can require people to leave reserves and those people must not re‑enter for at least 48 hours unless a lesser period is specified (reg 30).

• Right to interest and repayment on lodgements. On expiry or revocation of a permit, where conditions have been complied with, the Corporation must discharge any bond and repay any pecuniary sum lodged together with any interest that has accrued (reg 28(4)). If permit conditions are not complied with, the Corporation may forfeit amounts and apply them to costs of rectification, and repay any remaining portion on application (reg 28(5)).

Liability and debt recovery

• Costs as debts. The regulations convert a range of operational costs into debts recoverable by the Corporation: vehicle removal costs (reg 10(4)), costs of seizing, impounding and keeping property (reg 19(2)), and costs of capturing and disposing of animals (reg 21(4)). The mechanism is that the Corporation may require payment before return, and may sell property after one month if costs are unpaid (reg 19(2)-(4)).

Limits on discretion and safeguards

• Bond size constraint. Regulation 28(2) and (3) constrain the Corporation’s discretion to require financial assurance by capping the amount at what the Corporation considers the likely cost of rectification and requiring that the Corporation be satisfied a bond is justified by the risk.

• Time limits for sequestration and sale. Seized property may be sold or otherwise disposed of only after one month if costs are unpaid or owner cannot be contacted (reg 19(3)-(4)).

• Procedural protections for animal owners. Before destroying or disposing of an animal where ownership is claimed, a warden must serve a seven day removal notice, and the notice may be served personally, by post, or by publication on a Minister‑determined website or in a State‑wide newspaper if the owner’s whereabouts are unknown (reg 21(2)-(3)).

The duties and rights combine statutory prohibitions to protect reserves, an administrative authorisation pathway with conditions and financial assurances, and operational enforcement tools intended to enable the Corporation and its wardens to manage reserves and recover costs. The statutory architecture places a mix of compliance costs on visitor groups, commercial users and owners of animals and property, while centralising decision rights in the Corporation and operational discretion in wardens.

The regulations employ a consistent sanctioning architecture using three principal mechanisms: maximum criminal penalties, expiation fees for many offences, and administrative cost recovery. Enforcement responsibilities rest primarily with forest wardens and other persons authorised by the Corporation, with the Corporation exercising higher level administrative powers including permit issuance, variation and revocation.

Monetary penalties and expiation fees

• Monetary maximums. Most individual regulatory offences specified in the instrument carry a maximum penalty of $750. Examples include entering a forest reserve on a total fire ban day (reg 5), contravening a notice restricting entry (reg 6), entering at night or camping overnight (reg 7), entering caves or sinkholes (reg 8), lighting fires in native forest reserves (reg 9(1)), lighting fires in forest reserves during specified months except in limited circumstances (reg 9(2)-(3)), driving or riding vehicles (reg 10), use of boats (reg 11), aircraft and drone prohibitions (reg 12), possession or use of firearms, trapping devices, fireworks or explosives (reg 13), possession or use of chainsaws (reg 13A), operating generators and alternators (reg 13B), interference with unprotected animals (reg 14), removal or damage to vegetation (reg 15), water protection offences (reg 16), soil, mineral and fossil protections (reg 17), depositing rubbish (reg 18), unwanted animals and grazing (regs 20, 20A), disorderly conduct and defacement (reg 22), commercial and organised activities requiring authorisation (reg 23), failure to comply with directions on signs (reg 24), contravening permit conditions (reg 25(8)), taking false or misleading steps in permit applications is an offence with a maximum penalty of $750 though no expiation fee is specified for that offence (reg 29). The uniformity of the $750 cap suggests the offences are framed as regulatory breaches rather than large‑scale criminal sanctions.

• Expiation fees. Most of the listed offences are accompanied by an expiation fee of $105, which provides a standardised administrative disposal pathway. The text attaches that fee to many offences directly following the maximum penalty. Not every provision repeats the expiation fee; for instance reg 29 (false or misleading statements) specifies only the maximum penalty and not the expiation fee. The existence of expiation fees enables a person to discharge potential liability by payment without a prosecution, subject to procedures under the administering authority’s enforcement practice.

Operational enforcement and recovery of costs

• Wardens’ seizure and impounding powers. Wardens may seize and impound vehicles or personal property abandoned or left unattended for more than 24 hours in a forest reserve (reg 19(1)). The Corporation may require the owner to pay the cost of seizing, impounding and keeping the item before returning it (reg 19(2)). If, after one month following notification, the costs are unpaid, the Corporation may sell or otherwise dispose of the property (reg 19(3)). If the owner is unknown or cannot be contacted, the Corporation may sell or otherwise dispose of the property after one month (reg 19(4)). These provisions create an administrative enforcement route that converts the logistical cost of policing into a recoverable debt.

• Vehicle removal. A warden may remove or cause to be removed a vehicle left in contravention of the obstruction prohibition, and the Corporation may recover reasonable removal costs from the owner as a debt due to the Corporation (reg 10(4)). This is an administrative remedy to maintain access and impose the cost of removal on the owner.

• Animal capture, disposal and destruction. Where an unprotected animal is in a reserve and is not under control and is not present pursuant to lawful authority, a warden or authorised person may capture and dispose of the animal by sale or by other means, or destroy the animal (reg 21(1)(c)-(d)). If ownership is claimed or suspected, the warden must serve notice allowing removal within seven days before disposal or destruction (reg 21(2)). Costs of capture and disposal are a debt due by the owner to the Corporation and an owner cannot recover an animal or carcass until those costs are paid (reg 21(4)-(5)).

• Permit revocation and bond forfeiture. The Corporation may vary or revoke permits where conditions are breached and may determine that all or part of a bond or pecuniary sum is forfeited to pay for costs incurred as a result of non‑compliance (reg 25(9), reg 28(5)). On compliance, the Corporation must discharge bonds and repay pecuniary sums with interest (reg 28(4)). These powers link administrative enforcement with financial penalties for non‑compliance.

Procedural aspects and safeguards

• Notice requirements before disposal. For disposal actions affecting animals the regulations impose procedural notice requirements designed to protect claimants where ownership is known or suspected. Notice can be served personally, by post, or, if the whereabouts of the claimant are unknown, by publication on a Minister‑determined website or in a State newspaper (reg 21(3)). For property seized or impounded, the owner must be notified and given one month to pay costs before sale (reg 19(3)-(4)).

• Defence for false statements. Regulation 29(2) creates a statutory defence to an offence for false or misleading statements in permit applications, where the defendant proves belief on reasonable grounds that the statement was true.

• Administrative discretion and caps on financial assurance. Regulation 28 constrains the Corporation’s discretion to require bonds and sums by capping the amount at what the Corporation considers is the likely rectification cost and by requiring the Corporation to be satisfied a bond is justified in light of the risk of rectification. This provides a reasoned cap on the Corporation’s financial assurance powers, though the cap and justification standard are expressed in the Corporation’s terms.

Enforcement practice risk and uncertainty

• Centralised discretion. Enforcement and permission decisions are concentrated in the Corporation, with wardens and authorised persons exercising significant on‑the‑ground power to seize, remove, capture or destroy. Many enforcement outcomes rest on the Corporation’s or a warden’s judgment as to what is necessary to protect the reserve or whether an applicant poses sufficient risk to require a bond.

• Uniform small monetary penalties. The monetary cap of $750 for most offences places these breaches in a low monetary penalty band, which shapes enforcement priorities and the likely administrative response to widespread non‑compliance. The presence of an expiation fee of $105 for many offences suggests an administrative emphasis on quick disposals for minor breaches rather than severe criminal prosecution.

• Interaction with other licensing regimes. Conduct that may be separately regulated by other statutes (for example firearm possession or aviation) may attract additional penalties and licensing requirements outside these regulations.

In sum, the enforcement architecture combines low maximum penalties with standardised expiation fees, administrative seizure and cost recovery tools, permit variation and bond forfeiture powers, and procedural notice protections for owners. Decision‑making and enforcement discretion are concentrated with the Corporation and its authorised wardens.

The regulations operate within a network of statutes and administrative powers. The text explicitly imports definitions from other Acts, ties certain prohibitions to external legislative events, and reserves powers to the Corporation under the principal Act, the Forestry Act 1950. The legislative history also warns that references may not be automatically updated.

Direct statutory cross‑references and imported meanings

• Forestry Act 1950. The regulations are made under the Forestry Act 1950 and repeatedly reference "the Act" in definitions and procedural clauses (reg 3). The definition of "lawful authority" expressly includes authority pursuant to the Act or these regulations, and includes permits or instruments issued by the Corporation under the Act (reg 3). The non‑derogation provision emphasises the Corporation’s powers under the Act to deny access or otherwise authorise entry or activities beyond what is provided for by the regulations, subject to existing leases, licences, easements or permits (reg 4). Practically, the Act supplies the institutional and statutory framework within which the Corporation exercises broader powers not exhausted by these regulations.

• Fire and Emergency Services Act 2005. Regulation 5 links the prohibition on entrance to total fire ban days to the Fire and Emergency Services Act 2005. Specifically, a person must not enter or remain in a forest reserve on a day on which the lighting or maintaining of fires in the open air is banned under the Fire and Emergency Services Act 2005 in the State or relevant part of the State (reg 5). This makes the prohibition contingent on the operation of a separate statutory regime and creates an interdependence between fire management laws and reserve access rules.

• National Parks and Wildlife Act 1972. The definition of "unprotected animal" in regulation 3 uses the concept of "protected animal" within the meaning of the National Parks and Wildlife Act 1972. That cross‑reference governs the scope of reg 14 and reg 21 which address the taking, molesting, removal, capture and destruction of animals in reserves. The interaction means that protections or classifications under the National Parks and Wildlife Act affect how these regulations operate with respect to fauna.

• Road Traffic Act 1961. The definition of "vehicle" is imported from the Road Traffic Act 1961 (reg 3). This importation aligns vehicle governance in forest reserves with the wider road traffic legal definition, which may have implications for insured status, road rules, and licensing where vehicle definitions matter.

Operational overlaps and potentially concurrent regulation

• Fire management and access. Because reg 5 ties entrance prohibitions to total fire ban declarations under the Fire and Emergency Services Act 2005, enforcement and compliance hinge on the administrative communications of fire bans. Persons acting in reliance on being permitted to enter must check the status of total fire ban declarations under that Act before accessing reserves. Conversely, emergency services operations under that Act will likely override normal reserve permissions where fire risk is present.

• Environmental and heritage laws. The regulations prohibit removal of fossils and archaeological remains (reg 17(3)). Those prohibitions will interface with heritage protection laws and approvals under other Acts. Also, activities that affect water, soil, or ecosystems may require permits or approvals under environmental protection statutes outside the Forestry Act regime. The permit conditions under reg 25(6)(d) expressly allow the Corporation to require restoration of the reserve to pre‑activity conditions, but this does not displace environmental approval processes under other regimes.

• Statutory licences and qualifications. The Corporation may condition permits so that only licensed or otherwise qualified persons may undertake the permitted activity (reg 25(6)(a)). That allows the Corporation to make compliance with relevant external licensing regimes a contractual condition of a permit. For example, possession or use of firearms in a reserve without lawful authority is banned under reg 13, but the Corporation may require evidence of firearms licences or other authorisations before allowing firearms use under a permit.

• Aviation regulation. Regulation 12 bans landing, using and otherwise flying aircraft or drones in a forest reserve without lawful authority, referencing aircraft to include hang‑gliders, para‑gliders, ultra‑light aircraft, balloons and similar craft (reg 3). Aviation regulation under Commonwealth and State aviation safety regimes may overlap; a permit under these regulations would not remove obligations under aviation law and vice versa. The regulations carve out emergency use of aircraft but otherwise prohibit use and landing (reg 12(1)).

Administrative interplay and institutional precedence

• Corporation’s non‑derogation powers. Regulation 4 preserves the Corporation’s general powers under the Act to deny access or require departure from a reserve, independently of the permit system under these regulations (reg 4). That non‑derogation creates an administrative precedence for Corporation decisions made under the Act that may be exercised without recourse to these regulations’ permit apparatus. Practically, a person holding a permit under these regulations may nonetheless be required to leave a reserve if the Corporation exercises its broader statutory powers under the Act.

• Cross‑reference updating risk. The legislative history accompanying the text explicitly warns that references to other legislation, instruments, bodies or offices may be obsolete and are not automatically updated in the published text. Practitioners must therefore verify current cross‑statutory references and titles rather than rely solely on the wording in these regulations.

• Interaction with criminal and civil enforcement under other laws. Many activities subject to the Forestry Regulations are also governed by other criminal and civil regimes. For instance, unlawful possession of firearms will attract offences under firearms legislation separate from reg 13. Destruction of archaeological remains could entail penalties under heritage protection statutes. Persons should therefore assume potential cumulative liability when activity engages parallel regimes.

In summary, the Forestry Regulations 2013 are not standalone. They import meanings and depend on operational decisions under other Acts, particularly those dealing with fire bans, wildlife protection, and road traffic. The Corporation retains powers under the Forestry Act that operate alongside the permit scheme. Practitioners should check for overlapping obligations and parallel licensing regimes, and verify current external statutory references in the light of the legislative history note concerning potential obsolescence of references.

The source provides a legislative history record indicating the principal regulations came into force in 2013 and were subsequently varied in 2013 (a second instrument), 2017 and 2021. The regulations revoked the Forestry Regulations 2005 on commencement. The legislative history lists the instruments and records specific variations to named provisions. The schedule also records deletions and insertions made by later instruments. Below is a structured account, limited to what the source states.

• Initial enactment and repeal of prior regulations. The Forestry Regulations 2013 are the principal regulations, cited as Forestry Regulations 2013 (r 1). They revoked the Forestry Regulations 2005. The principal instrument is recorded as 48/2013 in the Gazette 30.5.2013 p2080 with commencement on 30 September 2013 (legislative history table).

• 2013 variation. A further instrument in 2013, No 187 (Gazette 18.7.2013 p3099), commenced 30 September 2013 immediately after instrument 48/2013. The legislative history notes that Schedule 1 cll 2 and 3 were substituted by 187/2013 r 4 on 30 September 2013.

• 2017 variation. An instrument numbered 238/2017 (Gazette 8.8.2017 p3479) commenced on 8 August 2017. The legislative history records that reg 21(3) was varied by 238/2017 r 4 effective 8 August 2017. It also notes that r 2 was omitted under the Legislation Revision and Publication Act 2002 effective 8 August 2017. Part 3 of Schedule 2 had its Part 2 omitted under the same Act on 8 August 2017.

• 2021 variation. Instrument No 10/2021 (Gazette 4.2.2021 p254) commenced on 4 February 2021 and made a number of variations across the regulations. The legislative history identifies specific provisions varied or deleted by this instrument:

  • Multiple definitions in reg 3, specifically "adult", "bus", "child", "family", and "senior or pensioner", were deleted by 10/2021 r 4(1) to r 4(5) effective 4 February 2021.
  • Regulation 9(3) was varied by 10/2021 r 5 (4 February 2021).
  • Regulation 12 was redesignated as r 12(1) and r 12(2) and (3) were inserted by 10/2021 r 6 (4 February 2021).
  • New regulations 13A and 13B were inserted by 10/2021 r 7 (4 February 2021) creating provisions regulating chainsaws and generators/alternators.
  • Regulation 15(1) was varied by 10/2021 r 8 (4 February 2021).
  • Regulation 17(1) was varied by 10/2021 r 9 (4 February 2021).

  • New regulation 20A was inserted by 10/2021 r 11 (4 February 2021) creating an offence for permitting straying and grazing of animals.
  • Regulation 25(3) and 25(6) were varied by 10/2021 r 12(1) and r 12(2) respectively (4 February 2021).
  • Regulation 26 was deleted by 10/2021 r 13 (4 February 2021).
  • Regulation 27(1) and (2) were substituted by 10/2021 r 14(1) and r 27(3) was varied by 10/2021 r 14(2) (4 February 2021). Regulation 27(5) was deleted by 10/2021 r 14(3).
  • Schedule 1 (prior contents) was deleted by 10/2021 r 15 (4 February 2021).

• Notes on deletion and substitution. The variation history shows targeted adjustments to definitions and to operational rules such as fire use (r 9), aircraft and drone use (r 12), addition of chainsaw and generator rules (rr 13A, 13B), animal management (rr 20, 20A), and permit application and fee processes (rr 25, 27). Deletion of reg 26 is notable because reg 25(11) references reg 26 as a qualification on the duty to carry a permit; the legislative history indicates reg 26 was deleted by 10/2021 r 13 on 4 February 2021.

• Transitional provision. Schedule 2 Part 3 preserves permits that were in force under the revoked 2005 regulations by treating them as permits issued under the 2013 regulations and subject to remaining expiry dates (Schedule 2 cl 3). This ensures continuity of permit entitlements on transition.

• Caveat concerning obsolete references. The legislative history includes a note that references to other legislation, bodies, offices and instruments are not automatically updated in the revision and publication process and therefore may be obsolete. Practitioners must verify cross‑statutory references against current law.

The source does not provide commentary on legislative intent beyond these annotations, and specific explanatory memoranda or second reading speeches are not contained in the provided text. The history documents the dates and instrument numbers for variations and records which clauses were varied, inserted or deleted, allowing practitioners to trace the regulatory adjustments that occurred in 2013, 2017 and 2021.

The regulations as presented in the source contain no case law citations, reported decisions or references to litigation outcomes. The legislative text and the accompanying legislative history list the creation of the principal regulations, the instruments that varied provisions, and notes on amendments, but do not record judicial interpretation or litigation involving these regulations. The schedule of legislative history details the statutory instruments that have varied the regulations and the specific regulatory provisions affected, but it does not include decisions by courts or tribunals.

Consequences for practice

• Absence of recorded litigation in the source. Because no judicial authorities are cited in the provided text, the regulations’ substantive terms and enforcement mechanisms are to be read primarily from the legislative wording. Where legal interpretation might be contested in practice, there is no guidance from case law provided by the source; practitioners must look to external legal databases or court registries for any subsequent judicial treatment.

• Questions likely to invite litigation in absence of guidance. Several provisions contain opinion‑based or discretionary language that can generate disputes in enforcement or administrative review contexts. Examples include:

  • The Corporation’s opinion‑based cap on bond amounts and its discretion to require bonds "in the opinion of the Corporation" (reg 28(2)-(3)).
  • The Corporation’s discretion to vary or revoke permits if "in the opinion of the Corporation" necessary to protect a forest reserve (reg 25(9)(b)).
  • The determination of whether an animal is "in the reserve pursuant to a permit or other authority, or a lease, licence, easement or other interest, granted by the Corporation" for the purposes of reg 21.
  • The assessment of what is "reasonably required" in connection with an activity lawfully engaged in by a person for exceptions in regs 15(2) and 17(2).

• Recommended next steps to identify litigation history. For a comprehensive litigation history a practitioner should search State and Federal court databases, tribunal records, and published decisions for cases referring to the Forestry Regulations 2013 or to enforcement actions by the Corporation under these regulations. Administrative review or merits review decisions may be held by the South Australian Environment, Resources and Development Court or other relevant bodies and are not reflected in the text provided.

In short, the provided source does not record any litigation. Where interpretation or enforcement of discretionary provisions becomes contested, external legal research will be necessary to locate case law and tribunal decisions bearing on these regulations.

The text contains several features that can produce practical traps for users, permit applicants, landowners and enforcement officers. These "gotchas" are concrete statutory mechanics that generate compliance risk, uncertainty, or unexpected costs. The points below are grounded in the regulations themselves.

• "Without lawful authority" is the operative phrase. Many activities are prohibited "without lawful authority". That means a wide range of conduct is permitted if an appropriate instrument exists. The knock‑on effect is that whether conduct is lawful depends on the existence and scope of permits, leases, licences or other instruments granted by the Corporation under the Act or the regulations (reg 3). A person relying on an alleged authority that is not properly documented risks committing an offence.

• Deleted regulation 26 creates potential ambiguity about production of permits. Regulation 25(11) requires a person to carry the permit or ensure it is readily available while acting pursuant to it, "subject to regulation 26". The legislative history shows regulation 26 was deleted by instrument 10/2021 r 13 on 4 February 2021. The interaction of reg 25(11) with the deleted reg 26 is a drafting consequence to note. Practically, reg 25(11) remains operative but the qualifier referencing reg 26 no longer has a live textual anchor. Practitioners should confirm administrative practice on whether on‑site production is required and how electronic permits are treated.

• Uniform small penalty level and expiation fee are low. The uniform maximum penalty of $750 and common expiation fee of $105 for many offences may mean that certain environmental harms are penalised at a low level relative to the potential cost of damage. For commercial operators, the small statutory maximum might not represent the only financial exposure because permit conditions can require bonds and restoration obligations, but it does frame criminal enforcement in a relatively minor monetary band (see regs 5, 6, 7, 9, 10 and others).

• Wide discretion vested in the Corporation. The Corporation determines permit forms, application requirements and fees, may waive fees in stated circumstances, sets the amount of bonds up to a capped estimate, and may vary or revoke permits where, in its opinion, necessary to protect a reserve (regs 25, 27, 28). That concentration of discretionary power can generate uncertainty for applicants because many outcomes are governed by the Corporation’s judgment and internal policy rather than by objective statutory criteria.

• Bonds limited by "opinion" standard. Regulation 28(2) caps the amount of a bond at "the amount that in the opinion of the Corporation is the likely cost" of rectifying damage. The use of "in the opinion of the Corporation" frames the cap as subjective to the Corporation’s view. Although reg 28(3) requires the Corporation to be "satisfied" that a bond is justified by the risk of rectification, both standards rely on administrative judgment.

• Permit expiry maximum of 12 months. Permits expire on the date fixed or, if none provided, after 12 months from commencement (reg 25(7)). Applicants planning multi‑year activities must secure renewals or rolling permits rather than assuming multi‑year coverage is available automatically.

• Permit fees for commercial activities set by the Corporation. Regulation 27(3) gives the Corporation the power to determine fees for permits issued for commercial or organised activities. That creates price uncertainty for commercial permit applicants and potential negotiation or disclosure of fee frameworks is necessary before operations commence.

• Recovery of costs as debts with short timeframes. Seized property may be sold one month after notice if costs are unpaid (reg 19(3)-(4)). Owners not promptly responding may lose assets with little delay. Similarly, vehicle removal costs may be recovered as a debt by the Corporation (reg 10(4)). Owners should act promptly to avoid loss and cost accrual.

• Animals and notice procedures. A warden may capture or destroy an unprotected animal in a reserve (reg 21(1)(c)-(d)). If the warden knows or has reason to believe someone claims ownership, the warden must serve a seven day removal notice (reg 21(2)). The notice can be served by publication on a Minister‑determined website or in a State newspaper if the owner is uncontactable (reg 21(3)). Owners who do not maintain contact details risk losing animals or carcasses and incurring costs for capture or disposal that will remain payable.

• Drones and aircraft prohibitions. Regulation 12 prohibits the use of drones or other unmanned aerial vehicles in a forest reserve without lawful authority (reg 12(2)) and prohibits landing or otherwise using aircraft except in an emergency (reg 12(1)). Recreational drone users and aviation operators may run afoul of these broad prohibitions, and even emergency exceptions will require careful documentation.

• Differentiation between native and other forest reserves. Several provisions are stricter in "native forest reserves". For example, lighting a fire in the open air is absolutely prohibited in a native forest reserve (reg 9(1)), whereas in other forest reserves fires may be permitted under specified conditions (reg 9(3)). Licensees and operators must identify whether a reserve is native to determine applicable rules.

• Interaction with other laws is necessary and references may be outdated. The regulations import definitions and rely on statutory events under other Acts (regs 3, 5). The legislative history cautions that references may be obsolete. Practitioners must therefore confirm current status of cross‑referred statutes and any relevant amendments.

• Wide list of "must be authorised" activities. Regulation 23 enumerates many activities that require authorisation to be lawful, including commonly commercial or organised leisure activities. Operators who inadvertently undertake sales, organised tours, or events without permits risk breaches even if the activity could be low impact.

• False or misleading application statements. Regulation 29 criminalises false or misleading statements in or in connection with permit applications, with a statutory defence for honest belief on reasonable grounds (reg 29(1)-(2)). Applicants must ensure application accuracy and evidentiary basis for asserted facts.

These features produce practical compliance traps. They underscore the need for robust documentation of authorisations, prompt responses to notices from wardens or the Corporation, early engagement with the Corporation for permit and fee clarity, and cross‑checking of applicable external licences and emergency declarations that affect reserve access.

Compliance under the Forestry Regulations 2013 requires a disciplined administrative approach, early engagement with the Corporation and attention to documentary evidence. The following steps are derived directly from the regulations and indicate concrete actions for visitors, commercial operators, permit applicants and owners of animals or property.

1. Determine the status of the land and the nature of the reserve

• Confirm whether the land is a forest reserve and, if so, whether it is a native forest reserve. Many prohibitions are absolute in native forest reserves (for example reg 9(1) banning fires). The definition that "forest reserve includes a native forest reserve" is in reg 3. Confirm the reserve classification with the Corporation or relevant land register before planning activities.

2. Check for total fire ban declarations and other external triggers

• Consult the Fire and Emergency Services Act 2005 declarations for total fire ban days. Regulation 5 makes it an offence to enter or remain on a day when lighting or maintaining fires in the open air is banned under that Act. Before entry, verify the status of total fire bans for the State or relevant region.

3. Identify whether the intended activity is prohibited absent lawful authority

• Use the regulations’ lists to identify whether the proposed activity requires lawful authority. The catalogue is long and includes fires, vehicles, boats, aircraft and drones, firearms, chainsaws, generators, removal of vegetation or fossils, depositing rubbish, commercial photography and tours, organised competitions, sale of goods, fund raising or profit‑making activities, erection of structures, beekeeping, and public gatherings (see regs 9, 10, 11, 12, 13, 13A, 13B, 15, 17, 18, 23).

4. Apply for permits where required and follow the Corporation’s application process

• Regulation 25 requires permits to be in writing and in a form determined by the Corporation. Applications must be made in the manner and form determined by the Corporation and accompanied by the prescribed fee, if any (reg 25(2)-(3)). For group activities a single application by one group member may suffice (reg 25(4)). Allow adequate lead time for Corporation assessment and be prepared to provide evidence of qualifications or licences if requested under reg 25(6)(a).

5. Expect and negotiate permit conditions and financial assurances

• Be prepared for permit conditions including area restrictions, permitted equipment types, restoration obligations and financial assurances (reg 25(6)(b)-(d)). If the Corporation proposes a bond or pecuniary sum, note the statutory caps and justification requirement in reg 28(1)-(3): the amount must not exceed what the Corporation considers the likely cost of rectification and the Corporation must be satisfied the condition is justified. Seek written reasoning for bond amounts and, if significant, consider requesting a written estimate or basis for the Corporation’s opinion.

6. Budget for fees and potential bonds

• Regulation 27 requires payment of prescribed fees for permits and allows the Corporation to determine fees for commercial, scientific or organised events (reg 27(1), (3)). Fees may be waived in specified circumstances at the Corporation’s discretion (reg 27(4)). Budget for these fees and any bond or pecuniary sum, and plan for timely lodgement to avoid permit delays.

7. Carry and produce permit documentation while on site

• Regulation 25(11) requires a person to carry the permit or ensure it is readily available while acting pursuant to it. Although regulation 26 was deleted, ensure permits are physically or electronically producible on demand to wardens or authorised officers. Keep copies of permit conditions, financial assurance receipts and any correspondence with the Corporation.

8. Comply with permit conditions and site notices

• Strictly comply with conditions of the permit. Contravening a condition is an offence and may lead to variation or revocation of the permit, and forfeiture of bond amounts (reg 25(8)-(9), reg 28(5)). Additionally, reg 24 prohibits contravention of directions in notices or signs displayed in the reserve, and reg 6 makes entry contrary to approved entrance notices an offence.

9. Manage animals and property proactively

• Do not allow animals to straying or graze in reserves without authority (reg 20, reg 20A). If animals are placed in a reserve, ensure contact details are current and respond swiftly to any notice. Abandoned property left more than 24 hours may be seized and impounded (reg 19(1)). Owners should monitor any property or vehicles left within reserves and remove them quickly to avoid seizure, cost exposure and possible sale after one month.

10. Plan for environmental restoration and anticipate costs

• If a permit includes restoration conditions, ensure an operational plan and budget are in place to restore the reserve to a state similar to pre‑activity conditions (reg 25(6)(d)). Bonds are intended to secure rectification costs and may be forfeited if restoration is incomplete (reg 28(5)). Document restoration activity and retain receipts to facilitate discharge of bonds under reg 28(4).

11. Maintain insurance and licences required by other laws

• The regulations may be augmented by other statutory regimes such as firearms, aviation, environmental protection and road traffic laws. Ensure all relevant licences, registrations and insurances are current and carry evidence. The Corporation may require only licensed or qualified persons to undertake an activity (reg 25(6)(a)), which imports external licensing obligations into the permit condition set.

12. Respond promptly to enforcement actions and notices

• If a warden seizes property or captures animals, respond quickly to notices. The Corporation may require payment for release of seized property and may sell property after one month if costs are unpaid (reg 19(2)-(4)). For animals, a seven day removal period applies after notice if ownership is claimed (reg 21(2)). Failure to act promptly can result in loss of property or additional cost recovery actions.

13. Keep accurate statements in permit applications

• Regulation 29 makes it an offence to provide false or misleading statements in a permit application. Maintain documentary support for claims made, and if uncertain, seek legal or specialist input. The statutory defence requires proof of a belief on reasonable grounds (reg 29(2)), so applicants should document factual bases for any representations.

14. Anticipate the Corporation’s discretionary powers and seek clarification or review when appropriate

• The Corporation’s discretion to vary or revoke permits where it considers necessary to protect reserves (reg 25(9)(b)) and to determine fee levels for commercial activities (reg 27(3)) requires applicants to engage pro‑actively. If a permit is varied or revoked, applicants should request written reasons and consider internal review or merits review rights where available under administrative law frameworks external to these regulations.

15. Verify cross‑statutory references and current legal status

• The legislative history warns that references in the regulations to other legislation or instruments may be obsolete. Confirm the current text of cross‑referenced Acts and any related subordinate instruments before relying on those external provisions in permit applications or operational planning.

In operational terms, compliance is a mixture of avoidance (do not engage in activities that are expressly prohibited without lawful authority), proactive authorisation (secure permits and meet conditions), documentation (carry permits, keep evidence of licences and insurance, and document restoration), and prompt response to enforcement. For commercial users, early negotiation over fees and bonds, and obtaining written reasons for significant financial assurance demands, will reduce uncertainty.
