Forest Products Regulations 2020

The regulations revolve around five recurring legal and operational concepts: Commission produce and Commission land; delivery notes as primary movement documents; receival records at sawmills; the General Manager’s authorising and supervisory powers; and offences, corrections and retention requirements.

Commission land and Commission produce. The definitions in regulation 3 set the scope. Commission land includes public land, sharefarmed land and land in which the Commission has an interest (reg 3). Commission produce is defined to include forest products as defined in section 4 of the Act and log timber (reg 3). The regulations therefore apply to timber lawfully felled on, and removed from, Commission land (see definition of log timber).

Delivery notes as control documents. Part 2 makes delivery notes the central compliance instrument. A delivery note can be hard copy, electronic or any other form approved by the General Manager (reg 5(1)). The note must include specific fields: removal date, consignee name and address, species, description/classification/grade, location removed from, production contract details if relevant, vehicle registration and the driver’s signature (reg 6(1)(a)-(h)). The General Manager may exempt classes of persons from some or all of these requirements (reg 6(2)). There is a presumption that each type of Commission produce requires a separate delivery note, with limited exceptions where the goods share description, destination and simultaneous weighing (reg 7).

Hard copy controls. Where hard copy notes are used, the General Manager issues forms and may issue books of notes, require receipts for books, and require return or accounting for books (reg 9(1)-(2), 10, 12). Destruction of notes is prohibited unless authorised in writing by the General Manager (reg 11). Alteration of hard copy notes is tightly controlled; permitted corrections must be legible and identify who made the correction (reg 13(1)). Electronic notes may not be altered by the person who created them (reg 13(2)); the General Manager may direct replacement notes where mistakes are discovered (reg 13(3)).

Sawmill receival records and timing. Responsible persons at sawmills must receive delivery notes with log timber felled on Commission land, ensure a sawmill employee signs the delivery note on receipt, and transmit the note to the General Manager , for hard copy within 3 working days, for electronic in the approved manner (regs 19-21). Sawmill receival records must be made on the day timber is received and include date, species and classification from the delivery note, quantity and, for electronic notes, the delivery reference number (reg 25(4)). Copies of receival records must be kept for two years (reg 26). Managers must provide receival records to the General Manager within the first three working days of each month for the preceding month (reg 28).

Quantification, weighing and storage. Whoever determines quantity must immediately record it on the delivery note and attach weighbridge tickets or equivalent where relevant (reg 22). Incorrect quantity entries are prohibited (reg 23). Sawmills may not store or process Commission produce unless quantity has been determined, unless authorised by the General Manager (reg 24).

Inspection, seizure and marking. The General Manager must endeavour to ensure nominated officers check not less than 5 per cent of delivery notes each month, and those checks may occur at various stages (before removal, during delivery, at the sawmill or in another approved manner) (reg 18). A nominated officer or conservation and land management officer may require a driver to produce delivery notes carried by a vehicle (reg 15). The mark an authorised person uses to indicate seized Commission produce is prescribed by regulation 31 for the purposes of Act section 65. Regulation 32 prohibits marking trees on certain land without authority, limiting marking to nominated officers or forest officers (reg 32).

Contractual information and coercive directions. The General Manager may, by written notice, direct persons who manage Commission produce, owners of sawmills, and owners of sharefarming agreements to provide contractual information about production and road contracts for specified periods. A person must comply within 14 days and in the form directed by the General Manager (reg 30).

Offences and evidence integrity. The regulations criminalise a range of behaviours: failure to keep copies of hard copy delivery notes (reg 8), unauthorised destruction (reg 11), false accounting for hard copy books (reg 12(3)), altering notes or receival records in prohibited ways (regs 13, 27), failure to produce delivery notes on request (reg 15), delivering produce to a different party or place than specified (reg 16), failing to deliver a copy of the delivery note with the produce (reg 17), making false or misleading statements in delivery notes, receival records or contractual information (reg 33), and others. Penalties are expressed as monetary fines tied to the specific regulation.

Collectively, these concepts create a paper-and-electronic traceability and oversight regime focused on Commission produce leaving Commission land and being processed in sawmills, with a central administrative role for the General Manager and inspection powers for nominated and conservation officers.

Primary parties affected. The regulations place direct duties on several clearly defined classes of persons.

• Persons removing Commission produce from Commission land. Anyone creating delivery notes, carrying produce or transporting Commission produce is subject to obligations to use approved forms, to ensure required information is included, and to carry originals or electronic notes in vehicles (regs 5, 6, 14). Drivers must sign delivery notes and produce them on inspection (reg 6(1)(h), reg 15).

• Sawmill responsible persons and owners. Responsible persons for sawmills, defined to include owners and managers, must ensure each delivery note accompanying log timber felled on Commission land is received at the sawmill, signed immediately by a sawmill employee, forwarded to the General Manager in the timeframe required, and that receival records are made and retained (regs 19-21, 25-29). Sawmill owners must keep copies of receival records for two years and provide monthly submissions of receival records to the General Manager (reg 26, 28).

• Commission employees and contractors. The General Manager may nominate officers and give them powers to check delivery notes, require production, and exercise other oversight (regs 5(2), 12, 18). Nominated officers are the Commission’s operational enforcement agents (definition of nominated officer in reg 3).

• Conservation and land management officers and authorised persons. Conservation and land management officers have power to require drivers to produce delivery notes (reg 15). Authorised persons under the Act who seize produce use the prescribed mark (reg 31); they are also required to record inspection outcomes in receival records when entering sawmills under Act s 64 (reg 29).

• Owners of sharefarming agreements and persons who engage in harvesting. The General Manager can direct contractual information from persons who manage Commission produce, owners of sharefarming agreements, and those who harvest (reg 30(2)).

Who bears the compliance cost. Administrative burdens sit mainly with removers of Commission produce and sawmill owners/managers. Obligations include using approved delivery note forms (potentially issued books of hard copy notes), maintaining copies, making same-day receival entries, attaching weighbridge tickets, retaining copies for at least two years, and monthly reporting to the General Manager (regs 5, 8, 22, 25, 26, 28). Drivers must ensure electronic notes are accessible while in the vehicle if electronic form is used (reg 14(1)(b)); that requires vehicle-based electronic access or tools such as mobile devices and connectivity.

Decision-makers and enforcement actors. The General Manager has broad administrative authority over forms, procedures, approvals, exemptions and directions to correct records (regs 5, 6, 9, 11, 12, 13, 21, 30). Enforcement is operationalised through nominated officers, conservation and land management officers and authorised persons (regs 15, 18, 29, 31).

Non‑covered parties. Regulation 4 excludes persons exercising powers under the Bush Fires Act 1954. That creates an express carve-out for fire-fighting related felling and removal of trees where that Act applies, removing those activities from the documentation requirements.

Party-level exposure to penalties. The regulations specify fines and identify the person obliged to act in particular contexts. For example, the driver who fails to produce delivery notes on inspection is subject to fines (reg 15(3)). Sawmill responsible persons are fined for failing to receive and sign delivery notes or forward them to the General Manager (regs 19-21). A person producing a hard copy delivery note who fails to keep a copy faces a penalty (reg 8). Making false or misleading statements in a delivery note, receival record or contractual information carries a $2,000 penalty (reg 33).

Secondary and systemic effects. The need to retain and transmit documentation will affect sawmill recordkeeping systems, weighbridge operations and logistics processes. Electronic delivery note systems will need to incorporate non‑alterability safeguards because electronic notes may not be altered by the creator and the General Manager can direct replacement notes when mistakes are discovered (reg 13). The General Manager’s powers to exempt classes, approve forms and require returns of books concentrates administrative discretion with the Commission, which may create differing compliance regimes for different classes of producers depending on the approvals and exemptions exercised.

Duties established by the regulations are procedural, time-sensitive and allocated by function. The primary duties relate to creation, carriage, content, retention and transmission of delivery notes and receival records. Rights are limited and primarily consist of the General Manager’s discretion to grant exemptions and approvals; regulated persons have rights to written approval or direction where the General Manager exercises discretion.

Creation and content of delivery notes. A delivery note must be produced in a form and manner approved by the General Manager, and must contain, at minimum, the date of removal, the consignee name and address, species and grading information, location removed from, contract details if removed under a production contract, vehicle registration and the driver’s signature (reg 5(1)-(2); reg 6(1)(a)-(h)). The General Manager may exempt a person or class from some or all of these requirements in writing (reg 6(2)).

Form options and requirements. Delivery notes may be provided in hard copy, electronic form or any other form approved by the General Manager (reg 5(1)). Where a hard copy is used, it must be the form issued by the General Manager and the person producing it must keep a copy (regs 8 and 9(1)). The General Manager may issue books of hard copy notes and require a receipt for a book issued (reg 9(2)).

Carriage and production on demand. A driver must ensure that during transportation the original and copies of a hard copy note, or an electronically accessible note, are carried in the vehicle (reg 14). A nominated officer or conservation and land management officer may require a driver to produce delivery notes for inspection, and the driver must comply (reg 15(2)-(3)). If inspection occurs, the inspecting officer must sign and endorse date and place on the note (reg 15(4)).

Delivery and forwarding duties. Commission produce must be delivered to the person and place specified on the delivery note; delivering to a different person or place is an offence (reg 16). A copy of the delivery note must be delivered with the produce (hard copy delivered physically, electronic delivered electronically) (reg 17). Sawmill responsible persons must ensure delivery notes for log timber felled on Commission land are received at the sawmill and are immediately signed by a sawmill employee (regs 19-20). Sawmill responsible persons must forward delivery notes to the General Manager within 3 working days for hard copy notes, or in the approved manner for electronic notes (reg 21).

Quantification and weighing. The person who determines the quantity of Commission produce must immediately record that quantity on the delivery note, and attach any weighbridge ticket or ticket-like form to the delivery note (reg 22). Incorrect quantity entries are prohibited (reg 23). Sawmills may not store or process Commission produce unless the quantity has been determined, unless the General Manager authorises otherwise (reg 24).

Receival records and retention. Sawmill responsible persons must ensure receival records are made on the day timber is received and include date, species and classification as in the delivery note, quantity and the electronic delivery reference number where relevant (reg 25(4)). Receival records must be retained for two years at the sawmill or another General Manager-approved place (reg 26). Managers must provide receival records monthly to the General Manager within the first three working days for the previous month (reg 28).

Duty to provide contractual information. The General Manager may direct persons who manage Commission produce, sawmill owners and owners of sharefarming agreements to provide contractual information regarding production or road contracts for specific periods. The person must comply within 14 days and in the form directed by the General Manager (reg 30).

Restrictions on marking trees. A person must not mark trees or other Commission produce on sharefarmed land or land the Commission has an interest in, except where the person is a nominated officer or a forest officer (reg 32). The regime thereby restricts informal or unauthorised identification marking.

Non‑alteration and correction obligations. Hard copy alteration is permitted only to correct mistakes, with the original entry remaining legible and the identity of the altering person recorded; electronic delivery notes and receival records must not be altered by the person who created them (regs 13(1)-(2), 27(1)-(2)). If the General Manager becomes aware of a mistake in an electronic note or record, the General Manager must attempt to have the mistake corrected and may direct creation of a replacement note or record (regs 13(3), 27(3)).

Inspection rights of the Commission. The General Manager must endeavour to ensure that nominated officers check at least 5 per cent of delivery notes completed in respect of Commission produce removed from Commission land each month, and may check at different stages of removal and receipt (reg 18). Nominated officers and conservation and land management officers may require production of delivery notes and endorse inspected notes (reg 15).

Penal consequences and fines. Each enumerated breach carries a specified monetary penalty, often $1,000 or $2,000, depending on the seriousness and nature of the infraction (see regs 8-13, 14-17, 19-28, 30, 32-33). The fines operate as the statutory sanctioning mechanism for compliance.

Rights and discretion. The principal rights conferred by the regulations are powers of exemption and approval vested in the General Manager. The General Manager may approve forms and manners of production, grant exemptions for classes of persons or vehicles from particular requirements, issue books of hard copy notes and require their return or accounting, and direct correction of electronic records. Those discretions are exercised by administrative act and are the levers through which the Commission shapes operational compliance.

Penalties are statutory fines tied to discrete breaches of regulatory duties. The Regulations deploy graduated monetary penalties, and assign inspection and enforcement powers to nominated officers, conservation and land management officers and authorised persons under the Act.

Monetary penalties by category. Penalty amounts are specified at many points.

• Low-level administrative: $50 for failing to use the General Manager’s hard copy form (reg 9(1)). This is the sole $50 penalty.

• Intermediate administrative and recordkeeping: $1,000 for failing to keep a copy of a hard copy delivery note (reg 8); $1,000 for failure to return unused hard copy delivery book when required (reg 10); $1,000 for unauthorised destruction of delivery notes (reg 11); $1,000 for failure to comply with a written notice requiring return or accounting for hard copy note books (reg 12(2)); $1,000 for knowingly giving a false account of location of hard copy notes (reg 12(3)).

• Operational and integrity offences: $2,000 for various operational or integrity breaches, including altering delivery notes (reg 13(1)-(2)), failing to carry delivery note in vehicle (reg 14), refusing to produce delivery note on inspection (reg 15(3)), delivering Commission produce to a person or place other than on the delivery note (reg 16), failing to deliver a copy of the delivery note with the produce (reg 17), failing to ensure that log timber is received with a delivery note at a sawmill (reg 19), failing to have sawmill staff sign the delivery note on receipt (reg 20), failing to forward delivery notes to the General Manager within 3 working days (reg 21), failing to record determined quantities immediately or attach weighbridge tickets (reg 22), knowingly recording incorrect quantities (reg 23), permitting unquantified Commission produce to be stored or processed without authorisation (reg 24), failure to make receival records (reg 25), failing to keep receival record copies for two years (reg 26), altering receival records improperly (reg 27), failing to provide receival records to the General Manager monthly (reg 28), marking trees without authority (reg 32), and making false or misleading statements in delivery notes, receival records or contractual information (reg 33).

Criminal character and enforcement machinery. The regulations create offences subject to fines rather than express imprisonment or demerit systems. The enforcement machinery is administrative policing by nominated officers and conservation and land management officers. These officers may require drivers to produce delivery notes for inspection (reg 15(2)). On inspection, the officer must sign the delivery note and endorse time and place (reg 15(4)). Nominated officers are tasked with checking at least 5 per cent of delivery notes each month if the General Manager endeavours to ensure that percentage; checks can take place before removal, during delivery, at the sawmill or in another manner approved by the General Manager (reg 18).

Seizure and marking. Regulation 31 prescribes the mark an authorised person is to use for seized Commission produce for the purposes of section 65 of the Act. While the regulations do not themselves define seizure powers, they integrate with Act s 65 via the prescribed mark. Regulation 29 requires an authorised person entering a sawmill under Act s 64 to record the date, nature and results of inspections in the receival record.

Administrative controls and corrective directions. The General Manager may direct correction of electronic delivery notes and receival records where mistakes are known, and may direct the person who created the note or record to produce a correct replacement (regs 13(3), 27(3)). The General Manager also has notice powers to require contractual information within 14 days (reg 30). Failure to comply with a notice to provide contractual information carries a $2,000 penalty (reg 30(3)).

Scope and limits of enforcement discretion. The General Manager’s language includes mandatory and advisory verbs. For example, regulation 18(2) states the General Manager must endeavour to ensure a minimum 5 per cent check rate each month; “must endeavour” is a non‑absolute obligation that creates a duty to attempt but not a strict numerical guarantee of enforcement. Many operational matters are left to the General Manager’s approval, which concentrates discretion and may mean enforcement priorities and the forms of compliance vary by Commission decisions (regs 5(2), 9(2), 12(1), 21, 30).

Operational consequences of penalties. Most fines are modest by corporate standards, often $2,000 per breach, but offences can be repeated across many vehicles, loads and events. The cumulative cost of repeated non-compliance therefore can be material. The regime is suited to use as a compliance tool where spot checks, documentary mismatches and recordkeeping failures are the usual triggers for enforcement. Authorities can use direction and correction powers alongside fines to remedy errors in electronic records.

Evidence and admissibility. The regulations impose documentary obligations that create presumptive evidentiary records. Delivery notes and receival records signed by officers on inspection, combined with weighbridge tickets attached to delivery notes, provide the Commission with contemporaneous documentary evidence of movement and quantity. The non‑alteration requirements for electronic records reduce the risk of after-the-fact manipulation from the regulated person’s side, while corrective directions by the General Manager allow rectification when the Commission identifies mistakes.

The regulations are expressly designed to operate within the statutory framework of the Forest Products Act 2000 and to interact with provisions of the Conservation and Land Management Act 1984 (CALM Act) and the Bush Fires Act 1954. The regulations reference and depend on Act provisions for definitions, powers of authorised persons and seizure mechanics.

Interaction with the Forest Products Act 2000. The regulations implement and detail procedures required under the Forest Products Act. Several provisions cross-reference the Act. The definition of sawmill in the regulations relies on section 62 of the Act (reg 3). Regulation 29 specifically concerns authorised persons entering a sawmill under section 64 of the Act, requiring the authorised person to make an entry in the receival record about inspections or inquiries (reg 29). Regulation 31 prescribes a mark to be used by an authorised person seizing Commission produce for the purposes of section 65 of the Act (reg 31). The regulations also rely on the Act’s definitions for terms such as forest products (reg 3 refers to section 4 of the Act) and production contracts and road contracts via regulation 30 reference to section 55 of the Act.

Interaction with the CALM Act. Regulation 32 uses the CALM Act definition of forest officer and restricts marking of trees on sharefarmed land or other Commission interest land to nominated officers or forest officers (reg 32(1)-(2)). Regulation 15 references conservation and land management officer as defined in the CALM Act section 3, and gives them power to require drivers of applicable vehicles to produce delivery notes (reg 15(1)-(2)).

Bush Fires Act carve-out. Regulation 4 explicitly excludes application of the regulations to any person exercising powers, functions or duties under the Bush Fires Act 1954. That carve-out exempts felling and removal activities conducted under fire-fighting powers from the documentary and handling obligations in these regulations (reg 4).

Administrative law and delegated powers. The General Manager’s extensive authorising powers and discretion to approve forms, exempt classes, issue books, require returns, direct corrections, and request contractual information, interact with general administrative law principles. The regulations create a framework where the General Manager establishes operational detail by written approval or direction (e.g., regs 5(2), 6(2), 9(2), 11, 12, 13, 21, 30). That administrative discretion is exercised under the enabling instrument of the regulations and must be consistent with the Act and the regulations themselves.

Evidentiary consequences for commercial law. The documentary obligations and non‑alteration rules will interact with commercial transactions involving timber. Delivery notes and receival records, signed by drivers, sawmill employees and inspecting officers, will function as contemporaneous records of quantity, grade and contractual destination. The attachment of weighbridge tickets (reg 22(2)) further integrates measurement evidence into the transactional document. Parties relying on delivery notes as the record of contractual performance or as evidence in disputes will find the regime prescribes a chain of custody and anti‑tampering rules that affect evidentiary weight.

Privacy and data considerations. The regulations require the inclusion of personal and contractual details on delivery notes and include monthly reporting to the General Manager. The regulations do not themselves address privacy or records management beyond retention periods and approved locations for storage, so interactions with privacy law and records management obligations will arise when the Commission and regulated persons handle personal data in delivery notes and receival records.

Overlap and potential duplications. The regulations’ routinised documentation may overlap with private contract requirements and commercial logistics systems. Parties will need to coordinate compliance with the General Manager’s approved forms and processes while maintaining their own commercial documentation, to avoid duplicative systems and incompatibility between the Commission’s required form and private tracking systems.

The Regulations include a compilation table capturing initial publication and commencement. The Forest Products Regulations 2020 were published as SL 2020/225 on 20 November 2020 and came into operation in two stages: regulations 1 and 2 (Citation and Commencement) on the day of Gazettal, 20 November 2020; and the remainder of the regulations on the following day, 21 November 2020 (Compilation table; regs 1-2).

There are no further amendments or revocations recorded within the text provided. The compilation table included in the document lists only the original instrument and its commencement dates. The defined terms list at the end summarises definitions for key terms and the provisions where they are defined; it is an editorial aid and not part of the substantive law.

Because the source material provided is the full text of the Forest Products Regulations 2020 as compiled, any subsequent amending instruments, repeal, replacement or partial amendment would not be visible here. Confirmation of later amendments or repeals would require consultation of the consolidated legislative database or Gazette updates beyond the compilation provided.

The regulations themselves provide a structural baseline for how the General Manager may exercise approval and exemption powers; they do not contain delegated legislation-making powers permitting further sub‑delegation beyond the approvals and directions described. Practically, administrative change in the operation of the regime will be effected by the General Manager issuing forms, approvals and written notices under the regulatory head powers set out in regs 5, 6, 9, 11, 12, 13, 21 and 30. Such administrative acts are not recorded as legislative amendments but will alter operational compliance requirements.

For practitioners, the key date to note is the instruments’ commencement in November 2020. Any legal advice or compliance regimen should verify whether subsequent amendments or updated General Manager approvals have been issued since that commencement date, by consulting the Commission’s current approvals, published forms and the consolidated regulations database.

The regulations text provided does not include any cases, court decisions or litigation references. It does not name any judicial decisions or instances of contested enforcement that would provide an interpretive body of litigation applying these specific regulations.

Because the regulations are administrative in nature, litigation where it exists may involve challenges to the exercise of the General Manager’s discretions, prosecutions for breaches of the specified offences, or disputes over evidentiary weight of delivery notes and receival records in commercial litigation. None of those matters are recorded in the materials before us.

Practitioners seeking litigation history must therefore consult court databases, tribunal records and prosecutorial files after the commencement date (21 November 2020) to identify any prosecutions, judicial review applications, appeals or contested interpretations involving these regulations or their interaction with the Forest Products Act 2000. The absence of litigation in the provided compilation does not mean no litigation exists; it means the legislation text itself does not purport to record case law.

When advising clients in the absence of reported litigation in the provided material, treat enforcement provisions and officer powers as current statutory rights and obligations. Any disputes that go to litigation will revolve around statutory construction of the Act and these regulations, the scope and exercise of the General Manager’s discretions, the sufficiency of documentary compliance (form and content of delivery notes and receival records), and admissibility or probative weight of documents signed by officers.

The regulations create a number of specific operational traps and tight rules that can generate liability or administrative friction if missed. Below are concrete points where regulated parties frequently err.

Double-signature expectations. The delivery note must bear the driver’s signature when the load is removed (reg 6(1)(h)), and when log timber is received at a sawmill the note must be immediately signed by a sawmill employee (reg 20). The driver must also produce the note on inspection (reg 15) and the inspecting officer must sign and endorse the note (reg 15(4)). Failure to capture any required signature can turn a delivery into non-compliant produce on arrival at the sawmill, exposing both driver and sawmill manager to penalties (regs 6(1)(h), 19-20, 15(3)).

Electronic non‑alteration rule. Electronic delivery notes and receival records must not be altered by the person who created them (reg 13(2), reg 27(2)). Mistakes in electronic records are not to be fixed unilaterally by the creator; the General Manager must be involved to direct a correct replacement (reg 13(3), reg 27(3)). Electronic systems must thus be designed with error‑correction workflows that allow for administrative direction from the General Manager and for audit trails that show correction by the Commission or pursuant to its direction.

“Must endeavour” inspection requirement. Regulation 18(2) requires the General Manager to endeavour to ensure at least 5 per cent of delivery notes are checked each month. “Must endeavour” imposes a duty to attempt rather than a guarantee. Regulated parties should not assume regular, predictable spot checks at a specific rate; enforcement effort may vary with Commission resourcing and policy. However, the minimum 5 per cent figure gives a target to calibrate probable inspection risk.

Hard copy book accountability. If the General Manager issues a book of hard copy delivery notes, the person issued the book is obliged to return the book on completion or on request and can be required to account for its location (regs 9(2), 10, 12). Knowingly giving a false account carries a $1,000 penalty (reg 12(3)). Businesses using issued hard copy books must implement internal controls to track issued note books to staff, drivers and subcontractors.

Destruction prohibition. Delivery notes and unused hard copy notes must not be destroyed without written authorisation by the General Manager (reg 11(2)). The definition of destroy in reg 11(1) is broad; it covers obliteration, rendering illegible or irrecoverable, or actions that prevent conveyance of meaning in visible, audible or recoverable form. Records managers should not discard or redact notes without explicit written authority (reg 11).

Attachment of weighbridge tickets and quantification timing. The person determining quantity must immediately record quantity on the delivery note and attach weighbridge tickets where determination is printed on a separate form (reg 22(1)-(2)). Processing or storage at a sawmill of unquantified Commission produce is prohibited except with Commission authorisation (reg 24). Weighbridge operations and timing of measurement relative to load movement must ensure attachment to the delivery note before storage or processing.

Delivery destination strictness. Regulation 16 makes it an offence to deliver Commission produce to any person or place other than as specified on the delivery note. This interacts with commercial scenarios like substitutions, last-minute redirection, or transfers between buyers. Any change in destination must be reflected in an appropriate new delivery note or be authorised in writing by the General Manager through an exemption; otherwise both the deliverer and receiver risk fines.

Non‑alteration of electronic records versus correction of mistakes. The regulations prohibit alteration by the creator but direct the General Manager to endeavour to correct mistakes in electronic notes or records and to direct replacement notes (reg 13(3), reg 27(3)). That structure can slow correction of genuine mistakes while the Commission processes the correction. Operations relying on quick fixes must build processes for notification and obtaining replacement notes under the General Manager’s direction.

Exemption dependence on General Manager. Several important operational flexibilities depend on a written exemption from the General Manager, including exemptions from some delivery note fields (reg 6(2)), exemption of vehicles from production-on-demand duties (reg 15(1) definition of applicable vehicle), and exemptions from receival record requirements (reg 25(5)). Regulated parties should not assume informal permission from staff will suffice; formal written exemptions are required.

Contractual information notices and tight timeframe. The General Manager can direct production of contractual information, which includes contract details and information about type and quantity of Commission produce and the destination (reg 30(1)-(2)). A recipient must provide that information within 14 days in the form directed (reg 30(3)). Failure carries a $2,000 penalty. Parties engaged in multi‑contract supply chains must be able to produce contractual information promptly.

Mark for seized produce not shown. Regulation 31 prescribes a mark for use by authorised persons seizing Commission produce for the purposes of section 65 of the Act and includes an image placeholder in the text. If a regulated party relies on a different marking or assumes the mark is not prescribed in practice, that will be incorrect. Practitioners should obtain from the Commission the prescribed mark and instructions for its recognition and handling in seized-produce cases.

Bush Fires Act exclusion. Activities undertaken pursuant to the Bush Fires Act 1954 are excluded from these regulations (reg 4). Parties involved in fire management and post-fire salvage should not apply these regulations reflexively to fire-authorised activities.

Monthly reporting timelines and business cycles. Sawmill managers must provide receival records within the first three working days of each month for the previous month's timber (reg 28). This requires monthly reconciliation processes and systems to export and submit records on time. Seasonal or episodic harvest peaks may strain monthly reporting capabilities and require resourcing.

Complying with the Forest Products Regulations 2020 requires operational systems, documented procedures, and clear allocation of responsibilities between producers, drivers, sawmill managers and the Commission. Below is a concrete, section‑linked compliance checklist and recommended operational controls for regulated entities.

1. Adopt the General Manager’s approved forms and procedures. Ensure the Commission’s current delivery note template, approved electronic procedures and any writing setting out manner of production are obtained and embedded in operations (reg 5(2); reg 9(1)-(2)).

2. Train staff on mandatory delivery note fields and signatures. Ensure drivers sign the delivery note prior to or at loading as required, and that sawmill employees immediately sign the note on receipt of log timber felled on Commission land (reg 6(1)(h); reg 20). Maintain checklists for signatures at loading, during transport and on receipt.

3. Implement electronic note systems to meet non‑alteration and accessibility rules. If using electronic delivery notes, configure systems to prevent alteration by the creator and to produce auditable logs; ensure drivers can access delivery notes electronically while in the vehicle (reg 13(2); reg 14(1)(b)). Include processes for notification to the General Manager when corrections are required, given the General Manager may direct replacement notes (reg 13(3)).

4. Manage hard copy books if issued. If the General Manager issues hard copy note books, implement chain-of-custody controls for issuance, returns and unused notes, including documented receipts on issuance and procedures for prompt return upon completion or on request (regs 9(2), 10, 12). Keep copies of all hard copy notes (reg 8) and do not destroy notes unless authorised in writing (reg 11).

5. Record quantities immediately and attach tickets. When quantities are determined, record them on the delivery note immediately and attach any weighbridge tickets or printed determinations to the delivery note (reg 22(1)-(2)). Ensure weighbridge systems can print ticket numbers that can be attached to delivery notes electronically or physically.

6. Prevent storage or processing of unquantified Commission produce. Do not allow Commission produce to be stored or processed at sawmills unless quantity has been determined, or obtain written authorisation from the General Manager (reg 24). Introduce pre-acceptance checks at gate and yard to confirm quantity determination and delivery note completeness.

7. Maintain daily receival records and two-year retention. Create receival records on the day timber is received, including date, species and grading from the delivery note, quantity and delivery reference number for electronic notes (reg 25(4)). Store receival records securely for two years at the sawmill or an approved location (reg 26).

8. Monthly submission process. Establish a monthly scheduling process to submit receival records to the General Manager within the first three working days of each month for the previous month (reg 28). Automate exports where possible to ensure timeliness.

9. Prepare for inspections. Keep delivery notes and receival records accessible for inspection by nominated officers and conservation and land management officers, and ensure drivers are instructed to produce notes on request (reg 15(2)-(3)). When inspection occurs, ensure staff understand the need for the inspecting officer to sign and endorse the note (reg 15(4)).

10. Implement contractual information responsiveness. Maintain a central repository of production contracts, road contracts, and related information to allow compliance with written notices from the General Manager requesting contractual information within 14 days and in the form directed (reg 30(2)-(3)).

11. Marking and physical identification controls. Do not mark trees or attach ribbons, tape, brands or paint on sharefarmed land or Commission-interest land unless you are a nominated officer or a forest officer (reg 32). Ensure contractors and field staff are briefed on this limit and that marking is controlled centrally.

12. Internal audit and non‑conformity management. Implement periodic internal audits to ensure compliance with the 5 per cent spot‑check likelihood (reg 18) and to prepare records that would be examined in those checks. Create corrective action procedures for when errors are found, including immediate notification to the General Manager if electronic notes require replacement or correction (reg 13(3), reg 27(3)).

13. Document destruction policy consistent with prohibition. Prohibit destruction of delivery notes or unused hard copy notes without written authorisation from the General Manager and keep a log of any authorisations obtained (reg 11(2)).

14. Contract-level alignment. Align contractual terms with regulatory duties to ensure that contractual arrangements allow for delivery notes to be created and attached, for timely remittance of delivery notes and for provision of contractual information to the Commission on request (regs 6, 17, 30).

15. Risk and penalty monitoring. Develop an internal register of contraventions, and maintain records of any penalties issued and steps taken to remedy systemic causes of non‑compliance. Because many contraventions carry $2,000 penalties, recordkeeping and prompt correction reduce recurrence and cumulative cost.

16. Seek written exemptions where appropriate. If a business model requires deviation from specified fields or methods, apply in writing to the General Manager for exemptions for persons or classes as permitted by regulation 6(2) and other exemption powers. Do not rely on informal waivers.

17. Liaise with the Commission for forms and approved manners. Regularly check with the Commission for updated approved forms, electronic protocols and any published approvals of classes or procedural notices. Because many operational details depend on the General Manager’s approvals and directions (reg 5(2), reg 9(2), reg 21, reg 30), ensure ongoing compliance requires current Commission guidance.

18. Prepare electronic audit trails for corrections. Design electronic systems so corrections to data are recorded as distinct entries with time stamps and identification of the person effecting correction, and ensure the General Manager is able to direct and document replacement records as required by regs 13(3), 27(3).

By implementing these steps, regulated persons will align business practices with the documentary, timing, signature and retention requirements in the regulations. The combination of administrative controls, employee training, electronic system design and proactive liaison with the General Manager is central to managing inspection exposure and avoiding monetary penalties.
