sec.124 Authorised officer may visit forensic disability service

An authorised officer may, for the proper and efficient administration of this Act, visit the forensic disability service (whether with or without notice) between the hours of 8a.m. and 6p.m. On the visit, the officer may exercise the following powers— inspect any part of the service; confer alone with a forensic disability client detained in the service; make inquiries about the admission, assessment, detention or care and support of a forensic disability client in the service; inspect any document, including a medical record, about a forensic disability client who— has been, or is being, assessed in the service; or has received, or is receiving, care and support in the service; inspect any record or register required to be kept under this Act; require the administrator, or another person employed or engaged in the service, to give to the officer reasonable help for the exercise of any of the powers mentioned in paragraphs (a) to (e) . When making a requirement under subsection (2) (f) , the officer must warn the administrator or the other person that it is an offence not to comply with the requirement, unless the person has a reasonable excuse. A person required to give reasonable help under subsection (2) (f) must comply with the requirement, unless the person has a reasonable excuse. Maximum penalty—40 penalty units. If a person is required under subsection (2) (f) to give reasonable help by giving information or producing a document, it is a reasonable excuse if complying with the requirement might tend to incriminate the person.
