Foreign Fishing Licences Levy Act 1991

The Act rests on a small set of statutory concepts and delegations. Those concepts determine who decides and how the levy is linked to licensing and to agreements.

Definitions and imported terms: section 3 imports AFMA, AFZ and fish from the Fisheries Management Act 1991, and defines licence to mean a foreign fishing licence granted under Part 3 of that Act. The Act therefore operates in relation to licensing that is governed by the Fisheries Management Act 1991, and depends on that Act to identify what an AFMA licence is, what waters and boats are covered by the AFZ, and what is or is not fish.

Imposition of the levy: section 4(1) imposes a levy on the grant of a licence. The levy is a statutory charge triggered by the act of grant. Section 4(2) sets an exception: if there is in force a Commonwealth agreement with the government of another country that contains a provision under which licences are agreed to be granted, then a levy is not imposed on the grants covered by that provision. The exception explicitly contemplates bilateral or multilateral government‑level arrangements that subsume licence allocation.

Determination of amount: section 5 establishes two mechanisms for fixing the levy. The primary mechanism is by regulation, with the regulations either prescribing a specific amount or providing a calculation method (s 5(1)). The secondary, contractually derived mechanism applies when AFMA has concluded an agreement with a non‑government person or persons that contains a provision specifying an amount to be paid to the Commonwealth in order to be granted licences; in that case the amount specified in the agreement becomes the levy for all licences the agreement covers (s 5(2)).

Liability for payment: section 6 assigns liability to the person to whom the licence is granted (s 6(1)). Where the AFMA agreement referred to in s 5(2) applies, liability is borne by the person or by the persons with whom AFMA entered into the agreement, and, if there are multiple such persons, their liability may be joint and several (s 6(2)). The Act therefore contemplates both individual licencee liability and collective contractual liability.

Regulatory scope: section 7 grants the Governor‑General power to make regulations necessary or convenient to carry out the Act (s 7(1)). Subsection 7(2) contains a non-exhaustive list of matters that regulations made under s 5(1) may link the levy to; these are operational variables connected to the physical boat, its equipment, authorised catch quantities and species, licence conditions, method of fishing and the degree of Australian resident control over operations. These items signal how a charging schedule might be differentiated across vessels or operations.

Commencement mechanics: section 2 stages the Act’s commencement. Sections 1 and 2 commence on assent; the remainder is to commence on proclamation, but will commence automatically six months after assent if not proclaimed earlier (s 2(1)-(3)).

In short, the Act’s core concepts are: a levy linked to the granting of foreign fishing licences, a regulatory mechanism to fix or prescribe the levy, a contractual override where AFMA specifies a charge in a private agreement, an exemption where a government‑to‑government agreement provides for licences, and liability rules that place payment obligations on licencees or on parties to AFMA contracts.

The Act affects a compact but diverse set of actors. The parties directly named or implicated in the text are AFMA (by import), licence applicants and holders, persons entering into agreements with AFMA, the government of another country where bilateral agreements exist, and the Governor‑General (via regulation-making power). There are also indirect effects on boats, operators, and any Australian residents with control over operations, because regulations may reference those matters when fixing the levy.

Licence applicants and holders: section 4(1) and section 6(1) make clear that the person to whom a foreign fishing licence is granted is the primary payer of the levy. Therefore every prospective licencee who is granted a licence under Part 3 of the Fisheries Management Act 1991 is directly affected, because a financial obligation attaches to the grant unless an exception applies.

Parties to AFMA agreements: where AFMA has negotiated an agreement with a person or persons (not a foreign government) that specifies a payment amount for licences, section 5(2) makes that specified amount the levy; section 6(2) makes the parties to that AFMA agreement responsible for payment, jointly and severally where there are multiple parties. This creates direct financial exposure for private contracting parties who enter into AFMA agreements that cover licensing.

Foreign governments and their nationals: section 4(2) exempts licences that are the subject of agreements between the Commonwealth and another national government containing provisions under which licences are agreed to be granted. In practice, this affects the nationals or vessels operating under such government‑level arrangements by removing the statutory levy; the Act thus distinguishes between licences granted under bilateral government arrangements and those issued otherwise.

AFMA and the Commonwealth: AFMA is central to the operation of the Act. The definition of licence is a foreign fishing licence granted under Part 3 of the Fisheries Management Act 1991; AFMA is the agency that negotiates and administers many fisheries arrangements. The Act also allows AFMA to enter into agreements with private parties that can determine levy quantum for licences covered by those agreements (s 5(2)), exposing AFMA negotiating outcomes to financial consequences for private parties.

Boat owners, operators and Australian resident controllers: although not named as payers in the general rule, these actors are affected because regulations may determine levy amounts by reference to boat class, tonnage, engine power, equipment, authorised catch quantities, species, licence conditions, method of fishing and the degree of control that Australian residents have over operations (s 7(2)). That means the operational characteristics of a vessel and who controls it can influence levy exposure, and therefore behaviour and contracting choices.

The Governor‑General and regulators: the Governor‑General, by regulation‑making instrument, sets the amount or method of calculating the levy (ss 5(1), 7(1)), so executive actors decide the detailed charging rules. The Act therefore assigns substantive rule-making and rate-setting power outside the primary statute.

Those who do not acquire licences under Part 3 of the Fisheries Management Act are not brought within the Act by its text. The Act’s scope is defined by the imported definition of licence and by its reference to agreements between the Commonwealth and foreign governments or between AFMA and other persons.

Duties

• Payment duty on licencees: Section 4(1) establishes that a levy is imposed on the grant of a licence. Section 6(1) then specifies that, subject to s 6(2), the levy is payable by the person to whom the licence is granted. The legal duty to pay therefore arises at the grant and is owed by the licence holder. The statute does not set timing or instalment rules; those operational matters are left to regulations that may be made under s 7.

• Payment duty on AFMA contracting parties: Where AFMA has entered into the type of agreement contemplated by s 5(2), the amount specified in the agreement is the levy; s 6(2) makes that levy payable by the person, or jointly and severally by the persons, with whom AFMA entered into the agreement. This is an express contractual allocation of levy liability to the AFMA contracting parties, and alters the ordinary rule under s 6(1).

• Compliance with conditions linked to levies via regulations: Section 7(2) lists matters that regulations may use to calculate levy amounts. Though the Act does not itself impose operational reporting or record-keeping duties, the regulatory design allows charges to be keyed to vessel characteristics, equipment, quantities of authorised take, species, licence conditions, method of taking, and degree of Australian resident control. In practice, that permits regulations to impose duties on licencees to provide or maintain information about these items for the purposes of calculating and administering the levy.

Rights and exemptions

• Exemption under intergovernmental agreements: Section 4(2) creates a statutory right not to pay the levy where there exists in force an agreement between the Commonwealth and another government that contains a provision under which licences are agreed to be granted. The right is contingent, it applies only to those licences to which the intergovernmental provision relates, and it operates as an exclusion from the levy’s operation.

• Certainty from AFMA‑specified amounts: Section 5(2) confers a right of certainty on parties to qualifying AFMA agreements: where the agreement specifies an amount payable to the Commonwealth in relation to licences, that amount is the levy for those licences. This removes regulatory discretion for those licences and gives contractual parties the benefit of a fixed quantum.

• Regulatory rule‑making and administrative discretion: The Act vests regulatory power in the Governor‑General to prescribe amounts or calculation methods (s 5(1), s 7(1)). Affected persons therefore have a right to expect that the detailed levy mechanics and possibly rates will be specified in regulations. The Act does not, however, create procedural rights such as consultation or appeal in relation to those regulations; such rights would need to be found in the regulations themselves or in broader administrative law.

Operational implications

• The duty to pay is triggered by licence grant, so licence applicants must anticipate potential levy exposure at the point of grant unless an exemption applies (ss 4-6). Because the Act leaves the amount and calculation to regulations, the precise monetary obligation may be uncertain until regulations are made and published (s 5(1), s 7). Where AFMA enters into private agreements specifying amounts, the duty is dis-applied in favour of the contractually specified charge and the contracting parties become liable under s 6(2).

• The Act does not set payment procedures, timeframes, enforcement mechanisms or penalties; absent regulations specifying those matters, the statutory duty exists without built‑in penalty or collection process in the text of the Act. That places importance on subordinate instruments for operational detail.

The Foreign Fishing Licences Levy Act 1991 contains no express provisions establishing penalties, enforcement powers, recovery mechanisms or interest on unpaid levies. The statutory text provided does the following.

Silence on penalties and enforcement: There is no section in the Act that prescribes criminal penalties, civil fines, debt recovery procedures, liens, withholding powers, licence suspensions, infringement notices, or administrative enforcement mechanisms related to the levy. The operative provisions impose the levy (s 4), set its amount by regulation or by AFMA agreements (s 5), and allocate payment liability (s 6). The Act does not set out how the levy is to be collected, enforced, or what consequences follow non-payment.

Delegated regulation-making: Section 7(1) empowers the Governor‑General to make regulations necessary or convenient to carry out or give effect to the Act, and subsection 7(2) specifies permissible bases for calculation of the levy. That regulation-making power is the statutory channel through which collection and enforcement mechanisms would normally be established, because the primary Act does not itself provide them. Any statutory penalties, collection procedures, timeframes for payment or processes for dispute resolution would therefore need to be contained in regulations made under the Act, or by reference to other statutory instruments, because they are not in the Act itself.

Contractual enforcement through AFMA agreements: Section 5(2) and section 6(2) make the amount specified in qualifying AFMA agreements the levy and make the contracting parties liable for payment. Enforcement against those parties could proceed by contractual remedies as well as by any statutory collection mechanisms; but again, the Act does not specify enforcement routes, so the available remedies will depend on the content of the agreement and on any regulations or other legal instruments that provide for enforcement.

Practical consequence for compliance risk: Because the Act is silent on enforcement, compliance risk depends heavily on the content and timing of subsequent regulations and on the terms of AFMA agreements. A person who assumes enforcement or penalty regimes from other contexts would need to verify those regimes against the actual regulations or contractual provisions. The absence of statutory penalties in the Act may delay or compress the channels by which non-payment is addressed, depending on regulatory action.

In short, the Act imposes the levy and allocates liability, but leaves the mechanisms for collection, enforcement and penalty to subordinate instruments or contracts. For anyone assessing compliance risk, the availability and content of regulations and any contractual provisions with AFMA are decisive.

The Act explicitly imports and defers to other legal instruments for key definitions and for detailed implementation. It also creates exceptions and contractual interactions that alter the effect of other instruments, and vests substantive regulatory power in the executive.

Dependence on the Fisheries Management Act 1991: Section 3 provides that AFMA, AFZ and fish have the same meanings as in the Fisheries Management Act 1991, and that licence means a foreign fishing licence granted under Part 3 of that Act. The levy’s scope is therefore coextensive with the definition of a foreign fishing licence in the Fisheries Management Act 1991. Determining which activities, vessels, waters or persons fall within the levy’s reach requires reference to that Act and to Part 3 in particular.

Interaction with bilateral or intergovernmental agreements: Section 4(2) exempts from the levy any licences that are covered by a Commonwealth agreement with the government of another country that contains a provision under which licences are agreed to be granted. That clause creates a statutory carve-out for licences allocated via intergovernmental instruments. The Act therefore operates alongside treaty or agreement-making practice, recognising and deferring to government‑level arrangements as limiting the levy’s territorial/commercial reach.

Interaction with AFMA agreements: Sections 5(2) and 6(2) give contractual force to AFMA’s agreements with non-government persons. If AFMA has entered an agreement with a person or persons (other than a foreign government) containing a provision under which licences are agreed to be granted if an amount is paid to the Commonwealth, that amount is the levy for those licences (s 5(2)), and the persons party to the agreement are liable for the levy (s 6(2)). This creates a cross‑link between contract law and the statutory charging regime; contractual arrangements with AFMA can displace the operation of any future regulations by fixing the levy for those licences.

Delegated legislation and executive power: Section 7 empowers the Governor‑General to make regulations necessary or convenient to carry out the Act, including prescribing the amount or method of calculating the levy (s 7(1)). Subsection 7(2) lists matters by reference to which regulations may calculate the levy, including vessel characteristics, equipment, authorised catch quantities and the degree of Australian resident control. That means the Act’s detailed operation is effected by regulation, and regulatory instruments will interact with administrative law and any existing statutory instruments governing fisheries management and licensing.

Absence of enforcement provisions: The Act does not provide internal enforcement or penalty provisions. Enforcement, penalty and recovery mechanisms will therefore depend on the content of regulations under s 7 and on any related statutory schemes. This means that the levy’s legal effect in practice is contingent on how other instruments and administrative arrangements are used to operationalise collection and compliance.

Administrative and contractual overlap: The Act creates scenarios in which multiple instruments must be read together: the Fisheries Management Act 1991 to identify licences; AFMA agreements to fix levy amounts and liability in specified cases; intergovernmental agreements to create exemptions under s 4(2); and regulations made under this Act to set amounts, define calculation methods, and potentially establish collection and enforcement processes. Practitioners will therefore need to trace the statutory-contractual-regulatory chain in each licensing context to determine obligations.

In sum, the Act is not a stand-alone charging statute; it is designed to operate in tandem with the Fisheries Management Act 1991, AFMA’s contractual practice, intergovernmental instruments and the regulations the Governor‑General is empowered to make. Determining the legal effect in any real-world case requires consulting those other instruments.

The source text contains the original enactment text with the assent date stated as 21 October 1991. It sets out commencement mechanics in section 2, specifying that ss 1-2 commence on the day of Royal Assent and that the remaining provisions commence on proclamation or, in default, automatically six months after assent (s 2(1)-(3)). The printed Act as provided does not include later amendment provisions, schedules of amendments, or marginal notes indicating repeal or substitution of sections.

Accordingly, the document supplied records the Act’s original structure at the time of assent. It does not record any subsequent statutory amendments, insertions, repeals or re-enactments. The text therefore must be read as the primary source for the original 1991 statute; for any later changes to substantive provisions, definitions or regulatory powers, one must consult subsequent legislative instruments or consolidated versions which are not contained in this source.

Two procedural points within the Act are relevant to amendment and timing.

• The Act leaves substantial detail to regulations (s 7). Because the levy amount and many operational features are to be provided by subordinate legislation, the Act anticipates that later instruments will fill out the statute’s practical content. Consequently, absence of amendment in the primary Act does not mean there are no effective operational changes; regulatory amendments could modify quantum, calculation methods or administrative procedures.

• Section 5(2) enshrines that where AFMA enters certain agreements specifying an amount, that amount is the levy for licences covered by the agreement. That mechanism embeds private contract outcomes into the statutory levy scheme; changes to AFMA’s contracting practice or to the terms it negotiates with private parties can therefore have effects comparable to statutory amendment with respect to particular licences, even though they are not formal amendments to the Act.

Given this source-only constraint, the Act as printed shows no recorded amendment history beyond its establishment in 1991. Practitioners requiring up-to-date law should verify the current version in official consolidated legislation repositories and check for regulations made under s 7 and for AFMA agreements in force, since those instruments materially determine how the Act operates in practice.

The Act as provided in the source contains no recorded cases, appeals, or judicial interpretations. There are no judicial decisions cited in the text, no annotated case notes, and no footnotes to litigation.

Because the Act is short and delegates substantive detail to regulations and to contractual practice (AFMA agreements), litigation that might arise concerning the statute would most likely focus on issues such as:

• whether a particular instrument qualifies as an agreement “between the Commonwealth and the government of another country” for the purpose of s 4(2);

• interpretation of whether an AFMA agreement qualifies under s 5(2), and whether the amount specified in such an agreement operates as the levy;

• the legal effect of joint and several liability under s 6(2) where AFMA contracts with multiple parties;

• the interface between regulatory prescriptions and the Act in determining levy amounts; and

• challenges to regulations made under s 7 for want of power or for inconsistency with the Act.

None of these potential litigation pathways are reflected in this source. The absence of litigation history in the printed text does not mean no litigation has occurred; it means that within the supplied text there are no recorded cases. Users needing to assess legal precedent or judicial construction should search external case law databases and official legislative consolidation records to determine whether courts have construed the Act or its delegated instruments.

The Act’s compact form and delegation to regulation and to AFMA agreements create several practical pitfalls and uncertainty points that practitioners should note. These follow directly from the text.

Regulatory uncertainty on levy quantum and collection: Section 5(1) makes the levy amount subject to regulations, and section 7 grants broad regulation-making power. Until regulations are made and published, a prospective licencee cannot know the levy quantum or the calculation method. The Act therefore exposes licence applicants to regulatory uncertainty, because the primary statute imposes the liability but defers the crucial monetary detail.

Commencement timing and operational readiness: Section 2(2) provides that the remaining provisions commence on proclamation, with a default automatic commencement six months after assent if no proclamation is made. This creates a window in which the Act may be law but its operation depends on proclamation and regulations; licence applicants, AFMA and contracting parties must monitor commencement instruments so they know when obligations will crystallise.

Exemption for intergovernmental agreements: Section 4(2) creates a categorical exemption for licences covered by agreements between the Commonwealth and another national government that contain a provision under which licences are agreed to be granted. A licence that would otherwise attract a levy may therefore be exempt by dint of a separate government-level instrument. Practically, that can generate heterogeneity in treatment across licence classes and may create strong incentives for private actors or foreign governments to structure licence allocation via government-to-government arrangements.

Contractual displacement of regulatory setting: Section 5(2) allows an AFMA agreement to specify an amount payable to the Commonwealth that becomes the statutory levy for licences covered by that agreement. That means a bilateral private contract can effectively set the levy for those licences, displacing the regulatory mechanism. Parties entering into AFMA agreements should watch the precise wording of payment provisions and the scope of licences covered, since those contractual terms become determinative under the Act.

Joint and several liability risks: Section 6(2) makes parties to qualifying AFMA agreements liable jointly and severally for the levy. Where multiple private parties negotiate with AFMA, each may therefore bear full legal responsibility for the levy payable, exposing each to the risk that co‑parties may default or become insolvent. Practitioners should consider indemnities, securities, and contract drafting to allocate that risk between parties.

Dependence on the Fisheries Management Act for core definitions: Section 3 imports definitions from the Fisheries Management Act 1991. Without consulting that Act, readers cannot determine what “licence” precisely covers, or what AFMA and AFZ mean. This dependency can be a trap for practitioners who read the levy Act in isolation.

No enforcement or penalty detail in the Act: The Act is silent on how unpaid levies are to be enforced, what penalties apply, or what collection and recovery processes exist. Unless regulations or AFMA contracts specify enforcement routes, there may be limited statutory clarity on remedies for non-payment; parties should not assume default enforcement models.

Regulation may use operational variables: Section 7(2) allows calculation of the levy by reference to a wide range of vessel and operational variables, including the degree of control that Australian residents have over operations. That creates compliance complexity: licence applicants should expect that the levy may be sensitive to vessel specifications, equipment carried, authorised catch quantities and species, licence conditions, and control structures. Record-keeping and reporting obligations may be necessary to support any calculation by reference to these variables once regulations are in force.

No procedural rights in the Act: The Act does not specify consultative procedures for regulation‑making nor does it provide appeal or review rights against levy assessments. Any procedural protections must be sought in regulations or by other legal routes.

In short, the key “gotchas” are: reliance on regulations for central details and on AFMA agreements for exceptions; potential for contractually imposed joint and several liability; exemption of government-level arrangements; definitional dependence on another Act; and statutory silence on enforcement and procedural protections. Each of those matters is a direct implication of the cited sections (ss 2-7).

To ensure compliance with the obligations the Act establishes, a sequence of pragmatic steps is required. Because the Act delegates amounts and operational detail to regulations and to AFMA agreements, compliance work must combine statutory review, regulatory monitoring, contractual diligence and operational record-keeping.

1. Confirm licence status under the Fisheries Management Act 1991 (s 3)

   • Before assuming any levy exposure, identify whether the instrument to be obtained is a “foreign fishing licence” within the meaning of Part 3 of the Fisheries Management Act 1991, because the levy attaches only to licences so defined (s 3). Consult that Act to determine the licence description, geographic scope (AFZ) and AFMA roles, since the levy Act imports those definitions.

2. Check for intergovernmental exemptions (s 4(2))

   • Determine if the relevant licence is granted pursuant to an agreement between the Commonwealth and the government of another country that contains a provision under which licences are agreed to be granted. If so, the grant is exempt from the levy under s 4(2). Obtain and review any applicable government‑to‑government agreements or exchange of notes to establish the statutory exemption.

3. Review AFMA agreements for specified levy amounts (ss 5(2), 6(2))

   • Ascertain whether AFMA has entered into an agreement with the applicant or other persons that contains a provision specifying an amount payable to the Commonwealth in order for licences to be granted. If such an agreement exists, the amount specified becomes the levy for those licences (s 5(2)), and the parties to the AFMA agreement are liable, jointly and severally, under s 6(2). When negotiating or entering AFMA agreements, clearly document the payment terms and understand that those terms operate as the statutory levy.

4. Monitor and obtain the regulations (ss 5(1), 7)

   • The amount of the levy in ordinary cases will be prescribed by regulation or calculated in accordance with a regulatory method (s 5(1)). Obtain and review the regulations made under s 7 as soon as they are published. Regulations may prescribe fixed amounts or formulae linked to vessel characteristics, equipment, allowed catch, species, licence conditions, method of fishing, and the degree of Australian resident control (s 7(2)). Ensure accounting systems can apply the prescribed method.

5. Prepare records and evidence aligned with regulatory variables (s 7(2))

   • Given the list of matters that regulations may use to calculate the levy, maintain contemporaneous and verifiable records regarding: boat class and measurements (tonnage, engine power), equipment permitted under the licence, authorised quantities and kinds of fish, licence conditions and methods of fishing, and details of ownership and operational control, including any Australian resident control. These records will be necessary if the levy is calculated by reference to those items.

6. Address joint and several liability in contracts and securities (s 6(2))

   • Where parties enter AFMA agreements that may give rise to joint and several liability, negotiate contractual indemnities, guarantees, securities or other risk-mitigation provisions to allocate payment risk among parties. Consider escrow arrangements or advance payments if the contractually specified levy is material.

7. Build regulatory compliance and payment processes

   • Implement internal processes for: determining whether the levy applies to a proposed licence, computing the levy using the regulation or contractual figure, collecting funds from the person liable, and making any statutory or contractually required payment to the Commonwealth or to the account specified. Because the Act does not prescribe times for payment or enforcement, the regulations or AFMA agreement may set deadlines; integrate those timelines into systems.

8. Seek clarity on enforcement and dispute resolution

   • Because the Act is silent on enforcement mechanisms, consult the regulations and any AFMA agreements to identify remedies available to the Commonwealth for non-payment, and dispute resolution or review processes for contested levy assessments. If regulations do not provide clarity, consider contractual dispute resolution clauses and seek advice on administrative law remedies.

9. Watch commencement instruments and regulatory amendments (s 2)

   • Track proclamations under section 2 and the publication of regulations under section 7. The Act may commence by proclamation or automatically after six months; any delay matters for timing of levy liability. After commencement, monitor for regulatory amendments that could alter the levy amount, calculation basis, or administrative procedures.

10. Legal and tax advice

• Obtain legal advice on the interaction between the levy and other statutory obligations, and on the importation of the Fisheries Management Act definitions. Obtain tax and accounting advice to ensure the levy is treated consistently in financial statements and that any tax consequences of payments or reimbursements are managed.

By following these steps , identifying licence status, checking for intergovernmental exemptions, examining AFMA agreements, obtaining and implementing applicable regulations, maintaining operational records, managing contractual risk, and monitoring commencement , businesses and advisers can position themselves to calculate and pay any levy required under the Act, and to manage exposure where AFMA agreements or government-to-government arrangements alter liability. All of these compliance actions flow from the statutory text: ss 2-7 set the operational contours and identify the points at which regulation or contract determines detail.
