Food Standards (Proposal P1044 – Plain English Allergen Labelling) Variation

This instrument centres on three main interlocking concepts: required name, mandatory declaration, and summary statement styling and placement. Each is defined or specified in the Code amendments and creates both semantic and presentational obligations.

Required name

• The Variation introduces required name as a defined concept for the purposes of Division 3 of Standard 1.2.3 (see 1.1.2,2(3) insertion and 1.2.3,1A). The required name is the specific word or words that must be used when declaring that a listed food or derivative is present. Section 1.2.3,5 links the required name to the table in Schedule 9, so the required name depends on whether the declaration is inside a statement of ingredients (use Column 3) or in other circumstances (use Column 4).

Mandatory declaration

• Division 3 (new) at 1.2.3,4 makes clear that if a food listed in Column 1 of Schedule 9,3 or a derivative of such a food is present in a food for sale in one of the listed manners (ingredient, additive, processing aid), a declaration that the food is present is required (1.2.3,4(1)-(5)).
• The Division distinguishes exceptions: the rule does not apply if the food appears in Column 2 exemptions in Schedule 9 (1.2.3,4(3)-(4)).
• The Division also creates special handling for processing aids; where a declaration arises from paragraph 1.2.1,8(1)(d) or subparagraph 1.2.4,5(6)(b)(i), the statement of ingredients must list the required name and must add the words processing aid alongside the required name if the item is a processing aid or a component of a processing aid (1.2.3,6(2)(a)(ii)). A summary statement is required where this paragraph applies (1.2.3,6(2)(b)).

Summary statement and presentation rules

• The summary statement must commence with the single word Contains followed by the required names only, and no other words (1.2.3,7(3)). It must be in the same field of view as the statement of ingredients, directly next to it, but distinctly separated from it (1.2.3,7(4)). This produces a precise spatial relationship requirement that affects label layout and packaging design.
• Typographic rules require bold font for required names in the statement of ingredients that contrast with other non-required-name text, and a size of type not less than the other non-required-name text (1.2.3,7(1)). The summary statement must be printed in the same typeface and size of type as any required name in the statement of ingredients and must also be in bold (1.2.3,7(5)).
• Required names in the statement of ingredients must be listed separately for each ingredient containing the relevant food and must be listed separately from, but next to, the ingredient name unless the required name is identical to or contained in the ingredient name (1.2.3,7(2)).

Schedule 9 table mechanics

• Schedule 9, section S9,3 provides a four-column table linking listed foods to exemptions and to the precise words to be used as required names in statements of ingredients (Column 3) and in other declarations (Column 4). The table includes specific entries and tailored exemptions, for example:
  • cereals containing gluten must be named by the cereal in Column 3 but in other declarations the required name is gluten (S9,3 Items 2 and 3).
  • wheat has specific exemptions for beer, spirits, certain processed glucose syrups (with processing and a gluten content not exceeding 20 mg/kg) and distilled alcohol (S9,3 Item 3 Column 2).
  • fish for the purposes of Schedule 9 excludes crustacea and molluscs and mollusc is defined as a marine mollusc (S9,3(2)(a)-(c)).

Complementary amendments

• The Variation amends Standard 1.2.4 to cross-reference Division 3 of Standard 1.2.3 (see [4.1] and subsequent Note) and amends Standard 2.9.5 to ensure food-for-special-medical-purposes labelling obligations capture the required advisory statements and declarations (see [5.1]-[5.3]). Schedule 10 conditions for the use of certain generic ingredient names are also modified, removing some specific obligations to declare particular species or specific cereal names and replacing them with different conditions for use (Schedule 10 amendments [7.2]-[7.6]).

Legal mechanics and commencement

• The Variation commences on the date of gazettal (clause 3). It provides a stated transition period of 36 months and a post-transition sale period of 24 months, with interim compliance options during those periods allowing products to be sold if they comply with either the pre-amendment Code or the amended Code (clause 4(2)-(4)). Clause 4(1) makes a narrow procedural carve-out by stating that Section 1.1.1,9 does not apply to these variations.

These concepts change both what must appear on labels and how it appears, replacing some prior specificity with the required-name mechanism and formatting requirements intended to standardise presentation across labelling contexts.

The Variation allocates obligations and influences behaviour across the food labelling and supply chain. Primary actors affected are food businesses that formulate, package, import, distribute or sell food for sale in Australia and New Zealand and that use listed foods or derivatives. Secondary but materially affected actors include packaging designers and printers, ingredient suppliers and certifiers, retailers, wholesalers and enforcement agencies. Specific groups and their relevant exposure under the text include:

• Food manufacturers and processors: Obliged to ensure that when a listed food (or a derivative) is present in a product in any of the enumerated ways (ingredient, ingredient of a compound ingredient, substance used as an additive or processing aid), the appropriate declaration and formatting is used (1.2.3,4(1), (5)). Processors who use processing aids must ensure their statements of ingredients either flag the processing aid with the required name plus the words processing aid, and in some cases produce a summary statement (1.2.3,6(2)(a)(ii)-(b)).

• Private label and contract packers: Must align label templates to the presentational rules: the statement of ingredients must have required names in bold and no smaller type than the other non-required-name text; the summary “Contains” statement must be adjacent to the statement of ingredients and in the same typeface and size as required names (1.2.3,7(1), (3)-(5)).

• Importers: Must ensure imported packaged foods comply with the amended Code at or after the transition periods; during the 36 month transition and 24 month post-transition sale period imported product may be sold if it complies with either regime (clause 4(2)-(4)). Importers also bear the burden of documentation where exemptions (Column 2) or processing exceptions (e.g. glucose syrup with ≤20 mg/kg gluten) are asserted (S9,3 Item 3 Column 2).

• Ingredient suppliers and commodity exporters: May need to provide specification documentation or certificates to downstream users who must decide required names and whether exemptions apply, particularly for items subject to conditional exemptions (S9,3 Item 3 Column 2 for wheat, Item 13 Column 2 for certain soybean derivatives).

• Retailers and food service: Packaged foods sold at retail must comply with the labelling layout and content obligations. Food service operations that create packaged foods for sale (including takeaway, ready-meals, and vending machine food) should review whether products present required names in the statement of ingredients or require a summary declaration (1.2.3,4, 1.2.3,7).

• Producers of food for special medical purposes and infant formula products: The Variation ties mandatory declarations into Standard 2.9.5 by replacing paragraph 2.9.5,9(1)(d) and renaming 2.9.5,10 to “Mandatory statements and declarations, food for special medical purposes” and cross-referencing declarations required by section 1.2.3,4 (see [5.1]-[5.3]). The Variation also provides that declarations for certain infant formula products must state the name listed in Schedule 9 Column 1 or any other commonly known name (1.2.3,4(4)-(5)).

• Packaging designers, printers and label suppliers: Must implement the typographic, size and field-of-view specifications. The definition of size of type in 1.2.3,1A describes the measurement to be used, which affects how designers measure and specify fonts on labels.

• Regulatory agencies and compliance officers: Must interpret the new Division 3 obligations, enforce presentation and content requirements and determine how exemptions apply. The Variation amends existing cross-references that enforcement officers must follow, and clause 4(1) alters the usual application of 1.1.1,9 to these variations (clause 4(1)).

• Consumers with allergies and medical professionals: While not the primary legal obligors, they are directly affected by the change in information availability and presentation. The Variation standardises a single-word summary format “Contains” and aims to make required allergen declarations more prominent by typographic and placement rules (1.2.3,7(3)-(5)).

Financially and operationally, most direct costs fall on labelling owners and supply chain participants who must redesign or reprint packaging, update product specifications and supplier documentation, and possibly alter formulations to avoid declarations or to benefit from exemptions. The Variation provides a 36 month transition period to moderate timing of those costs and a further 24 month sell-through allowance for pre-labelled stock (clause 4(4)(a)-(b)). Decision rights sit with proprietors of labelled products, their compliance teams and contracted suppliers; regulators determine compliance and may review documentation supporting exemptions. The Variation does not itself set monetary penalties; compliance enforcement will run via the Code and existing enforcement frameworks (the Variation is made under s 92 of the Food Standards Australia New Zealand Act 1991, preamble).

The Variation sets content, format and placement duties for labelling and clarifies who may rely on an exemption. It also creates rights to sell existing stock during transition periods. The principal duties and corresponding operational rights are as follows:

Duty to declare presence

• If a food listed in Column 1 of Schedule 9,3 or a derivative of that food is present in a food for sale in the ways listed at 1.2.3,4(5) (ingredient, ingredient of a compound ingredient, additive, processing aid or component), a declaration that the food is present is required (1.2.3,4(1), (5)). This is a substantive duty to disclose presence of listed allergenic foods and derivatives.

Right to rely on Column 2 exemptions

• Section 1.2.3,4(4) provides the Division does not apply when the listed food is present in manners or forms listed in Column 2 of Schedule 9,3. The Schedule sets out specific exemptions for particular items (for example, alcohol distilled from milk or whey for milk, soybean oil that has been degummed and processed for soybean) (S9,3 Column 2 entries). A business may therefore lawfully omit a declaration if the product squarely fits an exemption in Column 2.

Presentation duties in the statement of ingredients

• A required name in a statement of ingredients must be printed in bold and in a size of type not less than other non-required-name text in the same statement (1.2.3,7(1)(a)-(b)). Required names must be listed separately for each ingredient containing the food and be separately listed next to the ingredient that contains the food unless the required name is identical to or contained in the ingredient name (1.2.3,7(2)(a)-(c)). For processing aids, the statement of ingredients must include the words processing aid in conjunction with the required name where the food to be declared is a processing aid or a component thereof (1.2.3,6(2)(a)(ii)).

Summary statement duties

• Where a summary statement is required by 1.2.3,6(2)(b) or where a business elects to provide one for other declarations, the summary must commence with Contains followed by the required names only and contain no other words (1.2.3,7(3)). It must appear in the same field of view as, directly next to, and distinctly separated from, the statement of ingredients (1.2.3,7(4)). The summary must be printed in the same typeface and size of type as any required name in the statement of ingredients and be in a bold font that contrasts with other non-required-name text (1.2.3,7(5)).

Duties specific to some product classes

• The Division requires particular treatment for food for special medical purposes and certain infant formula products: declarations required by 1.2.3,4 must also be made on labels for food for special medical purposes under Standard 2.9.5 (see amendments at [5.1]-[5.3] and 1.2.3,4(4)-(5)). For infant formula products specifically formulated for premature infants or those with specified medical conditions, the name to be stated may be either the name in Column 1 of Schedule 9,3 or any commonly known name (1.2.3,4(5)).

Right to sell during transition and post-transition periods

• Clause 4(2) allows foods to be sold during the 36 month transition period if they comply with either the pre-amendment Code or the amended Code. Clause 4(3) permits products packaged and labelled before the end of the transition period to be sold during the 24 month post-transition period under either regime. In effect, businesses have a temporary right to sell existing stock without immediate re-labelling.

Duty to comply with related standards

• The Variation modifies cross-references and therefore businesses must ensure compliance across Standard 1.2.4 statement of ingredients provisions and Standard 2.9.5 for food for special medical purposes (see [4.1], [5.1]-[5.3]). Clause 4(1) also states that section 1.1.1,9 does not apply to these variations; businesses should therefore not rely on 1.1.1,9 where it would otherwise apply to standard variations.

Operational duties implied by the table in Schedule 9

• The S9,3 table not only lists required names but also provides specific exemptions and alternative required names depending on context (Column 3 vs Column 4). For example, cereals containing gluten require the cereal name in the statement of ingredients but require the use of the term gluten in other declarations (S9,3 Items 2-3). Wheat has detailed exceptions (S9,3 Item 3 Column 2). Where glucose syrups derived from wheat meet certain refining and gluten content thresholds, they may be excluded from declaration; this imports an evidentiary duty on the manufacturer to show refining and the gluten protein content not exceeding 20 mg/kg (S9,3 Item 3 Column 2(b)(i)-(ii)).

Formatting and measurement duties

• The instrument defines size of type as the measurement from the base to the top of a letter or numeral (1.2.3,1A). This creates an objective measurement standard that affects font selection and label proofs and imposes a duty on businesses to measure type size accordingly.

Procedural carve-out

• Clause 4(1) provides that section 1.1.1,9 does not apply to the variations. This is an explicit procedural adjustment; businesses should not assume that their usual entitlements or constraints under 1.1.1,9 apply to these variations.

The instrument does not itself provide sanction clauses or administrative penalty amounts. Those enforcement mechanisms are found in the broader regulatory frameworks that control compliance with the Food Standards Code. The Variation creates legal duties referenced above and rights to sell pre-existing stock during transition periods; the onus is on the label owner and persons responsible for sale to comply.

The Variation as provided does not itself introduce new penalty clauses or specify enforcement mechanisms and monetary sanctions. It is an amendment to the Australia New Zealand Food Standards Code, made under section 92 of the Food Standards Australia New Zealand Act 1991 (preamble), and enforcement of the Code and standards is generally achieved through the enforcement powers and penalties available under domestic state, territory and Commonwealth laws and administrative arrangements. The instrument therefore sets substantive obligations that will be enforced by the usual regulatory authorities that enforce the Food Standards Code, but the Variation text does not specify penalty amounts, infringement notices or enforcement regimes.

What the text does tell readers about enforcement context

• The Variation is a standard and forms part of the Australia New Zealand Food Standards Code (Schedule 9 Note 1 replacement at [6.2]). As a Code standard, compliance is required under the Food Standards Act framework rather than under a standalone criminal instrument in the Variation itself.
• Clause 4(1) removes the application of section 1.1.1,9 to these variations. This is an internal procedural direction; it may affect administrative processes or the application of particular provisions of Standard 1.1.1 but the Variation does not say how enforcement officers will exercise discretion or what compliance or penalty processes will be altered.

Practical enforcement considerations arising from the Variation’s content

• The Variation creates many technical, presentational and documentary requirements (for example, typographic measurements, the presence and form of summary statements, and the need to document specific exemptions such as refined glucose syrups with gluten protein content not exceeding 20 mg/kg in S9,3 Item 3 Column 2). Enforcement agencies will likely evaluate compliance by reference to the text of the Code as amended: whether required names are present and in the required font and location, and whether exemptions relied upon are supportable by supplier documentation or analytical testing. The Variation itself creates the objective standards that can be examined during inspections: presence of the word Contains followed by required names only (1.2.3,7(3)); the bolding and size rules (1.2.3,7(1), (5)); and adjacency and distinct separation from statement of ingredients (1.2.3,7(4)).

Evidence and documentation burden

• For companies relying on exemptions in Column 2 (for example, exemption of certain wheat-derived glucose syrups if refining removed gluten protein content to the lowest level reasonably achievable and gluten protein content does not exceed 20 mg/kg, S9,3 Item 3 Column 2(b)(i)-(ii)), regulatory inspectors will expect documentary or testing evidence. The Variation mandates the substantive condition, but the instrument does not itemise acceptable evidence formats. Businesses therefore have a practical obligation to maintain and produce supplier statements, process records, testing certificates or other evidence to support an exemption claim.

Transition and compliance scope

• The Variation’s transition clause 4 provides businesses with a defined period to transition. During the 36 month transition period and the 24 month post-transition sell-through period, enforcement officers will need to apply the rule in clause 4(2)-(3); a product that complies with either the pre-amendment Code or the amended Code is permitted to be sold in those periods. This eases immediate enforcement against non-compliant labelling for products that have not yet been relabelled.

No penalties specified in text

• Because the instrument does not itself contain penalty provisions, readers should consult the enforcement provisions of the Food Standards Australia New Zealand Act 1991 and relevant state and territory food laws for civil penalties, criminal offences, recall powers, and administrative enforcement mechanisms. The Variation creates duties that will be enforceable under those existing frameworks rather than creating new penal provisions within the Variation itself.

The Variation operates as an amendment to the Australia New Zealand Food Standards Code and therefore interacts with other provisions of the Code as well as with the broader statutory and regulatory frameworks that enforce and implement the Code. The instrument explicitly amends and cross-references several Standards and Schedules and removes the application of one procedural section to the variations. Key interactions and their legal mechanics are as follows.

Interaction with the Food Standards Code architecture

• Clause 2 states the Schedule varies Standards in the Australia New Zealand Food Standards Code. The Variation therefore modifies the Code’s internal normative structure; compliance will be judged against the Code as amended on and after the commencement date.

Effect on Standard 1.1.1 procedural provision

• Clause 4(1) explicitly provides that section 1.1.1,9 of Standard 1.1.1 does not apply to the variations made by this instrument. Readers must therefore not assume 1.1.1,9 applies to these amendments. The Variation makes a narrow procedural change that will affect interpretation or operation of the Code’s general standard-making or variation provisions as they relate to this instrument.

Cross-references to Standard 1.2.4 (statement of ingredients)

• Standard 1.2.4 is amended at [4.1] to insert a proviso that a statement of ingredients is subject to Division 3 of Standard 1.2.3. The Variation therefore integrates the new mandatory declarations regime with existing statement-of-ingredients requirements and obliges operators to reconcile their labeling with both sets of rules.

Interaction with Standard 2.9.5 (food for special medical purposes)

• The Variation alters Standard 2.9.5 by recasting paragraph 2.9.5,9(1)(d) and renaming section 2.9.5,10 as “Mandatory statements and declarations, food for special medical purposes” and by specifying that required advisory statements and declarations include those required by section 1.2.3,4 (see [5.1]-[5.3]). This explicitly brings the mandatory declarations regime into the food-for-special-medical-purposes labelling context, so manufacturers of those products must apply the new declaration and presentation rules.

Relationship with Schedule 9 and Schedule 10

• The Variation replaces the Schedule 9 heading and Note, inserts the new table S9,3 of Mandatory declarations and changes the language from “Mandatory advisory statements” to “Mandatory advisory statements and declarations” (see [6.1]-[6.4]). It also changes Schedule 10 conditions for the use of certain generic names and removes or replaces some specific requirements on declaring specific cereal names, nuts, fish species and starch conditions (Schedule 10 amendments [7.1]-[7.6]). Businesses must therefore coordinate use-of-name decisions across the Schedules and Standards.

Definition interactions and specific carve-outs

• The Variation inserts a definition of size of type into 1.2.3,1A. It also creates a tailored exception to the definition of fish for the purposes of Schedule 9: S9,3(2) states that the definition of fish in 1.1.2,3(2) does not apply for the purposes of the S9,3 table, and that fish excludes crustacea and molluscs, with mollusc defined as a marine mollusc. This is a targeted definitional interaction that changes how other parts of the Code are read for mandatory declaration purposes.

Exemptions that refer to other regulatory processes

• The table in S9,3 includes exemptions such as alcohol distilled from whey for milk and alcohol distilled from wheat for wheat (S9,3 Items 3 and 9). Those exemptions interact with regulations or standards that govern beverage production, distillation processes and labelling of alcoholic beverages. The Variation does not preclude other laws from imposing additional labelling duties on alcoholic beverage labelling; it simply provides these specific exemptions within Schedule 9.

Transitional operation vis-à-vis other laws

• Clause 4(2)-(3) provides that during the transition and post-transition sell-through periods, a food may be sold if it complies with either the pre-amendment Code or the amended Code. This dual-compliance route will affect how enforcement agencies apply other regulatory obligations that reference the Code. Businesses with products that fall under multiple regulatory frameworks may need to manage compliance with other laws (for example, state food safety laws) independently of the Code’s transition allowances.

Interaction with existing enforcement frameworks

• The Variation does not prescribe specific enforcement powers or penalties; enforcement will proceed under existing state, territory, and Commonwealth laws and administrative regimes that apply to the Food Standards Code. Inspectors and regulators will use the Code’s wording as amended to determine compliance. Clause 4(1) exclusion of 1.1.1,9 should be considered by enforcement agencies when applying any procedural rules that 1.1.1,9 would otherwise trigger.

In short, the Variation is not a standalone regulatory instrument; it is grafted into the Code. Effective compliance therefore requires businesses to reconcile the new Division 3 rules with statement of ingredients rules, provisions for special medical purpose foods, the Schedules, definitions, and the transitional carve-outs. The Variation also changes definitional relationships for the purposes of Schedule 9 and removes a procedural application of 1.1.1,9, which could affect how other Code provisions and variation procedures are read in enforcement contexts.

The Variation contains a sequence of specific amendments to Standards and Schedules within the Australia New Zealand Food Standards Code. Below is a section-by-section account of what the instrument changes, with the clauses and schedule references provided in the Variation.

Instrument formalities

• The instrument is titled Food Standards (Proposal P1044 - Plain English Allergen Labelling) Variation (clause 1).
• Clause 2 states the Schedule varies Standards in the Australia New Zealand Food Standards Code.
• Clause 3 sets commencement on the date of gazettal. The instrument records the making on 19 February 2021 and notes gazettal in the Commonwealth Gazette on 25 February 2021.

Transitional and procedural clauses

• Clause 4(1) excludes Section 1.1.1,9 of Standard 1.1.1 from applying to these variations.
• Clause 4(2)-(4) sets a 36 month transition period from the date of commencement and a 24 month post-transition sell-through period. During the transition a food product may be sold if it complies with either the pre-amendment Code or the amended Code (clause 4(2)). Packaged and labelled products packaged before the end of the transition may be sold during the post-transition period if they comply with either regime (clause 4(3)). The instrument defines transition period and post-transition period in clause 4(4)(a)-(b).

Standard 1.1.1

• Amendment [1] omits the words ‘Mandatory advisory statements’ from subsection 1.1.1,2(2) and substitutes ‘Mandatory advisory statements and declarations’.

Standard 1.1.2

• Amendment [2] inserts a definition for required name in subsection 1.1.2,2(3): “required name, of a particular food, means the name declared by section 1.2.3,5 as the required name for that food for the purposes of Division 3 of Standard 1.2.3.”

Standard 1.2.3

• Amendment [3.1] inserts Division headings, including Division 1 Preliminary and Division 3 Mandatory declarations after existing material.
• Amendment [3.2] omits section 1.2.3,1A and substitutes a new 1.2.3,1A Definitions, inserting the required name definition and a definition of size of type.
• Amendment [3.4] inserts a heading for Division 2 Mandatory statements and Division 3 Mandatory declarations.
• Amendment [3.5] replaces section 1.2.3,4 with a new 1.2.3,4 Mandatory declarations of certain foods, which:
  • Requires declarations where a listed food or derivative is present in specified ways (1.2.3,4(1), (5)).
  • Provides that declarations must comply with Division 3 (1.2.3,4(2)).
  • Applies section to foods listed in Column 1 of S9,3 or their derivatives, subject to Column 2 exemptions (1.2.3,4(3)-(4)).
• Inserts section 1.2.3,5 Food name required for a mandatory declaration linking required names to the table S9,3: required name is the corresponding name in Column 3 when listed in a statement of ingredients and the corresponding name(s) in Column 4 in all other cases.
• Inserts section 1.2.3,6 What a mandatory declaration must state, prescribing that most declarations must state the required name (1.2.3,6(1)) and that declarations required by paragraph 1.2.1,8(1)(d) or subparagraph 1.2.4,5(6)(b)(i) must list the required name(s) in the statement of ingredients and, where applicable, include processing aid wording; also that a summary statement on the label is required (1.2.3,6(2)(a)-(b)). Section 1.2.3,6(4) sets special rules for food for special medical purposes and certain infant formula products, while subsection (5) specifies how to choose the name in those cases.
• Inserts section 1.2.3,7 Form of a mandatory declaration, prescribing bolding, size, listing separately for each ingredient, format of the summary statement beginning with Contains and containing no other words, placement rules and typeface/size requirements for summary statements (1.2.3,7(1)-(6)).
• Inserts 1.2.3,8 Compliance with requirement for required name, permitting singular or plural form of a required name.

Standard 1.2.4

• Amendment [4.1] modifies section 1.2.4,4 to prefix “Subject to Division 3 of Standard 1.2.3” to the statement of ingredients duty.
• Amendment [4.2] adds a Note to point readers to Division 3 of Standard 1.2.3 for mandatory declarations.

Standard 2.9.5

• Amendment [5.1] replaces paragraph 2.9.5,9(1)(d) with a cross-reference to required advisory statements and declarations including those set out in section 2.9.5,10.
• Amendment [5.2] renames section 2.9.5,10 to “Mandatory statements and declarations, food for special medical purposes.”
• Amendment [5.3] replaces subsection 2.9.5,10(2) to identify that required advisory statements and declarations for food for special medical purposes include those required by items in the table to S9,2, by subsection 1.2.3,2(2), and by section 1.2.3,4.

Schedule 9

• Amendment [6.1] changes the Schedule heading to “Schedule 9 Mandatory advisory statements and declarations.”
• Amendment [6.2] replaces Note 1 in the Schedule to clarify that Standard 1.2.3 is about information requirements for warning statements, advisory statements and declarations and that the Schedule lists mandatory advisory statements and mandatory declarations for specific subsections.
• Amendment [6.3] replaces the phrase ‘Mandatory advisory statements’ with ‘Mandatory advisory statements and declarations’ in section S9,1.
• Amendment [6.4] inserts S9,3 Mandatory declarations, including:
  • A statement on the application of the table (S9,3(1)), and a note on definitions applicable to the table (S9,3(2)).
  • The substantive S9,3(3) table, which is the operative Mandatory declarations table setting out items 1 to 13 for sulphites, cereals with gluten, wheat, specified tree nuts, crustacea, egg, fish, lupin, milk, mollusc, peanut, sesame seed and soybean with corresponding Columns 2-4 entries and particular exemptions.

Schedule 10

• Amendment [7.1] omits section S10,1A.
• Amendment [7.2] omits a condition for cereals requiring specific cereal names where cereals are wheat, rye, barley, oats or spelt, replacing it with updates to the table conditions (S10,2).
• Amendment [7.3] replaces paragraph (a) of the condition for use for fats or oils so that the statement of ingredients must declare whether the source is animal or vegetable and, if a dairy product, the specific source of animal fats or oils (Schedule 10 change).
• Amendment [7.4] omits a condition requiring specific crustacea names and substitutes a statement that the definition of fish in subsection 1.1.2,3(2) does not apply for the purposes of this table.
• Amendment [7.5] omits the condition requiring the specific name of nuts to be declared.
• Amendment [7.6] replaces paragraphs (a) and (b) of the condition for starch to state the name starch may be used for any unmodified starch or starch modified by either physical means or enzymes.

These are the explicit textual amendments recorded in the Variation instrument. The instrument’s commencement clause and transition period provisions govern when these changes become operative. The Variation does not record prior amendment versions or a historical log beyond the immediate amendments it makes.

The Variation itself contains no litigation history. It is an instrument that amends Standards within the Australia New Zealand Food Standards Code; the Variation text does not reference any judicial decisions or administrative determinations. There are therefore no cases, challenges or judicial interpretations stated in the instrument.

Practically, the absence of litigation history in the Variation means businesses, regulators and courts have not yet had the Variation’s provisions litigated in a reported decision as part of the instrument’s own text. Any disputes about the Variation’s interpretation, enforcement, exemptions, typographic measurements, or placement requirements would need to be resolved under the usual administrative and judicial mechanisms available for disputes about compliance with the Food Standards Code, but the instrument does not record any such outcomes.

Users of this deep dive who require litigation precedents or judicial interpretation should be aware that this instrument does not include them and that they will need to search case law or administrative decisions external to this instrument for any adjudicated interpretations of these specific amendments. The Variation’s Note in Schedule 9 clarifies it is a Standard under the Food Standards Australia New Zealand Act 1991 and forms part of the Code (Schedule 9 Note replacement at [6.2]), but it does not document case law.

The Variation creates a number of technical traps and potentially ambiguous compliance questions that can affect legal and operational risk. The following items are concrete issues that businesses, compliance officers and suppliers should be alert to, each grounded in the instrument’s text.

“Contains” summary limitations

• The summary statement must contain only the word Contains followed by the required names and no other words (1.2.3,7(3)). Attempts to add clarifying phrases, translations, explanatory parentheses, or qualifiers in the summary statement will not comply with this requirement. Businesses that currently use broader summary phrasing (for example, “May contain” or “Allergen:”) must alter their layouts. The rule leaves no room for additional clarifying text within that summary.

Field of view / directly next to / distinctly separated tension

• The summary must appear in the same field of view as the statement of ingredients, directly next to it, and yet be distinctly separated from it (1.2.3,7(4)). Practically this creates a design tension: adjacency combined with distinct separation requires careful label layout decisions. Regulatory officers may need to judge whether an arrangement satisfies all three spatial conditions; labels that use tabs, borders, or different panels may produce interpretive disputes.

Typeface and size measurement

• The Variation defines size of type as the measurement from the base to the top of a letter or numeral (1.2.3,1A). This precise measurement method may lead to disputes about whether a particular font or font rendering meets the “not less than” requirement. The rule that the summary statement must be in the same typeface and size as any required name in the statement of ingredients (1.2.3,7(5)(a)) can be problematic where required names in the statement of ingredients have different typefaces or sizes.

Separate listing next to ingredient

• Required names must be listed separately for each ingredient that is or contains the relevant food and must be separately from but next to the ingredient name unless identical or contained in the ingredient name (1.2.3,7(2)). This forces granular labelling for compound ingredients and may increase label length and layout complexity. Businesses with compound ingredient lists will need to ensure parallels such as “maltodextrin (wheat)” are used consistently (1.2.3,7(2) Examples).

Processing aid wording

• Where the food to be declared is a processing aid or component of a processing aid, the statement of ingredients must list the required name and the words processing aid in conjunction with that required name (1.2.3,6(2)(a)(ii)). The Variation also requires a summary statement in those circumstances (1.2.3,6(2)(b)). Businesses that currently omit processing aids from ingredient lists or use alternative phrasing must modify their statements of ingredients and maintain supporting process documentation to justify inclusion or exclusion.

Scope of “derivative” and “component”

• The Division applies to a derivative of a listed food and to components of processing aids and additives (1.2.3,4(3)-(5)). The instrument does not define derivative or component in granular detail, so businesses will need to interpret whether their intermediate ingredients are derivatives requiring declaration. Disputes may arise over whether highly refined derivatives (for example, certain oils) remain requiring names, unless expressly exempted in Column 2 (see S9,3 Item 13 Column 2 for soybean oil exemptions, for example).

Exemptions with technical conditions

• Some Column 2 exemptions set out technical conditions which create evidentiary burdens. For example, S9,3 Item 3 Column 2(b) exempts glucose syrups made from wheat starch if they have been subject to a refining process that removed gluten protein content to the lowest level reasonably achievable and have gluten protein content not exceeding 20 mg/kg. Businesses claiming such an exemption will need process records and testing results; the instrument does not prescribe acceptable testing protocols or documentation forms, so industry must define acceptable practice and be prepared to defend it.

Different required names depending on context

• The table in S9,3 uses Column 3 for required names within a statement of ingredients and Column 4 for other declarations (1.2.3,5). For cereals containing gluten, the statement of ingredients requires the cereal name (barley, oats, rye) while other declarations require the word gluten (S9,3 Items 2-3). Manufacturers must therefore ensure consistency across label locations and contexts and check whether required names differ between in-ingredient statements and front-of-pack or other labelling.

Schedule 10 changes reducing species specificity

• The Variation removes several Schedule 10 requirements to declare the specific cereal, crustacea, or nut species (Schedule 10 [7.2], [7.4], [7.5]). This reduces some granularity of species-level information in statements of ingredients for those items, which may confuse consumers who previously relied on specific species names. Businesses must therefore be attentive to changed market expectations versus legal obligations.

Food-for-special-medical-purposes and infant formula carve-outs

• Section 1.2.3,4(4)-(5) requires different naming rules for food for special medical purposes and certain infant formula products. For those infant formula products, the name stated can be either the Schedule 9 Column 1 name or any other name by which that food is commonly known. Differing rules across product classes create potential for inconsistent labelling if a company markets both general and special-purpose products and uses common names inconsistently.

Transition period design

• While the 36 month transition period and 24 month post-transition sell-through period provide time to adjust (clause 4(2)-(4)), the staggered compliance window means both consumers and enforcement officers will encounter products in the market under two different labelling regimes for a protracted period. This may complicate compliance monitoring and consumer protection responses.

Absence of penalty detail

• The Variation does not specify penalties or enforcement procedures, and does not explain how disputes over typographic or spatial requirements will be adjudicated. Businesses should assume enforcement will occur under existing food regulation statutes and that regulators will interpret the new rules in context.

In sum, these “gotchas” arise from the intersection of technical typographic and layout requirements with substantive declarations and exemptions. They create precise compliance tasks and documentary burdens that require operational attention.

Companies should adopt a programme that aligns product labelling, supplier documentation, labelling templates, packaging proofs and internal compliance records with the Variation. The following stepwise compliance checklist is grounded on the Variation’s text and highlights where documentary, procedural and design steps are necessary.

1. Map products against the Schedule 9 table

• For each product, identify if any ingredient, compound ingredient, additive, processing aid or component contains a food listed in Column 1 of S9,3 (1.2.3,4(1), (5)).
• Determine whether the item is exempt under Column 2 for that S9,3 entry (1.2.3,4(3)-(4)). For example, check for exemptions such as distilled alcohol from whey (S9,3 Item 9 Column 2) or degummed and processed soybean oil (S9,3 Item 13 Column 2).

2. Determine the required name to use

• If the declaration is to be made in the statement of ingredients, use the Column 3 required name; for other declarations, use Column 4 (1.2.3,5; S9,3 table).
• For cereals containing gluten, ensure the cereal species name is used in the statement of ingredients while the word gluten is used for other declarations (S9,3 Items 2 and 3).

3. Update ingredient lists and declarations

• Ensure required names are listed separately for each ingredient that is or contains the relevant food and are placed separately from but next to the ingredient name unless included or identical (1.2.3,7(2)). For compound ingredients, include the required name adjacent to the compound ingredient name, e.g. “maltodextrin (wheat)” as per the Example in 1.2.3,7(2).
• For processing aids and components, include processing aid wording in conjunction with the required name within the statement of ingredients where this paragraph applies (1.2.3,6(2)(a)(ii)).

4. Implement summary statement rules

• Where a summary statement is required or used, ensure it commences with Contains and lists only the required names with no additional words (1.2.3,7(3)).
• Position the summary in the same field of view as the statement of ingredients, directly next to it, and distinctly separated from it (1.2.3,7(4)). Plan label panels and artwork accordingly.

5. Satisfy typographic requirements

• Ensure required names in the statement of ingredients are in a bold font that provides distinct contrast with other text and in a size of type not less than other non-required-name text in the statement (1.2.3,7(1)(a)-(b)). Apply the definition of size of type as the measurement from the base to the top of a letter or numeral (1.2.3,1A).
• Ensure the summary statement is printed in the same typeface and size as required names in the statement of ingredients and in a bold font that contrasts with other text (1.2.3,7(5)(a)-(b)).

6. Documentation and supplier declarations

• Obtain written supplier declarations for ingredients that rely on Column 2 exemptions (for example, distilled alcohol, certain refined oils, or refined glucose syrups). For exemptions with quantitative tests (S9,3 Item 3 Column 2(b)(ii) gluten ≤20 mg/kg), maintain testing certificates and process records demonstrating refining and gluten measurements.
• Maintain traceability records for compound ingredients so that required names can be listed separately for each ingredient containing the listed food.

7. Special medical-purpose foods and infant formula

• For food for special medical purposes and specific infant formula classes, apply the additional naming rules in 1.2.3,4(4)-(5) and ensure labels for such products comply with Standard 2.9.5 amendments (see [5.1]-[5.3]). Determine whether the product falls within the special rules and adjust labelling accordingly.

8. Integrate Schedule 10 changes into ingredient naming policies

• Review Schedule 10 changes that remove obligations to declare specific cereal or nut names and their replacement conditions. Update internal naming conventions to reflect that some species-level obligations have been removed or altered (Schedule 10 [7.2]-[7.6]).

9. Label proofs and regulatory review

• Produce new label proofs that demonstrate compliance with spatial and typographic requirements. Use the definition of size of type to measure fonts and document the measurements.
• If uncertain about marginal design choices (for example, what counts as the same field of view or distinct separation), seek pre-submission advice from the relevant regulator or maintain alternative label artwork that meets the strictest likely interpretation.

10. Manage packaging stock and transition strategy

• Use the 36 month transition period and the 24 month post-transition sell-through period to plan inventory turnover (clause 4(2)-(4)). Create a relabelling schedule aligned to stock levels and market launch timetables. Document packaging and labelling dates to show that products shipped or packaged before the end of the transition are eligible for post-transition sale under clause 4(3).

11. Quality assurance and training

• Train labelling, procurement and quality assurance teams on the new declaration rules, the specific required names for listed foods, typographic requirements, and supplier documentation needs.
• Update standard operating procedures for new product development, supplier onboarding, label approval workflows and compliance audits.

12. Monitor enforcement and update

• Because the Variation does not specify enforcement mechanisms, remain aware of applicable state, territory and Commonwealth enforcement practices. Be prepared to produce documentation and testing reports to enforcement officers.
• Monitor any guidance or compliance advice issued by regulators interpreting field-of-view, font measurement methods, or evidence standards for exemptions. Update label designs as necessary.

13. Legal review and risk assessment

• Have in-house counsel or external specialists review new label copy and supplier declarations, especially where exemptions are relied upon or where the product is on the borderline of a listed food derivative.
• Document the business rationale for any decisions not to declare a listed food, including technical evidence for exemptions.

By following these steps, businesses align label content, format and placement with the Variation’s textual standards and create the documentary trail required to assert exemptions or defend compliance positions. The Variation’s transition windows provide time to phase in changes, but companies should plan early to avoid rush reprints and to ensure supplier documentation is in place where exemptions or quantitative thresholds are invoked.
