128Appointment

#### 128 Appointment (1) There is to be a Chief Executive Officer of the Authority. (2) The Chief Executive Officer is to be appointed by the Board on a full‑time basis. (3) The Board must not appoint a person as the Chief Executive Officer if, at any time during the period of 2 years ending immediately before the proposed period of appointment, the person was employed by a body corporate whose primary commercial activity relates directly to the production or manufacture of food. (3A) For the purposes of subsection (3): (a) a director (however described) of a body corporate is taken to be employed by the body corporate; and (b) the secretary (however described) of a body corporate is taken to be employed by the body corporate. (4) The Board must not appoint a person as the Chief Executive Officer if the person has a pecuniary interest in a body corporate whose primary commercial activity relates directly to the production or manufacture of food.
