sec.116 Emergency powers
This section applies if an authorised officer is satisfied on reasonable grounds— the production of primary produce is being carried out at a place, other than a place, or part of a place, used only for residential purposes; and it is necessary to exercise powers under this section to avoid an imminent risk of death or serious illness of any person from the primary produce. The authorised officer may, without a warrant or the consent of the occupier of the place, enter the place. Before entering the place, the authorised officer must do or make a reasonable attempt to do the following things— comply with section 88 (1) ; tell the person the authorised officer is permitted under this Act to enter the place; give the person an opportunity to allow the authorised officer immediate entry to the place without using force. However, the authorised officer need not comply with subsection (3) if the authorised officer reasonably believes that immediate entry to the place is required to avoid an imminent risk of death or serious illness of any person.
