Food (Forms and Registration) Regulations 2025

The central concept is that the regulations give precise textual and layout content to statutory powers and procedures that would otherwise be incomplete. The Food Act 1984 gives authorised officers a power of seizure and detention of articles that the officer reasonably believes contravene the Act. Section 24 requires that the officer give a notice of seizure and detention in the prescribed form. The 2025 regulation supplies that form: it must name the recipient and the officer, describe the article, state the grounds for seizure, and include a prominent warning that unless the owner applies to the Magistrates' Court within seven days for a release order, the article will be destroyed or disposed of. The second concept is the release application. Under section 26(1) of the Act, a person claiming a detained article may apply to the Magistrates' Court for its release. The regulation prescribes the form for that application (Schedule 2), which must identify the article, the seizing officer, and set out the grounds for release. Importantly, the form includes statutory notes that replicate the criteria from the Act: the court must direct release if it is satisfied the officer lacked reasonable grounds for believing the article contravened the Act, or that the article was not in contravention. The third concept is the certificate of analysis. Sections 31(c) and 31A(3)(a) require that a certificate of analysis of a food sample be in the prescribed form. The Schedule 3 form requires the analyst to state the date of receipt, the condition of the seal, the results, and whether the prescribed apparatus or method was used. This certificate is admissible as evidence in prosecutions and other proceedings. The fourth concept is the certificate of registration. Under section 40(1), a registration authority must issue a certificate of registration in the required form. Schedule 4 prescribes that form: it must state the registration authority, the person in whose name the premises are registered, the expiry date, the food business name (if any), a description of the food business, the address, the class of premises, and the signature of the authority. The fifth concept is the record of registration. Section 43(1) requires the registration authority to keep a register containing the prescribed particulars. Schedule 5 lists those particulars: registration number, application date, proprietor name and address, business name, premises address, description of business, initial registration date, renewal dates, and any conditions of registration. Together, these five forms and the record schedule create the procedural skeleton through which the substantive food safety regime operates. For the regulated person, the forms are not advisory: using the wrong or incomplete form can defeat a seizure challenge or invalidate a registration.

The regulation directly affects five categories of persons. First, authorised officers under the Food Act 1984 - typically environmental health officers employed by local councils or the state Department of Health - must use the Schedule 1 form when seizing and detaining food or other articles. Any officer who issues a seizure notice that does not match the prescribed form risks the notice being held invalid, which could cause the ensuing detention to be unlawful and expose the officer or the authority to civil liability or an order for costs. Second, food business proprietors and other persons whose articles are seized are affected because they must use the Schedule 2 form if they wish to apply to the Magistrates’ Court for release. The form is mandatory; an application on a different format or without the required particulars may be rejected by the court registry or struck out on objection. This imposes a direct compliance burden on the applicant, who must either locate and complete the correct form (available from the court or online) or engage a lawyer to do so. Third, analysts authorised under the Act to conduct food testing must use the Schedule 3 certificate form when certifying the results of analysis. The certificate is a key piece of evidence in prosecutions for food safety offences. An analyst who certifies on a non‑prescribed form may find the certificate excluded or given less weight, potentially derailing a prosecution. Fourth, registration authorities - generally local councils - must issue certificates of registration in the Schedule 4 form and maintain records in the Schedule 5 form. This affects administrative staff and the council’s food safety program. The need to produce a certificate that lists the class of food premises and any conditions imposes an additional layer of administrative work beyond merely processing the registration. Fifth, food business operators who seek registration or renewal under the Act are indirectly affected because the registration authority will require them to provide information to populate the certificate and the record. The proprietor’s name, business name, address, description of the food business, and any conditions must be supplied accurately. Any error in that information may lead to a defective certificate, which could cause problems later if the business needs to prove its registration status (for example, when applying for a liquor licence or undergoing a compliance audit). The regulation also affects the Magistrates’ Court and its registry: court staff must process release applications that conform to the prescribed form and may need to reject non‑conforming documents. The broader public is affected only indirectly: the forms are a mechanism for enforcing food safety laws that are designed to protect consumers, but the regulation itself imposes no direct obligations on consumers.

The regulation does not create independent duties or rights; it provides the procedural tools through which duties and rights in the Food Act 1984 are exercised. Nonetheless, several practical obligations arise from the prescribed forms. The most time‑sensitive duty falls on the person whose article has been seized. Under the Schedule 1 notice, the recipient is informed that they must apply to the Magistrates’ Court within seven days after the seizure if they wish to prevent the article’s destruction or disposal. The seven‑day clock runs from the moment of seizure, not from receipt of the notice, so a proprietor who receives the notice on day three may have only four days left. The Schedule 2 form explicitly states that the application must be made within seven days after the seizure and that a copy must immediately be given to the authorised officer who made the seizure. Failure to serve the officer promptly may result in the court refusing to hear the application or the article being destroyed before the application is determined. A corresponding right is that the court must order release if the applicant shows that the officer lacked reasonable grounds or that the article was not in contravention - but that right can be lost if the form is not used or the deadline is missed. For authorised officers, the duty is to ensure the seizure notice uses the exact wording and layout of Schedule 1. The form includes blank fields for the officer’s name and address, the time, a description of the article, and grounds. Any omission or deviation could be argued to invalidate the notice, making the subsequent detention unlawful. There is no duty in the regulation itself to serve the notice, but the parent Act requires it. For analysts, the duty under the prescribed form is to certify that the analysis was performed or supervised, to state the results, and to declare whether any prescribed apparatus or method was used. The form includes optional text for that declaration. An analyst who fails to include the declaration where required could weaken the evidentiary value of the certificate. For registration authorities, the duty is to issue a certificate of registration in the form of Schedule 4 and to keep records containing all particulars in Schedule 5. The certificate must show the class of food premises, which forces the authority to classify each food business - a task that may involve judgment calls (for example, whether a bakery that also sells coffee is a food premises or a retail outlet). The record must include any conditions of registration, so the authority must record those conditions accurately. For food business proprietors, the right is to receive a certificate that accurately reflects their registration. They have no duty under the regulation itself, but in practice they must supply correct information to the registration authority; if they give false or incomplete information, they may face liability under the parent Act. The regulation also gives the public a right to inspect the register? The Food Act may provide for that, but the regulation does not address it. The forms themselves contain warnings and notes that do not have the force of law but guide the user - for example, the note on Schedule 2 about the court’s power to order release. Failure to read and heed those notes is at the applicant’s peril.

The Food (Forms and Registration) Regulations 2025 contains no penalty provisions. It does not create offences, set fines, or prescribe enforcement powers. All enforcement consequences arise from the parent Act, the Food Act 1984. However, the regulation indirectly influences the enforcement process in several critical ways. First, if an authorised officer fails to use the prescribed form for a seizure notice, the notice may be invalid. That would mean the seizure and detention lack statutory authority, potentially making the officer liable for trespass to goods, conversion, or an order for return of the article and damages. A court might also exclude evidence obtained as a result of the unlawful seizure in any subsequent prosecution. Second, if a person claiming a detained article fails to use the prescribed form for a release application, the Magistrates’ Court may reject it. The consequence is that the seven‑day window passes, and the article is destroyed or disposed of without the person ever having had a merits hearing. The economic loss to the owner could be substantial, especially if the article was a large batch of food product or a valuable machine. The regulation itself does not penalise non‑use of the form - it simply says the prescribed form is set out in the Schedule - but the parent Act makes use of the prescribed form a condition for the exercise of the power. Section 24 says the officer must give notice “in the prescribed form”. A notice not in that form is not a notice for the purposes of the Act. Third, for certificates of analysis, the parent Act (sections 31 and 31A) makes the certificate admissible as evidence only if it is in the prescribed form. A certificate that does not comply may be excluded, and the prosecution may be unable to prove that the article contravened the Act, leading to an acquittal. In a private civil claim for damages, a defective certificate may similarly be excluded. The regulation also interacts with the Subordinate Legislation Act 1994, which provides that the regulation will automatically sunset on 17 November 2035. After that date, the forms cease to have effect unless re‑made. Enforcement authorities would then have no prescribed forms, and the powers to seize, detain, and analyse would become inoperable until new regulations are made. That creates a regulatory gap risk. There is no transitional provision in the 2025 regulations to preserve the effect of forms issued before the sunset. Businesses and regulators should monitor the sunset date. The revocation of the 2015 regulations means that older forms are not saved; any form issued before 17 November 2025 that uses the 2015 schedule will be invalid after that date, even if it refers to an earlier seizure. Enforcement agencies must therefore ensure they update all templates and training materials by the commencement date.

The regulation sits within a hierarchy of Victorian food law. At the apex is the Food Act 1984, which creates the substantive food safety regime, including registration duties, powers of entry and seizure, and evidentiary provisions. The regulation is made under section 63 of that Act, which grants the Governor in Council power to make regulations for the purposes of prescribing forms and other matters. The regulation explicitly references sections 24, 26(1), 31(c), 31A(3)(a), 40(1), and 43(1) of the Act - all sections that require the form or particulars to be prescribed. Any amendment to those sections in the parent Act would necessitate a corresponding amendment to this regulation. The regulation also interacts with the Subordinate Legislation Act 1994, which sets the sunset period and rules for statutory rules. The endnote states that the regulation will sunset ten years after the day of making, on 17 November 2035, and that references to the Interpretation of Legislation Act 1984 are incorporated. That means the regulation is subject to the ILA’s provisions on headings, examples, notes, and punctuation forming part of the instrument. For example, the note in Schedule 2 that sets out the court’s power to order release is part of the regulation and may be used in interpreting the form. The Interaction with the Food Act extends beyond the sections listed. For instance, section 31 of the Act provides that a certificate of analysis in the prescribed form is prima facie evidence of the matters certified. The regulation’s Schedule 3 supplies that form, making it the key link between the analytical process and court evidence. If a regulated person challenges a certificate on the ground that it does not comply with the prescribed form, the court must examine the Schedule. Similarly, section 26 of the Act provides that the Magistrates’ Court may make an order directing release; the application must be in the prescribed form (Schedule 2). The regulation does not interact with the Food Standards Code (a Commonwealth‑state instrument) or with other regulations under the Food Act, such as the Food Premises Regulations or the Food Safety Standards Regulations. Those instruments impose substantive duties on food businesses; this regulation is purely procedural. However, because registration is a prerequisite to operating many food businesses, the certificate of registration form (Schedule 4) effectively conditions the ability to conduct that business. A registration authority could refuse to issue a certificate if the applicant does not supply the information needed to populate the form. The regulation also interacts with local government by‑laws; while a council may impose additional conditions on registration (such as operating hours), those conditions must be recorded in the Schedule 5 record. Finally, the regulation interacts with the Magistrates’ Court (Civil Proceedings) Rules or equivalent practice notes that govern the filing of applications. The Schedule 2 form requires the applicant to give a copy to the authorised officer immediately. That is a procedural requirement that sits alongside court rules on service. Conflict between the two would be resolved by the regulation’s requirement that service under the Food Act must follow the prescribed form’s direction, though the court rules might also apply. In practice, applicants should comply with both.

As at the commencement date of 17 November 2025, the Food (Forms and Registration) Regulations 2025 has not been amended by any subsequent statutory rule, subordinate instrument, or Act. The Table of Amendments in the endnotes confirms that there are no amendments. The instrument is brand new, replacing the Food (Forms and Registration) Regulations 2015 (SR No 132/2015). The 2015 regulations are expressly revoked by regulation 4. That revocation is a form of amendment by substitution: the 2025 instrument does not merely update a few forms but entirely replaces the old schedules. The 2015 regulations themselves had a similar structure - they prescribed forms under the same sections of the Food Act - but the forms are different in detail. For instance, the 2025 version of the seizure notice (Schedule 1) now includes a field for the authorised officer’s address, which the 2015 form may not have required. The 2015 regulations also sunset in due course, but the 2025 instrument pre‑emptively revokes them before their sunset date. This is a common practice: a new statutory rule is made to ensure the forms remain contemporary and to reset the ten‑year sunset clock. The 2025 regulation will itself be subject to amendment during its ten‑year life. Potential future amendments could include: updating the forms to reflect changes in the parent Act (for example, if a new category of food premises is created); adding or removing fields in the certificate of analysis (for example, to require a statement of measurement uncertainty); or adjusting the record particulars to align with electronic registration databases. The sunset mechanism under section 5 of the Subordinate Legislation Act 1994 provides a forced review: before 2035, the responsible department (likely the Department of Health) must assess whether the forms remain necessary and fit for purpose. If they are still needed, a new regulation will be made. If not, the forms will lapse, and the underlying sections of the Food Act that rely on prescribed forms will become inoperative until new regulations are made. There is no provision in the 2025 regulation for transitional amendments if the parent Act changes during the ten‑year period; practitioners would need to wait for an amending statutory rule. The Interpretation of Legislation Act 1984 provisions noted in the endnotes will apply to any future amendments: for example, if a regulation is inserted into the schedule, the headings, examples, and notes become part of the regulatory text.

There is no litigation directly concerning the Food (Forms and Registration) Regulations 2025 because it is a brand‑new instrument that came into force on 17 November 2025. However, its predecessor - the 2015 regulations - may have been the subject of case law, though the source does not mention any. In principle, challenges to the validity of seizure notices or release applications based on form defects are possible. The courts have previously considered whether a notice that substantially complies with a prescribed form is still valid if it does not strictly follow the layout. Under Victorian legislation, the principle of substantial compliance often applies unless the parent Act uses mandatory language such as “must be in the prescribed form”. The Food Act 1984 uses “prescribed form” for notices and certificates, which suggests strict compliance is required. If a matter were to be litigated, a court would need to interpret whether a minor deviation - such as a missing field or an extra line - invalidates the notice. The inclusion of the entire form in the Schedule, with blank fields and optional text, suggests the drafter intended the words and layout to be followed exactly. The notes in Schedule 2 are part of the regulation (by virtue of the ILA provisions) and would likely be considered by a court as an authoritative guide. There is also potential litigation around the consequence of a defective certificate of analysis. Section 31 of the Food Act makes a certificate in the prescribed form prima facie evidence. If a defendant argues that the certificate is not in the prescribed form - for example, because the analyst did not tick the correct box about the apparatus - the prosecution may have to lead oral evidence to prove the analysis, which is more costly and may be less persuasive. No reported decisions are available for the 2025 version, but practitioners should monitor the Victorian Magistrates’ Court and Supreme Court for cases involving seizures or prosecutions that turn on form compliance. A future case might also arise if a registration authority issues a certificate of registration that omits the class of food premises, and the proprietor suffers loss (for example, because a potential buyer cannot verify the registration). The regulation itself would be the standard against which the certificate is judged. Another conceivable litigation scenario is a judicial review of a decision to destroy a detained article where the owner claims the seizure notice did not comply with Schedule 1 - for example, if the notice did not state the grounds for seizure. If the court finds the notice invalid, the destruction would be unlawful, and the owner could claim damages. In the absence of case law on the 2025 regulation, the best guide is the approach Victorian courts take to statutory forms generally. The principle from cases such as Project Blue Sky v Australian Broadcasting Authority (1998) 194 CLR 355 (a High Court case on statutory validity, not strictly on forms) is that the consequence of non‑compliance depends on legislative intent. Given that the Food Act sections use the word “prescribed”, the intent is likely that the form must be followed.

Several features of the regulation can trap the unwary, and they are worth identifying even though the instrument is brief. The most critical trap is the seven‑day deadline for a release application. The Schedule 1 notice states that the application must be made within seven days after the seizure. The Schedule 2 form also repeats this. The deadline is short and runs from the seizure, not from the date the owner receives the notice. If the owner is away on holiday, the notice may be left at the premises, and the seven days might expire before they return. There is no provision for extension of time in the regulation. The only remedy would be to seek an extension from the Magistrates’ Court under its general powers, but that is not automatic. The second trap is the obligation in Schedule 2 to “immediately give a copy of this application to the authorised officer responsible for the seizure and detention”. “Immediately” is not defined. If the applicant files the application at the court but delays serving the officer, the officer might proceed to destroy the article before the court hears the matter. The court might also require proof of service before listing. The third trap is that the certificate of analysis form (Schedule 3) includes an optional declaration about the use of prescribed apparatus or method. The note says “*Delete if not applicable.” Practitioners often overlook such optional text. If the parent Act requires that a certain method be used for a particular analysis, the certificate must include that declaration. Leaving it out could mean the certificate does not comply with the prescribed form, and therefore is not admissible as evidence. The fourth trap is the class of food premises field in the certificate of registration (Schedule 4). The regulation does not define “class of food premises” - that would come from the Food Act or other regulations. If the registration authority assigns the wrong class, the certificate may not accurately reflect the business’s obligations. For example, a business classified as a “retail premises” when it is actually a “manufacturing premises” may face different inspection frequencies and fees. The proprietor should check the class is correct. The fifth trap is the record of registration particulars in Schedule 5. The record includes “Conditions (if any) of registration of food premises”. If conditions are imposed but not recorded in the schedule, they may be unenforceable because section 43(1) of the Act requires the register to contain the prescribed particulars, and that includes conditions. A prosecutor trying to prove a breach of a condition would need to show it was recorded. Conversely, if a condition is recorded in the schedule but the certificate does not mention it, the proprietor may not know about it. The sixth trap is the revocation of the 2015 regulations without a savings provision. Any form prepared before 17 November 2025 but used after that date will be invalid. This includes printed stock of old forms. Businesses and councils must destroy old stock immediately. The seventh trap is that the regulation does not specify how the forms are to be supplied. The endnote provides a web link for legislation but not for blank forms. If a food business proprietor tries to download the form from the internet, they may find a version that looks different from the official Schedule. The authorised form is the one set out in the statutory rule as published on the Victorian Legislation website. Using a mis‑typed version could be fatal. The eighth trap is the sunset clause: ten years from 30 September 2025 (the making date) means 30 September 2035, though the regulation says it will sunset on 17 November 2035. Any legal proceedings that depend on the forms after that date will be problematic unless the regulation is replaced. The nineth trap: the regulation is made under section 63 of the Food Act, but that section also allows regulations to prescribe fees, offences, and other matters. This instrument does not do that. A practitioner might assume that registration fees are included, but they are not - they will be in a separate regulation. Finally, the notes in Schedule 2 state the grounds on which the court must order release. Those notes are part of the regulation and could be used in litigation to argue that the court has no discretion if the grounds are made out. A party could be caught off guard if the prosecutor argues that the notes impose an evidentiary burden on the applicant.

Compliance with the Food (Forms and Registration) Regulations 2025 is straightforward but requires attention to detail. For authorised officers, the primary step is to ensure that any notice of seizure and detention issued after 17 November 2025 uses the exact wording and layout of Schedule 1. The officer must fill in all fields: the name and address of the recipient, the officer’s own name and address, the time and date, a clear description of the article, and the grounds for seizure. The form also requires the officer’s signature and the date. Officers should double‑check that the seven‑day warning is included as printed - it is part of the prescribed form. Any handwritten alteration to the form could be argued to deviate from the Schedule. It would be prudent for enforcement agencies to print the form as a standalone document from the authorised version on the Victorian Legislation website and not rely on a photocopied version where the layout may be skewed. For a person whose article has been seized, the first step is to read the notice carefully. The notice tells them they have seven days to apply to the Magistrates’ Court. They must obtain the Schedule 2 form - the court registry or the Department of Health website should provide it. The applicant must fill in: the court venue, their name and address, a description of the article, the date and address of seizure, the name of the authorised officer who seized it, and the grounds for the application. Crucially, the applicant must sign and date the form. The note requires that a copy be given immediately to the authorised officer. The safest approach is to file the application at the court and at the same time serve a copy on the officer by hand or by email (if the officer has provided an email address). The applicant should keep proof of service. If the article is perishable, the applicant should consider seeking an urgent hearing. For an analyst, compliance means using the Schedule 3 form whenever certifying the analysis of a sample taken under the Food Act. The analyst must state the date of receipt, the condition of the seal (sealed and intact, seal broken, or unsealed), the marking on the sample, whether they analysed it or supervised the analysis, the results, and optionally a declaration that they used a prescribed apparatus or method. The optional declaration should be included if the Food Act or a regulation requires a specific method. The analyst should delete the inapplicable options in square brackets and the asterisk text as indicated. The signature, laboratory name, and date must be completed. For a registration authority (local council), compliance involves two actions. First, when issuing a certificate of registration under section 40(1) of the Act, the authority must use the Schedule 4 form. That means printing or generating a certificate that contains: the name of the registration authority, the full name and address of the person registered, the date of expiry, the name of the food business (if any), a description of the food business, the address of the premises, the class of food premises, and the signature of the authority. The authority should ensure the class is correctly assigned according to any classification system under the Food Act or other regulations. Second, the authority must maintain a register that includes all the particulars listed in Schedule 5: the registration number, date of application, proprietor details, business name, premises address, description of business, date of initial registration, dates of renewal, and any conditions. The register can be kept in electronic form, but the fields must match the Schedule. If conditions are imposed (for example, a condition that the premises must install a grease trap), those conditions must be recorded. Failure to record them could make them unenforceable. For food business proprietors seeking registration or renewal, compliance is indirect but important. They must supply accurate information to the registration authority so that the certificate and record can be correctly completed. They should check the certificate when issued to ensure it matches their business - particularly the class of premises, the business description, and any conditions. If there is an error, they should ask the authority to correct it and issue a fresh certificate. The proprietor should keep a copy of the certificate as proof of registration. All regulated persons should also be aware of the sunset date. The regulation automatically expires on 17 November 2035. Well before that date, the responsible department will likely consult on replacement regulations. Practitioners should monitor the Victorian Government Gazette and the Department of Health website for announcements. In the meantime, using the prescribed forms correctly is the single most important compliance step. The forms are not long or complex, but they are mandatory, and overlooking a detail - such as the class of premises or the seven‑day warning - can lead to invalidity, loss of rights, or evidentiary exclusion.
