What it does
This instrument, the Food Amendment (Beef Labelling) Act 2009 as inserted into the Food Act 2003 No 43 by Schedule 1, adds a new Division 2A titled "Beef labelling" (see inserted sections 23A-23D). Mechanically, it does four things.
First, it creates an express regulation-making head of power enabling the regulations to prescribe labelling schemes for beef intended for sale. Section 23A(1) authorises regulations to "prescribe schemes regulating the use of words and expressions used in the labelling of any type of beef intended for sale or beef for sale to indicate the type of beef, the quality of beef or any other characteristic of the beef". Subsection 23A(2) then lists the sorts of regulatory rules such schemes may contain, including scope (23A(2)(a)), labelling requirements (23A(2)(b)), additional conditions (23A(2)(c)), prohibitions (23A(2)(d)) and record-keeping requirements (23A(2)(e)).
Second, it creates statutory rules that treat particular labelling and advertising conduct as misleading or deceptive for the purposes of section 18(1) of the Food Act. Section 23B sets out specific circumstances in which a person carrying on a food business "is taken to have engaged in conduct that is misleading or deceptive (or is likely to mislead or deceive)" in relation to advertising, packaging, labelling or sale of beef. Those circumstances include inconsistent use of AUS-MEAT language (23B(1)(a)), voluntary but inconsistent adoption of a prescribed scheme (23B(1)(b)), and specific express-labelling rules about the words "budget" and "manufacturing" (23B(1)(c)-(d)).
Third, it defines when beef is a false description for the purposes of section 18(2). Section 23C describes three concrete bases for false description: use of AUS-MEAT language for a particular grade without assessment or compliance with the AUS-MEAT manual (23C(1)(a)(i)-(ii)); descriptions contrary to a prescribed scheme (23C(1)(b)); and misuse of a "consumer descriptor" where the law prescribes that descriptor for a particular cut (23C(1)(c)).
