57 Payment of penalties (1) Where an offence against this Act has been prosecuted by the council, all penalties recovered in relation to the offence shall be paid into the municipal fund of that council. S. 57(2) inserted by No. 42/2009 s. 40. (2) If an infringement notice has been issued by a council under this Act, the infringement penalty recovered in relation to the notice is payable to the municipal fund of the council. S. 57(3) inserted by No. 42/2009 s. 40. (3) For the purposes of this section— (a) an offence prosecuted by an authorized officer of a council is taken to have been prosecuted by the council; and (b) an infringement notice issued by an authorized officer of a council is taken to have been issued by the council.
