4I Declared authority for the purposes of references in Chapter 4 of the Food Standards Code (1) The Minister, by order published in the Government Gazette, may declare a person or body or a person or body belonging to a specified class of person or body to be a declared authority for the purposes of carrying out any function or duty or exercising any power of an Authority, authority or relevant authority referred to in a specified primary production and processing standard or any specified provision of that standard. (2) An order made under subsection (1) may be made so as to be limited in respect of time or circumstances including in respect of— (a) a person or a person belonging to a specified class of person; or (b) a premises or a premises belonging to a specified class of premises. (3) An order under this section takes effect on the date that the order is published in the Government Gazette or on any later date specified in the order. (4) For the purposes of any provision of this Act that applies the Food Standards Code, a reference in a primary production and processing standard or any provision of that standard to an "Authority", "authority" or "relevant authority" is taken to be a reference to a "declared authority" declared in an order under subsection (1) for the purposes of that primary production and processing standard or that provision of that standard (as the case requires).
