19U Audit by council staff (1) An officer or member of the staff of a council must not conduct, or assist in conducting, a food safety audit of— (a) any fixed food premises located within that council's municipal district unless the audit is conducted on behalf of the council; or S. 19U(1)(b) amended by No. 42/2009 s. 47. (b) any temporary food premises, mobile food premises or food vending machine unless the audit is conducted on behalf of a council. (2) If a food safety audit of a food premises is conducted by or on behalf of a council, the proprietor of the food premises must pay to the council the reasonable costs of the audit. (3) The council may waive or vary the costs of an audit payable under subsection (2) if the council considers that there are special circumstances having regard to criteria fixed by the council. (4) The council must ensure that the method of determining the reasonable costs of an audit payable under subsection (2) and the criteria fixed under subsection (3) are available for inspection by the public.
