Fly Eradication Regulations

The regulations deploy a compact set of legal concepts. Those concepts and their mechanical operation under the text are:

• Prescription by cross‑reference: regulation 2 prescribes “flies” under s 199(20) of the Health (Miscellaneous Provisions) Act 1911. That means the machinery of s 199(20) of the parent Act applies to flies, and the reference continues to operate as s 199(20) is amended over time. The text thus anchors these regulations to the parent Act rather than restating primary powers.

• Territorial application: regulation 3 limits the regulations to the districts listed in the Schedule. The Schedule names cities, towns and shires by municipal district, including a long list of shires and towns. The territorial limit is a gatekeeper for applicability; outside the listed districts the regulations, on their face, do not apply.

• Preventative duty: regulation 4 creates a positive duty for owners and occupiers. The duty is to avoid placing or permitting matter that is likely to attract or breed flies on land or premises unless that matter is “covered, protected, treated or dealt with” so as to “effectively prevent” attraction or breeding. The language frames compliance by method (covered, protected, treated or dealt with) and outcome (effectively prevent attraction/breeding).

• Authorised officer direction power: regulation 5 gives an authorised officer the power to give written directions to an owner or occupier where the officer considers flies are prevalent or breeding on the land or premises. The direction must specify measures and a time within which they must be taken. The officer’s choice of measures is limited in the text only by the officer’s opinion that the measures are “necessary” to control prevalence, effect eradication, and effectively prevent breeding.

• Local authority execution and cost recovery: regulation 6 permits a local authority to carry out required work if the person required to do so fails to comply. The local authority can recover the cost of that work from the person, in addition to any penalty under the regulations.

• Entry for remedial work: regulation 7 expressly authorises the local authority or its officer to enter land or premises and execute the work required by the regulations.

• Offences, tiered minimum penalties and daily continuing penalties: regulation 8 makes contravention of regulation 4 or failure to comply with a direction under regulation 5 an offence. It sets a maximum penalty of $1 000 and prescribes minimum monetary penalties for first, second and third or subsequent offences ($100, $200 and $500 respectively). It also provides a daily penalty of between $50 and $100 if the offence is a continuing one.

• Administrative simplicity and local enforcement: the scheme places investigation, notice and execution powers with authorised officers and local authorities who operate within the Schedule’s districts, rather than establishing complex administrative processes in the regulations themselves.

These concepts show a regulatory architecture that is outcome‑oriented (prevent breeding, control prevalence) but uses relatively brief, broad provisions to grant officers and local authorities discretion to specify measures and execute remedial action, coupled with express monetary sanctions and cost recovery for non‑cooperation.

The text identifies who bears duties, who may act, and who is subject to penalties.

• Owners and occupiers: The primary regulated parties are “the owner or occupier of any land or premises” (regulation 4). The wording makes both owners and occupiers subject to the preventative duty and liable for contraventions and penalties. Regulation 5 confirms that notices are to be given to “the owner or occupier of the land or premises”, so enforcement attention can target either party.

• Authorised officers: The regulations empower “an authorised officer” to investigate prevalence or breeding and to give written directions requiring remediation (regulation 5). The text does not define “authorised officer” within these regulations, so the term is to be read with whatever definition, appointment process or scope is provided in the parent Act or in other instruments. For operational purposes, the authorised officer is the official decision maker who determines when directions are necessary.

• Local authorities: Local authorities are charged with enforcement execution powers. They may execute work when the person required to do so fails or neglects to comply (regulation 6) and may enter land or premises to execute required work (regulation 7). Local authorities also have the financial right to recover the costs of work executed (regulation 6). The Schedule lists municipal districts and shires, which are the local government entities that will bear the administrative and operational burden of enforcing the regulations in their areas.

• Persons subject to penalties and cost recovery: An owner or occupier who contravenes regulation 4 or fails to comply with a direction under regulation 5 commits an offence and is subject to monetary penalties under regulation 8. Additionally, where the local authority executes remediating work after non‑compliance, the cost of that work is recoverable from the person required to execute the work (regulation 6).

• Geographic limitation of effect: The Schedule defines the set of municipal districts and shires to which the regulations apply. Persons located outside those districts are not captured by these regulations, at least not by the territorial application stated in regulation 3.

• Overlapping public entities: The Schedule lists multiple municipal districts including cities, towns and shires. Note 2 in the compilation notes records that the former municipal district of the City of Perth has been divided into four local government districts: City of Perth and the towns of Vincent, Cambridge and Victoria Park. That administrative detail affects which local authority is responsible in what areas identified in the Schedule.

In short, the compliance and enforcement burdens fall on owners and occupiers of premises within the Schedule’s districts; authorised officers and the relevant local authorities are the executors of regulation and enforcement, and they have power to enter premises, direct measures, carry out work and recover costs from the regulated parties.

This section isolates specific positive and negative duties, discretions given to public officers and rights (procedural or financial) identified in the text.

Duties on owners and occupiers

• Preventative duty: Owners and occupiers must not “place, throw or leave, or permit or cause to be placed, thrown or left” on their land any waste food, manure, refuse, garbage, waste matter or other matter likely to attract or be a breeding place for flies unless that matter is “covered, protected, treated or dealt with in such a manner as to effectively prevent it attracting or being a breeding place for flies” (regulation 4). The duty is both substantive (prevent breeding and attraction) and procedural (the material must be covered/protected/treated).

• Compliance with directions: Where an authorised officer gives a written notice under regulation 5, the owner or occupier is required to take the measures specified within the time set in that notice. Failure to do so is an offence (regulation 8(b)).

Powers and discretions of authorised officers and local authorities

• Direction power: An authorised officer may give a written notice directing an owner or occupier to take measures that the officer, in their opinion, considers “necessary to control the prevalence, effect eradication, and effectively prevent the breeding of flies” (regulation 5). The regulation therefore confers discretion as to what measures are “necessary”, and to set the timeframe for compliance.

• Entry power: The local authority or its officer may enter upon any land or premises and execute any work required by the regulations (regulation 7). The text gives an express right of entry for enforcement purposes; the regulations do not in themselves set conditions or limits on the manner of entry, nor do they set requirements for consent or warrants in the text.

• Execution and cost recovery power: If a person fails to execute required work, the local authority may execute the work and recover the cost from that person, in addition to any penalty under the regulations (regulation 6). That creates a financial enforcement lever beyond criminal penalties.

Offences and penalty rights

• Monetary penalties: Contravention of regulation 4 or failure to comply with a regulation 5 direction is an offence (regulation 8(1)(a)-(b)). The statute caps the maximum penalty at $1 000 (regulation 8(1)(c)) and prescribes minimum amounts for first, second and third or subsequent offences: $100, $200 and $500 respectively (regulation 8(1)(c)(i)-(iii)). The regulation also prescribes a daily penalty for continuing offences between $50 and $100 (regulation 8(1)(d)).

Rights that are absent or not specified

• No express procedural review or appeal in these regulations: The regulations do not set out a statutory appeals or internal review mechanism for notices given under regulation 5, nor do they specify notice content beyond requiring the direction to be in writing and to specify a time. The lack of a procedural framework in the text means rights to contest or seek internal review of a notice, timing of entry, or detailed process for cost assessment are not set out in these regulations themselves.

• No definition of “authorised officer” within the regulations: The regulations rely on the concept of an authorised officer but do not define appointment standards, training, or scope. That definition and any conditions on appointment are left to the parent Act or other instruments.

Overall, duties are focused and outcome‑oriented for owners and occupiers; rights are mainly enforcement rights for local authorities and authorised officers (entry, direction, execution, cost recovery). The regulations anchor penalties and provide cost recovery but leave procedural safeguards and appointment mechanics to the parent Act or other law.

The regulations provide a two‑track enforcement regime: criminal penalties for contraventions and civil cost recovery for remedial work executed by local authorities.

Criminal penalties

• Offence triggers: Two behaviours constitute offences under regulation 8(1): (a) contravening regulation 4 (the duty not to place/leave matter likely to attract or breed flies unless otherwise protected); and (b) failing to comply with a direction under regulation 5 within the time specified in the notice (regulation 8(1)(a)-(b)).

• Monetary limit and tiered minimums: Regulation 8(1)(c) sets the maximum monetary penalty at $1 000. It imposes statutory minimum penalties tiers depending on the number of offences: $100 for a first offence, $200 for a second offence and $500 for a third or subsequent offence (regulation 8(1)(c)(i)-(iii)). The presence of minimum penalties for repeat offenders signals a legislative intent to escalate financial consequences with recidivism.

• Continuing offences and daily penalties: If the offence is “a continuing offence”, regulation 8(1)(d) allows a daily penalty in addition to the per‑offence penalty. The daily penalty must be not more than $100 and not less than $50, giving a daily range of $50-$100 while the contravention continues.

Enforcement powers and remedies

• Written directions and remedial work: Authorised officers can issue written notices requiring specified remedial measures within a specified time (regulation 5). This creates a compliance fix option short of immediate prosecution.

• Local authority execution: If the person required to execute the work under these regulations or a notice fails to do so, regulation 6 allows the local authority to execute that work. This is a coercive administrative remedy that shifts the immediate cost and practical burden of remediation to the local authority temporarily but secures it as a recoverable debt against the private party.

• Cost recovery in addition to penalties: Regulation 6 states the local authority may recover the cost of executing the work from the non‑complying person, “in addition to any penalty for which that person may be liable under these regulations”. That makes cost recovery a civil enforcement mechanism that supplements criminal sanctions. The text does not specify the procedure for cost quantification, notice of costs, or time frame for recovery.

• Entry power for execution: Regulation 7 authorises the local authority or its officer to enter upon any land or premises and execute work required by the regulations. The text contains no express constraints on the circumstances in which entry may occur, nor any express requirement for warrants, consent or notice within the body of these regulations.

Operational enforcement consequences

• Enforcement is local: These powers are allocated at the local authority level; those entities will resource inspection, notice‑issuing, remedial execution and cost recovery in their respective districts. The Schedule identifies the municipal districts in which those powers may be used (regulation 3 and Schedule).

• Administrative discretion and practical enforcement intensity: The authorised officer’s opinion determines when notices are given and what measures are necessary (regulation 5). The combination of broad remedial discretion, entry power (regulation 7) and cost recovery (regulation 6) provides local authorities with accessible tools to secure compliance without litigation in many cases.

• Financial exposure for regulated parties: Owners and occupiers face criminal fines with prescribed minimums and repeat offender increases, daily accrual for continuing offences, and exposure to civil recovery of the cost of works carried out by local authorities.

The enforcement architecture thus mixes criminal deterrence for contraventions, administrative coercion through notice powers and entry, and financial compulsion through cost recovery, all implemented at the local authority level within the Schedule’s territorial bounds.

The regulations are compact and rely on statutory cross‑reference and local government operation. The text itself points to several interaction points with other law, and is silent in other respects.

Direct cross‑reference to the parent Act

• Regulation 2 expressly applies the provisions of the Health (Miscellaneous Provisions) Act 1911 section 199(20) to flies “as amended from time to time” (regulation 2). That means the regulatory regime here is not standalone; it operates in tandem with the parent Act. Any powers, definitions, appointment mechanisms or enforcement procedures in s 199(20) of the parent Act therefore interact directly with these regulations by virtue of the incorporation.

Territorial overlap with local government powers

• The Schedule lists municipal districts, towns and shires. Local authorities in those districts will use their general regulatory powers, council by‑laws and administrative processes to effect enforcement. The regulations give specific rights to enter and execute work and recover costs (regulations 6 and 7). In practice the exercise of those powers will sit alongside local government powers under the Local Government Act or other municipal statutes. The regulations do not articulate the priority or procedural interplay between those local regimes and these specific regulations; procedural and administrative practices will determine how the instruments are used together.

Potential interaction with property, trespass and administrative law

• Regulation 7 authorises entry to execute required work. The regulations do not set out procedural protections or requirements such as warrants, prior notice, or limits on timing. That absence means other laws governing entry, trespass, property rights, and administrative action may influence or constrain how a local authority exercises the power to enter. The regulations themselves do not resolve those interactions; the authority to enter “shall be lawful” (regulation 7), but the regulatory text does not displace or elaborate how this will sit with existing statutory or common law protections. Any reliance on other statutes or common law will need to be referenced in practice.

Civil recovery and enforcement procedures

• Regulation 6 allows local authorities to recover the cost of executing works from the non‑complying person. The regulations do not prescribe the recovery mechanism or the priority of such recovery against other debts. Those procedural features will depend on broader local government debt recovery and civil procedure rules, and possibly the parent Act’s mechanisms, but the regulations themselves simply create the entitlement to recover costs.

Relationship to amendment and subordinate instrument law

• The compilation table and notes show that regulation 2 and regulation 5 were subject to amendments at different times, and that the regulations have been reprinted and amended by other regulatory instruments (Gazette entries noted). The dynamic cross‑reference to s 199(20) in regulation 2 means that amendments to the parent Act will alter the operative legal effect of these regulations without further amendment to the regulations themselves.

Absence of procedural appeal or review mechanisms

• The regulations do not provide an internal appeal or review process for an owner or occupier aggrieved by a notice or the exercise of entry or cost recovery powers. Any right of contest or judicial review will need to be taken under the parent Act, general administrative law or local government statutes rather than under these regulations, because the regulations themselves are silent on those points.

In sum, the regulations are a focused subordinate instrument that operates in close conjunction with the Health (Miscellaneous Provisions) Act 1911 via a cross‑reference, while relying on local authority administrative and civil mechanisms for entry, remedial works and cost recovery. The regulations leave a number of procedural and definitional matters to other statutes or to administrative practice.

The regulations’ compilation notes provide the chronological amendment record and reprint history. The document itself also marks specific amendments next to the relevant regulations.

Key gazettal and amendment events (as recorded in the compilation table and inline notes)

• Original Gazettal and commencement: The Fly Eradication Regulations were gazetted on 2 March 1961 (pp. 579-580) and commenced on that date, per the compilation table.

• Schedule insertion/amendment: A Schedule was inserted on 10 October 1961 (Gazette p. 2860) and an amendment recorded on 16 March 1967 (Gazette p. 722). The Schedule currently lists the municipal districts to which the regulations apply and includes cities, towns and a long list of shires.

• Reprint: A reprint of the Fly Eradication Regulations as at 2 November 2001 is recorded; it includes the earlier amendments.

• Penalty regime insertion in 1988: Regulation 8 was inserted by the Health (Offences and Penalties) Amendment Regulations 1988, gazetted 14 October 1988 (pp. 4160-3). The notes mark regulation 8 as “inserted” on that date. That insertion introduced the present offence and penalty structure, including tiered minimum penalties and the continuing offence daily penalty.

• 2016/2017 Public Health amendments: The Health Regulations Amendment (Public Health) Regulations 2016, Pt. 5, were gazetted 10 January 2017 (p. 237‑308) and commenced 24 January 2017 (see r. 2(b) and Gazette 10 Jan 2017 p. 165). The inline notes in the regulations show specific amendments: regulation 2 was amended (Gazette 10 Jan 2017 p. 253) and regulation 5 was amended (Gazette 10 Jan 2017 p. 253). The compilation table records both this instrument and the particular gazettal citations.

Other notes relevant to territorial administration

• Note 2 in the compilation notes clarifies that the former municipal district of the City of Perth has been divided into 4 local government districts, namely the City of Perth and the towns of Vincent, Cambridge and Victoria Park (formerly Shepperton). This administrative change affects how the Schedule’s references to “City of Perth” are to be interpreted following local government reorganisation.

What the text does not record

• The compilation table summarises the instruments that amended or reprinted these regulations up to the listed dates. The regulations and their notes do not record any further legislative history, subordinate instruments, or internal rule‑making beyond what the compilation table and inline annotation show.

For practical purposes, the key amendment events for legal practitioners to note are the insertion of regulation 8 in 1988 (establishing the present offence and penalty framework) and the 2016/2017 amendments to regulation 2 and regulation 5. The regulations remain linked to the parent Act via regulation 2’s ongoing application of s 199(20) “as amended from time to time”, meaning future amendments to the parent Act can change the operational legal effect of these regulations.

The text of the Fly Eradication Regulations and the compilation notes provided do not record any case law, judicial interpretation, litigation outcomes or appeals concerning these regulations. The regulations themselves name no cases and the compilation table and notes make no reference to litigation.

Consequently, based solely on the source text, there is no litigation history supplied to explain how courts have interpreted:

• the scope of “covered, protected, treated or dealt with in such a manner as to effectively prevent” (regulation 4);
• what measures an authorised officer may validly require under regulation 5, or the limits on the officer’s discretion;
• procedural constraints on entry under regulation 7; or
• the mechanics of cost recovery under regulation 6.

Absence of recorded litigation in the provided instrument does not preclude the possibility of cases existing elsewhere. However, for the purposes of analysis limited to the provided text, there are no judgments, reported decisions, or litigation summaries appended to or referenced by these regulations. Practitioners seeking judicial guidance on interpretation, procedural protections, or enforcement practice will need to search court records, tribunal decisions or administrative law reports outside this instrument.

Given that the regulations delegate enforcement discretion to local authorities and authorised officers, common sources of litigation in analogous contexts could include disputes over:

• the sufficiency of notice and time to comply under regulation 5,
• the lawfulness of entry and the manner of execution under regulation 7,
• the quantification and recoverability of costs under regulation 6,
• the characterisation of conduct as a continuing offence for daily penalties under regulation 8.

None of those issues are adjudicated or evidenced in the text supplied. The absence of litigation history in the instrument itself is a notable informational limitation for readers seeking precedent on contested points.

This section flags technical traps, gaps and consequences that arise directly from the text.

Territorial scope is decisive and precise

• The regulations apply only “in the districts specified in the Schedule” (regulation 3). If premises lie outside a listed municipal district or shire, these regulations do not, on their face, apply. Practitioners should verify whether a property falls within a listed district, and pay attention to the compilation note concerning the former City of Perth being split into four local government districts (note 2).

Broad and outcome‑oriented duty language

• Regulation 4 uses broad phrasing: “waste food, manure, refuse, garbage, waste matter or other matter whatsoever” and requires that it be “covered, protected, treated or dealt with in such a manner as to effectively prevent it attracting or being a breeding place for flies”. The combination of expansive subject matter and an outcome requirement (“effectively prevent”) creates potential uncertainty about what methods suffice. The regulations do not list approved treatments or standards, so compliance requires a judgment about what is “effective” in the circumstances.

Authorised officer discretion and unspecified standards

• Regulation 5 permits an authorised officer to give a written notice directing “such measures as in the opinion of the authorised officer are necessary”. That places substantial discretion in the officer’s hands. The regulations do not set objective standards for “necessary” measures, nor do they prescribe minimum notice periods or steps the officer must take before issuing a notice.

No procedural content for notices, entry or appeals

• The regulations require a notice to be in writing and to specify a time (regulation 5), but they do not specify required content, minimum compliance timeframes, or procedural steps for contesting a notice. Similarly, regulation 7 authorises entry but does not outline requirements for notice of entry, consent, warrants, or time of day. The instrument does not set out an internal administrative review or appeal right. Those gaps mean procedural protections and dispute resolution are determined by the parent Act, local government processes, or general administrative law, not by the regulations themselves.

Costs recovery mechanics unspecified

• Regulation 6 allows local authorities to recover costs for work executed. The regulations do not stipulate the method of cost calculation, notice before recovery, interest on unpaid amounts, or mechanisms for enforcement of the debt. Those procedural matters will have to be managed under local law or general civil procedure.

Tiered minimum penalties and continuing offence exposure

• Regulation 8 prescribes minimum penalties for repeat offences and a separate daily penalty for continuing offences. Breach of regulation 4 can therefore attract both an offence penalty and daily accrual if the contravention continues. Parties should note how quickly a continuing breach can aggregate financial exposure through daily penalties.

Dynamic cross‑reference to parent Act

• Regulation 2 applies s 199(20) of the Health (Miscellaneous Provisions) Act 1911 “as amended from time to time”. That means changes in the parent Act could extend, curtail or otherwise alter substantive powers and procedures that affect flies without amendment to these regulations. Users must track amendments to the parent Act as well as to these regulations.

Potential duplication or overlap with other statutory regimes

• The regulations do not specify how they interact with local by‑laws, broader public health regulation, or property law. Entry and remedial powers in the regulations may overlap with powers given under other statutes; those overlaps could create duplication or procedural uncertainty unless coordinated at the local level.

No litigation guidance in the text

• As noted, the instrument provides no case law or judicial guidance. Where the regulations are silent, users will need to rely on the parent Act, general administrative and property law, or seek judicial clarification.

In practice, these “gotchas” mean that owners, occupiers and local authorities need to be precise about territorial applicability, be proactive in documenting compliance measures, and understand that remedial standards and procedural protections are shaped by external legal regimes and administrative practice rather than by detailed rules in these regulations.

The regulations set clear, practicable obligations and enforcement consequences. Compliance requires four core steps, each grounded in the statutory text.

1. Establish territorial applicability

• Check whether the land or premises fall within the Schedule listed municipal district or shire (regulation 3 and Schedule). If the property is in a listed district, the regime applies. Note the compilation note about the division of the former City of Perth into four local government districts (note 2), and confirm the current local government boundaries before reliance on the Schedule.

2. Preventative measures for premises management

• Owners and occupiers must not place, throw or leave, or permit placement, throwing or leaving, of “waste food, manure, refuse, garbage, waste matter or other matter whatsoever” that is likely to attract or breed flies, unless that material is covered, protected, treated or otherwise dealt with so as to effectively prevent attraction or breeding (regulation 4). Practical compliance steps, consistent with the statutory text, include:
  • Removing or disposing of waste promptly rather than storing it on premises where flies could access it.
  • Ensuring bins and storage for organic waste are tightly sealed and maintained.
  • Applying accepted treatments to known breeding media (for example, prompt compost management or secure storage) so that the effect is to prevent attraction or breeding.
  • Keeping records of waste removal, treatments applied and maintenance to demonstrate that measures are being undertaken to “effectively prevent” breeding.

3. Respond promptly and document responses to notices

• If an authorised officer issues a written notice under regulation 5 directing measures and specifying a time, comply with the measures within the time period specified. The regulations make failure to comply an offence (regulation 8(1)(b)). Practical compliance steps include:
  • Treat any written direction as immediately actionable, and establish an internal process to assess and remedy the issue within the timeframe specified.
  • If compliance requires engaging contractors or suppliers (for removal, treatment or remediation), secure those services promptly and keep invoices and work confirmations.
  • Retain copies of all written notices and documentary evidence of steps taken to comply, including dates of completion.

4. Anticipate entry and cost recovery, and mitigate exposure

• If a person required to execute remedial work fails to do so, the local authority may enter and execute the work, and recover the costs from the person (regulation 6), and may enter premises to do that work (regulation 7). To avoid forced entry and subsequent cost recovery:
  • Prioritise compliance with regulations and notices. Proactive remediation avoids the local authority executing work and the associated cost recovery and penalties.
  • If entry is proposed or imminent, document all engagements with the local authority, attempt to negotiate access or an agreed time to undertake remedial work, and obtain written confirmations of any agreements about cost allocation.
  • If the local authority executes work and seeks recovery, obtain complete invoices and statements of cost and review them for reasonableness.

Additional practical points grounded in the text

• Be mindful of continuing offence exposure. If the contravention continues, a daily penalty may accrue (regulation 8(1)(d)). This means matters that persist should be remediated promptly to prevent accumulating fines.

• Track the parent Act. Regulation 2 applies s 199(20) of the Health (Miscellaneous Provisions) Act “as amended from time to time”. Changes to the parent Act could affect the scope of enforcement, definitions, or procedures. Practitioners should monitor amendments to the parent Act.

• Use local authority channels. Since enforcement is operationalised through local authorities and authorised officers, establish contact lines with the relevant local government environmental health officers or authorised officers. That practical engagement supports compliance and can clarify acceptable remedial measures.

• Maintain records. The regulations place duties on owners and occupiers and make notices enforceable; comprehensive records (waste collection contracts, cleaning logs, treatment receipts, photographs) will be valuable in defending against alleged contraventions or in negotiating cost recovery disputes.

The statutory obligations are concise: prevent fly‑attracting/breeding material from being left on premises unless effectively controlled, comply with written notices, and avoid the practical risks of local authority entry and remedial work which can be recovered from the owner or occupier. Compliance therefore hinges on prompt waste management, documented mitigation, engagement with local authorities, and attention to the territorial scope in the Schedule.
